How long for your case processing ??? I'm at NVC now and waiting for the reply on our checklist, btw I'm CR1 visa and it has been a year since we applied it , dont know when will it finish. should wait for them or just call them to ask?

I never heard that they send emails in any other languages but English, my husband and me both received same emails from NVC in English only. U need to call them and ask to speak to a supervisor. They will put u on hold for 1 hour until someone answers your call. My case has been in NVC for over 3 months now... we do hope it finish soon too :( have u sent your supporting documents by DHL or UPS ??? it's the safest way to know they receive your docs right and fastest.

Just call them every day to inquiry on ur case. My husband starts calling them after 10 business days which we not hear anything from them, then they sent us an email about checklist but shorter than the first one with only the request for Number 1 (saying waiting for supporting documents for AOS or IV) but we sent all already after we got the checklist, and asked to speak to a supervisor. They said they would email us to correct sth else and other supporting documents were accepted. Btw , it has been a year now since we applied I-130. How about yours???

Hi everyone, my case is completed in April but unfortunately they have blocked interview schedules for embassy in VN for May... so they say its most likely in June.... I'm wondering if any cases in VN reschedule or delay for any personal reasons then I could have a chance to fill up for that????or just have to wait until they send interview letter ????

That's correct.  Why is the 2011 tax return not available?


He said he might misplaced it and try to find it somewhere. He said he earned little that year. Eventhough he earned sufficient this year, do you think we will still be needing a joint sponsor or its better if we just have a joint sponsor just in case?

The number of tax returns available has nothing to do with whether you'll need a joint sponsor.  If current income is sufficient, you shouldn't need a joint sponsor.  Why is the 2011 tax return not available?  If his income below the filing threshold in 2011, that's not a problem.  There's really no other acceptable excuse for not filing.  Need more information.  Are both the current income and 2013 income enough to qualify?
 


He said his current income is sufficient and said that he computes that he makes $30,000 which I think is enough for the household of three (husband, me and his daughter)

All,

 

My current passport will expire in about 1 year. 

We expect to get an Embassy interview somewhere in June / July, our case just got forwarded to NVC ! (Does happy dance)

 

Even though having a Visa in an expired passport is acceptable for travel, once you have your new passport, it's not exactly convenient to carry both.

 

I was thinking of applying for a new passport now, as it's convenient because everything is close by, and bringing that in to the Embassy interview, so they can put the VISA in that one. By the time it has expired, I'll be eligible for citizenship anyway...

 

I seem to remember providing copies of my current passport for the I-130 petition, will that be an issue? Or should I ask the official here to give me the invalidated passport once I get my new one, so I can bring both to the interview?

You submit evidence, not proof. A statement of WHY he didn't have to submit a tax return would state his income (which would be BELOW the threshold for filing  while NOT figuring the Foreign Earned Income Exclusion), and include any evidence he has, including bank statements, a copy of his contract, or other such evidence.

 

If he earned OVER that threshold, he can still file a late return - he MUST do this in order to claim the Foreign Earned Income Exclusion. Since he would still owe zero taxes, there is no late fee or penalty for doing this.

The "record of you" is in your hukou book, which you said was moved to Beijing. This is what you need to find, whether your (or your mother's) hometown hukou book, or the one in Beijing.

 

Yes, your husband will need to demonstrate a level of income which is adequate for your support (125% of he poverty level). I would also have him include a statement as to WHY he is not required to file a tax return.

Thank you RandyW, my husband's income is not adequate, so his grandma is our co-sponsor, and you mean he just has to make a statement about why he is not required to file a tax return? he doesn't need an official document to prove?

1.  really?  hukuo book shown, cannot make a birth certificate in the hukuo city?  ouch !      try a larger city in the province....

 

 

2.  tax refund - you mean tax return document.    I would show the income another way, without showing a tax return document.   The income requirement, to the best of my knowledge, cannot be waived but income can be shown in other ways besides a tax return document.

Our I130 was approved on MARCH 18, so we began preparing the documents recently, many questions and confusions show up too, so I need the help from all of you, thank you in advance!

1.       About birth certificate: I tried to get birth certificate at my hometown police station, but they told me that they could not find the record of me!!! I am a Chinese , my hukou was moved from my hometown to Beijing after I went to college in Beijing, so they probably lost the record of mine!

     and I read If your birth record is not obtainable for any reason, a certified statement must be obtained from the appropriate government authority explaining why your          birth record is unavailable. You must also submit secondary evidence such as:

·                                 A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

·                                 An adoption decree for an adopted child

·                                 An affidavit from a close relative, preferably your mother, stating the date and place of birth, both parents names, and your mother?s maiden name.

More specific information is available from the NVC, the nearest U.S. immigrant visa processing post, or online at Reciprocity by Country.

·                                 Note: An affidavit executed before an official authorized to take oaths or affirmations must also be provided. More specific information is available from the NVC.

Carefully read the I-864 instructions when it comes to using assets, your alternate option is unlikely to be accepted.

Your FIL's household count would be 5 in this scenario, here's the breakdown:

Wrong,

 

Your father in-law is a joint sponsor.  Second, he needs to also complete an I-8864.  Your mother in-law would complete an I-864A.

Right now, plan on 10-12 months from the time the petition is filed to the time an interview takes place.  That timeframe is subject to change.

 

He is correct that joint sponsors are always allowed in CR-1 cases (by law).
