The Embassy has the ability to revalidate the petition if an interview has not yet taken place.  Revalidation of petitions prior to an interview taking place is routine and happens frequently with no action needed on the part of the petitioner or beneficiary.  Go to the interview on the scheduled date, you have nothing to worry about in regards to this date.

I'd love to hear from the VJ community some examples of petitions that were denied as a result of criminal history on the part of the beneficiary and stories of those that were approved in spite of criminal history.


The beneficiary's criminal history is usually not relevant at the USCIS stage, it's the Embassy/Consulate phase where it becomes an issue. Your petition is unlikely to be denied on the basis of the beneficiary's criminal history.

Sending things to USCIS after you have submitted your petition unsolicited may be an exercise in futility. Even if you were to include a copy of your NOA1, it's still highly unlikely that anything you send after you submit the petition would be matched with your file.

Yes, that letter is necessary; expect to receive an RFE for them. Don't bother trying to send them separately now, it will not get matched with your file.

You both have to write one. You write that you are legally able to willing to marry the other person and intend to do so within 90 days of the beneficiary's arrival on a K1 visa.

Since I'm from New York. Is there any service center that is more advantageous to send your a packet to? And by advantageous I mean faster processing times.


You are only able to send the package to the lockbox facility. The lockbox facility will then send it to a service center for adjudication. You won't know which service center it is going to until you are informed of the center it was sent to, you have no choice as to which service center the package will ultimately be sent to.

To get the semantics out of the way first, the petitioner would have receive an NOIR letter (the R standing for revoke) and the petitioner would have revealed the prior relationship in a new petition, not an application.

 

It's unlikely person B's visa application may not be affected by the petitioner not responding to an NOIR in regards to the petition for person A.  The petition that was filed on behalf of person A would have been revoked based on the failure to respond.

 

It's not often USCIS sends NOIR letters on returned K1 petitions, they usually allow them to expire and then tell the petitioner to start over at square 1.

 

 

Petitioner did not actually proposed but girl B made him do it in tears before leaving on the first and last visit.  I just want to know your thoughts? 

 

This is another issue altogether.

The purpose of sending a copy of the entire passport (yes, every page) is to establish US Citizenship.  If the passport copy is the method you wish to use establish your US Citizenship, then you have to send a copy of every page.

 

If you send in your birth certificate, then pages of your passport is necessary other than copies of the pages with the stamps indicating evidence of travel.

Those lawyers answering on Avvo are probably being overly cautious; I stand by my original statement.

 

All I can inject is my personal experience, I didn't translate any relationship evidence (letters, emails, chat transcripts, Facebook postings, etc.).  The only things that were translated were the official documents as required.

 

Furthermore, I've never seen anyone be issued an RFE for not translating such items.

Okay, I'm a guy for one. For second I did not even imply that getting the NOA2 early was a bad thing. I said I was shocked by it, I was surprised and completely shaken. That doesn't mean it's a bad thing, what it means is that now I have to work out what I'm going to do about our trip which is an added load of stress that I really did not need right now.

 

Now I am truly sorry that the visa rules are stricter on people from your country than they are from mine but that is not my fault and it's not really fair for you to be projecting your frustration on the matter onto me like that. It's not my fault that people from your country are scrutinized harder when entering the US and I do not deserve to be treated this way for asking for assistance just because my circumstances are different to yours. 

 

I came here to ask for advice, to ask if there was any way to suspend the process for a few months or do my interview in the states. I'm not being ungrateful that I got my NOA2 early, it's stressful. This entire process is stressful and you should know that it is. I don't have anyone who I can really talk this out with and who can lend me a hand with it all at the moment so I came here hoping that the people who had been through it all would have the answers to help me.

 

I do not want to cancel my trip to see my fianceé because it is something that we have both been looking forward to for months, something we both need and something I have put a fair bit of money into already. I come from a very poor background so the idea of paying upwards of £250 to change the date of my plane ticket is not exactly negligible for me. 

 

Third, stop assuming things about people. One would think that given we are all in the same shitty position you would be more sympathetic towards those in a similar place to you. Would you want people coming into your threads in which you asked for help and having a go at you? No. So don't do it to other people.

  1. Based on the circumstances you describe, the petition will probably be approved.  However, approval of a petition does not guarantee that a visa will ultimately be granted.

I have a further question:  What if we use my dad as a sponsor just for the K-1 Visa, but not for adjustment of status?   By the time we adjust for status, my income will have risen.   Will my dad therefore be free from obligation?

 
yes, if he only signs the I-134 for the K1, then his obligations will be practically nil as the I-134 is not legally binding:
 
"Because INA 212(a)(4)© and INA 213A require the use of Form I-864 for so 
many classes of immigrants, the use of Form I-134, Affidavit of Support, has 
been reduced considerably. Nevertheless, there still are circumstances when 
Form I-134 will be beneficial. This affidavit, submitted by the applicant at your 
request, is not legally binding on the sponsor
and should not be accorded the 
same weight as Form I-864."
