Aw, he sounds lovely. I understand completely how you're feeling. Leaving children and in my case, grandchildren, close friends, people who have been part of my life for many years. Yes, there have been times when i thought, why am i putting myself through this! Then I look at my husbands lovely face and listen to his calming voice and know that I can't be without him. We're lucky in that I will still have my home here in Ireland to spend our holidays in. The whole visa process certainly takes its toll on us but we'll be all the stronger for it. Good luck.

We filed our 129f on receipt of the i797 for the 130,  we're June filers. The 130 is in Overland Park and the 129 is in Lees Summit. Have heard nothing since NOA1s. Will be interesting to see if the 129 is approved first. Either way, at this stage we'll take the quickest route, even if the K3 costs more. We just want to be together!!

Just to clarify N-O-L-A, although I live in Ireland and have an Irish passport, I live in the north which is in UK so have to go to London for my interview. It's a bit ridiculous really as the embassy here is only less than an hours drive from where I live but I'll have to fly to London, stay overnight there for interview. Have also to go to London for medical. Hard to understand when they are BOTH U. S. EMBASSYS! Just makes the whole process so much more expensive too!

My case is with NVC since Feb 11th and still no case no. So as Saylin says, it takes a few weeks, currently 30 business days, as I was told, AGAIN, by NVC this morning. Good luck.

We have the same situation. Currently our 129 is with our embassy and 130 is in NVC. We have already filled out the online ds160 form for the 129, so we're going to go with that if possible. Costs more but it will be faster. Will depend on the embassy, if they go ahead and process it. In some cases it is closed by the embassy, I think its just the luck of the draw really.

I had the same thing happen to me. So the embassy will receive the file and you will be asked to have your medical and get your documents together. At that stage I emailed the embassy to inform them I had everything ready. I then received an email giving me my interview date. It took about a month from embassy receiving the 130 to interview date. Check CEAC for updates to your case. I have to pay the fees at the embassy. I will be taking the i864, the 260 and all supporting documents, in fact everything that would have been in the IV and AOS pkts. Will give you an update after my interview which is on Tuesday next week.

Yay!!!!! We got a message earlier today that we were given an alien registration number, and at midnight tonight we received another text saying our case was updated, so we went online to check right away, and it said our I-129F was approved!!!! We're soooo excited

We filed on September 4, 2012 so it's been 7 long months of waiting, but it's finally here:) hopefully the next steps go a little quicker

We just phoned uscis and the national visa center, and when we spoke to the woman at the visa center she said that because our NOA2 said it was being forwarded to the consulate listed that it wasn't even going to go through them, it was just going to be sent straight to Canada......does this happen? I thought all cases went through NVC?

I asked earlier about whether putting Calgary as the consulate on our I-129F form was a problem, and the answers I got said that it would be changed for us to reflect Vancouver as the consulate because Calgary doesn't handle k-1 visas. We received our NOA2 in the mail today and where it says consulate, it still says Calgary and that's where they're sending it. Will it still be changed for us or do we have to call somewhere and change it

hey guys, I'm filling out the form DS-156, the one you submit online and I have a few issues with it.  Filling out the space where it asks for previous visits to the U.S, and I have run out of room because I visit the U.S a lot.  Do I just submit it online stating that the rest of the answer is on a separate sheet and just bring it with me to the interview?  I don't know how I would attach it to the online one

Anyone had any luck visiting the US from Canada for around 5 months while waiting for the NOA2. I'll have to quit my job (which I hate anyway lol), but will evidence of bank loans, accounts, etc be enough? I could get a letter from my "landlord", but he is just a friend I stay with. I pay rent but there was no lease etc. I'll also be bringing my pets with me, will this raise red flags? I wouldn't want to be away from them that long.

I'm from winnipeg, Manitoba and while we were waiting for our NOA2 I've been in the states visiting him for the past 3 months and I've got another couple weeks left before I go back to winnipeg. I had no problem getting in. I would suggest getting a letter from your "landlord", because you need to show that you have ties to where you're staying. With regards to pets, I have a small dog that I left behind with my parents, if you bring them along with you, just show that you couldn't leave them behind for that long

Sorry to hear about your father in law. If Aus still has DCF I would certainly think this would qualify you for a speedy DCF processing. I'm not familiar with the rules for Australia. I'm a USC living in Canada and filing for my Canadian citizen husband. I had to submit my I-130 though the lock box in Chicago, but I believe that if your situation is urgent (and I personally believe your situation may qualify because of your father in law's illness) they do allow for DCF processing, at least they do here in Canada. Anyway, as long as Aus *offers* expedited DCF at least for emergency situations I'd try to do that. The worst they'll say is no, but I'd like to think your situation will get the special attention it deserves due to your circumstances,

For the children you have together, have you actually sought US citizenship for them yet? Just having a US parent does not automatically grant them citizenship by itself if they were born in Aus. You'll need a Certificate of Birth Abroad, and that will grant them their US citizenship. If you haven't done this already, you'll need to go to the website for your nearest US consulate and make an appointment to bring your children there to get them a certificate of birth abroad for US citizenship. I'd suggest doing this today because it may take a little while to get an appointment. Your USC husband will need take the children with him to the appointment and present his proof of US Citizenship and some evidence proving he's lived in the USA for X amount of time (I believe 5 years...but all of this should be on the website as far as what they need for proof.) I ordered my university and high school transcripts and that worked fine for me. There are a few forms to fill out and a fee and a few weeks after the appointment at the consulate you'll have a very fancy certificate mailed to you proving you children are officially US citizens.

While you're at the consulate, I'm pretty sure they'll let you apply for a US passport for your children the same day. At least they allow that at the Toronto consulate. Again, there are forms to fill out and fees but it would potentially save you another trip to the consulate for a US passport.

It may not hurt to ask the US consulate workers if they can advise you on what to do in your situation with immigrating. The people I dealt with at the Toronto consulate were all super nice and friendly and helpful. Hopefully you'll have a good experience at your consular office. Thanks so much for your reply. It gives me hope to think i can file for DCF. They still have it here, but has restrictions, such as illness. I'm hoping we fit into the category for this. I will get onto the passport for my daughter. I had no idea it could be so difficult!! Thanks again.

Well you cannot file for AOS from VWP with intent. However you can file for CR1 from Australia and visit with VWP as long as you are able.


Do you mean that I can file from Australia, enter the USA on a VWP and then extend the VWP? I thought I could only stay for 3 months with VWP.

Hello

I am looking for some advice about my situation...

I have been married to a USC since 2008. We were married in the USA but have lived in Australia since then. My husband (USC) now has permanent residency in Aus (soon to be a citizen). We want to go back to the USA as my husband's sister is getting married in August 2013 and my husband has work lined up starting ASAP with his father. His father has been diagnosed with Parkinson's Disease and is ailing. We also have a 5 month old daughter born is Aus.

What is the quickest option for me?
Do you think this is grounds for DCF, because his dad is sick?
Can I file an I-130 while living in Aus and then move to the USA on a visa waiver and convert my status while there?
Or, should I begin the process there?
Should I go over on a tourist visa or waiver and then apply?

Any information would be greatly appreciated.

Hey again guys!

This is hopefully the last time i need to look for advice! This is more to put my fiance at ease, She has her interview on Tuesday (Hooray)!! When she tried to schedule her medical they were not able to get her in till 2 weeks later, She lives in Adelaide so she was hoping to save a trip to Sydney, so clearly that back fired. so we just want to make sure that she wont be turned away from the interview and will just have to wait till the embassy receives the medical results in a few weeks before they issue her the visa. Thanks again guys! This forum has mad this horrible, stressful, and at times hopeless ordeal easier!!



I have the same problem as I live in Tassie. I emailed the Sydney consulate asking if I could do the medical and interview in one trip. They said to do the interview in the morning and schedule the medical for the afternoon. They said the results could be sent straight to the consulate when they are ready (since it can take a couple of weeks for them to be done). So I assume it doesn't really matter if the results arrive after the interview. Good luck!

Even though our 130 is approved and we're on our way to NVC, we got a notice today saying our I129f has been transferred and being processed at a USCIS office! I thought it would have been administratively closed. But maybe that will still happen!
