Haonie,

Good Luck to your coming interview.
May I have your collected interview questions? It would help me to prepare my fiancee a lot.

Thanks a lot in advance! best wishes!

Yes, I second that request. I know you and Peter had a list of possible/probable questions that might be asked. Did you amalgamate them yourselves from many posts, or is there a master list somewhere?

Peter and Thi

Peter,

Can you please tell me how a timeline letter to the Consulate should look like?
I did not have one when I turn in my I-129F to USCIS.

Thanks a lot in advance!
2007K1

2007K1

The timeline I made was a list of the dates and what happened. I also included a few paragraphs about our relationship. The purpose of the paragraphs was to further impress on USCIS (for the I-129f) and Consulate (for the interview) that we have a real relationship, truly love each other and expect to be together soon and forever. Here's an example of the paragraphs from my cover letter about the evidence for my September trip:

"In July 2007, Thi and I decided we wanted to see each other again. Being apart is difficult even though we video chat almost everyday and talk on the phone since December 31, 2007. We decided September would be best since we thought her interview would be in January or February. Waiting until then would be very hard. I decided on EVA Airlines and booked the date September 11, 2007 to September 28, 2007.
My flight was pleasant and spent time talking to a French Canadian doctor who is working in HCMC on the flight from Taipei to HCMC. His postive feelings about Vietnam reinforced my own opinions."

Here's a short example from my cover letter which had the timeline from my September trip to see Thi which I submitted at her interview at HCMC Consulate (which of course they didn't even ask to look at!!):

"The following is submitted as proof of our relationship and my September trip:

* Passport and Visa stamps dated September 12, 2007 (Arrival) and September 28, 2007 (Departure)
* Interary printed from Expedia.com showing my EVA flights to and from Vietnam.
* Boarding Passes and Bagage Claim Tickets for the flights
* Wells Fargo Credit Card Statement dated 8/13/07 showing payment of flight. Note red arrow.
* Wells Fargo Credit Card Statment dated 9/13/07 showing See’s Candy charge (9/10) for candy gift for Thi. Note red arrow.
* Wells Fargo Credit Card Statement dated 9/27/07 showing CVC Pharmacy charges (9/4/ & 9/5) for candy gifts for This’s family, An Dong SBit charge (9/17) for diamond earrings, EIBVN Vietnam Eximba charge (9/22) for curtains and Liberty 1 Hotel charge for 9/26/07 family dinner. All marked with red arrow.
* Khanh Duc Tran’s Temproraty Residence Book page.
* Bus tickets from September Trip
* September 12, 2007 Arrival at Tan Son Nhat International Airport photos
* September 13, 2007 Photos of sightseeing
* September 13, 2007 Receipt of Lunch at Pho Xua with discount coupon and photo
* September 14, 2007 Receipts from Dam Sen Park
* Photos from Dam Sen Park. It rained while we were there.
* September 16, 2007 Receips from Suoi Tien Theme Park. I paid for Thi, Khanh, Dung and Nhung, a neighbor of Dung’s. Also the Suoi Tien Theme Park map and game tickets
* September 16, 2007 Photos from Suoi Tien Theme Park. It also rained while we were there."

I used a red marker to outline dates or items of importance on the evidence I submitted which I remarked about in the timeline. The layout of this is similar to the #18 "Statement of having met your fiance(e) in the last two years" and "Proof of on going relationship" evidence I submitted.

I hope this helps you in getting a pink!

Thanks for helps Peter.

1. Folder A:
D. DS - 230: Will it hurt if I fill-out part II? Well, I'll go ahead and do it.
E. Passport Photos: Thanks for letting me know this.

4. Folder D:
A: When I submitted I-129F, I've already included my timeline (day by day) of the first and second trips. So, at this time, I will explain only this trip(otherwise will redundancy).

Again, thanks Peter. Yes, I'm looking for pink slip on April 24 (haven't see her for 7 months, I'm so crazy).

Haonie

Hoanie

1. Folder A While the Appointment letter (Packet 4) doesn't say to fill it out, we did just because it we didn't want to not have it in case they asked for it.

If any of the recent interviewers would post about the 5th photo (posted on the outside of the Consulate in the waiting area) and single certificate, that would be great.....As I'm still confused about what the Consulate wants sometimes..... Also please submit your reviews of your interview in your timeline.

4. Folder D I understand, since you already have submitted those timelines in your I-129f, the Consulate should be aware of them.

I think you're set to go and I won't be surprised if the interview went well. I just read Lucas's review of his fiancee Chan's interview. He also had spent lots of time preparing his evidence, only to have Consulate Officer (a man) ask a few questions then didn't look at any of the evidence Chan brought and handed her the pink slip. May your fiancee's interview go as smoothly!

It looks good except for a couple of things which could be just the way you worded it.

1. Folder A:

D. DS-230 part one (you should also have part two filled out. The Appointment letter may have not said anything about it but "just in case" have it filled out.)
E. Passport photos (Do you have 5 passport photos? At Thi's interview they wanted another passport photo for the passport besides the 4 in the letter. )

4 Folder D:

A Timeline of third trip (unless you meant to write "Timeline of the three trips, I would have a timeline of all trips/emails/phone calls etc. )

If you put everything in your evidence folders in order, oldest first, then I think your evidence is about as ready as you can be. good.gif

Good Luck on April 24! yes.gif Get a pink slip!!

QUOTE (Melrose Plant @ Apr 15 2008, 11:12 PM) <{POST_SNAPBACK}>
I got my plane ticket yesterday. I paid $1,324.29 for a round-trip from Des Moines International Airport. Hahahahaha, that's funny. Des Moines International Airport. They must have a UPS plane that flies up to Winnepeg or something. I feel very lucky to get that price on 2 weeks notice. That is only $125 more than I paid last January (2007). Not bad, considering the hefty increase in the price of fuel. Have to leave on Monday or Tuesday, though. Any other day is $300 to a whopping $2,100 more expensive.

So I got to playing around with the fare search on Orbitz. It turns out that if I could somehow get a ticket within the next few hours, and leave at 10 a.m. tomorrow morning, I would still pay $1,324.29. But if I left on Wednesday, April 30th, one day after my actual departure date, I would have paid more than double. How do they come up with these pricing schedules? It boggles the mind.

I know what you mean!!! ranting33va.gif I always have to end up using "Flexible schedule" as it's called on United.com to get a good idea of where the best fare is...... Even then you don't know...... My brother's daugther is getting married in June and we're going to the wedding. I spent about 3 days looking for a cheap domestic flight vs using the United coupon I got when my flight was 6 hours late last March. I ended up giving up trying to find one and just used United. Here's the crazy part...... I kept looking for the cheapest non stop morning flights to leave to Seattle from LAX. United.com said there was only one at 6:10AM. (I also used the automated phone system and it came up with the same flight). It didn't matter what day we flew, the 6:10AM was available and the cheapest. It did that for 3 days. So I finally started to book it but then decided to due another search using schedule. It showed the 6:10AM flight and another one at 10:43AM both at the same price. Getting to LAX at 5AM isn't fun so I booked the later flight. Why didn't it show that flight before? protest6wz.gif I checked and found that flight was available on other days too..... huh.gif

Have a great time in HCMC and get the pink.

It seems the Consulate still thinks there's something going on that you're not telling them. Others have said the Consulate will ask neighbors about the fiance(e) to see what they say. Perhaps the neighbors said something that the Consulate wanted to check. Or maybe you just got "lucky" and the Cos wanted to make your life miserable as they have been known to do. I figured after they called and told Hoa she can pick up her pink slip, it would be simple.....Oh well......

Thi didn't have any problems or questions when she picked up her visa. They just called her name, gave her everything and called the next person.

It's great Hoa's picking up her visa on March 31st. good.gif Thi and I hope she gets to the US soon so the two of you can be together. After all this, it's about time and you deserve it! yes.gif We hope everything else goes smoothly for you.

I am kinda new to this form stuff myself and your post have been a god send. I am leaving for Siagon on Friday April 18 for my second trip. I got a lawyer up front and I have sent everything my my 2 front teeth in my packet is seems. The support form, 3 years tax returns, a letter of intent to marry, the letter from my employer, the Bio form for both of us, copies of my passport, copies of plane tickets, copies of recipts from my first trip, some photos, and of course the I 129. This trip will be for the engaugement party and more photos and another set of plane tickets for her interview. My question is where are these post you reffer to in this post? And what would you reccommend we get done on this trip if anything? Our packet was recieved on March 10 2008 and of course now we wait. It is California and it looks like a 6 month back log from what I can tell. I do have one concern. Xuan was born 1979 and record keeping during that time was less then robust. She does not have her birth certificiate and I know it will be important at the interview. She does have a valid passport and another question I have is can we just go to the hospital or the "court house" if that exhist there and get a copy? Any thoughts on that.

Again thanks for all you post. They help very much

Congratulations on getting engaged. If you don't already know, getting married is 90% married in Vietnam.

If you do an advanced search with my member name (PeterFB), you will be able to see everything I've posted here. You will have look thru the posts but you'll find a lot of helpful info from everyone.

First, have fun!!! Unless you have the funds to stay a while or visit again soon, it's a long wait..... When you visit places, buy tickets, etc, keep them!! Take as many pictures as you can because it's great to look at them while you're waiting (and it's good for the interview...). There's time for getting the Packet 3/4 info ready as you filed in Ca.......

I sent you a PM about the her birth certificate. You probably can go the Ward or District offices to ask them about that if she lives in HCMC or another city. If she was been "in the country" then you have to go the local area authorities.

BTW timeline.gif

Good luck and have a great time!

Rodney

She will need your signed notarized I-134 at the interview and employment letter or business license. Your tax returns need to be complete with W2s, all schedules, etc. Also don't forget she needs to have your original birth certificate and a copy at her interview.

You are only required to have the current year tax records, they prefer tax transcripts as Melrose Plant mentioned. If you have more than the poverty guidelines for income for your family size, you don't have to supply any other financial info unless you want to. You will need a letter from your employer stating whether your job is permanment or not, when you started to work, how much you make or if you are self employed, your business license.

Your fiancee will need to get several things. There's posts here listing that and it's in the Packet 3 letter she will get. Also have her put all the evidence in order so it's easy understand. For an example of that, there's a post of mine you can look at that's about timelines.

While the Consulate may not look at any of it at the interview, having it will give her confidence and if needed it will be ready and handy so she won't get a blue slip asking for more evidence or information.

Well, being as you got approved in 63 days, I'm guessing both of you will be snug as a bug in the U.S. within about 45 days. At the interview, they will ask your fiancee about 3 questions, one of which is "What is your name?", before handing her the pink slip. Then they will say come back later this afternoon to pick up the visa.

Now, if your approval had taken 163 days, then it would be an additional 4-6 months of waiting. When you finally got an interview date, they would keep your fiancee in there for an hour and ask her the exact dimensions of the mole on your lower left back. Of course, she would give the reply in millimeters when they wanted inches, resulting in the blue slip and an additional 3 months of administrative review. After all that, and with pink slip in her hand, they would tell her to come back after 3 weeks and maybe they might have the visa for her, even though they knew she had a plane ticket for departure in 2 weeks.

And that's how it works, as far as I can tell, so don't worry, you've got it made. Congratulations on the approval.

P.S. You can look at all our timelines under "Immigration Timelines" at the top of the screen. You also have the ability to show only Vietnamese K-1 timelines (maybe K-3s are in there too, I don't remember).

Rodney

I know it seems like that!!!! yes.gif

From what I've been able to figure, It usually takes 5-7 business days for NVC to figure out to send it to HCMC. then it takes HCMC about a month to process it and send out the Packet 3. If you're ready for the Packet 3 and personally take to HCMC the checklist letter, DS-230 and DS2001 ASAP, ie the next day, you can speed things up a bit. After they recieve your documents, the Packet 4 is sent in 2-3 weeks with an appointment date about 6-8 weeks from the date they sent it.

If you're lucky, it will be less than 3 months time from NOA2 to interview. Most seem to be 3-4 months. Now is a good time to prepare for everything that may come up at the interview.

Good Luck.

I wonder why Vermont is so fast? California is very slow at processing....... unsure.gif

NVC usually just is a few days.

Make sure to have all your evidence in order at your interview.

Asia: East and PacificI-134
QUOTE (Melrose Plant @ Apr 20 2008, 10:30 PM) <{POST_SNAPBACK}>
OK, I got another I-134 filled out. Simple enough. OK, why can nothing be simple? 1st: Since I filed one before, I put that I filed one before, right? Even though it was for the same pending application, and hasn't really had a chance to take effect? 2nd: The first one, filled out by a lawyer, I believe was filled out incorrectly. It put BOTH my fiancee and my son as full dependents. The question is worded in the present, not the future. So I am thinking my fiancee shouldn't have been on there? She is not dependent on me financially, and certainly not fully dependent. She WILL be, of course, but I can't go crossing out words on the form now, can I? Even my son is not FULLY dependent on me, it is spelled out fairly clearly in the divorce decree who is responsible for what, and what costs will be split.

What to do, what to do.

1st. A cover letter explaining the reason(s) for updating (or replacing) the I-134 is a good idea since the Consulate already has the one filed with the I-129f. A call and/or email to them is also a good idea so you have a record of telling them about the change. If you call, try to the name of who you talk to and/or get them to make of note about this in your case file.

2nd. Dependents on the I-134 are the ones listed on your tax return for the year(s) that you are submiting with the I-134. Unless you claimed her as a dependent, she's not to be listed. If you listed your son as a dependent on your taxes, then he should be listed in the same way on the I-134. If you are thinking of crossing out things on the original I-134, no, that will only confuse the Consulate in my opinion. A correct I-134 with the necessary evidence with the cover letter explaining why you have two different I-134s should be fine.

Good Luck and get the pink!

Asia: East and PacificHCM interview date
What you recieved was the stock answer from the Consulate. If you call them they (the Vietnamese staff) will first try to give the stock answer and try to hang up. I think they get a call like yours every 10 minutes since at Thi's interview, it appeared that there were 20 K1/3 visas on that day.

I had started to email the Consulate about some questions and also Thi and I had called them. When we called, we got the same answer about when to call back about the Packet 3 (Also got similar replies to our other questions, you can search for our posts about that or check our profile "topics" for more info).

However we got email reply from the Consulate with our interview date about 7 days before we got our Packet 4. That email also contained their reply to our questions so whoever wrote it decided to tell us our interview date because the Packet 4 already had been sent. (See our timeline) Mail in HCMC is very slow and seems to get lost easily (that's what the Consulate staff told me in one of my calls to them). If you have a reason to contact the Consulate about something else, you might get their attention long enough for them to actually tell you more than the stock answers. I found that once I had their attention, they were actually trying to be helpful.

My best guess is if you handed the Consulate your Packet 3 docs on February 29, you should be receiving your Packet 4 around April 27 with the interview around May 28th.

If you are trying to get a good fare, you're going to have act fast as you may less than 30 days (usually the best fares about 30 days or more in advance). However if you have a travel agent, they may be able to help you better than booking the flight yourself. I booked the flight myself and was lucky that the Consulate send me that email with our intervew date so I had a couple of days to find the lowest fare/best route.

I can understand your frustration since we were waiting like you almost 3 months ago. Try to relax and work on getting all your evidence and requred docs ready. Your interview is coming!!

QUOTE (Melrose Plant @ Apr 21 2008, 08:31 AM) <{POST_SNAPBACK}>
Mai and I have been doing mock interviews. She has the ability and natural propensity to go on, and on, and on, and on about something. That's one reason our phone bills are so high! Is this a good interview technique? Obviously, if a question is direct and narrow, such as, "Have you ever been married before?" the answer can only be "no." But if the question were, "Has your fiance been married before?" many people would answer simply "yes" until prodded further. Mai would tend to answer, "yes" and then go on to explain for five minutes about it. Within reason, do you believe that is a good technique with the HCM consulate? To let them stop you when they've heard enough?

Hmmm she sounds like me..... Did she ever want to be a lawyer?.........or a Politician?...... laughing.gif

Seriously. I agree with WideAwakeintheUSA and KimandRuss. While it's good to explain your answers if they need to explained, less is more where the Consulate is concerned.

just looked through all my paperwork and saw an error on my form. some how my lawyer checked male in stead of female on gender. i hope this doesnt mess anything up. can i just call and let them know of the error or is this not a big deal since all the supporting documents are correct?

Rodney

You should call/email the Consulate about this only because it could be used to cause you problems if they want to find something to cause you problems. If you bring it up, then it's unlikely they will. They will probably say it's not a big deal, since you can easily write a statement explaining it (and get one from the lawyer if the Consulate asks for it).

We had a found an error about Thi's mother's birth place which we tried to fix. I had emailed the Consulate several times (it took a couple of times to get them to understand what we were asking) and got them to write that it wasn't a problem but we should submit a statement explaining how it happened and bring her mother's original birth certificate to show the correct birth place to her interview. At the interview, no one asked for it and Thi forgot to give them the statement and show them the birth certificate. She got her visa anyway. I called after she had the visa to ask them if they still wanted the statement or see the birth certificate. The Vietnamese woman I was talking to, put me on hold then came back and said not to worry about it. Since Thi had her visa, the Consulate felt their part was over.

The questions they ask at the interview are usually based on your I-129f. Everything including the state you're from can generate a question. The question about what is your favorite movie is more of a general test question, there's no right or wrong answer unless you have put "Spiderman III" is my favorite movie that we have watched together on DVD or something like that in your petition. laughing.gif The same is true for where you will get married, license, etc. Just answer the questions truefully.

In Thi's case, he asked her about what my hobbies are then asked where was my favorite place to ski (one of my hobbies). Her answer was "I don't remember" which is true since I never told her I had one. However in my I-129f I did include a reference to going to ski at Mammonth Mountain and chatting with Thi from my motel room where she chatted with the friends I went skiing with.

I think part of the problem is the Consulate doesn't want you to submit items it doesn't ask for. They seem to ignore them, then if they decide they want that information, ask you for it then. It's a government trait, they want a paper trail that they understand. So when they want information, they gave you a notice (blue slip, for example), then in the file they have your answer to their request. It makes sense to them..... wacko.gif

Andy

Thi thinks from your description, he interviewed her as well. He seems to like to ask questions first about something general, then follows up asking a more specific question based on the first question.

OK, so that's a little scary. They ask for things they already have. Typical government, I guess.

Anyway, if I may ask, how do they get what they want at the pre-screen? Do they ask for certain things, or do you just hand over the whole 20 pound stack of documents, and they take what they want and give the rest back to you?

At Thi's interview, the Vietnamese woman asked for certain "required" docs and didn't want anything else. Which included asking for the Singles Certificate not listed in the Packet 4 letter. The woman didn't want to see any evidence of the relationship, just the forms, birth certificates, etc.

It is a little scary as it seems there's little consistancy at HCMC.

All,

Thank you, thank you and thank you all. Here are the details.
Pre-screen: a very nice lady (VN) collected all papers, but did not collect my parents, fiancé parents, and myself birth certificates (she was only taken my fiancé BC).

At the Interview:

A very young CO interviewed

When is the first time you meet him?
How many trips did he visit you?
Did you aware that he did have previous K1?
Please let me know about his K1 and why it end up
Does your relatives relate to his relatives? (same last name)
What is he usually doing on his free time?
What is the name of movie, he like the most? (my fiancé can’t spell it)
Does your fiancé tell you about Kentucky?
What are the famous in Kentucky? (she just said, KFC, they’re all laugh)
Anything else in Kentucky?
Where are you going to get marry?
Be exactly location, the place that you will register your marriage license (my fiancé said, she did not know)

Please show me all your evidences. He looked at phone bill and asked how long did he talk with you on the phone? He then looked at pictures and letters. He did not even look at the church and engagement pictures at all.

The blue slip has already printed out on his table. My fiancé tried to slide my time-line of the third trip, but he handed it back to her. “blue slip asked time-line relationship”.

The point is, I’ve already submitted my time-line, first and second trips (4 pages) with the I-129F for the first time. I assumed he was missing my time-line or whatsoever.

She got out at 10:30 AM with blue slip. I then reprinted my time-line of first and second trips.
At 11:00 I ran over to US Consulate to notary it
At 1:00, submitted time-line first, second and current. Plus pictures (church and engagement pix), invitation card, jewels receipts and air tickets for 3 trips. I waited for 3 hours, I then received the green slip asked for Birth Certificates (both parents)
Friday 25, at 1:00, I resubmitted all 6 certificates (original and copies with translated to English). 2 hours I received a pink slip (Thanks God).

However, I’m so happy now. Good luck with you all. Once again, thank you all. From my experiences, make sure you are ready everything you can. So, whenever they ask, just turn them in and you will get the pink.

Hoanie,

Thanks for your details. Was it a Young American Man? If it was then he could be the same one who interviewed Thi. The questions seem similar to the type he asked Thi.

You're correct. Be prepared for everything at the Interview. Then you will get the pink.

Finally, I got the pink today.

My fiance had an interview on April 24. The interview was about 5 minutes then the blue slip gave out, please submit your time-line. I turned in time-line at 1:00 clock, then the green slip gave out (birth certificates). Friday 25, at 1:00, again I turned in Birth Certificates (myself, fiance, parents both side). Pink was given out. We plan leave VN on May 13. I will post details later. I couldn't sleep for couple days, i'm so tired now. Thanks all for support me. Good luck to everyone.

Peter, your wedding was beautiful.... thanks for inviting me! kicking.gif Thi is just adorable, beautiful and sweet. You are both very lucky to have found each other. I wish you only the best things forever. I hope you guys will have ALOT of fun with the presents I brought.... devil.gif hihihihihihihih

I can't seem to Download your vid clips but I would like to see how hot I looked... hihihihi your friends kept telling me that they heard the soundtrack to Casablanca playing when looking at me. I think that is a compliment but I am bit too young for that reference.... it is a GOOD thing right? hihihihi blush.gif

Again, now that I am back in the states, I am available anytime to help you and Thi... I am glad to translate or help her with english. Certainly it would nice for her to have a friend who not only knows about America and is American but can also speak Vietnamese. Anyway, we'll talk more privately. Enjoy your honeymoon... anything SPECIAL planned? hihihi can I EVER remove my mind from the gutter????? TROI OI (ohmygod!) in vietnamese

Just to let everyone who asked about me know, I just got back to America and I am sure I will posting around asking for help with Tan's K1 ... it is hard for me to keep my spirits high and post all the time because we literally talk for 3 or 4 hours every day by webcam and he cries. It hard to endure seeing someone you would die to protect crying in agony because you aren't with them. I am a tough chick but really, this is tearing me apart. If I didn't have important work here, I would be running back to him.... but I can't abandon what I have worked for in America for 3 years and it will only benefit him and his life when he comes here. He really doesn't belong in VN.

*hugs to all* Thanks again Peter for the fun last night!
Thuy .... I LOVE TAN

Thanks Thuy and everyone else.

We're glad Thuy was able to come. We'll post our pictures from the wedding for those who want to see them.
Thuy really can tone down if she wants too! We have pictures to prove it yes.gif The Casablanca thing is very good..... We're still trying to figure some of your gifts out laughing.gif

We were sorry you had to leave early but we understand you wanted to chat!! I was the same before Thi came to the US. We'll PM you about helping Thi.

idea9dv.gif If you want to make a webroadcast, it's not that hard as long as you have enough upload bandwidth. My AT&T account has 1.6mbps download but only 429 upload (it's suppose to have 760 but DSL loses speed the further from the hub and if you have copper wire that doesn't help either). You have to have at least 300mbps upload, I used Ustream.tv because it's free, allows live feeds and you can record the live feed for later viewing.

I had 3 different webcams set up and two different computers so there wouldn't be much to reconfigure during the wedding. One was my Sony Digital Hi 8 camorder for the reception which the battery ran out and I lost most of the music in the reception..... I didn't have anyone who knew about this to help so I did it myself so there wasn't anyone monitoring it.

If anyone has more questions about doing this, PM me and I'll explain in detail, etc.

Congratulatioins to both of you! I'm so happy for guys. Thi looked beautiful. I'm glad you got her to move closer to you so we could see her. laughing.gif Is the dinner a live stream? If so, that's a great idea. Can't see much in the dark, but still a great idea. I would love to do something like that for our party in VN so my family and friends here in the US could watch part of it. Very clever of you Peter. wink.gif Good luck to the two of you.

Thanks!!!

Yes, it's a live stream and now it's music time!

Asia: East and PacificDNA tests
DNA tests are becoming easier to do. What is needed is the DNA material from the person who is getting the test. That can be a cotton swab of the mouth to get saliva. There are even kits you can get where you collect the material then send it to the lab.

However the beneficiary should contact the Consulate to ask how they want the test done, ie what labs/tests in the US can be used that they will accept? The Consulate will probably want the son to go to a lab so the lab can verify his identity.

Would I be better served if I filed my taxes QUARTERLY?

Also, this employer is willing to sign a 5 year contract with me stating that the work will be solid for 5 years, same income plus bonuses paid. Would this be necessary and/or advantageous?

Thanks again all
ILOVETAN

You don't file your taxes quarterly, you pay estimated taxes quarterly if you are self employed. If you don't file quarterly and you owe additional taxes when you file your return, you can pay a penalty. The Government likes having your money sooner than later........ dry.gif

Thuy

If Tan has his interview before the IRS can supply you with a tax transcript for 2008, you will have to submit your tax return for 2008 with your 1099s since you're not getting W2s.

If Tan has his interview in January or February, You will need to have your employer give you your 1099s asap after December 31, 2008. Then you have to fill out your 2008 tax return in time for his interview.

If Tan has his interview later say in March, and you filled your tax return in January, the IRS could supply you with a tax transcript which is what the Consulate likes to see. Then your 1099s, and tax return aren't required but you can still submit them.

1099s are for independent contractors (self employed) so depending on what your job is, you may need to have a business license. The Consulate requires a business license if you are self employed. If you file a Schedule C for your taxes, you are self employed. (for example, I have a retail business license since I sell music/computer gear). There are many self employed jobs that don't require a license, If you live in Los Angeles you can find out if you need one by clicking here: http://ttc.lacounty....icense_list.htm If you outside of the city of Los Angeles you have to check with the local government to find out for sure. Chances are the list of businesses will be the same.

If you have an accountant, they will be able to do your taxes, making sure you have filled all the correct forms and schedules. Myself I use tax software which usually available before the end of the taxable year, ie 2008 tax software comes out in October 2008 or so.

You should download the I-134 form since that is what he will need you to fill out, as well as the supporting documents, which is your tax return/transcript and anything else needed.

Thanks everyone for helping answer the question.

I have another question regarding to the Poverty Guidelines. As of now, what is the minimum income requirement for 2 people? When they say minimum income requirement, do they mean Income or Adjusted Gross Income shown in Form 1040?

The minimum income requirement is Adjusted Gross Income for the Poverty Guidelines. For 2008 it's $17,500.

Asia: East and PacificHow to create a time-line when get a blue slip

* September 13, 2007 Photos of sightseeing

Asia: East and PacificI-134 questions.....
Hi All

I'm putting together the I-134 and of course there's questions that I don't seem to find answers to.... If anyone can help, that would be great.

1. Since I'm self employed, I don't have a W2, or whatever. What income figure do they want from my tax return? Gross or Net? Either is over the 125% guideline but I'd like to put in the "correct" number.....

2. Also since I'm self employed do I write myself a letter of employment?

3. Do they want my retirement mutual funds/CDs/Annuties listed? Where? Would the mutual funds be listed under stocks and bonds (I only have account numbers not the actual stocks and bonds) The CDs/Annuties under saving?

4. I own my home, I'm not sure to list it since it's not really an asset. The current mortgage balance is about or less then it's current market value. I'm concerned it could confuse the Consulate. In fact I see the money draining out of it as I write... Opps, that's the rain in California..... If I list it do I need to include my property tax bill to show it's value and mortgage statements?

5. Personal property and life insurance, should I include any evidence to support them? Policy numbers, statements, appraisals?

6. Item 10 (I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services (USCIS) on behalf of the following person(s). If none, state none.) I've found that some say answer that with "None" and others have written their fiancee's name in. Which is it?

Thanks

Peter and Thi

Asia: East and PacificMeeting with Consulate
I'll be arriving in HCMC on Feb 25th and her interview is the 27th. I don't know if I'll have time before her interview to see anyone at the Consulate but I may try to see somebody while I wait for her. If she passes, and gets a visa in 3 weeks, she'll ask them to speed it up so we can return together. If not I'll try to see if I can speed that up as I'm have to leave on March 5th (I might be able to stay an extra day or so if it means she'll be able to come back with me). If there's a problem, then I have to get it fixed before I leave.

Right Now I'm trying to get all the evidence organized so the Consulate can find everything they need to find easily and everything I think they should see, ie cover letter for my September trip and evidence, cover letter summary for each month of chats (about 200 single space both sides at font size 10 or 12?), phone logs, ecards, Christmas cards, etc. And my financial records of course.

Thanks everyone for the advisement.

I will try to speak to her parents. although she is the oldest, she is not the first to leave the house. She has a 22 year old sister already married to an american, living in the US.

As far as them living in the country, Rach Gia is far from living in the country. Rach Gia is the largest city in the far south next to Can Tho.

Her parents are very accepting of me and love me very much. Her family usually goes to sleep between 10 and 12, so it's not a time issue.

Again, I will try to talk to her parents

I'm sure you'll say the right things and get everyone to understand each other. Then everything will work out. Problems like this can bring everyone closer when handled correctly.

We wish you our best!
