what will be negative effect if both fill-out  I-864 form as two joint sponsor ( husband/wife ) if both does not fulfill 125 % poverty level separately ????
 
Like 1st sponsor has low income than 125 % individually
2nd sponsor also has low income than 125 % individually
 
but both have high income combine

The purpose of combining incomes is to meet the requirement. See my previous post on how to proceed.

There can only be one joint sponsor. Between your aunt and uncle, have the one who has the higher annual income complete the I-864 as the joint sponsor and the other complete an I-864A as a household member to combine the incomes.

If your dad qualifies on his own, then only have him complete the I-864 and include a complete copy of his tax return along with a copy of his W2 that shows only his income.

The risk of applying for a tourist visa is if it goes badly and you get denied, I think you then also lose the ability to use the VWP.  Someone will no doubt confirm this shortly. :)

If your request is granted, it will not carry over to subsequent stages, you will have to make the request at each stage.

NVC requires the original and a photocopy of the marriage certificate.  Sending the original marriage certificate to USCIS was a huge error as USCIS only requires photocopies.  Obtain a new original document from the relevant authority.

It's me again. You've been very helpful, by the way. My husband and I are way over the poverty line because he has a regular job as a professor in a college. We submitted 1040 for 3 recent tax years, w2's for 3 recent tax years, employment letter and pay stubs (but just for the recent 3 months). Although the pay stubs are OPTIONAL, I read in the guidelines that we should submit paystubs for the recent 6 months. Do you think we're fine with just submitting 3 months of paystubs? Thanks!


Most pay stubs show what has been paid year to date (YTD). If your stubs have this figure, the only the most recent one you received would be sufficient.

Sending the original documents to USCIS was a major mistake because only photocopies of said documents were required.  Nicaragua cases are not eligible for Electronic Processing so scanned documents are unacceptable.  You need to go to the relevant issuing authorities and obtain new documents to send to the NVC.

When an I-864 is involved, joint sponsor is the proper term, not co-sponsor.

Should I just make this all easy and change the mailing address to my families home in the U.S.A and have them forward all my mail to me?

 

I would suggest you not change address, another member was living abroad and was incorrectly told that USCIS does not send mail overseas and told the member to change their address.  When the member did so, USCIS screwed the whole thing up by changing the beneficiary's address also and pegged the file as an AOS case.  It became a nightmare for that member to get everything straightened out.

That figure is what you have been paid for the year to the date of the check, it is not the same as annual income.  My previous post explains how to figure annual income.
