For boarding passes - I wonder if it's a stretch to say that someone could have boarded the flight, arrived at customs, but denied entry (thus no entry stamp). Therefore, the passes on their own weren't good enough and the entry stamps are needed? Must have been a real nitpicky adjudicator though. Anyway, it sounds like you're good to go with all the evidence you've gathered. Don't feel too disappointed about the RFE, once you send the reply, I'm sure the approval will be right around the corner. :)

Finally got the RFE in the mail. It was as I feared. They want more evidence that my fiance and I have personally met in the last 2 years. We were employed in the same place for a year. I don't know how much more proof I can give. I got the cruise line we worked for to write letters confirming our dates of employment & show that we were assigned to the same ship. I'm going to send copies of our passports, but they don't have stamps from the cruise line. My fiance's has stamps from when he came to the US to visit me before we filed. Will this be enough?

 

I *think* this has to do with the letters from the cruise line being secondary rather than primary evidence. If the dates that he visited you in the US were within the last 2 years before you filed, you should send those in. Do you have credit card receipts that show you were in the same city/port at the same time? How about paystubs from each of you from the same months that come from the same employer (i.e. the cruise line) that show you were both employed at the same time?

 

ETA: Just read one of your earlier posts that said you sent in boarding passes - were those from the April trip? Wonder why those weren't sufficient...maybe it's the passport stamps they want?

I don't think your case would be transferred to a different service centre, and I doubt it would be delayed by very long, if at all, but you would need to put in a request to change your address. There's an option to do it online: https://egov.uscis.g...i/go?action=coa if you are the USC. You'd need to make sure they had your new address in case the NOA2 is sent to the wrong address. The NOA2 hardcopy is needed for Adjustment of Status later on and there is an exorbitant fee for getting a replacement.

Did you get an e-mail with a DHL tracking ID? Damn this immigration attorney we used...we've been completely kept in the dark!

 

We didn't receive a tracking ID, but if you have the date your petition left the NVC, you can track yours too. Just go to DHL.com and select "express" then "tracking" then "track by shipper's reference". The shipper's reference is keyed in, for example, like this: EXP 21 OCT 2013A. The date should be a day *before* the day NVC says they shipped it off. Put in the date range of the date before NVC sent it off to the day or two after. Leave account number blank and select your country. Only one shipment left the NVC with destination Singapore during the date range I selected so I knew it was mine. :)

Just to add, if you have your case number from NVC, you can key it in here (select Immigrant Visa) to see your case status. Typically it will say "At NVC", then "In transit" while it's being DHL-ed to the consulate, then "Ready" once they receive the actual file. You can also track your case status throughout the interview process.

My understanding is that they just have to prove sufficient income (over 125% of the poverty guidelines for the appropriate household size) at the time the I-134 and I-864 are submitted. If they move, they have to notify USCIS of their change in address using form I-865, or there is a possibility of a fine.

Your fiancee (spelling for the female half of the engaged couple) needs to provide you a Letter of Intent to Marry with an original signature.  She might also provide you any "evidence of bona fide relationship" that might bolster your petition package (although Manila is not a tough embassy).  Given the time that it takes for USCIS to process petitions, there's no need for her to return to the Philippines anytime soon.

 

The above can be inferred from the Guides in the link above, and from studying the forums.

 

Just adding on: Foreign fiancee also needs to provide the G-325A form with an original signature and passport photo in accordance with US specifications (items 9 and 10 in the link previously posted) to be included in the I-129F petition. Also, if applicable, items 12-13.

 

OP: Do you mean that you are starting to gather the documents needed to file the I-129F petition or that the petition has been approved and your fiancee is now applying for the K1 visa? If you look at  items 8-9 in this link that's the point at which your fiancee needs to be back in the Philippines. If she's a legal resident in Hong Kong, there's a possibility for her to interview in Hong Kong as well (someone correct me if I'm wrong).

The first step in applying for a K1 visa is filing the I-129F petition. She can be with you while the petition is being processed, provided she has a tourist visa/some other kind of visa that gives her legal status in the US. However, once USCIS has approved this petition, she will have to return to the Philippines for the interview and issuance of the K1 visa. That can take anywhere between 2-5 months or so.

Sure, I use a label maker to mark all my boxes and files at home, but then I'm a little neurotic when it comes to being organised. :P

 

For I-129F filing purposes though, I don't think you need to label the individual forms and separate them. You have a cover page - just put the documents in the order they're listed on the cover page and clamp all the pages together. Plus you stand a greater chance of someone losing your papers if they have to disassemble your package, pull each page out of the plastic sleeves and put them all back together again.

most people get the shots during their k1 medical exam as the costs for getting them done could be much cheaper than in the US and the beneficiary may not have medical insurance during their first month or two in the US. if you have already gotten the required shots during k1 and you have your medical exam for adjustment of status less than a year from the date of the previous medical, you can merely get the civil surgeon in the US to sign off on your form instead of doing a full new medical exam.

I was wondering if someone could give me an rough estimate for the cost of the k-1 visa application. My fiancee being the us citizen is paying the petition. But I kinda want to save up a bit first so I have enough to cover in case of mistakes.

 

1. $340 to file the I-129F petition.

 

2. Once your petition has been approved, you will need to make a $240 visa issuance fee to the Consulate you are interviewing at. You will also need to pay for a medical examination/vaccinations, the costs vary by country.

 

3. Once you have entered the US on your K1 visa and married your fiance, you will need to file for Adjustment of Status (to get your green card/legal permanent resident status). That is $1070.

The problem is she is having problems with her medical examination and having to go for another one on 2-6-2014. Do I have to write the US embassy in Laos to extend your petition. She is Laos citizen. We can't proceed forward without passing the medical part.

 

You mentioned that your fiance has been to Udon, Thailand thrice since September and has not received a document she needs - what document is that? Is she interviewing in Thailand or Laos?

 

In either case, to extend the petition, drop an email to the US embassy in the location she will be interviewing at and ask what needs to be done to extend the petition. Often, it is done automatically, but do check if any extra documentation will be required at the interview (some consulates require a new letter of intent to marry from both of you since some time has lapsed since filing the petition).

Did you get any vaccinations done at the time of your K1 medical? You should have been provided with a vaccination record, form DS-3025 - you can get a civil surgeon to transcribe it on your I-693 when you are adjusting status. For the I-134/I-864, household does not mean who lives physically under the same roof. It means dependents that you include on your taxes. Minor children will be counted as dependents whether or not you claim them on your taxes. If your fiancee does not have any dependents/kids, then you are looking at a household of 2 (you and her). While I (the beneficiary) didn't have to provide copies of my birth certificate at the I-129F stage, I did refer to it when filling out my G-325A for the city I was born in, my parents full names, date of birth, etc - could this be the reason why the lawyer asked for it at this early stage?

 

Your fiance can interview anywhere she is a legal resident - if she is on a student visa in Ireland then she is authorised to be there and can most likely interview there. There is a section in the I-129F form where you can list the consulate you want to apply at, however getting the NVC to actually look at it is a different matter. I think the NVC has a tendency to forward cases to the consulate in the same city as the beneficiary's "current address".

Does he currently work all 3 jobs? Current income is what he is making currently, not what he made from several jobs he had since Jan. If he is working all 3 jobs then add up the annual income from each and enter that as his income that meets the requirement. If he is only currently working one, then you list the annual income from that one as his income amount on the form. Whatever documentation you have to prove his current income should work, such as his earning statements from his work's HR online portal.

 

If Singapore wants the last 3 years of taxes, then perhaps order IRS transcripts. They do not take long to receive, and he can them the same day if he has a nearby IRS office he can walk into to get them. He can scan and email them to you for you to print out.

 

It's just the one job now but we were worried because he's only had it for just under 2 months. Thank you so much for the tip about walking in, we put in the online request recently and thought it would take 10 business days (too late as interview is early next week). I'll bug him to drive down to the nearest office tomorrow and get a copy. :)

Thanks for the reply, we've spoken to the US embassy in singapore (embassy instructions letter doesn't give any detailed info on this). They want last 3 years but wouldn't say whether ITRs are required or if W2s will suffice.

 

His employer wouldn't issue him a letter stating his pay, and nature of his position, so we're going with his offer letter (the contract he signed). No actual "paystub" since it was deposited directly into his account so we printed out his earnings statement from his HR portal.

 

I can't wait till all this is over, I'm losing enough hair to be bald by thirty. :(

Hi all

 

I tried posting this in the Asia: East and Pacific regional forum but didn't get any bites so, I'm trying here instead. I'm looking through the financial documents my fiance sent me for the I-134 and I'm not sure if we have enough. We've got:

 

For 2010-2012

 

 

1. W2s for 2010 and 2011, well above poverty guidelines

 

2. 3 different W2s for 2012 which add up to above poverty guidelines

 

We don't have his ITRs and it's too late to request them now. :(

 

For 2013

 

For income this year, it's a little trickier cos we don't even have any w2 forms yet and he's had three employers, one of which is fairly recent. We have:

 

3. copy of last paystub from job A showing gross earnings from january to end june 2013

 

4. copies of electronic bank statements showing some of the direct deposits (net income) from job B over july to september 2013

 

5. copy of the offer letter from his current job (job C) on business stationery stating the start date (21 oct 2013) and gross pay on a bi-weekly basis (does not say whether it's a temp/permanent position though)

 

6. copy of earnings statement for the first week of job C stating hourly rate and number of hours worked (40 hours that week)

 

no. 3-6 add up to *barely* above the poverty guidelines mostly because our proof for earnings in job B are lacking. any ideas if this is sufficient or if i should be worrying? he has a great job now and current income is just fine, but i'm also aware it's a new job and will carry less weight than a long-held position.

They most likely just lost it, misplaced it or didn't see it, don't stress. Just mail out another original just like the first one and if they don't lose or misplace that, you'll be good to go. Don't over think these things, and remember, you're dealing with low level government functionaries, not brain surgeons.

Two weeks ago my fiance received the letter from the NVC stating our case number. I was just wondering when should be a good time to do my police check? Can it be done anytime?

To my knowledge police certificates are valid for one year and are necessary at visa interview. In my case I prepared them well in advance because NVC requires them as well! Be sure to have two copies for each police certificate (if you spent more than 6 month in any country).
