Removing Conditions on Residency General DiscussionI-751 November 2010 Filers
Hello fellow November filers :)

I haven't been on here for a while so here's a quick update. I received my NOA on 12/14/2010 and my biometrics appointment was yesterday in Milwaukee. It all went very smoothly. I was only there for about 20 minutes and then I was back outside. And now we wait...

Good luck to all other November filers!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 interview approved!!
Well, I had my interview yesterday at the consulate in Amsterdam and I'm very happy to say that our petition was approved!! kicking.gif
The interview itself went pretty smoothly. It wasn't very long either. Unfortunately I did have to wait for 2 hours for the 5 minute interview. But when I was told that I would be getting my visa, that definitely made the wait worth it. I will post a review of the interview shortly.

Thanks to everyone here for their help and support. It made a huge difference. good.gif

CSC received our I-129F on October 17, 2007. Our case was touched for the first time today (2/26/2008). Keeping fingers crossed...

Our case was touched for fhe first (official) time yesterday too. It's good to know that at least it's there and someone did something with it, even if they probably just took it from the big pile to someone's desk. I got all excited when I saw yesterday's date on the USCIS website smile.gif

Good Luck good.gif 'Stardust72' Maybe this will be the beginning of many October CSC'ers?!

Oh yes, that would be great. I'm all for that yes.gif

Nebraska service center, lucky you hehe. When are you going to send the I-129?

It looks like it's going to be a few weeks yet. I know they don't process them anymore so I need to update my info. It's going to California now.

K-1 Fiance(e) Visa Process & ProceduresK1 question (I-129F form)
My American boyfriend and I have made the decision to start the K1 procedure so we can finally be together. I have a question regarding the I-129F form that he has to fill out. One of the questions he has to answer is when I last visited the US, which was just last month. It also asks for the I-94 number. How important is this and can we leave it blank? The reason I am asking is that when I left earlier this month from the airport in Green Bay they, they took the green I-94 form from my passport so I have no idea what the number was. If it is really important, is there a way to find out what the I-94 number was? I don't want to leave the question blank just so the form gets returned to my boyfriend and we face a delay.

What I always wonder about when I read stories like this is how can you just decide to stay in the US? I mean, if my boyfriend proposed to me the next time I'm there (and I have no indication that he will wink.gif ) , I'd still have my job and apartment and lots of other stuff here in Holland to take care of. But without AP I wouldn't be able to leave the country. I'd get in all sorts of trouble if my rent didn't get paid and I just didn't show up at my job. So I'm just wondering how people do this.

I was divorced in Wisconsin. It clearly stated on my divorce decree that I was not free to marry for six months after the final hearing where the divorce was finalized. If your boyfriend was divorced in Wisconsin it will state this on his decree as well. Since you have to send this decree with your I-129f as proof of divorce and you must be free to marry at the time of filing your I-129f you will have to wait out the six months. I did.

To the OP: Did you miss this post? The person above answered your question.

No, I didn't miss it. But this just seems to be one person's opinion. So it doesn't really answer my question without any doubt.

i was informed that i can't get married within that six month period, however, i can still file because there is about a six month wait. and the clock does not start ticking on the "90 days to get married clock" until Lidia comes back into the U.S. so if our case takes 120 days we are safe because you add 60 to that and we have a 30 day window to get married. sorry if that was a bit long winded. my point is go ahead and file if they say no because a time factor at least you tried. hope for the best plan for the worst.

So far that seems to be the point of view of the firm we want to use, but before we file anything I want to make absolutely sure that they know what they're talking about so we will talk to them again.

If you use this firm...make sure you have a money back guarantee when you get denied.

Dont worry, we checked... they do.

My boyfriend just called to tell me that after I gave him all the information from here, he contacted an immigration firm. They think it shouldn't be a problem, but they agreed to look into it for us. So that means there's still hope that we can file this month smile.gif

K-1 Fiance(e) Visa Process & ProceduresK1 after divorce
Thanks Nini & Bee for the link to that thread. I just went through the whole thing and it looks like it's not as straightforward as it seems. I think I'll let my boyfriend read it and see what he thinks. Actually the whole getting married in Vegas thing has come up. But since we will be living in Wisconsin, that won't be a valid marriage if it happens within 6 months of his divorce. So the question of whether he is officially free to marry remains. I'll check with him what it says on his decree. If it says that he is not free to marry for six months after the final hearing where the divorce was finalized, I think it's clear that we'll have to wait. Ugh.... that's not good sad.gif

Your boyfriend is right I'm afraid. In order to file the I-129F you both have to be legally free to marry and he won't be until his divorce is finalised.

Sorry to be the bearer of bad news. sad.gif

Gillian

His divorce is finalised though. But according to Wisconsin law he can't get married for six months after his divorce is finalised. I'm not sure if that means he is not legally free to marry or if that just means he can't get married in Wisconsin. He has all his divorce papers so that's not the problem. I just really hope we don't have to wait another 4½ months before we can even file the I-129F. But if we have to... so be it.

K-1 Fiance(e) Visa Process & ProceduresK1 after divorce
My boyfriend and I want to start the K1 procedure as soon as possible and we are now busy gathering all the evidence and documents. He has been married before and his dovorce was final in July of this year. He is not allowed to get married for six months after that. Now he is worried that this means he won't be able to file for K1 for six months after the divorce either. It seems unlikely to me because the whole procedure is going to take over six months and we obviously won't be getting married during that time. I can't find anything about this anywhere though. Does anyone know if there actually is any rule that says you can't file for K1 within a certain amount of time after your divorce?
