Hello again,

 

I have some silly questions. I read that many people send their evidence of relationship with the packet 3, such as photos, tickets etc. How many of you did it that way? Is it acceptable from the Embassies? 

 

I prepared 2 folders with transparent folder to send my papers. Or should I buy an acco fastener?  Or heavy clip. I'm confused.

Hello all.

 

My NOA2 was on 6th May.Until now the Consulate did not receive anything and my fiance called NVC and they said that they sent all the files to Frankfurt on May 14th and if they donit have they need the consulate to send notice that they haven't received.

 

I email them twice over the past months. Should I email them again or should I just wait? :(

Hello people. Yesterday I had my interview at Frankfurt and everything went perfect. The interviewer told me everything is fine and you got approved. I was so happy. He told me to expect the passport with the visa within the next 10 days. Now I saw my case online and it says Administrative Processing. What does that mean? :(

I was deported from China about a month ago, but my fiance wants to come live with me in the US. I want to fill out an I-129F petition and I found a section in the petition that reads the following:

 

Moreover, I understand that this petition, including any criminal conviction information that I am required to provide with this petition, as well as any related criminal background information pertaining to me that U.S. Citizenship and Immigration Services may discover independently in adjudicating this petition will be disclosed to the beneficiary of this petition.
 
My fiance has no crinimal record. I was assuming that the focus would mainly be on her because she is the one coming to the US not me. Now I am really worried that my being deported might be a reason to deny my petition or a reason for denial for the K-1 visa on her end, at the visa office in Guangzhou, China?
 
I would greatly appreciate anyone's help with this.

The quote from USCIS that you provided only states that whatever they may find out about you will be shared with your fiance, not that your petition may/will be denied. Is that your real concern, that they will tell her the real reason of your deportation? I think you have more to worry about than a denied petition.

I am going through a similar situation. My family isn't very supportive of me marrying an American (I'm Canadian). My family have met my fiancé and spoken to him on Skype and the phone quite a few times, and they approve of him and like him, so it's a little hurtful that they don't support our decision to get married and for me to move the the us. What's even more confusing to me is that my mother is originally from Australia, so she has had to go through the immigration process (granted, to Canada), so it's difficult for me to understand why she is unable to support my fiancé and I as she knows what it feels like to go through an immigration process. I am also a little worried if I am asked questions about my family, I haven't really thought about what I would say. My fiances family on the other hand has been more than amazing, they are so supportive and I am in constant contact with them. :) Hang in there, and the best of luck on your journey!!!

My fiancé and I hired an immigration lawyer. We don't think our petition will move along faster because of this, it is an option that works for us. My fiancé is out of the country every 6 months for a 2 month period, and in and out of the country for up to 2 weeks at a time otherwise- so we thought a lawyer would be helpful if he wasn't in the country when things were approved (If that makes sense).

I was just reviewing the copy of our I129f as a friend of mine is just about to go through the k1 process herself. I noticed that his letter of intent isn't dated. I am wondering if he should resubmit a dated letter of intent, or should we just wait for rfe?

I don't know what topic this fits in, but I am just wondering if anyone would know the answer.

We hired a lawyer (long story, but we thought it was the right decision at the time), BIG MISTAKE!

I regret it and although we are waiting on our noa2 (it's still early in our journey- hoping to recieve noa2 later this month), I have found a couple of mistakes in the papers we filed. This could potentially mean we could get a rfe. Fingers crossed that we don't, but it is a possibilty. That frustrates me a little bit because I am a perfectionist and I would have made sure the papers would have been flawless (I didn't see the papers before they were filed as I was not in the us at the time.) It is also frustrating to hear our lawyer say that if we were to receive a rfe, it's not a big deal... It might not be a big deal to her, because it's not affecting her. It's putting my life and my fiancés life on hold. We hired you for a reason, we didn't want little mistakes that could have been prevented to slow down the process. As the lawyer should have checked all papers before filing- so we basically paid $2500 (for the first of three phases) for her to print forms that are readily available online and mail them for us? Sounds like a deal!
Sorry, I'm still a little salty about it; hard to tell lol

As everyone else has mentioned, unless you have any red flags; you can file everything yourself. And probably do a better job (as you will probably be more diligent!:))

I only wish I had found vj before we decided to go the lawyer route, the one good part is that we hired our lawyer in phases, so when we receive our noa2, goodbye lawyer!!!

And I know getting a rfe isn't the worst thing that could happen (at least we know our file was touched!), it just slows everything down.

You can marry wherever you want, however, requirements differ by state and you need to consider that as it could take longer/shorter. We married in Colorado (though reside in TX) because we wanted to do it ourselves (that is, not priest, licensed officiant, etc). In some states you need a blood test, etc.

For the employer letters, did the employers sign the letters?

 

Personally, I'm at the NOA1/RFE stage and I don't have personal experience with the NOA2 process just yet. But just look over the Visa Journey guides to double check if you have all of the required documents. Looking at your list now, it looks ok to me.

 

Can somebody else with affidavit of support success answer these questions? I know these answers are in the guides, but it'd be nice to hear real world exceptions and experiences.

Sorry to respond so late, for the employee letter, my boss physically signed my letterhead and for my mother's letterhead, it just stated "signed by (company name)" electronically. You can get a letterhead from your boss and it should have some sort of signature on it from the company or the boss themselves. 

And all the papers I had submitted had no problems, my fiancé already did the interview and is coming back here in two weeks! He said during the interview they just asked him two questions (how did we meet and when did we meet) and he passed and there was no problem with our financial packet (which I was super stressed about because my lawyer kept stressing it beyond belief).

So, my fiancé finished packet 3 and along with packet 3 it had the checklist in which the final steps were to pay for the visa and schedule an appointment. So I am confused on what packet 4 is about? Does it come after he schedules the interview? Will it just be sent by email? What else is there to do for packet 4? 

And also, I gathered a lot of information for the affidavit of support and I also have a co-sponsor. I make around $16,500 annually.

For myself I gathered:

- Last 4+ months paystubs

- Last years W2's

- Last years tax return

- Letterhead from my boss stating how much I make per hour, how many hours on average I work, annual income, when I started, position, etc.

And for my co-sponsor I retrieved:

- Last 3 years tax returns

- Last 3 years W2's

- Letterhead from company (the letterhead states hourly pay, annual pay, position, date of hire, but it does not state how many hours a week they work, will this cause a problem?

- Passport

- I-134

 

Am I missing anything or is there anything else that I should get for the financial part of the process? I'm really confused on what to do after this. After I send the financial packet to my fiancé and evidence for our relationship (pictures, emails, phone calls, etc) then what else is there for me to do?

You should definitely contact the embassy that you schedule the interview through, but typically if you miss the interview or if you don't bring all required papers, it can push your process back very far and they are very stingy on doing second interviews. For the embassy in Seoul, if you miss the interview you can't schedule again for several months.

I would either wait to schedule the interview until you have the paperwork, or contact the embassy you are planning on interviewing at and ask them about it.

You will schedule it yourself. My fiancé scheduled it himself. Also, depending on where you are from, the embassy requires the medical exam to be from certain hospitals. When my fiancé scheduled, he had three hospitals to choose from to do the medical exam. So make you sure you check which hospital(s) are eligible for you to schedule a medical exam at.

Yes, the American's petitioner's jab is finished, now it is down to the foreign visa recipient in Ethiopia. The Ethiopian must gather the relevant documents with help from the American petitioner i.e. for proof of financial support etc. Your packet 3 does not come with an appointment. Packet 3 will give you instruction on how to acquire the relevant documents and only when you have collected these and sent the relevant forms in Packet 3 back to the embassy will they send you Packet 4 with the appointment letter. 

 

You should be able to get information for how to pay your visa fee and the cost, in the visa section on the relevant embassy website. This information will be contained in Packet 3 so don't do anything until you get Packet 3. 

Loughrey, In Addis Ababa they don't have packet 4, you will just get the interview letter and packet 3, That's what I've heard, also I'm not sure if my fiance can go to the embassy and ask them if they can give to her case number so she should start the process..

Why would you want to pay thousands of dollars to get the K-1 visa? All of these expenses could be avoided by marrying in the US and adjusting.

Also, why would you want to be separated from her for 6-12 months? (Your 4-6 months of waiting after filing 2 months before she leaves the US is very optimistic. Currently, many couples aren't even getting their NOA2 until month 8.)

If you want a big fancy wedding, then you can have it.

Think about getting a quickie marriage at the local courthouse, file to adjust, and then have your big wedding at a later date. The advantages over your current plans are 1) save money for things you really need rather than toss it for a K-1 you don't need, 2) you and her will not be separated, and 3) you can still have your big wedding.

If she needs to go home, she could get AP while she adjust her status. That would allow her to go to Thailand and come back to the US to Colette her adjustment.







 

Seriously, If you're both ready to marry then do it. At least have a conversation about it, cause with the K-1 there is no guarentee on how long it takes, and trust all of us, waiting isnt fun.
