K-1 Fiance(e) Visa Process & ProceduresPolice certificates

Two weeks ago my fiance received the letter from the NVC stating our case number. I was just wondering when should be a good time to do my police check? Can it be done anytime?

To my knowledge police certificates are valid for one year and are necessary at visa interview. In my case I prepared them well in advance because NVC requires them as well! Be sure to have two copies for each police certificate (if you spent more than 6 month in any country).

K-1 Fiance(e) Visa Process & ProceduresVaccinations

are vaccinations needed for the k1 visa prior to interview? i read that they arent needed but once youre adjusting your status you will need them. (my fiance is in tunisia)

Thank you!

Yes, I am pretty sure that the vaccinations are needed. They are pretty much country-dependent. Check your embassy instructions PDF (as if you received the invitation letter).

K-1 Fiance(e) Visa Process & ProceduresVisit your fiancee only one time.

You still have time so start to skype or emails to each other for more evidence. By the way, Do you have emails or letter with your fiancee before you visited Cambodia???

Good luck

Yeah, I do have a facebook msg.

Thank you

Hope and Pray,

Please do not waste anymore time. Read carefully all the above help/advice from good people who care to share.

Follow those you think applied to you and your fiance(e) and start doing it now.

You do not have interview date yet ( from your time line) so you have at least 2 months to make call or send email.

Again, read each and every advice above. I think they cover what you need.

Good luck

Thank you

K-1 Fiance(e) Visa Process & ProceduresVisit your fiancee only one time.

You still have at least 2 more months before interview to come up with more evidences of continuing relationship.

Start now by writing emails to each other daily or weekly what ever you can. Broken English is OK from Cambodia as long as one can tell the meaning.

Start using Rebtel or other phone service that can give you record of call made to Cambodia. A person in Cambodia can go to internet cafe to call you and ask for a receipt each time or if you have ATT or Tmobil you can print your bill showing incoming call from Cambodia.

You must do it now so that at least you have 2 months of evidences.

Phone cards can not tell anybody anything because one can just pick them up from sidewalk.

Hope this will help.

Hi savath

Will this count I used phone card call her through Tmobile service. On Tmobile record show the number of phone card but not her number. Will they take as evidence of relationship or no?

K-1 Fiance(e) Visa Process & ProceduresVisit your fiancee only one time.

Hi

I am almost at the last stage of the fiancee visa. My case was sent to the embassy in Phnom Penh, Cambodia. I know her about year now and I only visited her one time and I plan to visit her again when she has an interview. Another concern that I have is because I don't have good evidence to prove my relationship with my fiancee beside my phone call record which I have been using phone card to make to her.

Do you think will this be enough for evidence of reationship?

K-1 Fiance(e) Visa Process & ProceduresWhat happened to the 'pirated' luggage, clothing, etc...thread?

Am I just missing it somewhere? I clicked on the link earlier and it only said 'file not found'.

My fiance is from Cambodia and I am currently in 'The Kingdom of Wonder' with her. Our interview is next week with hopes of leaving for the US the first week of January. Unfortunately in Cambodia it is extremely hard to buy luggage, clothes, movies, etc. that are not 'knock offs'. For example, today I bought her a North Face jacket, upon bringing it home I realized it has a Nike zipper (obviously a fake), do I need to worry that they will take it from her at the border? I also bought a box set of John Wayne movies only to learn later that there are no 'original' movies sold in Cambodia, are they going to take these from me? I am concerned now that all my luggage and all my fiance's clothing will be confiscated at the border, yet I don't have any other opinions.

I was really hoping to read some more on the subject today but the thread seems to have disappeared. Can we please re-visit this issue or is against the TOS of the site. Moderators?

I am not sure this help you or not. Last year I brought some clothers from Cambodia and most clothes was fake but since to be fine when bring into the states.

K-1 Fiance(e) Visa Process & ProceduresForeign fiance does not currently have a job. Problem?

Hello,

Hopefully someone else has been in the same situation before and can help.

Here's the deal: We have received our NOA2 and are just waiting for the NVC to send our visa application to our embassy in Tokyo. I (the American fiance) was living in Japan with my fiance and not working. Now I am back in America and still not working until my foreign fiance can join me in America.

However, my foreign fiance also has no employment currently. Several of the forms he has to fill out prior to our interview ask him about his employer and employment info, though...

NOW, we DO have a financial sponsor(my parents) making plenty enough to support both of us.

The question:

If we both are unemployed, even though we have my parents as a financial sponsor, will this be cause for concern or even a chance they won't approve us? We will start work once he gets his visa and joins me in America. But currently we both have no employment to show on the forms we are to submit for the interview. Help?

K-1 Fiance(e) Visa Process & ProceduresK-1 Fiance Visa : Same-sex

Hi Jonathan,

I think using your parents address would be better than a PO Box, and as far as his age I would not see any problem because he is of age and can decide for himself.

I was told that USCIS is supposed to be sensitive to situations like this.

Your passport stamps, boarding passes, photographs, emails or chat logs should give you some good material for evidence.

I'm glad that both our families approve of our relationship, going on 9 years now.

Hold on, be brave and go for it.

Best of luck

Fred and Tonton

K-1 Fiance(e) Visa Process & ProceduresK1 co-sponsoring question
Hi, we need advice to ease our anxiety. Thank you.

My fiancee is a graduating college student who works 15h per week and we are using her sister who shares the same household as a co-sponsor. Her salary is above the required threshold (60,xxx).
We are already approved by the CSC and waiting for our #MNL from NVC.

Please share your experiences, knowledge and wisdom with us.
Much appreciated. Thank you in advance.

and also, is she and her sister are going to fill up both the I134 and I864 support forms? thanks again.

I have not yet had an interview as I am still in NOA1 process, but I have spoke to a few people who used co sponsors.

They passed they interview with a co sponsor.

You should be fine as long as your co sponsor provides a letter from their employer, tax transcripts for the last 3 years, and pay stubs for the last few weeks to be safe. I would even recommend bringing the co sponsors birth certificate, but I do not think it is required. Good luck, and let us know how it goes!

THANKS!!!! Fingers croseed!!!!

K-1 Fiance(e) Visa Process & ProceduresMedical exam, vaccines.

3:30 might be pushing it.  The embassy is in the middle of nowhere and it will take you forever to get from there to Callao for your flight.

The problem is that you will sit around and wait a potentially loooooong time.  So, if you are unlucky and don't get out of there until, say, 1 PM.  Now you have 2 and half hours to get from the embassy to the airport, check in, clear security and make your flight.  Good luck, but I would schedule a later flight (remember you are going to be exhausted and hungry when you get out of there, so I suggest lunch and a round of pisco sours and you will want a little leisure time to enjoy that).

The questions they ask will depend on the information you presented.  First, they will call you up and you will give them the application form and then be told to pay the visa fee.  Go to the window to pay the fee and if no one is there, press the green button.  You can pay in dollars, soles or credit card (visa and mc I think).  After that, they will call your fiance over and he will give them the forms they ask for (judicial certificates, I-134).  She will also ask a few questions about how you met, etc.

Then you will get to wait.  After a waiting period you will either be called to a window or a little room.  You can go with him at this point.  I let my fiancee answer all the questions, except for a couple that were directed at me.

Think about any red flags in your situation (age differences, few visits, short relationship, etc) as those may be asked.

I think Lima is a pretty easy embassy from what I have read here and the experience we had.  You will probably be okay.

Where in WA are you guys going to be?  We are down in Olympia.

Mark

Yikes!! I hope it doesn´t take that long; we already booked our flight back to Tacna!!!! :(

Do you know how often they turn people down? I am worried that because I quit my job to move back to Peru a couple months ago, and I have to use a financial sponsor they will tell us no, even though I have a job lined up back in the States... We are both so nervous; I hope they are nice!

We will be living in Tacoma; although I do love the Olympia area!!!

I dont know if it will help your case but maybe ask your friends and family write some letters for you ! info like how well you both get along togeather,if you have done things with each others friends and family. how much your friends and family likes your partner and such. it may help it may not just throwing out an idea !

Such letters carry little to zero weight to begin with and would not satisfy the RFE that the OP received.

How about if the two of them take photos together in each borders, one in the US and also one in Canada?

good.gif You mentioned in your first post that you highlighted the purchases from your time together on those statements; while I can't guarantee it will be sufficient, it is good evidence.

Is there anyway you can get your car mileage officially stated? Or is there something inside your car that shows the mileage that you could take a picture of? (I don't drive so I have no idea what I'm talking about biggrin.png ).

I believe you are referring to an odometer.  A picture of an odometer would also carry zero weight because it doesn't show that a person drove from point A to point B and back; it only shows total miles driven.

K-1 Fiance(e) Visa Process & ProceduresOrientation please!

1.  No

2.  You will be the primary sponsor, even if you don't meet the threshold on your own.  One of your parents will be a co-sponsor (joint sponsor during the AOS process).

3.  Following the directions on the form will reduce the likelihood of an RFE.  Hiring a lawyer or service will not make a difference.

4.  IMO, such a letter is best when the story starts from the very begining.  In your case, that would be how you met.  This is something you will spell out in what is commonly referred to as a relationship letter that you would include separately along with your evidence.

You wouldn't report the baby's birth to USCIS, they have nothing to do with it.  You already know about the Consular Report of Birth Abroad (CRBA) that you file at the embassy in order for the baby to obtain a US Passport.

We planned on putting the baby down on the embassy forms . I just did not want it to be a surprise to them and cause a problem .

This is not an issue.

Yes it is necessary.  The document she will obtain will come from the notary office (???) where her hukou is located.  It's the notary office that issues the "white book" Darnell speaks of and it is the "white book" of all civil documents the Consulate will require.

K-1 Fiance(e) Visa Process & ProceduresSecond K1 Do I need to prove what happened to last spouse?

sorry for the confusion, I'm in so much love that I called her spouse...she is my fiancé currently and did the engagement when I visited her.

The danger about refering to your fiancee as your spouse is it could lead an adjudicator at USCIS or a Consular Officer at an Embassy or Consulate to believe you are married which would result in the denial of your petition at USCIS or a denial of a K1 visa at the Embassy/Consulate.

K-1 Fiance(e) Visa Process & ProceduresSecond K1 Do I need to prove what happened to last spouse?

I'm getting ready to apply for my second k1 visa for a new spouse. Previous K1 marriage failed, filed divorced with state and during the AOS process withdrew my petition for I-864 affidavit of support which was accepted.  Is this a good sign that I was truthful with immigration by telling them marriage was not viable and withdrew affidavit before the decision was made on spouse AOS.
My main concern is if I have to prove that previous k1 marriage was genuine and not a sham when I send the I-129F application ?
I have told my new spouse of how my previous marriage was not viable and canceled the process and have no knowledge of if my spouse left USA. There were no abuse and police reports during the relationship.  Is this something I have to prove in the K1 application or the interview officer will ask my new k1 spouse during the interview process at the consulate?
Any tips for this situation will be helpful especially for sending the I-129F application and if I need to send any documents or write any letter stating what happened with my previous k1 spouse?

Regarding everything I put in bold:

  • You don't apply for a K1 visa, the beneficiary does that.  You file a petition
  • If you have a spouse, then you are married and looking into the wrong type of visa
  • An I-129F is not an application form, it is a petition form.

The most important thing to clear up is this, have you and your new significant other married yet?  If so, then the K1 path is not for you, you will have to pursue the spousal visa path.
