My fiance filed I-129f last May 7th and got our NOA1 on May the 9th. I was in Singapore back then working but my contract ended last July. We went home together in Phil on that same month for him to formally ask my hand in marriage and when he got back to his homeland he called USCIS to update my address. Few days after, they sent him an email confirming the change. We have nothing to worry about until last friday, post thanksgiving-Black friday, and our anniversary, we received a letter from NVC saying we are approved and they're sending the packet in US Embassy in Singapore. We haven't received our NOA2 yet so we were both confused as to why it is now in SG when we already updated the change of address 4 months ago. My fiance made a lot of calls and was passed around with everyone. It's frustrating. NVC said it's our fault that we haven't called them in the first place. Our papers was still in Vermont that time, we updated and they confirmed it, we've done our part and why would we call NVC if the papers are not there??? Are they joking??? My packet was sent to my old address in SG and I had my landlady send it to me here in Phil. It's fine if I'm coming back there to have my medical exam and interview but now they recently sent an email saying they cant process it since I'm not working there anymore. They will have to send it to Manila. But when I checked the local embassy site about transferring visa file it stated "PLEASE NOTE THAT IT WILL TAKE SEVERAL MONTHS TO RECEIVE CASES FROM OTHER EMBASSIES/CONSULATES." Meaning to say we waited in vain for 6 months and we're going to wait again?? This wasn't our fault and we suffered from it. They wont even help us because they can't do anything about it. What the heck?!
This is really just frustrating being passed around with everyone when we are already approved.

Things have changed over the years. To be eligible for DCF (direct consular filing - which it reads like that blog was talking about) you need to be living in Japan for at least 6 months prior to filing, and remain there at least for a little while while it processes.

DCF also isn't available in every country anymore (since around August last year I believe).


Correct, last August is when the new procedure took effect and since then, Japan is one of many countries where DCF is now unavailable.

Hi, thanks for reply. That is part of my confusion, the K-3 option looks best, but there have been some posts saying that K-3 has become obsolete. May my fiance come to US and marry and then file for the CR1? What is the real difference between K-3 and CR1?


K3 is a non-immigrant visa spousal visa that would require the holder to eventually go through the Adjustment of Status Process in order to obtain a green card. CR-1 is an immigrant spousal visa; it's holders are given green cards on arrival (the visa in combination with a CBP entry stamp acts as a temporary green card, the actual card arrive in the mail a few weeks after arrival).

The K3 is obsolete because it is often administratively closed by the NVC.

To the point of your original question. You can start the K1 process now (as long as you have met at least once withing the past two years). You will not be able to start the spousal visa process until after you are in possession of a marriage certificate. The K1 process allows her to come, you two get married, and then she files for Adjustment of Status.

Briefly: Fiance is in Syria. We met online over a year ago and have been trying to visit in person, but something crazy always happens over there to mess things up. We want to apply for the exception to the two year rule, but everything I've read suggests it's nearly impossible. If we're denied, I'll have to fly somewhere to meet him, say Turkey or Jordan, but once I do that we could just get married and then apply for AOS. Is it pretty much the same or would that method not be recommended for some reason?


Don't plan on being granted an exception to the in-person meeting requirement. However, once that requirement is satisfied and you file the petition, you can request that it be expedited for humanitarian reasons. I would think the current situation in Syria certainly would fall into this category.

No, you don't apply for AOS if you get married in Turkey or Jordan. You would file a petition on behalf of a spouse. The foreign spouse would apply for a spousal visa.

Also, is there anyone here going through this process with a Syrian living at home currently or earlier this year? All posts I've seen are about Syrians living abroad or applications done in 2010/11 and the situation is deteriorating by the day. Is it even possible to go to a foreign embassy for the interview anymore or would he have to leave Syria all together? I'm sick over this and any help is much appreciated. Thanks again.


All operations at the US Embassy in Damascus have been suspended since February. Syrian beneficiaries have been interviewing at the US Embassy in Amman.

You need not worry about the expiration date on the petition, the Consulate has the ability to revalidate a petition if an interview has not yet taken place.

Whatever point you are trying to make here is irrelevant. A signed letter of intent by both the petitioner and beneficiary to marry each other within 90 days of entry to the US on a K1 visa by the beneficiary is a required submission item per the I-129F instructions. Failure to follow the instructions could result in an RFE or outright denial of a petition.

It may also be culture dependent. I know that in Japan I can hold a ceremony without filing any paperwork, and as such would not be legaly married. Likewise, I can file the paperwork without a ceremony and be consider legaly married.

In other cultures just the meeting of the two families can be considered a legal marriage.


This is an important thing to determine, what actions in which countries constitute a legal marriage by law.

Hello All!

First off, thanks for all the helpful info. I Express Mailed our I-129F Fiancee application yesterday and was just looking that the receipt confirmation. The ball is officially rolling.... There is so much info that is almost difficult to process. This is how I think it goes down:

1. Send in application
2. They receive it and send NOA1 and then send to appropriate service center. In our case, (I live in Seattle) I am assuming that it will be the California center.
3. Then they review the application and that takes like 5 months or so?
4. Once that is approved, they send NOA2 and from there it goes to NVC or CV something?
5. Then they send my application to Manila.


Thanks in advance for any info.

You sent in a petition, not an application. You are not applying for anything, you are petitioning the government for your fiancee to be given permission to apply for a fiancee visa.

To answer number 4, I too live in Seattle and at the time I filed my petition, it was routed to the service center in CA.

USCIS lists criteria for granting an expedite request (you can find it on the USCIS website or by using the VJ search tool). If your expedite request does not fall within the established criteria, then the request will be denied.

You need not worry about the expiration date that is stated on the notice. The Embassy has the ability to re-validate the petition if an interview has not yet taken place by the aforementioned date.

Re-validation of petitions by Embassies and Consulates is common and routine.

I am wondering how many of you used a Visa Service, Immigration attorney, or chose to file on your own.


Filed on my own (you will find this to be the common answer of many VJ members).

When I read the attorneys websites, I see that they try to get you to use them by saying the services cannot go to bat for you when something is wrong. Is it worth the added expense to use an attorney?


The claim being made by attorneys about services is accurate, the caveat is the "something is wrong" statement doesn't really come into play unless a petition or a visa has been denied. Therefore, at the starting line of this process, services provided by an attorney or a visa service are on par. You have to gather all the required documentation and evidence before anything can be filed.

Now with that being said, carefully study required forms and instructions for said forms. Also, read the guides here on VJ. Determine your comfort level in dealing with the paperwork and go from there. Also, there are some cases where that have very complex issues and such cases do require the assistance of a qualified attorney.

In a nutshell, no one here can tell you what's best for you, you have to decide that for yourself. However, the experiences that other members choose to share may or may not assist you in your decision making.

You have to call the NVC and ask them if your file has been sent. They won't notify you and there is no way to check online.

Browse the link www.uscis.gov, you will find in the top left of the webpage there is CHECK STATUS with green color asking you to enter receipt number in the search box. There you go!

One thing you need to be prepared for is that it is a near certainty your fiance's file will be placed into Administrative Processing (AP) when the interview is complete. AP can last from a few weeks to more than a year.

if your fiancee does not have a middle name then put NONE.


The problem with writing "NONE" for the middle name field is that doing so can and has resulted in the beneficiary being identified as having "None" for a middle name (e.g. Jane None Doe).

Before I begin filing for a K-1, I wanted to make sure that it is the right visa category for my fiancée and I.


Since your fiancee is the US Citizen, she will be doing the initial filing, not you.

She is an American and Canadian citizen and is studying in Vancouver, BC for the next 8 months. We will be living together in Canada while we wait for the visa to process. Is there any requirement that my fiancée be a US resident at any time in the process?

USCIS makes determinations on petitions, not visas. It's the consulate that determines if you are eligible for a visa or not. To answer your question, you need the visa to come to the US, get married, and then stay. Therefore, you would not be denied a visa for the reason you state.

First of all, an I-129F is not an application form, it's a petition form.

Secondly, as previously posted, sending anything to USCIS at this juncture is likely to be nothing more than an exercise in futility as it's highly unlikely it would be matched with the file. I'm not suggesting that you don't try, but merely informing what is likely to be the result.
