You should get the required documents to the Consulate ASAP. Make sure they're complete and accurate so you don't get another blue slip. Once the Consulate has them, they will continue to process your case. That means if all they needed was the documents on the blue slip and they're satisfied with what you submitted, you wil get a pink slip. The pink slip could come on the day you submit the docs, they look at them and hand you a pink slip. Or they may want to review them for anywhere from a day to several months. Once you give them the documents, they will tell you.

I can relate to your confusion. Vietnamese can be confusing at first. However once you start to learn what the marks are and start speaking/reading Vietnamese, it does make a lot of sense. I still know just a little of written Vietnamese because I'm learning to speak Vietnamese first but I do recognize the the marks as they tell you how to pronounce the tones. And Yes, Vietnamese uses the Roman alphabet so you can write N/A for Question 16.

I called the USCIS to ask the same question you have about how to sign the letter of intent and G325a form for the I-129f. According to USCIS, all signatures are to be "American". First Middle Last. Thi doesn't sign her name that way or the Vietnamese way Last, Middle First. She signs "Thi". The USCIS didn't like that either....... So she signed Thi Kim Nguyen.

Our NOA2 end date was 2/25/08 and Thi's interview was 2/27/08. So your fiance's interview could be around your end date if there are no problems or delays at the Consulate. In any case, the Consulate will extend the I-129f approval for an additional four months when your case is at the Consulate if additional time is needed before her interview.

If you are employed you need to include a letter from your employer on their letterhead that states your job, your income from your job and whether your job is permanent or temporary. If self employed you need the original of your business license.

Like ZeeNusah said, you can get a tax transcript from the IRS it takes about a week and the HCMC Consulate says in their Packet 3 letter it's perferred over tax returns.

The bare minuim I-134 the HCMC seems to accept is if your gross income is over the 125% poverty guideline for your family size (see I-864P on USCIS website for current guidelines:

1. I-134 form signed and notarized
2. Current year Tax Transcript
3. Letter from your employer

However every interview seems to be a little different depending on the interviewing personnel involved (both Vietnamese and American). It NEVER hurts to have more than what is needed. The I-134 instructions list everything possible you could do. If you don't want to include it in your I-134 folder (I put everything into their own folders to make it easy for Thi and CO staff, see my Consulate review for more info). I would suggest you review your case carefully so you can cover everything the Consulate may question and have answers ready for them. You can either give the answers as statements included with your interview evidence or if you don't want to "raise the question" at the interview have them ready if they give you a blue slip.

The HCMC Consulate requires the current year tax return or tax transcripts according to Thi's Packet 3. I submitted one original and one copy of my tax transcripts for Thi's interview because HCMC Consulate prefers tax transcripts over returns. The instructions for the I-134 states there should be two copies of all evidence submited.

Here's where things interesting...... I have both a copy of Thi's Packet three and an older one uploaded by another VJ a few months ago. They are different. They both start by stating the Affidavit of Support should include a statement of the status of their citizenship (US citizenship or Permanent Legal Alien).

Then the older one states "To substantiate the information regarding income and resources the sponsor should attach two or more of the following items to the affidavit:

1. Copies of his or her's current tax return......
2. Statement from their employer......
3. Statement from a bank officer......
4. Any other evidence.......

The one Thi got states "To substantiate the information regarding income and resources the sponsor should attach an IRS complete tax transcript for the most recent tax year.

Additional materials may be also attached, including

1. Copies of his or her's current tax return......
2. Statement from their employer......
3. Statement from a bank officer......
4. Any other evidence......."

Then the two letters agree again.

Now to confuse us more, the instructions for the I-134 further states: "The sponsor must submit in duplicate evidence of income and resources, as approipate:

A. Statement from a bank officer....
B. Statement of your employer........
C. If self employed ...
D. List containing serial numbers and denominations of bonds and name of records owner(s).

Just to be safe, I got letters from my banks, made a statement stating I'm self employed with the required information and since I am self employed I submitted my business license. I also included my tax return for the same year with all schedules. I submitted all as 1 original and 1 copy.

I haven't used Marc Ellis but I would see if he could help me if I needed his legal services. From what I've read about him and his posts here, the Consulate may not like him because he will make them do their job. In many of the cases he has helped with, the couples were denied visas without just cause from what I've read. He stepped in and resolved the issue. The consulate denies many visas by saying they don't believe there is a real relationship between the couples yet they haven't read the emails, chats, phone records, etc that were brought to the interview. I can only assume they read the I-129f supporting evidence.

I don't remember when but someone posted the 2005 status report on the Embassy and Consulate in Vietnam. In 2004, HCMC handled more K1 visas than any where else in the world and the 6th largest number of IV visas. The denial rate was 55% for first time visitor visas. The report didn't say what denial rate for K1/3 visas but did say it expected an increase in applicants following the trend. 2390in 2000 to 7480 in 2004. The last two emails I got from the Consulate did make clear they are operating with a heavy workload so I think there's perhaps double the number now from 2004.

I for one would like everyone who has gone thru the visa process at HCMC to compile who they talked to for the interview, as detailed as possible report on it such Eric and Thuy did. The more you read and understand the process, the people involved that you have to deal with, etc the less stress you will feel.

This site and the people here are extremely helpful and supportive. So you can relax, you'll get help.

My wife, who just recently arrived in the US under the K-1 Visa status, would like to bring her mother over for a short period of time. Basically, we plan on having kids late next year. One of the things my wife would like to do prior to being pregnant is to be with her mom for a couple of weeks. Now, I can apply for the Advance Parole document and travel back for her and her mother to reunite. However, I have been reading up on this and a lot of people recommend not to do this during the AOS filing period. I plan on mailing out my AOS no later than the end of the month - her I-94 expires on 7/11/08. So, with the Advance Parole definitely being a possibility, but also risky, I was thinking of an alternative. That is to fly her mother from VN to the US for a couple of weeks, maybe right after her delivery, so they can reunite. Is this possible? Can a K-1, under the AOS filing period, somehow petition for her mother to come to the US for a visit? Any help is greatly appreciated.

AP is for what you want to do, have your fiancee visit Vietnam while waiting for AOS. The only reason not to go to Vietnam during the AOS period is because if the USCIS sends you any RFEs, or other documents or her interview is scheduled you may not know about them untill after you return. That can delay the process unless you have someway to check your mail and respond to any requests or her interview date. If you go for 2 weeks as you say, that shouldn't be a problem even if don't check your mail. Longer stays can make responding to the USCIS more difficult.

As to others saying there's problems with AP, there are sometimes confusion when returning unless you have all your papers in order, just have everything ready for your POE. And as others have said, overstay your visa can cause problems on re entry when returning from AP.

Getting a visa for her mother, as others have said, is going to be hard.

Yes, the Message Archive. If you edit them in a Rich Text word processor (I used Text Edit on the Mac so I think you could use Word on the PC or the buitt in word processor in XP). It will keep the form unless you edit it out. When printed they will look exactly like the original except they will not have the parts you feel are too personal for the Consulate or USCIS to see. Only one of you need to Archive the chats unless you want to have a "safety copy" (which is a good idea anyway).

You should include her two middle names if her passport/ID has them. The USCIS says to write the names on the I-129f in the US tradition. First Name, Middle Name, Last Name. In Vietnam, it's Last Name, Middle Name, First Name. So you just change the where the First Name and Last Name are, leave the Middle Name as it is.

If Mobilecaller.com is like most carding cards, you will have the ability to print out your call log and phone statement from their website. You need to log into your account online and see.

Yahoo messenger the ability to log and print your chats. If you haven't been logging and printing already, do it now. If you want to edit your chats, you can do that by either marking out the parts you don't want to be read or use a program to edit them before you print. Thi and I didn't know we could log our chats at first so she would save them, then send them to me. So we also had the email time stamp and headers to use as evidence but we didn't use them.

You will need to explain why you haven't been saving them. It's ok to say you didn't know as that's what we did and it seems it was ok with the USCIS and Consulate. They never said anything.

Your I-129f is your first step and you should start out right. Take your time and triple check everything before you send it off. A properly done I-129f will result in no RFEs at USICS and usually no blue slips at HCMC Consulate at your interview.

Once you send it in, fill out your timeline. It helps us help you and your timeline helps others get an idea of how long it's taking.

Since the HCMC Consulate is a high fraud one, to me the only senseable approach is to make your case from the beginning. I've read over and over again about how the Consulate didn't look at any evidence at the interview and handed out a blue slip based on how the I-129f written, including saying the case didn't include any proof of first meeting or ongoing relationship in the I-129f. Of the VJers here who have gotten a pink slip at the interview, most had spend a lot of time preparing their I-129f making sure their case was presented properly including proof of meeting and on going relationship.

Also Marc Ellis has pointed out in a post here on VJ, that your I-129f if approved by the USIC, it will result in a visa unless the Consulate can find evidence that the USCIS didn't know about which would cause the USCIS not to approve your I-129f if they knew about that evidence or evidence that fraud or other unlawful actions that taken place.

Each Embassy and Consulate is different so I'm only saying that this is my approach to HCMC Consulate and getting a K1 visa.

As to editing your yahoo chats or emails, any rich text editor/word processor should keep the icons and formating. You may need to check the manual to be sure. In my case I used TextEdit in OSX 10.4 What I did in Yahoo was to use the "print view" of the email (that gets rid of the ads, mail columns, etc) then copy the entire email, then paste it into the word processor. I'd then edit out the parts I didn't want the USCIS or Consulate to see. Before printing I would also slect a small font size, ie 10 then because my printer also supports printing on both sides, I'd print on both sides of the paper. In Yahoo Messenger, I'd just copy everything into the word processor. Edit then print.

You are going thru the toughest Consulate, so prepare very carefully and be throughal. B_weeks just returned from there with his fiancee and got a pink slip on the first try. His fiancee is pregnant. He can give you insight on what you should do.

I don't know how long it will take for you since you're going thru Nebraska but from the Vj timeline it looks like it's a bit shorter than CA. If you file now, the wait for the interview day will be around the time she gives birth depending on how long she has been pregnant.

My advice is to start the process so the birth and interveiw date are not close, advise the USCIS in your I-129f about the baby as well as the rest of your relationship. From what I've seen here at Vj, proactive usually works better than waiting for the USCIS or Consulate to ask for documents. With that in mind, I would gather any evidence that would prove the baby is yours as well as showing them that you are taking action now about your future child and wife. Then prepare your I-129f #18 statement and proof of ongoing relationship completely so the USCIS and HCMC Consulate have no questions about your case.

Her K1 visa allows her to work without EAD. She doesn't need to get a work permit until her K1 visa expires but by then she should have her EAD or at least AOS filed. She can get her SSN as soon as she arrives and you can get married as soon as you arrive. One isn't dependant on the other. Once her SSN paperwork has been filed, she can get her SS number in a couple of days by calling the SSA office, the card will take 7-10 days. If she gets the SSN before marriage, then you have to admend her SSN (go to the SSA office with your marriage license) if she changes her name to yours.

There are no rules about finding love or when love finds you. The best news is you have found love.

It's true HCMC Consulate is one of, if not the hardest Consulates to get a K1 visa. Those who are truly in love and have relationship get their visa. Sometimes it takes longer and is harder than planned. The good news is you have found VJ. Reading the posts here will educate you to avoid mistakes and plan your I-129f so it will be approved by and USCIS and your fiancee's interview will be a success.

You've started to carefully look at your relationship the way the Consulate will, that's good. You do have some pluses, the main one is that Tien speaks English well enought to be an English Teacher. The bad is you have just met..... The pictures you have without dates isn't a problem, most people write the dates on the back of the pictures. The lack of evidence of your first trip can be explained as you did, you weren't planning on falling in love.

As Wide Awake said, you should plan on going back to Vietnam to have an engagement party. The more trips you make and the extra evidence from it will help establish your relationship as real with the Consulate. Now you can further your case by sending her gifts and she can send you ones as well. You just do the normal things two lovers do when they are far apart. Also the sooner the rest of her family and yours start communicating would be helpful.

The most important part of this process is your I-129f. You have total control on how the USCIS and Consulate will see your case in it. Use it to explain and answer any problem there could be, ie your co worker introducing you to her cousins. The Consulate will be concerned why she suggested that ,etc. Answer it now and they won't ask about it at the interview.

It's important to fill in everything. If there's a item that doesn't apply then write, NA or None for things like children. Leaving anything blank will get you a RFE from the USCIS.

As the dates, everything needs to backed up and consistant. Her birth certificate should match her age on the marriage certificate, etc. Any dates, etc that can't be lined up need to be explained why the facts don't match. The HCMC Consulate will blue slip you at the interview for these kinds of differences. It may be "normal" for Vietnamese to have several different sets of facts but the Consulate doesn't think that's ok about the beneficary.

In our case, we mistakenly had the wrong birthplace for her mother on the G-325A, we told the Consulate about it before her interview. The Consulate wasn't concerned about that once they understood it wasn't Thi's birthplace that was wrong. they said to write a statement and bring the original birth certificate of her mother's to the intervew. We did but they didn't ask for it at the interview. The DS-230 submitted at the interview with the correct birthplace was accepted without a problem. Thi forgot to bring up the statement about the different birth places as well. When I called after she got her pink slip to ask if they wanted it, they said it wasn't important now that she had the approval.

It's best to present the best case in your I-129f and get everything settled before you get to the interview. At the interview, they like to hand out blue slips if they have questions instead of asking if you have the info with you.

It's not the USCIS that's the problem. The USCIS is concerned that you have proof that you meet in person first. Having a relationship means showing that you have been talking, chatting, emailing, writing letters, sending presents to each other, etc. The kind of things you expect to see in a relationship. The USCIS usually will ok you if you file the forms honestly and correctly. It's easy to give them only a little evidence and get an approval. The HCMC Consulate is much tougher. You I-129f is the best evidence vehicle for HCMC Consulate. They can review it before your interview to get a picture of your relationship. That's why it's important to make it as complete and easy to understand as possible what your relationship is, how it began, the course of events in your relationship up to filing your I-129f and explain any "red flags" so the Consulate won't have questions at the interview. IF the Consulate has no questions and your fiancee answers her questions easily and honestly at the interview, you will get a pink slip.

From what you have posted so far, waiting until your next trip, making sure you get all the evidence you can of your trip and documenting your relationship from when it began to when you file after your trip will make getting your visa easier.

It may seem hard to wait but it's better to wait now then get a pink slip at your interview than to get a blue slip and go thru those worries, and emotional trials.

In order to have the easiest time of having a successful K1 Petition that ends in a pink slip (Visa), you have to make sure you have the best possible evidence prepared properly in your I-129f. Pictures are an important part of that but not the ony part. It is easy to get USCIS approval of your petition if you have visa stamps, airline tickets and baggage claims, and other evidence to prove you met in person in the last two years and of course have filed out the forms correctly.

However, HCMC Consulate is a different story as you can see from many of the posts here about getting USCIS approval then being told your relationship is a sham by the HCMC Consulate. Most of the blue slips people have gotten can be traced back to not having a strong I-129f petition. It is that petition the HCMC has the most time to review, if they do review it before the interview. You have to lay out your I-129f evidence of meeting and relationship there. If you wait until the interview, you risk getting a blue slip because the Consulate rarely looks at the evidence you bring to the interview if your evidence seems incomplete to them in your I-129f. That doesn't mean you won't get approved but it does mean it will take longer.

Based on your post, I feel you should take more time to get the proper evidence before filing. A second trip to Vietnam with pictures would be a great help since you're lacking hotel, sightseeing, dinner, etc receipts, pictures from the first trip. While having an engagement party isn't required, it would show the Consulate a progression of your relationship because of the emails, chats, etc that would lead up to the engagement. The Consulate wants to see a reasonable progression of a relationship which usually means, gifts for special occassions, contact with other family members from both familes even if you don't get engaged. Remember they are Americans, if you're serious about getting married you do meet the folks!!

I'm not saying you have to do the above to get a K1 visa from HCMC Consulate but you do have to make the Consulate believe you have a relationship that any reasonable person, based on what you give the Consulate in your I-129f and at the interview, would conclude is real.

As a rule, you don't have an interview. However there are cases where the Consulate will want to interview you. That usually happens if your fiancee/wife fails to get a pink slip/visa. Depending on the circumstances, the Consulate will want to interview and your fiancee/wife seperately to check answers, etc. For now concern yourselves with getting everything ready for the step of your journey.

You can't go with her inside the Consulate to her interview. You can wait outside and make sure by calls or emails that the Consulate knows you're there if case there's anything you can do to help get her visa. Being there waiting seems to help everyone involved. smile.gif

Sorry the interview didn't go well.

You need to be prepared when you go on 8/30 with all the evidence the Consulate asked for. Do you have all of it? Any info you need from the US you should have before you leave as it will be hard to get once you'll there.

The timeline should be as complete as possible with evidence supporting any events you list, ie plane tickets, receipts, pictures, etc. You can include the interview in the timeline as it's why you're going to Vietnam.

Be prepared for the Consulate to take some time to check the addresses, etc. Many times when they ask for this extra information they check it. You should try to talk to the Consulate while you're there to make sure you're doing everything possible to get the pink slip. Also that should help them understand your relationship better.

If you're asking about the brown envelope, I don't remember for sure about what they kept or gave us. At LAX they stapled the I-94 to her passport and stamped it. You need that number and on her passport K1 visa is the A number for AOS. They didn't keep the Xray that we carefully hand carried from HCMC. You should have the original I-129f and evidence in your possesion.

I believe you can be sucessful with Phoung because you understand more about what you're getting yourself into in applying for a K1 visa from Vietnam and having cancelled the other I-129f.

The fact that Phoung speaks English well is a big plus.

If the two of you are willing to wait 2 years before applying that is also a plus, however, the main concern is to properly prepare your I-129f to explain the cancelled I-129f. Any and all evidence of the Chinese woman's decieption as well as how you found out about it plus explaining why you decided to apply for the I129f so quickly needs to be convincing to the USCIS and HCMC Consulate.

The cancelled I-129f will make USCIS and HCMC Consulate more closely exam your new I-129f so you need to make sure you build a 150% stronger case for it. Everything possible to show how you and Phoung have a real relationship that includes your family and friends, her family and friends, etc needs to be filed in your I-129f. By making your I-129f answer every possible red flag, you should find her interview will go smoothly. If not then you'll find a bumpy road, but if the two of you love each other, remember, you will be together in the end no matter how long it takes. The Consulate wants to stop immigration fraud, not keep people who are in love apart.

My post was clear on what you do, if you have already filed a I-129f before or have a K1 visa from a broken relationship, you have to include a statement explaining that and include any evidence of it with your new I-129f.

According to the instructions in the I-129f, you have to request a waiver if you have file two or more petition in the past or had a previous K1visa approved in the last two years before filing this petition. To request a wavier you have to submit a written request with your I-129f and document to show why the wavier should be granted.

There isn't a form to fill out but you should treat this as you would your proof of having meet in person and proof of your ongoing relationship. Your request should clearly and completely say why the other I-129fs or previous K1 visa didn't work out and why this one will. Then have evidence to back that up. For example, if your earlier I-129f was submitted for a different fiancee, what happened in that relationship and why, was the I-129f cancelled or denied, etc. You would include emails, letters, court documents if applicable, USCIS and Consulate documents, etc to explain what happened.

If you are serious about this, you need to cancel the other application. I think you will need to file for a waver when you file your second I-129f. Also the HCMC Consulate is very picky. You need to have as complete as possible picture explaining your canceled petition and why you feel this women is the right one. Then you need to show enough evidence that this new relationship is the real one. Going to visit her is a good idea even before you cancel the other petition. You have to build a strong case for your relationship that meets the guidlines the Consulate has. You have to have a relationship that a reasonable person would believe is real based only the evidence you supply in your I-129f and at the interview. The key to a sucessful visa is in your I-129f petition not at the interview. At the interview the Consulate checks your story with your fiancee. If everything is believeable in your I-129f and what she says at the interview, you get the visa, if not then you get a blue slip, green slip or outright denial.

If you do everything right, you'll get it on the first try.

Thi also signs her name just Thi in Vietnam so this is a common mistake on US forms. According to the USCIS person I spoke to when I was filling out our I-129f. Her signature has to be US style (First Name, Middle Name, Last Name) or it will be rejected at USCIS and you'll get RFE which will delay your petition. Like the other poster said, if you need to sign her name on a copy so she can see how she is suppose to sign it. According to the USCIS person I spoke to, these are legal US documents and as such need to signed formally, ie a complete signature.

The Consulate has been doing this for years. Just as you can go to a mechanic with your car, he'll know lots about, what could be wrong with it and why. He's seen lots of cars and knows from experience. The Consulate has seen a lot of applicants so they know what to ask that can seem like they're reading your mind.

Just be confident and relaxed (as much as possible). Answer the questions truthfully and don't be afraid to ask questions of the CO and translator. Like a job interview, you have to "sell yourself".

Sorry to hear that you didn't pass. Like everyone else said, get what they want to them, prepared with the greatest care to make sure they accept it and don't ask for anything else. Don't worry you'll be together.

It's one of the strange things about the Consulate, some cases they don't ask much or anything about the ex, others they ask a lot. If I may ask, what did you say in your I-129f about your ex? How did the timeline of your meeting of Hanh and your divorce relate? I'm wondering if there's anything in your I-129f that would have made the Consulate want to know so much about your ex.

The Consulate is also concerned about your ability to support Hanh, not having a stable job can be a red flag. Did you explain how many IT jobs work or just assume the Consulate knows?

It's the level of fraud cases in Vietnam that causes the Consulate to be very careful which to us seems unfair. Just remember they're doing their job and that everything will work out fine. I'd definitely get ME involved as he is very successful.

The Consulate in HCMC understand both US and Vietnamese customs. Tatoos isn't the problem for getting denied a visa. Not having a real relationship or being able to document one is the reason for denial. What you should be worrying about is having shown the USCIS that you have a real relationship and that any "red flags" are explained in your I129f so the Consulate in HCMC won't be asking for additional evidence at his interview. If now you realize there are things missing such proof of trips, gifts, calls etc, you should prepare to answer them at the interview.

Once you have your NOA2, you need to make sure you have everything ready for the interview. If you get a blue slip, be prepared to quickly respond so he can get his visa. Most people in Vietnam don't get a K1/K3 visa the first time because of paperwork missing or poorly presented in thier I129f and at the interview.

The good news is most people end up getting their visas to the US. In some cases it can take a while but if the love between you is real and lasting, you will succeed.
