Hello all. I have some questions.

 

1.In Queston #10  what do I have to write? I read the sample http://www.visajourn.../Form-I-134.pdf

 but the answer NAME (Filling now with I-129F) is kinda off because we have been approved. Isn't Approved I-129F better? What did you write?

2.Question #3 STATE : Well. In Germany there is a big name for my state it only fits 2 letters, can my fiance write it in a different sheet of paper and attached it? 

3. What about question #11? I know what's written in the form but its still kinda confusing

So I've done a bit of research and am currently in the k-1 process. However, a question has been asked that I would like to get cleared up. Is it possible if they are Canadian to simply jump across the border to get married and then file for adjustment of status? Because all the k-1 visa seems to do is get them here in the US.

Just curious; Is it even legal? What would happen later if it is legal? Anyone come across this before?



It is not legal to enter with he purpose of getting married but it is legal to enter as a tourist with no intention to marry and then change your mind.
It all comes to the interview when they will ask you when did you decide to get married.
My husband proposed 3 days after I entered US as a tourist. And we got married 2 months later. It took me 59 days from applying for AOS to greencard approval. Good luck !

The only thing you are risking is the money you spent on your plane ticket ( one round trip ticket purchased before the trip and a one way ticket bought on the spot in case you get sent back ) plus the time spent traveling. If you can afford that , give it a shot. In the end it is at the discretion of the IO if he believes you will return to your country or if you will stay in the US and adjust status from there. What country are you from?

Well, the pastor (a friend) who will be officiating the ceremony has not renewed his licensing as an officiant. He has no legal power in the province to perform a legal marriage. He has also agreed to bring no paperwork.


Even if he is authorized you need a marriage license, without documents signed it is just a blessing don't worry. You can't be married with " verbal agreement " :) at least not in Canada and US.

After a religious ceremony in the US you will be LEGALLY MARRIED, so you will no longer qualify for a K1 visa. Under the circumstances, what I would do, is go ahead with the wedding party but without the ceremony (no pastor!!). You can still wear your wedding dress, but no rings exchanged and no papers signed. You can then get married legally once the visa is issued and you move to the US.


I dissagree. You will only be legally married if you get a marriage license and get married in front of an autorized person. If a pastor agrees to marry you religiously without a marriage license then you are not legally married and you can continue your K1 process.

It would make sense for a family member to apply for a visa, maybe they want to go to your wedding? I don't see that being a reason for denial for you.

Baron555 she probably won't get to the point of needing a chaperone since she is very likely to get her visa denied.

Daddys_dream. Right now, I don't see anything else you can do other than submiting the reason she can't travel to see you. In the eyes of the USCIS the only thing that can stop her from visiting you visa denial.
Not having the money to travel because her family likes her to travel in groups of three is nonsense.
At the same time, this whole chaperone thing is very unusual for a phillipina looking online for a husband. I am not saying there aren't religious families in the phillipines, but their daughters don't try to marry older American men online. Be careful not to fall into a scheme of sending visa money + plane ticket money for 3 people. You are an easy target since you are disabled and can't travel to The Phillipines to cause trouble after losing all the money. Usually, If it's too good to be true it's because it's not true. You don't want daddy's dreams to be shattered now do you?

If I understand what they sent me correctly. The evidence we submit has to be for the time period between Oct. 9, 2010 and Oct 9, 2012, when we applied. I only have until July 15th to provide them with the evidence........

Would that give them enough time to make a decision on a tourest Visa?
How long does it normally take them to reach a decision on a tourest visa?


Sorry I don't knw th answer to your questions. I do know that you are wasting valuable time by not having her apply for the tourist visa.as soon as you have the denial submit the evidence.

I agree, when faced with the condition of having to sign documents than it's clearly a wedding. Some churches will do blessings though, calms down the bride, and it's totaly harmless in the eyes of the immigration.

And without written documents how did you prove you were married?
I would see it being accepted localy but I doubt USCIS would not ask for a legal document as proof of marriage.

Church marriage is not a legal marriage, make sure you do not sign anything though.....
Are you sure your church will marry you if you are not legally married first?
As long as church marriage is a " blessing " you are more than fine, but if they have you both sign documents in front of witnesses, your church might have the power to legally marry you so check first. But as a general rule in the eyes of USCIS no signed documents= no marriage

I just want to ask,.I am a Filipina married in Islam rights, but I was divorced through Islam court known as Shariah, I have all the documents that shows I am divorced, an authenticated NSO decree of divorce, Certificate of Divorce, The finality of Divorce and annotated marriage contract from NSO also... I think what most are saying is that it will be another eight months if you continue with your K1. It will likely be more than twelve months to circle back and get married, then file for spouse visa. What's the priority? Get the visa or get married? If you just want to get married, then fly to the Philippines and do it. If you want the fastest route to getting your future spouse here, the K1 petition is best. (Although, if you end up with RFE's, who knows?!? =-O )



It sucks to be waiting around when all we want to do is be together just like everybody else. If the process is taking longer than 6 months is it advisable to have my fiance sign another contract, he's a seafarer and their next route will be U.S.

Hi there. There is almost no way that you will have your visa by June 25. Right now the California center is taking 7-8 months to process, plus you have 2-3 months after USCIS approves you to have the interview and actually get the visa. It is best to plan to not have your visa until the October-November.

If you switch to the CR-1, it will still be until the end of the year, best case, until you would get that so it's probably best to just wait with the K-1.

Hello everybody! I'm a newbie and I need help. Last year my childhood sweetheart found me on Facebook after 20 years of no contact and got engaged when I went to visit him in the Philippines for the first time after 20 long years. I sent out our K1 file on January 16, 2013 and were hoping to get approved before June and have my fiance with me for my Graduation and have our wedding on June 25 but reading everybody's comments it seems like it is not going to happen. My question is would it be faster to go get married in the Philippines, cancel the K1 and apply for the spousal visa or to just wait. Any opinions and information will be greatly appreciated for we are so eager to be together.

US citizens generally have no issues getting a tourist visa into other countries.. Its other countries citizens that have to go threw hoops to get here (obviously) lol thats wat were all waiting on... Idk much about Korea.. But i can tell u its not needed to prove ur returning.. Everyones trying to come to the US not stay away in a foreign land lol ... Also idk wat u filed but a personal meet is necessary for k-1 visa's as well as many other types of visa's so u will have to go see ur partner before u can even file... The proof u met in person at least 1 time within 2 years prior to filing has to b sent in with the petition.. Have fun n take lots of pics.. Time stamped if possible.. And also keep all records..(flight itinarary, boarding passes, hotel receipts, ect..) may ur journey b blessed

He had to go back after his visa expired and we were engaged before he left. So we filed for the K-1 Visa last year in November, and since everything seems to be slowing down with the USCIS we decided to just have myself come visit him because we have a feeling our wait is gonna be awhile before we receive approval~~ but thanks so much for the answer and I'll be sure to keep all our records and take lots of pictures ^_^

Hello, I plan on visiting my fiancé in South Korea this summer for at least 2-3 months. I was just wondering what I should expect and if this will be a problem. Does anyone have any experiences they'd like to share? I know that it is difficult for the fiancé to enter into the US and my lawyer advised against it as well but I asked my lawyer about the other way around and they said me visiting to Korea would be completely fine.

Will I be questioned at the airport about my plan on returning? Do I need to bring proof with me that I plan on returning to the US? Thanks!
