- Is this going to be a problem since the I-130 will be with my old name (my new one will be the same one but with his last name attached)?
- Should I wait to legally change my name until the visa is approved? And if I do, will changing my name in Norway be sufficient or will I have to notify the US government/do anything else as well? 
- Should I change my name first, get my new passport and everything, and then apply for the I-130?

 

Answers:

  • This is a non-issue; therefore, it will not cause any problems.
  • Timing is up to you, changing your name is a personal choice and has no bearing on the immigration process.  You will probably have to pay applicable fees to the applicable authority to update your documents (e.g. drivers license).
  • Again, timing is up to you as it is irrelevant to the immigration process.  Also, the I-130 is not something you apply for, it's a petition form that is filed.

DS-3032 is still active on the Government website and it was updated in 2013

If I remember correctly, DS 3032 is what you need. But could you please let me know:

A. Are you working with an attorney or

B. is the Alien (your partner) filed I-130 by himself or did you do it,

C. A child is being adopted

 

Reason I am asking this is because FORM DS-3032 - Choice of Address and Agent for Immigration Visa Applicants is what you and your partner needs.


 

DS-3032 is no longer used.  It has been replaced by the online DS-261.

Leave all asset related questions blank, when income is sufficient.  Leave all asset questions blank on petitioner affidavit, when using a joint sponsor.

 

Other members have recently been reporting receiving a checklist from the NVC for leaving those lines blank even though the instructions say doing so is ok and nobody had this issue in the past.  I would suggest writing N/A in all those sections to avoid receiving a checklist.

Hello "pushbrk", today i received the the receipt notice for my spouse and kids. I did a terrible mistake some how got the wrong place of birth on I130 for my wife. i called them to make the correction. will they update the information or??? i am worried please advise

Terminology is used when you speak with USCIS officers. I tried io use applicant to them. They said your husband is a "petitioner" of I-130 application.

Likewise, when speaking with a teacher or a doctor, they will correct you if you use an incorrect term.

 

One thing to keep in mind when speaking with USCIS phone operators (they are not officers); the USCIS phone line is often referred to as the misinformation line here on VJ.  There is a reason for that term, the phone operators often give out inaccurate information over the phone when you ask them specific questions about your case (they are trained to read from a script).  I've seen it posted many times over on VJ just how wrong they can be, in fact, their bad information has caused members significant problems with their cases that would not have otherwise occurred.

That's not what I was saying, your first post that I was replying to implied that a spousal visa applicant hand carries original documents to the interview and that is not correct when the NVC is involved in document intake. Original documents are sent to the NVC in that instance.

The stamp next to the visa serves as a temporary green card for a year.  The visa itself is dead. 

 

The only stamp that is next to the visa is a standard CBP entry stamp, it's a combination of a standard CBP entry stamp and the visa itself that acts as a temporary green card (not the stamp by itself).  CBP is no longer placing special stamps in passports of immigrant visa holders.

 

Here is how I know this, when my wife entered, the bottom of her visa had the following notation, "Upon Endorsement Serves As Temporary I-551 Valid for 1 Year."  The 'endorsement' is a standard entry stamp that was placed on the page next to her visa.

You should have a receipt confirming that your payment was received. And on the receipt it should indicate the proper time period.

Once you land on USA Soil, the custom border will "STAMP" your passport. And, kindly check your entire passport for any type of stamp or signature the custom officer may have posted. Usually, jab hum usa ate hen Finace ya Marriage Visa pe, custom offer humein sha stamp lagata hai ke ap kya ho permanent resident ya conditional resident. ZARORI hai ke "STAMP" lage.  Agar koi confusion ho to reply karo. If you have any concerns, kindly reply.

Your POE was abu Dhabi? I thought poe is usually the US city you enter in. And when you enter, they stamp your passport there. May be someone else has same experience as you, who can answer better.

 

CBP has a preclearance facility in Abu Dhabi.

  1. He can send them directly to the NVC
  2. Pay the fee when you are ready to do so and it's available to be paid via the payment portal.  Don't wait for the NVC to inform you because you will be needlessly waiting for a long time for something that will never come.  The I-864 is not an online form, it will need to be printed and mailed.

The evidence you submitted with the file does not need to be included again.  However, if you choose to do so, it should go with the IV package.

 

Regardless of whether or not you decide to include relationship evidence with the IV package AND regardless of whether or not you frontloaded; all evidence should be brought to the interview, even though none of it may be looked at.

I have another quick question. We are going to get a couple of friends to sign an affadivt stating that they know our relationship is bona fide. Do they need to get these documents signed in front of a notary, or is just their signature enough?

These affidavits carry little to zero weight in the overall picture.  If you choose to include them, they do not need to be notarized.

Greetings, 

 

The requirement of chat logs and phone calls or instant messaging are not mandatory. If your marriage is legal and real, than you don't have to worry about sending in your chat logs or video logs and even phone/text logs. 

 

Simple way to proof your marriage is through

- Marriage Certificate registered with your local government where you got married

- 2-4 Affidavits, 2 Affidavit of your self asserting that your of legal age to marry and are joining in marriage with ____ your partner at free will

- Marriage/Reception pictures, with description of what is it you are showing, Don't send them a 40 page album, few are fine, that shows the couple, couple with relatives, friends, gifts, than 3-4 pictures from a vacation or a dinner you guys attended,

- Passport Entry and Exit stamp

- Copy of your tickets

- And if possibly you got pregnant than that's something they can't deny. If you have a doctors report  that shows you got pregnant during the time of your stay and after marriage they won't have anything else to question about your marriage and eliminates the requirement sending in pictures, but you should still send like a minimum of 10.

Your birth certificate is not needed for the filing of the I-130.

Any evidence of time spent together should be included. After that, include communication records. For pictures, don't limit those to just your wedding day.

According to the OP her husband's psychiatrist had to sign a statement that he won't offend again and he refused to sign...I do not think the OP will be able to get a visa through this marriage.

Here is really the main point. His own psychiatrist won't sign off it, meaning no guarantees he would not re offend. Add this to having a new child in the house if you live together? I was a victim of childhood sexual abuse from a family member and I guarantee you I will never let a child of mine near them now, signed off or otherwise. Could you honestly comfortably take that chance?

No judgement meant, just something very serious to think about.

I'm really frustrated now... today is a year since we applied CR-1 visa but its not done yet :( ... it's at NVC now. We replied on our checklist but so far no hearing from them, don't know what is going on. Should we wait until this friday for 10 working days to call and ask or just call them now?? will they email to reply on the result of the checklist or we have to call them??? It has been 14 months we are being apart, I feel lonely, depressed and tired, many cases got approved that makes me feel more anxious , what can I do ??? anyone has the same problem ???It was @ USCIS for 8 months and got approved without any RFE but NVC ....

we did have the same problem as yours, but keep checking the site to see if ur case number shown there yet, they told us 30 days too but actually it was shown up within 20-25 days, lol..... it would be there soon if they said they got ur package, dont worry. u can go ahead to prepare for aos FORM AND DS 260 SO  when it's shown up u can be ready to pay the fee and fill up the forms. good luck
