To get the semantics out of the way, you didn't apply for anything, you filed an I-129F petition form.

 

Now to answer your question, there is not much you can do to speed anything up; it's unlikely your case qualifies for an expedite.  Furthermore, even if she were to have an interview in Frankfurt quickly, there is a high degree of probability that she would be subjected to Administrative Processing after the interview because she would be a citizen of a country that has been designated as a state sponsor of terrorism.  Cases placed on AP have no set timetable, times can range from a few weeks to over a year.

Are you saying I must get a lawyer to file?

 

That's not what I'm saying at all.  If you want to sign her G-325A form for her, she has to give you limited power of attorney in order for you to do that.

 

Specific to your situation, a limited power of attorney is a written authorization that allows you to sign the form, filled in with her information on her behalf.  It would only be limited to the G-325A, nothing else.

She would need to provide you a limited power of attorney for the sole purpose of signing the form on her behalf.

 

You said "married under Islamic law," does the country where you were married in recognize this as a valid and legal marriage?  If so, then you cannot do the K1.

Marry there and do Direct Filing CR1visa it is much faster than mailing it in. When you file K1 or CR1 visa neither is faster when you file in the states so the best option is to file in your country. IJS

DCF is only available in countries that have a USCIS field office.  After going through some of the OP's content, it appears that the country of the beneficiary does not have a USCIS field office and therefore DCF is not available.

Third party affidavits from your foreign fiance's parents would carry little to zero weight; your best evidence is evidence of time spent together in-person.

We (me - benefiaciary, him - petitioner) have just decided to go the K1 route and were filling out the form from the USCIS website this morning when we noticed the expiry date is listed as 30 June 2013. Link here: http://www.uscis.gov...form/i-129f.pdf

 

Would there be any issues with us using this form, or is there any other way to get a form that doesn't have an expired date on it?

 

We are also filling in the G-325A - as I don't have an Alien Registration Number yet, I'm assuming it's ok to leave this section blank?

 

Another dilemma we're facing is that he is currently living in Colorado but will be moving to Seattle in May/June next year. Would this delay our application by a long time and is there an avenue for us to inform the relevant agencies of the address change? We're trying to work out a way he can postpone the move till after we get the K1 visa approved (optimistic, aren't we :P ).

1. I've read on previous threads that the minimum income required for the I-134 is based on the petitioner's gross income. What does that include/exclude? Does this mean his income before state/county tax? How about 401K deductions or insurance?

 

2. If he is not self-employed, would it be sufficient to attach pay stubs or would we need to submit his tax forms (w-2) as well? Do we have to submit most recent or multiple? He was not employed for the full year in 2012 (but will have a full year of employment in 2013) so his 2012 returns are likely below the 125% benchmark.

Hi guys - don't laugh. :P We are having trouble getting the information we typed in the I-129F to show up in hardcopy. For some reason, although we have saved the details and it appears on the soft copy on the computer screen, when the form is printed, some text boxes are empty.

 

Would USCIS have any issues with us printing whatever information we can get to appear and then handwriting the rest of the details in (in black ink, all caps, of course)?

I don't think a previous tourist visa denial will be a deal-breaker in applying for the fiance visa, but I'm sure someone more familiar can confirm/refute this. :)

 

For future visits, I think if the basis of the denial in March was that you didn't have strong enough ties to ensure your return to Colombia then you need to bring better proof of that - e.g. financial ties (ownership of property/investment, bank statements from your account in colombia), employment ties (letter from your employer that you have agreed to return on x date or family ties (copies of offical documents proving family relationships and their residence in Colombia). 3 times is for spouse or child (minor), 5 times for all others. I've read differing opinions on whether 3 or 5 times the shortfall is required for I-134 - best to err on the side of caution in my opinion and go with 5. :)

You need $3000 (or however much is lacking) x 3 = $9000 in assets. The website below defines eligible assets as those that can be easily liquidated to cash without considerable hardship or financial loss to the owner/family members within one year can be used. I should think 401Ks could be eligible if your fiance is able to cash his out?

Hi :) You have to show evidence of having met in person at least once within the last two years. I think this means that if (for example) you are filing in February 2014, then your evidence should prove that you met with your fiance anytime between February 2012 and February 2014, e.g. passport stamps that show entry into DR, boarding passes, and to supplement that, photographs of the two of you together. Since you were living there you can probably also provide credit card receipts, bills with your name and address on it etc.

 

For the second part of your question, you only have to list the places you have lived in - short vacations don't count.

Merry, unfortunately, there are no restrictions on civil marriages in Singapore except for Muslim marriages. I made an inquiry at ROM a while back to find out more about registering a marriage between a Muslim and non-Muslim and they referred me to ROMM (who of course said no can do, not without a conversion). :(

He had actually already had the interview, and was not given any paperwork at the end telling him if he was approved or denied. The State Department had him listed as a no show. 

I was able to get hold of an officer after much effort and a few threats   innocent.gif   and was able to get it sorted out.

Everything was able to move through my phone contact with them at that point. I believe they were originally planning on a denial, but we wound up with an approval. It is a long story for another time, but I am just saying they were not so open for me to come in, and that was for something they HAD to fix. AP is something they don't speed up for anyone in general. It would most likely be a waste of time... except for the part where you two would get to spend time together.

Unless he is there anyway, I would have him ask them first by email. In general there is nothing one can do to speed up the AP process. I would hate to see him fly all the way over there just to have them tell him you just have to wait.

When I was speaking directly with one of the consular officers she had said that AP is a process they cannot predict or change. At the time, which is now a good 6 months ago they were several months behind. 

 

I tried talking to them about me coming in to clear up a mistake made on their end and they were not open to it. They had marked my husband as a no show to his interview when he had in fact been there. They made me go through the State Department instead. 

 

So what it boils down to is if he wants to try or not and if he can go with the understanding he may get anywhere. He would get to visit with you though, so that's always a plus!

For the petition, the proof was mostly regarding having met (entry/exit stamps, boarding passes, pictures).. but the proof of ongoing relationship that my fiancé took to the interview was a Skype log (just showing our calls and times) print-out of inbox and a few emails  a month or so of cell phone records, some greeting cards and pictures from our visit in between the petition filing and interview.  As I recall him saying, they didn't look at any of it (it was originally refused on the basis of my income, but not for lack of "bona fide relationship" so I don't know what extent our proof of on-going relationship was a factor, but it couldn't have hurt-- they allowed a chance to overcome the refusal and it was later approved smile.png  ) 

In any case, it's probably better to have more than enough proof than not.

This embassy in general does not look too much at what you bring. One of the officers told me they generally review your file before the interview so they know what questions they want to focus on. They have looked at what they have ahead of time. With that said I would still bring anything extra or more current to the interview as well just in case.

With the Algerian embassy more is better. We sent everything but the kitchen sink and were still going to originally be denied. We wound up approved though but it was not all based on the toms of evidence we sent.

To answer your question about whether your friend can sponsor his wife and your fiancee, the short answer is yes IF his income is sufficient.  On the affidavit of support he has to include every member of his household, any children he has regardless of custody or whether they live with him, and every person he sponsors.

 

So from what details you gave, he is a household of 3 currently (himself, his wife and baby).  If he supports your fiancee as well, he will be a household of 4 (himself, his wife, his baby, your fiancee).  His income of $36,000 is sufficient and well above the poverty line of $29,437 for a household size of 4. 

 

 

Again, assuming the embassy would accept this. There have been multiple cases where the embassy in Algeria would not take a friend that made plenty of money as a cosponsor for a fiance visa. Serendipity9 was still dealing with this exact issue in February of this year. 

 

So yes, the income is enough to be a co-sponsor, but OP, you may want to check with the embassy if they would accept them being outside of immediate family members. Unless of course you don't mid taking the gamble. 

To me, I always preferred better safe than sorry through the process.

You may want to check into the cosponsor with Algeria. I know for fiance visas some people have had issues with cosponsors that were not direct family members.

I am not sure how your joint custody comes into play and counting them or not. Do your kids physically live with you?

Are you a US Citizen? Did you meet her in person within two years of filing? You don't have to prove you were dating to meet the 2 year requirement. Having dinner at her family's home with some photos showing the two of you together would suffice. It is a Muslim custom to not "date" but is also required that you see your prosective spouse prior to marriage. A chaparoned meeting is most certainly permitted. Even a meeting with the Imam to discuss the prospective marriage would suffice, all you need is proof. Photos, plane tickets, etc.

The problem is not with the system, not to say it is perfect or fast, the problem is with not following the rules which are there for a reason. I don't agree with all the rules and laws but if you want the visa for your fiance you will do as the government says and shouldn't be surprised when you are denied because you didn't meet the basic requirements.

 

Agreed. No where does it state you must be alone when you meet. If you managed to meet 3 years ago and not break any Muslim customs I am sure you could have within the last 2 years before filing. Your meeting 3 years ago, provable or not is still outside the required window. As for the waiting 11 months to process, it was not done on purpose... it is not personal. It took that long to even look at your file to see you did not send what was required... and then how long for you to respond? Sorry, but this really boils down to you not following directions... not anything to do with the USCIS process.

 

All you can do is meet up again, then file again... fiance visa or cr1 if you marry.

Thanks for the reply. I know some fellow Germans send evidence with the packet 3 and a friend of mine did not, but they didn't request anything in the embassy to look at like you.

I read some stories of people getting denied for not showing evidence and the interviewers don't want to see them and I'm thinking then, why they say bring evidence that makes no sense, right?

I prepared 2 folders with transparent folder to send my papers. Or should I buy an acco fastener?  Or heavy clip. I'm confused.
