No experience with family lawyers in Mexico, I suspect fees vary widely by type of practice and experience just like in the US, but there is no doubt your novia needs to secure the services of one to get this done. She might go to the local DIF office to get some advice and perhaps find low-cost legal resources for gaining full legal custody.

I would definitely talk to a South Korean attorney of some sort regarding the military service to confirm that whatever plan you're formulating will be beneficial in the long run. Living in South Korea, I encounter so many wild situations, both for delaying/avoiding the military service, and for serving it despite circumstances that would seem to indicate otherwise. It seems very complex to me, personally. As far as the visa, I see no reason why a K1 is better, personally. Have you looked through the flow charts for the different visa types on here? In any situation where the beneficiary is currently in the US otherwise engaged in some kind of visa-granting activity, it seems counter-productive to have them leave for consular processing, which is what happens with a K1 visa. I suggest reading those guides linked at the top ribbon of this forum to see some of the reasons why a spouse-based adjustment of status is better in terms of US immigration.

Start by just asking for your invoice number. Say you need it for your records. They might say "You can't pay online!". Say, "I just need it for my records". They should give in.

Or you might get lucky. When I called, the operator was very polite and said even though online payment wasn't available, he'd at least give me the number. Have you tried calling yet?

If so, you need to call the NVC (603 334 0700) to get the IIN. You must speak to an operator. They will tell you online payment is not possible, but of course we all know that it is. smile.gif

Keep insisting that you need your invoice number for your records. You should be able to get it from them. I did on the first try, but some people have to call back and speak to a different operator.

I'm guessing first class mail would take up to a week to arrive, plus it seems like it takes them about 1-2 days to register it in the system at NVC after it arrives. But really, anything else you send to the NVC you should send at least Priority because then you can add tracking, it arrives faster, and is generally just a bit safer. It is VERY worth the money.

Our DS-3032 was emailed and accepted within a week. About 2 weeks after that, the hard copy of it arrived in the mail! So in our case email was faster. But it does seem like lots of people complain that the email way takes longer...

I guess it depends on the country. For example, the heads of the Cuidad Juarez consulate in Mexico stated last November:

So at least in some places, it can be signed by the agent. You might see if you can get in touch with the consulate processing your case to make sure. Could be that they'll let you sign it just like Mexico does.

My situation was extremely similar to yours and I got an RFE for not including a letter proving my current employment, even though I have a Joint sponsor. I guess they just want to know what exactly you're doing right now??? Or maybe I was just unlucky...

Well, we were delayed for awhile with a false RFE and this past week has been a headache because I was truly convinced they lost something. But this morning, the AVR said we're complete. Such a relief!

Now the wait for an interview. They just yesterday assigned interviews for completed cases through Mexico, so I have a feeling it's going to be another month of waiting, but at least I know we're clear on our end with the paperwork! smile.gif

This EXACT same thing happened to me! It drove me nuts!! I asked to have a supervisor review the file and then our case was complete in 5 days. They never actually were missing anything the second time around. Something dumb got triggered in the system. A few days after our case was complete, I received the 2nd RFE letter requesting the same stuff the 1st letter had requested. So somehow they re-submitted the RFE after they received the response....good luck to you!!

I had an I-864 RFE, which is why I suggest being extremely thorough.

1) You will still need to file everything for yourself. I had a joint sponsor covering us totally, but the NVC still wanted proof of my employment. So include your taxes, W2s and paystubs or employment letter, or a letter explaining why you don't have these.

2) I recommend having your sister include tax returns or transcripts + W2s for both herself and her husband, along with her current paystubs (at least get a month's worth) or an employment letter.

Stay strong and don't let this get you down. Do you have exact copies of everything you gave your attorney? Do you have the packet together to file yourself? If not, don't fire your attorney yet. See if you can figure out what happened to your packet. Give this attorney a few more days to respond to your inquiry about the paperwork and then if he doesn't respond, send the paperwork yourself. Also, if he sent the paperwork by regular (first class mail), it could still be a few more days before it shows up in the system at NVC. I would hope an attorney charging $1400 wouldn't use standard mail, but I don't know your attorney, either.

If you do end up firing him, it can't impact your paperwork in any way as long as you know at what point in the process you are and what has been filed so far. I believe you'll need to change your choice of agent so that it's not your lawyer anymore, but that shouldn't be too difficult, I hope. You should be prepared to take charge of your case now, but you already know that this forum will provide all the help and advice you need.

During certain parts of our process, I was with my husband in Mexico and mailed documents from there. I seriously don't think it matters. As long as all the forms are properly filled out, all the correct documents are included, and you send it to the correct address, there should be no problem.

I'm not sure what exactly you're asking for... The NVC doesn't have an online case status like USCIS does. However, you do have the choice to pay your fees online, kind of.

To pay fees online you need to call the NVC and speak to an operator to get your IIN. This seems to be getting very difficult as many operators refuse to give it, but with persistence you should be able to get that.

Once you have it, you go to https://ceac.state.g...ice/signon.aspx and sign in using your NVC case number and IIN. Once your fees are posted, you can pay them using a bank account routing number.

I think they're making it increasingly harder to get the IIN. Back in early June, I got it right away on the first try. Now it sounds like they put up such a fight. Maybe they're on to all the people using shortcuts and are afraid of overloading the system somehow.

It might depend on which consulate/embassy you're going through. I talked to an operator today who said interview scheduling was complete for September at the Mexico consulate. I believe this is true because for the past several months, NVC has released all appts for Mexico on the Friday of the second week of the month. So I have to wait until the second Friday in September to hear about our October appointment.

Also, I was under the impression the automated system does not get updated with interview information, you have to speak to an operator to find out. Do people from other consulates find out their interview dates on the auto system?
