My British husband and I (American citizen) have spent the last few years traveling and don't have any lease agreements, joint bank accounts or any of the more solid types of suggested supporting evidence.

 

 

USCIS and the Embassy will not expect a couple living apart in separate countries to have such items.  Any evidence you have of time spend together in-person is always your best evidence.

1. After sent the OPTIN email, should I receive an auto reply right away?

2. If I didn't receive the auto reply, what is my next step to fix the problem?

  2. I waited 6 days before I was notified that the enrollment had been successful

How about the family register?  It has my name on it now so do you think it would be worthwhile proof of marriage?
 
As for my passport and birth certificate, I already scanned and printed every single page of my passport in color but I haven't copied the birth certificate yet.  Does either of the 2 documents hold more weight/value than the other? 


Your proof of being married is satisfied by the marriage certificate; the family register means absolutely nothing.

The purpose of sending a complete copy of your passport or a copy of your birth certificate is to establish your US Citizenship, no one document holds weight over the other.

I am just about finished with putting together my I-130 packet and hope to have it sent out early next week.  Before doing so, I would very much appreciate it if some of you could take a quick look at my I-130 cover letter and tell me if everything looks OK.  I will assemble the packet in the order as listed with the G-1145 on top as indicated in the instructions for the G-1145.  I will put small thin post-it note tabs on the bottom of the first page of each numbered section, labeled with the corresponding number.  I also will use paper clips to separate each numbered section.  Finally, I will clip the entire document together with a Jointex clip (or very large paper clip if that is better?).

 

Does the order of documents seem OK?  Is there anything else I should add or omit from the wording of the cover letter?

Also, the letter JUST fits on one A4 size sheet but only if I change the margins to be 12.7 mm all around on each side. 

 

Does all this seem OK?  Thank you for any feedback you can provide!

When you do the w2 you will get a original tax transcript from your accountant called 1040/EZ you just make a copy of it only federal tax income that shows the total gross income/total income do not print the whole pages then sending that together with other document you going to send


A 1040EZ is tax return form that is filed, not the name of a tax transcript.

Your petitioner will always be your sponsor regardless if they meet the threshold as defined by the I-864P.

 

If a joint sponsor is needed and your uncle is willing to act as one and he meets the required threshold, then he will be allowed to act as one.  The fact that you are related is a non-issue.

Submitting the DS-260 now would be done under the old case number and unlikely to be transferred once the case is converted and would probably not force anyone to look at the ENROLL requests.

 

I would call the NVC and speak to a supervisor about this.

Did you send the ENROLL email before or after the you received the AOS invoice?

 

I see no benefit to submitting any forms or documents until you have the GZO number, you would probably have to resubmit under the new number.

How come on that sept by step guide doesn't show how much I am supposed to send a check along with the i-130 packet? Do I need to send out a check at this point?

 

You must include the fee when the petition is submitted.  The fee can be found in the I-130 form instructions.  Since government fees are subject to change, you won't find them in the guide as it is simpler to refer people to the form instructions.

Hey question on that one since I took my husbands name and obviously had to change my passport at the NVC stage would you send copies of the old passport pages with my maiden name or the new passport with the new name.  However, since I haven't been over there I wouldn't have any stamps in the new book

 

Unless those old passport pages had stamps from trips taken together and you were "side-loading" as NLR was asking about, then there would be absolutely no reason for you to send the old passport.

For starters, an I-130 is not an "app," it's a petition form you are filing.

 

Does the beneficiary plan on taking a married name or keeping her maiden name?  If they plan to have a married name, then it's perfectly fine to complete the applicable forms using the married name and writing the maiden name in the "other names used" field.  One thing to remember, if the beneficiary is planning to take a married name, they will need to update their passport to reflect that because the visa will be issued with the name that is in the passport and the green card will match the name on the visa.

The customer service line at USCIS is often called the misinformation line and there is a reason for that; they often give out inaccurate information over the phone.

 

I'll take your questions point by point:

  • Translations; the only thing required is a signed attestation statement that says the translation is accurate and the person doing the translating is competent to do so.  While I usually recommend a 3rd party sign the attestation statement, there is no rule that I have seen that says you can't self translate.
  • The family register; it's up to whether or not you want to include it, it's not required.  Should you elect to include it, I don't see how it would harm your case.
