K-1 Fiance(e) Visa Process & ProceduresDo I need a cover letter for the I-129F petition?

If my gf wants to visit me sometime between October and December of this year after we have already started the petition process, will it mess up the entire process?

White book is VJ vernacular for Notarial Certificate. These certificates are issued by the Notary Office that has jurisdiction where her hukou is located. USCIS only accepts white book photocopies for translated Chinese documents.

K-1 Fiance(e) Visa Process & ProceduresDo I need a cover letter for the I-129F petition?

I just came across this:

http://www.visajourn...content/k1forms

So, I need to fill out an I-134 form I guess. I currently don't make enough money to show that I can support her, but our plan is to get married and both work and live on a shared income. I will go to school to be an insurance salesman soon as well. Would I be able to have my father sign as the sponsor on this form for both me and her? He makes good money, but he wouldn't actually take care of us. I just need it on paper, so that they don't deny us being together. Would this be the only way around this?

On interview day, an I-134 completed by you and an I-134 completed by your father (provided he is willing to fill one out) will need to be submitted (your father is not sponsoring you, he would be your fiancee's joint sponsor {you would be the primary sponsor, regardless of what your income level is}).  When going through the Adjustment of Status process, you both would need to complete and submit an I-864 (this is the form that contains the binding contract).  This doesn't come until later so don't focus on it too much at this juncture.

I understand that it is listed...but how would they not know whether or not I am a citizen? I have been in this country my whole life and they have my records. Just seems like this country loves to cut down trees for the sake of cutting down trees. I will just send a copy then.

Unless you were naturalized, USCIS will not have a clue who you are.  If you were naturalized, the adjudicator who will review your file will not have access to that information hence the requirement to provide proof.

K-1 Fiance(e) Visa Process & ProceduresDo I need a cover letter for the I-129F petition?

As far as the birth cert. or passport...I would just send copies I'm not cool with mailing the originals. Even mailing copies doesn't seem required.

Yes, only copies are sent to USCIS, never send originals.

The statement I put in bold makes no sense, one of the requirements of filing an I-129F is that you must be a US Citizen and you have to show proof of citizenship.

K-1 Fiance(e) Visa Process & ProceduresDo I need a cover letter for the I-129F petition?

Letter certifying intent to marry (Petitioner and Beneficiary) (I need this?)

  • Proof of having met in person in the past two years (isn't this something that my fiance needs to show when applying for the K-1 visa?)

You both need the intent letter and you must prove that you have met in person at least once in the past two years prior to filing.

You should also include as much evidence as possible when you file because if you wait until the interview to have your fiancée show it to a CO, the CO more often than not will immediately pass it back without so much as a cursory glance at it.

K-1 Fiance(e) Visa Process & ProceduresParental support and inter-religious marriages

Does parental support/awareness (beneficiary's parents) of a relationship play any role in the approval/denial decision-making for K1?

I did a brief search of a forum and a few threads came up where it was mentioned that it might matter, and the embassy may choose to verify the relationship with family members, friends, etc but these were mostly pertaining to I-130s. What are the chances of this happening for K1 applications, and how important is it to have family members acknowledge and support the relationship/future marriage?

Basically, I haven't informed my family (and don't plan on doing so) that I'm planning on a) getting married and b) leaving the country for good. They were not supportive of our relationship when I first tried to broach the subject a year ago and are under the impression that we ended it.

Secondly, we are from different religions (Atheist/Muslim) and neither of us sees the need to renounce/convert. I understand that this might be an issue in certain countries. I can't imagine it being one in Singapore - but has anyone heard differently?

Lastly - to allay this awful anxiety of mine - does any of the mail from the US embassy that reaches the beneficiary indicate that it is with regard to a fiance visa?

K-1 Fiance(e) Visa Process & ProceduresQuestion about the K-1 Guide: Step 4

Yep, the guides are referring to Qn 18 on the older version of the forms. On the most current forms, it's question 34a.

We only included the details of our first meeting in person on the form, and included the rest of the information (how we met online, how the relationship was established, all trips to meet in person, etc) in the addendum.

Did you receive packet 3? I found this thread where the embassy in Guangzhou said the beneficiary had up to a year to respond to packet 3. You/your fiance could try writing to the embassy and asking whether they can extend the validity of the NOA2. Good luck!

K-1 Fiance(e) Visa Process & ProceduresWhich USCIS office to submit to...

Thank you for your help and the links you provided, they were helpful. I actually sent an email today to consulate in Sarajevo today about the address, so we will see what they say; since that will be the Embassy we will have to deal with. We haven?t discussed getting married first, I will have to talk to her more about that, but I think the intention right now, is to get married in the states.

No, she is not a legal resident of Iraq, she is Bosnian. I was asking if she could do interview here, because this is where we are working, and she was able to get her interview for her tourist visa here. I would assume the tourist visa isn?t as hard as a K-1, and they might not want to process here?thus making her go to her home country to process.

Thanks again for your responses

Legal resident just means that she has legal status to reside in the country, e.g. an employment pass, permanent residency, etc. If she is working in Iraq, I assume she is a legal resident. If so, she can interview in Baghdad instead of her country of citizenship. Under questions 36a and 36b of the I-129f form, you can indicate the embassy/consulate she wishes to interview at.

K-1 Fiance(e) Visa Process & ProceduresWhich USCIS office to submit to...

Hi, welcome to VJ. :) All K1 petitions are filed at the Dallas Lockbox. The sorting facility there will decide which service centre (either California or Texas) will adjudicate your petition. You can find the address to mail the petition and other useful instructions here: http://www.uscis.gov...00045f3d6a1RCRD and here: http://www.visajourney.com/content/k1guide

You will have to list an address in the forms where you will be sent notices of action or requests for further evidence. Maybe someone else can confirm whether you can list your friend's US address in the forms and have him forward you any mail you receive from USCIS.

Since you are already together, have you also considered marrying and then filing an I-130 instead?

K-1 Fiance(e) Visa Process & ProceduresExperienced K1'ers

Oops i totally forgot.

What is the average K1 VISA process time? We're thinking of having the wedding on 5th April. Do you think thats possible?

Also we're planning to have a small event in my home country before we both goto US for our actual wedding, you know, just to celebrate it beforehand with the lads back at home because they wont be a part of it. Do you think this could cause some trouble or is there a need to mention it anywhere during the interview etc?

Processing times for K1 vary widely, you never know if you'll be lucky and get a quick approval or be stuck waiting for a while. I wouldn't plan a wedding date till the visa is in hand.

Make very sure the event can't be construed as a wedding (off the top of my head - no exchanging vows, no officiant, etc) - I wouldn't mention it at the interview.

K-1 Fiance(e) Visa Process & ProceduresExperienced K1'ers

Not experienced by any means, but here are my thoughts:

1. Depends on what you mean by hidden cost. $340 for the petition. There's also the cost of the medical examination (varies per country) and a visa fee before your interview. Plus all the expenses from mailing, getting photographs taken, etc. You will also have to do an adjustment of status after marriage in the US which is $1070 if I'm not mistaken.

2. Sorry, it's too late for me to do all that math right now but...it's not cheap, heh. tongue.png

3. The evidence required for the I-129f petition is proof of meeting in person within the last two years. You can, but are not required to,  "frontload" your petition with evidence of an ongoing relationship so that when it reaches the US consulate in the beneficiary's country, the officers there can look over the evidence before the interview. You will likely need this evidence for the interview so I suggest extracting chats that are less risque in nature, in preparation. tongue.png

4. Send original, physical copy by mail. If you like, you can sign in blue ink to distinguish it from a photocopied signature.

5. We typed up 2 sentences on the first time we met in person (within the last 2 years) and wrote "Please refer to attachment for more details" with information on how we met (online) and how our relationship progressed.

6. Tourist visas for your family members have to be applied for separately from K1 visas.

You can indicate your preferred consulate/embassy in questions 36a and 36b in the I-129F form. It does also say acceptance is at the discretion of the designated embassy/consulate.

K-1 Fiance(e) Visa Process & ProceduresShould I-129F Petition package include I-134 AF of support?

Yes, her (only her) annual, gross income. Household is a misleading term - it refers to the number of people who are dependent on your fiance for support (such as her minor children, if any). Does not refer to the number of people living under one roof. My fiance and I have interpreted this to mean the number of people he claims as dependents when he files taxes. The household size should include you, so, minimally, a household size of two.

Yes, you only need the I-134 at the consulate/embassy stage. 125% of the poverty guidelines is required, depending on her household size - listed here: http://www.uscis.gov...form/i-864p.pdf

It's the I-134 you want for both you and your mother. The I-864 is for Adjustment of Status, once you have married your fiance.

Yes, the entry stamps are a good way of proving he entered the country. Here are some other suggestions:

- Credit card/bank statements showing purchases he made in Singapore

- If he was on a student visa, did he have a Singapore residence (like a dorm room or a rental apt? Did he retain any letters addressed to him at his Singapore residence?

- Did he receive any letters from the local school he was enrolled in, e.g. an acceptance letter?

You can "frontload" but the other stuff like chats and facebook messages are probably more useful at the embassy stage.

K-1 Fiance(e) Visa Process & Procedureschange of address and phone number

since you're a csc filer, it may take a bit longer for nvc to receive your file - at the moment it's averaging 5-7 weeks after NOA2, so your file is probably still at USCIS. suggest first calling the NCSC (1-800-375-5283) in about 2 weeks time to check whether your file has been sent out. once you have confirmed it's been sent out, you can call nvc (603-334-0700) to ask if it's been received, and for them to update your address and phone number.
