Hello, I plan on visiting my fiancé in South Korea this summer for at least 2-3 months. I was just wondering what I should expect and if this will be a problem. Does anyone have any experiences they'd like to share? I know that it is difficult for the fiancé to enter into the US and my lawyer advised against it as well but I asked my lawyer about the other way around and they said me visiting to Korea would be completely fine.

Will I be questioned at the airport about my plan on returning? Do I need to bring proof with me that I plan on returning to the US? Thanks!

My fiance and I actually went through with a lawyer. We used Lawrence R. Holmes. http://www.kvisas.com You can find them on this website!
They are very, very helpful if you aren't sure what to do or where to start. My fiance and I had no idea where to start and we heard so many things like people getting their papers sent back because of small mistakes and wasted time because USCIS takes awhile to respond back and then sometimes it'll take a month+ for them to tell you you need to redo your paper or you forgot to send something that is important, etc.

You CAN file for the visa by yourself and without the help of a lawyer, but it does make it easier to have a lawyer helping you.
Basically, they just help you and make sure you filled everything out properly, are sending out all the information and papers that you need to be sending,
and they help to prevent you from getting your papers sent back to you due to errors, etc.

Many people who do the fiancé visa on their own sometimes send out their papers and end up waiting a month for the USCIS to receive it and then end up waiting another month just to get it sent back due to small mistakes. But if you do want to do it without the lawyer, just be very careful and look at many examples online and also double check your papers before sending it in and make sure you're sending EVERYTHING that you need to send.

Gathering all the necessary info and documents can be a hassle and sometimes some might slip your mind so always double check! With the lawyer, they will give you a full list of everything you need, and you can send it to them little by little and they'll always make sure you have everything that you need.

The lawyer service I went through has been really helpful to me and they make me feel at ease (sometimes). Sometimes I still get very stressed out because the process and the USCIS is just so frustrating! This process has been stressing me out, but having my lawyer to ask for help is very beneficial to me. They are very polite and will call USCIS for you if you have concerns or questions, but there is not much they can do about speeding up the process.

It's just really up to you. ^^

It is a bit expensive and my fiance is annoyed at the lawyer because they can't do much about speeding up the process and they are a bit expensive to hire. I think the lawyer is just more reassurance.

So I apparently do not make enough to sustain my fiancé and I when he comes here so I needed to get a co-sponsor. I chose my mother and she makes well over the poverty level, but my lawyer still says it's not enough because she says my mother has to include her support towards my siblings and my father as well as for my fiancé and I, but my father works and makes more than my mother so I don't understand why it would not be enough.

 

It's not like I would need my mother's entire paycheck, I hardly need any of it, honestly. I work full-time and I'm doing fine the way I am now. My fiancé also has been working and has saved up money while he's been away. My mother would just be supporting us with a small amount of money until my fiancé found a job (which wouldn't take too long since we already have connections to a couple jobs for him where I live). I have no one else to ask as my co-sponsor, my father is definitely not willing to join in because he already had the hardest time giving me the information of their tax returns. He is very hard headed in that sense. I know he would not be willing to do it.

 

What else am I supposed to do? Does this mean I can't even finish the process?

I am pissed beyond belief.

I don't understand why they are making the decision that because my siblings still live at home, my mom's entire income goes to them. My parents split costs in everything. So I don't understand why her income isn't enough to support my fiancé and I.

I just received an email stating that an RFE is being mailed to me. It states in the email that once they receive the requested information a new processing time will begin. I called them and they said my processing time won't start over. They said the only delay should be the time it takes me to receive the letter and return it.

I was hoping someone might be able to let me know what stage in the process this is for them. Or maybe it can be at any stage. We are already 6+ months since submitting the petition so I hope this is a sign that they are close to making a decision once they receive the requested information. So I guess what I am asking is what might be a typical timeline for them to send me a decision once I send in the information requested on the RFE.

Sorry if this sounds redundant or if I neglected to include anything that would help answering the question. I am a first time poster. Thanks.

The RFE only asked for a translated copy of my fiances divorce decree. That is all. I am going to overnight that right away.

 

What I noticed while having the document translated is her name is different on her international passport than what I have written on the application.

 

My question is, should I do anything about this now, or wait for them to ask questions about it? I see 3 options. Send in documentation explaining why the name is spelled different due to tranlastion -or- Send in a request to have her name corrected on the application so it matches her international passport -or- wait for them to request something.

Sorry if this has already been addressed, but I could not find it.

 

I received an RFE because I neglected to have my fiance's divorce decree translated. I had it translated and noticed her name was spelled Olena Borysenko instead of Elena Borisenko (as I put on the application). The reason for this was some confusion between her and I when I will completing the application. She gave me her name as it was listed on her Ukrainian passport instead of her International passport. At the time, I had no idea she had two seperate passports so I was unaware. I guess her name on her Ukrainian passport was translated to Russian and then into English which is how it changed from Olena to Elena. I am getting ready to send in the translated divorce decree, but I am unsure if I should send in anything else explaining the name misspelling or if I should not worry about it at this time. I can make copies of her passport and send it in along with the translation or will all this get sorted out during her interview? It seems to be a common occurance to misspell or have multiple versions of translating a name in Russian or Ukraine.  THanks

Hello all,

I am confused about how long it will take for my fiancée to get an interview at the US Embassy in HCMC. I read the following on the embassy portal and am not sure if the K1 Visa is completed at NVC. Once the US Embassy has received the K1 from NVC how long do we have for the interview? 2-4 or 1-2 month? Thank you in advance for your response.

Approx Waiting Time for interview date from when the Consulate receives the package from the NVC: 2-4 Months (For CR1/IR1, NVC does the schedule for interview date even before the package has been sent to NVC.
1-2 months from when case is completed at NVC.)

My fiancée submitted the I - 129F petition on January. We received NOA 1 on January 25. I read that the process would take about 5 months. I was a J1 visa holder & my home residency requirement will end on June, so it should be coincide with the visa processing time. However I'm worried because we're applying before I finish the home residency & I don't have waiver. Would that affect my chance in getting K1 visa? Do you think i could get the K1 Visa because the time of finishing HRR would be coincide with the visa processing time? I'm trying to go back to the U.S this July & got married there.

He's here on a F-1 student visa, entered December 2012, and there's no paper I-94 in his passport, or anything resembling it on the visa itself...I mean, the visa has a date of expiration, which seems to me serves the same purpose, but I don't want to get rejected for missing one detail!

 

Already checked with his school and they explained that he'd already been admitted under the new (electronic) system, and to order a paper one would take 4-6 months (!). Can't wait that long! There's an I-94 search engine on the CBP Info site but when we put his information in nothing comes up. Frustrating.

 

But thank you so much for your kind advice!! We're just going to keep working on our application packet and hope this number turns up somewhere.

Hello all! So glad I finally found this community - it's exactly the place to find all the information (and support!) we've been missing in our crazy, romantic, bureaucratic adventure. :)

 

Our situation is: I'm an American, and my fiance (who is French) is currently a student at a community college here in the States, on a 6-month student visa. So, in filling out our application, I'm asked to include his arrival information from when he came over as a student - no problem, except it asks for something called an I-94 number, which theoretically is given as a proof of entry and exit into the country. Well, he hasn't got one! They didn't give him an I-94 at customs, and there seems no way to find one (we already tried the I-94 automaton on the website). The news we've heard indicates that I-94s were once given on paper, and now done all electronically, and it seems we were either lost in the shuffle or otherwise cannot access the number.

 

So, what to do?? I'm really hoping someone had had a similar experience and can offer some insight! Is there any other document we can submit in place of an I-94 paper? (I was thinking a copy of his visa, with entry stamp, and his airplane ticket home before the expiration date...not sure what else to do...)

 

We're in a but of a time crunch now so I'm hoping to get this packet in the mail as soon as I can! Any thoughts? Suggestions? Condolances...?

You can refile the I-129F petition (it's a petition form, not an application form). In order for her to interview in Moscow, you will need to indicate a current address in Russia on all applicable forms.

If you submit a copy of all pages of your passport (black and white is acceptable), then you don't need to send a copy of your birth certificate.

The reverse is also true, if you send a copy of your birth certificate, you don't need to send a copy of all pages of your passport.

A CO will consider the totality of the circumstances; for example, how long have you known your fiance, how many times has he come to see you, how often you communicate, etc.

I or anyone else cannot predict the outcome of any interview. The best thing you can do is have plenty of evidence to show a genuine relationship.

I just looked at the website for the Consulate in Vladivostok, they don't process K1's. I also looked at the immigrant visa section on the Embassy in Moscow website and it contained K1 information. I can say with 99% certainty that your fiancee's interview will take place in Moscow.

No, the birth certificate of the beneficiary is NOT required to file the petition.

There is misinformation in some of the posts above. Only the USC petitioner needs to send in a copy of their birth certificate, or other means of proving they are a USC. The foreign fiance(e)'s birth certificate is not required until after the I-129F petition is approved and they are applying for a K-1 visa at their local consulate. Follow the guide A&B linked to.

If you were to get married before the K1 process concludes, then you would have to go back to the start by filing a new petition and paying new fees. There is no "switching" mid-process.

Any waiting done up to that point will have been for naught and fees already paid prior to that point will not be refunded.

With all that being said, it's not illegal to do so nor would it likely to raise any kind of suspicion.

Re-read the section of my previous post above. Once you have your NOA2, see if you can schedule an interview date best suited to the needs of all involved. The Embassy might work with you on this (they may not, but you won't know unless you try).

I think U should check this out but I am almost sure, for sure, that the NOA2 is only good for four (4) months from the date of issue. That means if it's issued on Feb 1, 2012 then U have until June 1, 2012 to get the interview thing done.

I think the NOA2 is valid for 4 months from issue, too.


You are both correct that validity of the NOA2 is limited. What both of you neglected to mention is the Embassy has the ability to re-validate the petition if an interview has not yet taken place by the date listed on the notice.

I applied for my fiance on august 3, 2012. My fiance is form Iran and our application has been processed through California Service Center. I only have received my first letter that they accepted our applications... how long do we have to wait for an actual interview date ? we are both anxious..



Lets get the semantics out of the way first, you did not apply for your fiance and you did not submit an application. What you submitted was a petition. Your fiance will apply for a visa only after the petition you submitted has been approved.

To answer your question, using USCIS' stated goals of 5 months from submission to adjudication decision, the soonest you should expect to hear a decision on your petition should be January. It may be sooner, it may be later, no one will be able to give you an exact timeframe. If the petition is approved, the file still must be sent to an IV unit abroad where an Iranian beneficiary will be able to interview (Iranian beneficiaries usually interview in Ankara). You should plan on this at least one more month before an interview date is assigned.

My fiance filed I-129f last May 7th and got our NOA1 on May the 9th. I was in Singapore back then working but my contract ended last July. We went home together in Phil on that same month for him to formally ask my hand in marriage and when he got back to his homeland he called USCIS to update my address. Few days after, they sent him an email confirming the change. We have nothing to worry about until last friday, post thanksgiving-Black friday, and our anniversary, we received a letter from NVC saying we are approved and they're sending the packet in US Embassy in Singapore. We haven't received our NOA2 yet so we were both confused as to why it is now in SG when we already updated the change of address 4 months ago. My fiance made a lot of calls and was passed around with everyone. It's frustrating. NVC said it's our fault that we haven't called them in the first place. Our papers was still in Vermont that time, we updated and they confirmed it, we've done our part and why would we call NVC if the papers are not there??? Are they joking??? My packet was sent to my old address in SG and I had my landlady send it to me here in Phil. It's fine if I'm coming back there to have my medical exam and interview but now they recently sent an email saying they cant process it since I'm not working there anymore. They will have to send it to Manila. But when I checked the local embassy site about transferring visa file it stated "PLEASE NOTE THAT IT WILL TAKE SEVERAL MONTHS TO RECEIVE CASES FROM OTHER EMBASSIES/CONSULATES." Meaning to say we waited in vain for 6 months and we're going to wait again?? This wasn't our fault and we suffered from it. They wont even help us because they can't do anything about it. What the heck?!
This is really just frustrating being passed around with everyone when we are already approved.
