You aren't a K-1 petition filer so I guess this question isn't directed to you.

 

If you look closely at my signature, you will see that when I entered the wonderful world that is US Immigration, the K1 process was the path that I was about to start down and all of my initial research was about that process.

 

The letter from the Embassy, specifically states to bring a copy of the I-129F, and pretty much everywhere else you read says to bring a copy ( see VJ guides, for example - and also I read a legal guide I got from the library that says the same).  They don't give guidance on how to package it though.  Also you are supposed to have a copy of the NOA2 as the other person above, stated.  Maybe they won't ask for it, but don't want to be caught unprepared if they do.

 

If the instructions from an Embassy or Consulate were to specifically instruct something, then I would not dispute it.  However, I am curious as to why an they would instruct such a thing as CO's work off applicable DS forms, not the I-129F.  I would also like to know the date that legal guide you speak of was published, procedures can and do change with varying degrees of frequency.
 
I stand by what I said earlier with the qualifer about Embassy/Consulate directions (follow those).  As for having a copy of the NOA2, I still say it is worthless but ultimately, it's an individuals choice.

When you go to the K-1 visa interview, you need to bring a copy of the I-129F as it was filed with USCIS.  Is there any required or recommended way to bind it.  The original filed with USCIS is 2-hole punched in the top and acco clip binded. But for the interview it seems would be better to 3-hole punch on the side and put in a binder or in folders by section maybe?   

 

Any suggestions on how others did it?

First of all, you don't need the I-129F form itself at a visa interview; the interview would not be taking place had the petition not been approved.  Secondly, the space to exchange documents is small, so anything you want to excnage would have to be removed from the binder.

You don't need this, an interview would not be taking place had the petition not been approved.  The NOA2 is nothing more than the notice that the petition has been approved.  All you are doing by including it is putting a piece of fluff in the file you are taking with you.

No he won't, an interview would not be taking place had the petition not been approved; the NOA2 is nothing more than the approval notice.  All you are accomplishing by including it in the evidence pile is including a piece of fluff.

That's a CBP form that's now completed electronically at the POE.  In the past, it was handed out by the flight crew to be completed prior to landing.

Answers:

  • First of all, you are filing a petition, not an application.
  • Second of all, when "attaching" a separate sheet of paper, you do so using a paperclip.  So use supplemental sheets as needed and paperclip them to your forms.
  • The beneficiary's birth certificate is not need at this stage.
  • Passport style pictures only need to meet the dimensions; if you are able to print them from a scan while keeping the dimensions intact, then you can do so
  • Proof of meeting in the last two years can be separate or can be part of your ongoing relationship; it's your preference on whether or not you want to separate it
  • You do not need to translate evidence such as chat transcripts, Christmas cards, letters, etc.
  • IMO, if you want to frontload your file, go ahead and do so, it will not be frowned upon.  Only you can decide what you feel presents the most compelling case.
  • A previous rejection of a tourist visa in of itself will not hinder your process; it does not need to be included in your file but must be disclosed if it is specifically asked about.

Why would they though given that DCF is cheaper, easier and the beneficiary can work right off the bat?

I'll surmise that a majority couples living together abroad would marry and pursue the spousal visa process. But not all couples living abroad who are married and pursuing a spousal visa would be able to DCF because DCF is only available in a few countries.

Even then, if you were living together now out of the US, you'd be doing DCF, not K1.


DCF is only available in a few countries and theoretically, it is possible for the petitioner and beneficiary to be living together in the beneficiary's country and opt for the K1 process.

what about the beneficiary birth certificate? Should the petitioner include it

Another reason why I usually post that it is unnecessary to translate chat logs in addition to the needless busy work is that it shows you, the petitioner can speak in the language of the country of the beneficiary. For some countries, ability to communicate in a common language is sometimes scrutinized at the Embassy/Consulate level.

IMO, necessary; also include the names of the people in the pictures. 
 

 

For the original petition any evidence submitted must be translated for USCIS.

 

Evidence such as chat logs, letters, emails, retail receipts, etc. never needs to be translated.  There is nothing wrong with translating such items but doing so is nothing more than needless busywork (or expense if done professionally).

  1. IMO, you have sufficiently responded to the RFE that was issued to you
  2. The public charge issue will be determined by the Embassy.  Have an I-134 signed by both you and your parents at interview time, they will be submitted then.  FYI:  when going through the AOS process, you and one of your parents will need to submit an I-864.
  3. You can use another envelope.

I (or anyone else for that matter) cannot accurately predict the likelihood of success or failure of your petition.  What I can and will say is this, have plenty of evidence pertaining to your relationship at the ready and make sure your significant other knows the details surrounding your prior relationship (in case it comes up at the interview).  Being properly prepared reduces the likelihood of failure.

I'm getting ready to send off my K-1 Application for next weekend, and just have a question about ledger sized documents.

The bottom portion of it does not have any signatures or verifiying information, just the terms of the rental 9It's a storage locker rental agreement that my fiancee and myself signed for together) so is it okay to only copy the top portion or should I send the whole thing in?

First the semantics, you are subitting an I-129F petition, not a K1 application (the beneficiary will submit the application at the appropriate time).

 

To answer your question, IMO, you should submit the whole thing.

Since you were not a US Citizen when your daughter was born, you do not qualify to file a CRBA.  Your situation is different from that of the OP.

All you have to do is to put the name of the baby in the I129F wile you apply, that's it. and when your case is send to the embassy for interview, you will prepare 2 packet 3 one for ur fiancee and the other one for your Baby, K1 et K2 Visa.

In may case,I am the US citizen petitioner and mi future wife and I have a baby girl, same situation as you.

Incorrect, a K2 visa will not be issued to the baby because the baby has a US Citizen parent.  They would be told to obtain a CRBA

The baby will need a Consular Report of Birth Abroad (CRBA) and once that is issued, a US Passport.

 

Plan on a minimum of 6-8 months from the time the petition is filed to the time an interview takes place.

 

You can apply for a tourist visa but the chances of you obtaining one are next to nil.

I disagree about the notarization on the letter of intent.  It may not be legally required but think about what that says by not notarizing it.  The INS is looking for shame marriages and essentially you are telling them, "I'm not going to promise that I'm enter in a bonafied marriage in good faith."   You don't know who is reviewing you I-129F so I'd think you want to cover all your bases and not have the application returned over a very trivial step. I'd play it safe and get it notarized.  

 

First of all, INS is an agency that hasn't existed since 2003 (USCIS and ICE are the successor agencies); but that's just semantics.

 

With regard to notarization, all that shows is the person who signed the paper was in fact the person who signed the paper.  It doesn't authenticate the document itself in any way.  A letter of intent that is not notarized will not make or break a persons case.

First of all, the form that is about to be filed is an I-129F, not an I-129.

 

Secondly, letters of intent do not have to be notarized (there is no requirement to do so and anyone who says otherwise is wrong).

 

Thirdly, if a letter of intent is going to contain an address (even though it's not required) then the address should be current.

So I'm intending to file my i129f in November of this year to allow 5 months for the NOA2 which will allow me to schedule my interview at the embassy in London in June based on the subsequent 4 months validity. 

 

You don't file the I-129F, the US Citizen petitioner does that.  As far as the validity of the petition goes, do not worry about that, the Embassy has the ability to revalidate the petition if an interview has not yet taken place before the original expiration date (they do this routinely).

Family members on the same household registration are allowed to go to the notarial office of jurisdiction and obtain what you need for you.  Do you have any family willing to do that and then send it to you?  If not, you may have to make a trip to China and obtain it yourself.
