Hi Nat,

It has been a while since my original post, but honestly I am not that much further forward. I have an immigration attorney working on my application and I literally just couriered the signed application back late last week. I am hoping my attorney files the application in the next week.

Having said that in answer to your question, we used our China address as our primary address (part 4.a), then my attorney's office address as the mailing address (part 4.b).

With reference to the fingerprints, I had them processed in Beijing at the consulate. It was a nightmare, since I could not get them done here in Shanghai and really couldn't get any help from anyone at USCIS. Anyway, they finally agreed to make an appointment, I went to Beijing, got fingerprinted and they gave me the fingerprint cards back in a signed, sealed envelope to mail in with my application. I wish I had a name of someone there that could help you, but they seem to enjoy the anonymity and no one gave me their name. To add insult to injury, the officer that took my prints said 'why didn't you do this in Shanghai?' She was quite surprised that I had to travel to Beijing just to do it.

Where in China are you? We are living in Shanghai and I have requested Fairfax, VA for my interview and oath.

I have the same problem as you... I'm about to send my application, under the same conditions, but I dont know if I should list on "Home Address" my address overseas or an address in the states (by the way Im also in China). From what I have read on this forum some people think their application was rejected because they listed their overseas address... but Im not certain what is the right way to go... I know it has been a while since you posted your question... what did you decide to do?
You could list a family member's address... what address does USCIS have from you?

If you are still around please let me know what is the status of your application, if you sent it yet.
Also, what did you do about fingerprints? did you have them taken in China? the people from USCIS office at the US embassy in beijing refuse to take mine because they say I need a request from USCIS in the states that asks for fingerprints to be taken overseas... how did you figure that one out?

Hi there,

I am hoping someone here that has filed for 319b expedited naturalization and who is not in the military can help me.

The question I have is with regards to having a US residence. My DH and I sold our house prior to leaving the US, due to the financial market and not wishing to lose even more money, but my attorney seems to think that we will have an issue since we do not have a current US residence. Our US mail is forwarded to us by my DH's company, so we only have a PO Box in the US or our actual address in China.

Anyone else filed without a US residence? I can see why having a US residence would help my application, but will the lack of having one harm us?

Just curious to see if you managed to resolve the rejection issue yet?

I am in the process of starting my application and am also living in Shanghai.

If you don't mind sharing, which office are you filing the N400 (319b) with? Right now, I am thinking it is best to use the Fairfax, VA office due to the same day oath option.

Did you do your wife's fingerprints here in Shanghai prior to sending your application?

Any advice you can offer would be so appreciated.

Thanks for your reply. I am filing from Shanghai for my wife and I work for a US company. Therefore, I do not have an APO address. I entered our Shanghai home address in part 4A and in 4B simply mentioned "same as above".

Maybe, I should put an an explicit address in part 4B as well??

Thanks Sunny, I have seen/know a lot of people applied under 319(b) section and living oversea had gone to hawaii and get everything done within the same week (including the passport) before, but since it seemed like a lot of things has changed regard to becoming a u.s. citizen - so I am not sure if I still can rely on the information that I have, thought maybe someone here just done it recently. Anyhow, I'll post it when it's done.

I am in a similar position in that I am a green card holder currently living in China, married to a US citizen and applying for naturalization under N400, 319b.

There is a lot of confusion about the process, but basically you CAN apply from outside the country if you fulfill certain criteria. A lot depends on how long you have lived outside the US, why you are living abroad, who you are working for, if you are with the military, etc, etc.

I highly suggest you do a search on this forum using '319b' as your search criteria. There is also a great post at the link below.

I also had this question but you beat me to it, thanks! I received our P3 from Guangzhou last week and we questioning what to send in. From the instructions it clearly says to send in the checklist (169) and DS-230. If you got what I got, it was a booklet which was the checklist(169), then a separate booklet called form 167, a DS-230 form and an outdated I-864 form. For some reason before receiving the P3 from Guangzhou I was also however confused what to send in since the I-864 came along with the P3, somehow I immediately assumed anything they send was to be returned, I was wrong. So I'll return the Ds-230 and the checklist and thats it.

Thanks for the responses. I'd looked at several timelines before, but hadn't fully understood all of the steps -- or that DCF would allow me to skip the NVC steps. I've made an appointment with the Beijing office, and will be updating my own timeline as I go through the process.

I'm a US citizen who's been living in Shanghai for 10 years, and married to a Chinese citizen for the past three years. We've decided to start the immigration process, but I have a question about the first step (I-130): Is DCF always preferable to filing at the Chicago lockbox?

I've read on this forum that DCF can be faster by several months, and if that's really the case, the hassle of a one-day trip to Beijing seems worthwhile. However, I emailed the Beijing USCIS office yesterday to make sure I'm eligible for DCF, and this is the response I received:

Our earliest appointment is on Jun 06. Our office will typically complete an approvable case within 30-45 days. If additional evidence is needed it can take longer. A review of Service Center processing times indicates their overall processing times are less than this. If you choose to express mail your petition to the Chicago Lockbox, you may receive a quicker decision. Of course the choice is yours, and if you wish to file the petition with our office, please respond to confirm your appointment on Jun 06 at 2:15pm.


What do you think? Should I go with DCF or Chicago?
