Not to be nit picky but here are some issues:

Evidences of Relationship - Evidence (no S)
Copy Chase bank joint account statements for every 4 months. I would detail which months and years you are sending in
Electricity bills in wife's name showing address. - I would say that either she is the green card holder or the petitioner so that they can read it quickly.
the term "showing our address" I would change to "showing our joint address."
Mails (no S)
My car insurance policy and a letter stating that my wife don't have a driver's license and planning on one. - shouldn't this be two different bullet points. Also, wife doesn't and is planning on obtaining one.

I guess if I wouldn't write that they sent a "request for more evidence" if they did not actually sent a request for more evidence. That's awfully confusing, at least to me.

If your spouse is a beneficiary on your retirement account, that is one more thing you could throw in there.


My bad, I'm sorry for confusing you and others which I'm sure I did. I did add her to my 401K as my beneficiary and will include that too. Any more suggestion? Thanks for responding.

With regard to the lease, I'd suggest covering the entire period of marriage. We renewed twice, so we showed a total of three leases. If you already have that, I say mail it!

1: Yes. Unemployment Insurance is not a means tested benefit. It is a mutual 'insurance' program you and your employer participate in so that if you do lose your job you will have a continuing source of income, albeit small, that will help take care of your financial needs while you look for other employment. As long as you and your employment paid the appropriate amount in premiums, you can claim unemployment insurance benefits.

2. You may need to check and see if being unavailable for work would compromise your receipt of EI benefits. Also, if you are expecting your ten year card in December or January, you should be aware that you may still receive an RFE for the ROC to which you would have to respond. There is also a possibility, albeit low, that you would be called to an interview for the ROC . You would also be outside of the country when your 10 year green card was sent to you. Have you made arrangements to have someone very reliable checking your mail every day and being able to send you any RFEs or interview notices so you could return back and take care of them? Also, your 10 year green card cannot be forwarded so you don't want to risk it being returned to USCIS as undeliverable. You also don't want to risk someone sending it to you out of the country

There is no problem with travelling outside of the US in and of itself for the time frame you suggest. You do need to meet certain physical presence requirements in order to be eligible to apply for US citizenship. That means first, no absences more than 6 months in length as that could 'reset' the clock on when you start accumulating physical presence. If you meet all of the eligibility requirements for physical presence, and you have been married for 3 years when you apply in April and are within 90 days of being a permanent resident for 3 years, then you can apply for citizenship in April without a problem.

You may want to wait until you actually get your 10 year green card, though, before you plan to travel out of the US for several months, for practical reasons.

Well, domestic violence is a big deal with immigration. Even though she will be "dropping the charges" the arrest record still exists and you still need to disclose it. Even though she's withdrawing it, she still called the police, and they can see the withdrawal not of you being innocent, but possibly as you "convincing her it's in her best interest" to withdraw... do you see what I'm saying?

How it affects you, only time will tell. You need to admit the arrest, you will need a copy of the arrest record and the results (fine, jail time, withdrawn etc). Certain crimes you need to wait a certain period of time before you're eligible. I suggest a consultation with an immigration attorney to go over the specifics of your case. Often you can have the first hour for free.



I do sincerely and honestly appreciate your response. We are back living together and actually she didn't press on any charge on me but the police officer did. She really do regret it and I have heard she could send the DA a letter telling them she overreacted and didn't intend on going too far and won't be showing up on the court if that helps my case. I'm new to these and need help.

I got into an arguement with my wife and grabbed her by the hand, so she called the police and they arrested me and charged me with minor domestic violence. I have filed for my ROC since April and awaiting response or approval. My wife regretted calling the police and will be dropping the charges tomorrow or anytime soon. My question is, how does this affect my ROC and would this affect me from getting approved for N400 when I file in April?

Use the receipt number on your biometrics letter and you shouldn't have any problem.

After my arrest, I felt like I was by myself in this world and I'm sure you felt like that. Please avoid trouble when when trouble comes to you. By seriously, you are in a very good situation. Continue your work and doing good things and living a normal life and you would be fine. Yes, I understand. It will be expunged to help with your employment if they asked for criminal record. However, with immigration paperwork, your answer is always YES if you used to get arrested under any outcomes( Guilty, Not guilty, dismissal,etc...)



Oh yeah, I could have clarified my message. There is nothing like expunge in the eyes of the federal government, FBI. They always will have the record and what really matters the most is the declaration of the arrest when dealing with them. I would scan a copy of the arrest record from the police, court disposal and expungement papers and save in my email incase I loose the original copies.

I didn't take any anger management or marriage counseling. The case was just dismissed, but in front of the judge. I read your post already. I think your case was better than mine because you settled things down before going to trial. I had to go there, faced with judge, then having the court disposition (dismissal) to give to my attorney. I definitely have to assist my immigration attorney about my case. Yes, this incident taught me so much things. I knew I was stupid for 1 moment, however, I'm glad to see a true face of a person I called "husband" too.

Good luck to your N400. Please let me know if the officer asks you about the arrest when you interview for your citizenship.


Getting your case dismissed is a very good one and you should be very happy about it. You were blessed with a good judge who understood family issues. A lot of them would convict you if they want to because the evidence is there and they can get it if they want to. You have an arrest, being charged and dismissal on your record and always on the record of the FBI. I accepted my Pretrial because they didn't charge me and I didn't plead guilty so I'm technically innocent. If they had charged me then I would have headed to court like you did. Scan a copy of the disposition from the court and save on your email because you will be needing it. We can get angry sometimes and do something silly and i'm glad we learned a lot using our little mistake. Some people learn after they hit their spouse and get a conviction and then be removed. You are just as good as having a clean record but be prepared to defend the situation and for that, that's why you would be needing an attorney. When applying for citizenship, there are more than arrest which USCIS check to determine good moral which also comprise of paying your tax, working hard, living a drug free life and being good generally. People make mistake and they understand that. Your best investment at this time is investing in an immigration attorney. You will get your ROC approved if you don't get a RFE. Go have you some drink and celebrate bcos the worse could have happened.

Hi all,

I hired the attorney and he helped me to get the case dismissed on pre-trial court because there was not enough evidence. The attorney told me that the police should call me to let me know it was illegal to call him several times, rather than taking me to jail right away. Even the judge was so surprised because of this action...I feel like a big burden on my shoulder was gone. Thanks God for all !!!!

Now, I have to hire an immigration attorney to take care with the deportation issue, because as I heard, even when the case was dropped, I was still arrested and was convicted at the first place. This arrest will be related to "moral character" when I apply for citizenship, or when I travel outside US because it was under Domestic Violence. I will ask the immigration attorney how to avoid these things, also asked him/her when is the best time for me to get the divorce with this heartless husband.

He knows that he has the upper hands now, so he said very mean things to me through the phone. However, I didn't feel hurt anymore. I just felt very pity for myself and realized that I should feel lucky to get away from him to the end.

I'm very happy for you and the way the whole thing went. You have an arrest record for sure but it can be expunged. Did you have to take anger management class? I'm actually in the same situation as you are now and if you search for my posts, you would see. I was charged for domestic violence battery and it was dismissed by pretrial diversion. Me and wife took 2hrs anger management class and the DA dismissed the case, I didn't even make it before judge and was never charged. You will get your removal of condition approved for sure, don't worry. I received an email 2days ago about my approval and an immigration attorney will be helping me for my N400. Make sure you talk to one.
Let this incident teach you a lot of lesson and I'm sure you have learned. I'm happy for you. No need to worry anymore and make sure you consult an immigration attorney.
P.S. This don't mean no conviction for immigration, it was just an arrest and people always get arrested for the wrong reason. If no probation, deferred sentence, parole, guilty plea infront of a judge, you are good. Just consult an immigration attorney to advice you.

The information I've provided I'm a tiny bit worried about. I didn't get a bank account until I had a job in the US. I opened my bank account October 2011 and had my husband put on the savings account November 2011 (I included that statement) then a few others throughout the year.

The vacations we took were all in 2012 as we weren't in a place financially to really go on vacation. I do have tons of photos (photographer)and will have them labeled with our label maker. Question is should I put this on the front of the photo or is the back ok? I'll be sure to put them in chronological order.

My uneasiness is about our taxes. We really didn't know how to file jointly last year. But we did file as married on both of our taxes (does this matter or should I take it out all together?)

I did include our Fertility treatments because I read somewhere that pregnancy and ultrasounds were a good thing to add. This would let them know that while we don't have children it hasn't been for lack of trying.

Our joint ownership of our new car was just in 2012. I'm getting a bit worried only because a lot of our documentation is in 2012 and late 2011. I've heard a few get an RFE. Hopefully photos of friends with their babies 'growing' will kind of help with timelines as well.


I'm not sure if this will be of assistance but my husband and I do both work together at the same company. Should I provide pay stubs from the same work place? I'm not sure if that will make a difference.

Also I'll be sending this out with a money order (for traceability) should we also send it out via Certified Mail? (I was going to do this but want to be sure it's still ok to do)


Good package and I would throw in these. 2010 tax transcript also explain to them why you filed separately, utility bills, insurance card with both names, 401k of any of you with the spouse as beneficiary. You don't have to get them all but some added to what you already have.

Your evidence is very strong enough. Affidavits are for people who don't have strong evidence as you do. Few things I see missing is water bills, electricity bills and possibly any bill from any hospital or dentist which you have visited. If you have them and mail them off, there is no way you would get a RFE. Good luck.

Lets say , I got denied.What are my consequences ? I understand my GC is right away terminated. What would happen to my visa status in the time period I file for a appeal or a motion to reopen?. It would really help if you could answer this question.

Thanks ! I already printed some bank account statements and they are many, should I print them again or just to write with a pen huh ?What do you think ?



From knowledge, I would recommend you print the bank statements of every 3months that way you won't be sending not just plenty but meaningful. You should make sure they cover the period from you and your spouse living together and yes write them on top using a pen if possible but more important, a cover letter with the number ontop. Also remember to include your tax transcripts among others.

I have a question to see if anyone can help me a bit. On the last page on the RFE it says ''include your A file number on all corespondence''. What does that mean ?That on each page of evidence that I send I should put that number ? Each and everyone ? Or just on the cover letter ?


I would include it on all the documents you will be sending. It doesn't hurt, rather be on the safe side. Goodluck.

Okay I just called back and spoke to a representative and they said the application was approved and the permanent GC was on it's way and provided me the tracking number. I looked it up and it shows that it should arrive today!!!

Can someone please update the timeline? Also, if the date on her 2 year GC is 5/5/10...Does that mean that I can apply for her Citizenship on 2/6/13?


Congrats DND2009 on your approval. CSC is almost done with July filers. It really suck and annoying being a VSC filer. Guess not much we can do but just keep waiting.

I called the USCIS also and they told me they were approving March 5th applications like I didn't know what they would say lol. I don't know I should ask about expediting the case. I'm loosing my patience and have been checking my USCIS account hoping I see a touch on my case or application. What can we do to get this move quicker? By the way, congrats on those who are approved already.

Look at the dates on the chart above and you can see how long it took people at VSC and CSC from NOA1 to Biometrics letter! :) I guess that doesn't give you exact dates, but if you scroll on this page you can see people updating on receiving their letters.

It took ours about 2 weeks in between.

The receipt date is 24th of April. I was trying to update my case number to the USCIS website and it's not verifying it. Does it mean it takes time to update on the USCIS website or what?
