The advice given above by others is quite contrary to what you just said.  We may still be apply for an AOS if she leaves prior to the 90 days and then comes back on a tourist visa or if she overstays but we get married without her leaving.  And no, I will not be marked for life by the USCIS.           If she comes back on a tourist visa with the intent to marry and stay this is fraud. She can get married and leave on a tourist visa, but not come on a tourist visa with the plan to adjust status.  Honestly the best, safest and one that follows the laws the best was the option to have her leave before 30 days and return on a tourist visa to spend time to determine if you want to get married.    Of course as always, just my 2 cents	MedRoni	Female	Algeria	2013-05-08 18:23:00

It will most likely center around proof of you seeing each other within the last 2 years or proof that you are both free to marry. It wouldn't hurt and would be a good idea to eventually have some pictures of you with your fiance. I would suggest start working on those, as florida4life said - even by something like oovoo or Skype.    The good news here is at least you know they are looking at your file! They may not know about the divorce in Europe but you are on record here in the US for the marriage. I would recommend getting in touch with the courts over in Europe and try to track down the paperwork. There needs to be record of this somewhere. I posted that question on the "Yes, you can visit" topic, but I wanted to get some attention because there are quite a few people with that worry. So I need help from people maybe, who got denied entry at the US. Who pays for the ticket once you get denied at the POE in the US? The airline or you? Do they use your return ticket? And does the VWP (ESTA) gets banned forever? And another silly random question just because I'm on it (lol), when you get your K1 Visa and go on the airport of your country to board the airplane, they check normally your visa or whatever you have like ESTA. I know the k1 comes in a sealed envelope. What about when you don't have ESTA? How do you present it to the airline people and the control (before the US entry) Thank you and have a nice day! Sometimes when we video chat I make print screen too. Then copy paste in paint (I use windows) and save and ready. I think it's kind of nice so they can see it's not fake or something.
