For the K1 process, the NVC is only a mail stop. All that will occur is a case number will be assigned to the file and sent to the appropriate post abroad.

Should I edit it down to show the times we called?  Should I show some random conversation we had?  Would I even need logs going back to when we first met in 2006?

Yes, yes, and not necessarily.  While it's good to submit evidence of your relationship over time, you don't need to submit mountains and mountains of chat logs.

K-1 Fiance(e) Visa Process & ProceduresQuestion about affidavits for RFE before NOA2 for I-129F

We also wanna send as an extra affidavits to support the evidence. My question is do they need to be notified by a Notary and all that?

Such affidavits carry little to zero weight.  However, if you choose to include them, notarization is not required.

K-1 Fiance(e) Visa Process & ProceduresSend Money Order from outside US
Will the USCIS accept a money order from out of country?

No, fee payments can only be drawn on a US financial institution.

Do you know someone in the US that you can send your file to?  That person can place the check into the file and then send it to the lockbox; you can then reimburse said person at a later date.

K-1 Fiance(e) Visa Process & ProceduresNOA2 extensions question

The Embassy has the ability to re-validate the petition if an interview has not yet taken place by the date on the notice.  This is routinely done and no action is needed on your part.

K-1 Fiance(e) Visa Process & ProceduresNo, you CANNOT file a I-129F and marry while waiting.
July filer too :)

I'd like to add here that a WEDDING and a LEGAL MARRIAGE are two very different things. So if someone is wanting to do a religious ceremony in their SO's country, they need to check the legalities of it. USCIS clearly tells us that a non-legal religious ceremony is ok, as long is it is not legal in the country in which it takes place.

Good thread, Lisa. Maybe people will read it?

K-1 Fiance(e) Visa Process & ProceduresWhich office do I send the petition to?
OK, one more try and I am off to bed :star:

Per the instructions directly from the USCIS it states:

If you live in the United States or if you are living abroad:

File Form I-129F at the USCIS DALLAS Lockbox facility.

For US Postal Service:

USCIS
PO Box 660151
Dallas, TX. 75266

For Express Mail and commercial courier deliveries:

USCIS
ATTN: I-129F
2501 S State Hwy 121 Business Suite STE 400
Lewisville, TX. 75067

There are no other addresses in the actual instructions themselves. I am not sure what you are looking at but I would take another look. You would hate to send it to the wrong place. Also it would be a good idea to double check you have everything they asked for as well – to help make the process smoother and faster. No RFE means faster finishing!

K-1 Fiance(e) Visa Process & ProceduresWhich office do I send the petition to?

I live in Phoenix, AZ and I see there is an USPS address for a Phoenix, AZ lockbox. I guess it would be best to send the application there. It looks like you can ask for a email or text message receipt of the petition too. Thanks guys.

I mentioned the address was in the instructions themselves. Did you check out page 4?
It has the address to send by regular mail/USPS and the address to send by courier.
Both are Texas addresses.

K-1 Fiance(e) Visa Process & ProceduresWhich office do I send the petition to?

I live in Phoenix, Arizona. I am going to start a K1 petition for my girlfriend. She lives in the Dominican Republic. Where do I mail this petition off to? The California Service Center?

It is on page 4 of the I-129F Instructions. You should make sure to read them so you do not miss something.

What type of vocational school did he attend? I am sure it will not be considered the same as a high school diploma, but depending on the field his skills from this may transfer. Has he been working in this field since? Getting a GED when he gets here might be helpful in the overall job market. It couldn't hurt.

Sorry I just have a question...you said you sent your fiancee everything via USPS? I was told not to send anything via USPS but DHL. I was told if I send stuff through the postal service if most likely will not reach him. Did you experience any problems sending things using USPS?

I used USPS for everything and never once had a problem. They should use DHL coming this way though.

K-1 Fiance(e) Visa Process & ProceduresInterview
I sent my husband a copy of absolutely everything, even though the embassy should already have had everything. Right down to the support paperwork, birth certificates, proof of relationship. I used the "If it fits it ships" postage from the USPS which helps with cost and gets it there in about 5 business days.
Make sure he brings his medical exam, passport photos and passport of course, but also make sure he has a new updated copy of his police record along with the certified translation. He also needs to bring the email/paper that shows the confirmation of his interview appointment.

Hey there, I saw the USCIS link you were looking at. Yes, you still need this for the fiance visa. You will need the I-864 when you adjust status after getting married.

K-1 Fiance(e) Visa Process & ProceduresExpedite Effects

As I said, I'm not trying to expedite to jump ahead of everyone else. I'm doing it because we've been offered a place to stay for free, which is ultimately better financially than living apart, with one of us(Me) in hardship.

Won't that place to stay still be available with no expedite? I am sure if they are willing to take you in now they will be when you get processed down the line. I would be very surprised if they gave you an expedite for the reasons you originally posted.

K-1 Fiance(e) Visa Process & Proceduresthink I got robbed..Part 2

Hey guys

I posted a topic "think i got robbed" about a month ago. Turns out the guy just wanted to waste my time. He told he'll do my papers for me but just threw them in his desk for 3 months and didn't do a thing. I got fed up with waiting and went back to his office and ask him what's going on. He told me he has been really busy doing taxes for people but said he already sent it in. I asked him for my papers back so I can do it somewhere else. He was very quick with this as i got everything back within 10 minutes. I was so angry with him but knew being cruel and showing my frustration was going to get me nowhere. He wrote me a check for my money back(which I am going to scan before I cash it just to be safe) for the 340 i gave to him for my application and 300 for his services. I am very sad to know that I have wasted 3 months for absolutely nothing! Three months I will never get back. It made me wonder what the persons intentions were? I guess I'll never know the truth and there's no point in looking back, just got to stay strong and move forward. I am wondering now if I should hire another person to do them for me only because I am nervous that if I do it myself, I will make a mistake and will have to wait even longer. One reason is that I do not have that much evidence to show, because I only went to visit her for a month in 2012. I have plane stubs showing i went there. Also photos of us at our ceremony and traveling around her country. I am thinking that if I do it with an experienced attourney, I will have a better chance of being approved. All advice would be greatly appreciated! Thanks ahead of time!! :)

The way I see it is the attorney will not have any more proof to add then you do. He will not be doing anything more for you then you can do for yourself. I think you should save your money and do it yourself. No one will be as careful with it as you.
If you are worried about only having one trip, then try to make another before interview time (use the money you would have on an attorney). Keep adding up all your relationship proof - send what you have with your petition, but keep accumulating more.
If you follow the guidelines and instructions you should be fine :)

K-1 Fiance(e) Visa Process & ProceduresA dilemma with co-sponsors.

Well, my co-sponsors would be able to support her until I get employed. It's just that I spent a lot of money already and would hate to see it all go to waste, because my government so suddenly decides I can't have her come here. She is from Indonesia, by the way. I just have a limited time frame to work with now. I have to get a job very soon or face the possibility of being denied, so I'm a bit frustrated now. But yes, I do plan on getting a job as soon as somebody will hire me; that's just an unknown when I will be hired.

The government did not suddenly decide anything. The rules haven't changed.
You need to provide proof of income - as mentioned, how are you going to support her when she gets here? Co-sponsors (If a fiance visa and allowed in that country) are for government coverage - not her everyday living expenses. Unless you worked out some kind of plan with them.
I think you hit the nail on the head - keep looking for work, full time, eight hours a day and I am sure you can come up with a job soon.
Best of luck on both the job search and your visa journey!!

K-1 Fiance(e) Visa Process & ProceduresCancelled visa

I had a visa with my future wife and I canceled this about 2 weeks ago. I made a mistake and I still want to proceed. How can I restart this Visa if at all possible. I thought this my lady was not being honest with me and i jumped to conclusions. My mistake, but i would like to move forward still with her. Any suggestions or help would be much appreciated. The visa was about three months in when i sent cancellations in.

I am assuming you meant you cancelled the petition to start the process?
Maybe the I-129F? If this is the case, you will need to start over. New petition, new fee.

Best of luck in your journey! :star:

K-1 Fiance(e) Visa Process & ProceduresTourist visa AOS to Fiance visa

I strongly suggest you to follow the k1 route cause is the faster one, but you need to get married after getting the k1 visa and you only have 90 days after her arrival, but its ups to you

Faster is not always better. It depends on the importance of having the green card and the right to work right away ot not. Fiance visa requires an adjustment of status which costs more and takes longer for the spouse to work and move forward. Being married they have the greencard, right to work and social security card all up front with no other immigration to worry about until the ROC 2 years down the road. OP, just check out all the options and chosse what works best for your situation. It seems the time difference is not that large right now anyway.

K-1 Fiance(e) Visa Process & ProceduresTourist visa AOS to Fiance visa

These things are okay, if she can come here as a tourist, and we can file for K1 after she gets here, as long as she leaves when here tourism visa ends, and waits for the fiance visa to finish. At least that reduces the amount of time we will have to spend apart.

Can you elaborate more on the process of her coming on a tourism visa and then us getting married? Also if I am correct after she gets a fiance visa and gets into the country on that, she doens't need to leave once we get married and wait for that to process?

Do you know how long a tourism visa is valid for, or for how much time she can stay on a tourism visa?

Coming on a tourist visa and getting married is fine. Then you file a CR-1, still fine. She goes home before her tourist visa expires and waits out the CR1 process - all good.
If she comes and marries on the tourist visa and stays, it is illegal. You are intending her to move here while on a tourist visa which is premeditated and a big no.

Best way is to be correct, follow your legal paths. Either fiance visa or marriage visa, but she returns home when tourist visa expires to finish the immigration process. All legal, no worries, no lies, no fraud.

K-1 Fiance(e) Visa Process & ProceduresAnyone ever get RFE for wrong size passport pics?
My husband had sent his passport photos and they were the right height, but too skinny. I had him email the digital copy and I took it to Walgreens. They printed them up the correct size in no time flat.
It was all done same day, no delays.

Better to be safe and do them right then sorry and get delayed by an RFE! :star:

Hi There,

Just curious... Your timeline says you filed your I-129F in July of 2012, but then it shows a marriage date of December 15th of 2012.
Was that a typo and you plan on getting married in December of 2013?

The Algerian embassy has been known to be tough on cosponsors for fiance visas. They seem to like direct family members as opposed to friends, etc. It would be a good idea to have one if you can, but may not be required. It all depends on your individual circumstances. I am sure if you have been working in the same field for years making above the poverty line that would be stronger then if you have multiple periods of inconsistent work or salary.

Best of luck!

K-1 Fiance(e) Visa Process & Proceduresshould we be worried?

I would suggest he wait a little longer if the status recenty changed. If it goes 10 business days out or so from the printed date you guys might want to follow up, but I wouldn't before then. They are tough to get answers from anyway - and showing up on their doorstep without an appointment means no guarantee they will let him in to find out anything anyway.

It may have taken a few people just a few weeks to get their visas, others it takes a while. Luck of the draw...? Timing with understaffing....? Hard to say. I know it is tough waiting, but you really are in the home stretch now. When you think it has been way to long, reach out and see what they say!

Congratulations on getting to this point!   goofy.gif

The embassy sends them to UPS in batches, not one by one - so it is very possible it is waiting to go out with the next group.

Just a bit more patience at this point. Looks like it will be there any day now!    :)

Have you checked your status with the state department to see if he was put in AP?

Aside from that, the Algerian embassy has been a bit behind for several months now. It took my husband about a month to get his visa printed and sent back out. I would not worry, just check on the status to make sure it is where you think it is.

K-1 Fiance(e) Visa Process & ProceduresTo G-325A or not G-325A...that is the question. Again.

The instruction forms actually have these answers for you, so you may want to review them closely so you do not miss anything.

Under the General Rules - Step 1 -Type or print legibally in black ink.

Under Step 6 - What other documents do you need - 1) Submit a completed and signed form G-235A for you and a completed and a signed form for your fiance - so one each, original signature.

Hope that helps!

Call the State department. When I had issues reaching this embassy the State Department was able to help. When you explain the situation they should be able to tell you where it is at, or what is going on.

For me they had to call back after a few days, but they did indeed follow up and get me an answer.

Just something to try  :)

K-1 Fiance(e) Visa Process & Proceduresinterview went wrong i guess

Actually there are 19 states that allow it, with another 6 under certain circumstances. The big question here though, is the OP said it was legal in their state - so why lie??
This will be a tough one to overcome... as mentyioned many times, once proven to lie immigration has no reason to believe anything else. Seems like a weird thing to lie about if it was in fact a legal state.

MedRoniFemaleAlgeria2013-05-08 19:32:00
K-1 Fiance(e) Visa Process & Proceduresinterview went wrong i guess

I also assume he will be denied as well due to the lie. Lie once to immigration and they have no reason to believe another word.
If this winds up to be the case, and the fact they handed him back his passport shows they are in no hurry to approve - she may want to lawyer up.
