There is no "change of status" form to file before you file the petition; just file the petition when ready to do so.

 

If you decided to take your husband's last name and it is on your marriage certificate, then use it when you fill out the forms.  Your maiden name would go in the "other names used" section.

On the I 130 in section C it ask on line 21 for last address where you lived together.  do I have to put an address there if we have not really lived together other then when I visit there for two weeks at a time?

 

That question can be answered with a statement such as "We have not yet lived together" (this is what I wrote for that question).  "None" is also an appropriate response.

 

N/A is not an appropriate response because the question is applicable to you.

As you are married already the road to a green card should be fairly smooth. There are no waiting periods or quotas for people in your category. Your US entry visa and green card are available to you as soon as you get through the application procedures, which usually take at least a year, and more often 18 months. However, one of your first tasks is to decide which set of application procedures to use. You have two choices: the old-fashioned "immigrant visa," meaning that you'd complete all of your paperwork overseas and enter the US with full rights as a permanent resident (you might even be eligible for Direct Consular Filing (DCF)) or the new K-3 nonimmigrant visa, which is an adaptation of the fiancé visa (K-1).

 

NOTE: If you've been married for less than two years when you either arrive in the US on an immigrant visa or are approved for a green card after arriving on a K-3 visa, you will begin life in america as a conditional resident. your conditional residency will expire after a two-year "testing" period. Just before the expiration date, you will have to apply for permanent status. 

 

The words in bold and red are problematic:

  • DCF is only available in countries that have a USCIS field office, France is not one of those.
  • The K3 visa is not "new," it came into existence in 2000 when the LIFE Act was signed.  Procedural changes at USCIS and the State Department in the intervening years have rendered the K3 obsolete and virtually unobtainable.
  • The period where an LPR has conditions on their green card is not a "testing period"

Yes, the past tax information will be the same for both of them.  Adding the W2's or just using complete tax returns that would include the W2's anyway, is the best plan.

u should call them to check about the schedule for interview, my case completed in april 16th but due to they already fixed the schedule for May's interview in vietnam so they schedule my interview in June 19th

we are waiting for their reply on our checklist too, it has been 10 business days already and we only received a email from them saying they are reviewing on their case after they got our supporting documents.... and they said the same thing " 20-30 days" .... dont know when we will receive the next email from them...and they are very rude each time my husband calls to inquiry on my case, it sucks

we applied on 20dec in texas for a Cr1 and a k3 on january 13 and both of them got approved on 23 april ..... Don't know what to feel :D

Doesn't your marriage certificate say both your wife's maiden and married names? I'm Japanese and in Japan we cannot even have a last name that is not Japanese. So...I mean a PCC with my husband name? Impossible. I didn't even think about that. Nobody asked anything!

 

Yes, marriage certificate has both names on it. I believe I read somewhere that PCCs needed to be issued in ALL names used, hence the worrying. Well, we got a case complete with the maiden name only PCC, so everything worked out!

Didnt you change the national identity card to married name? Did u speak with the police head quarters?

Thanks. Sorry for the late response. Just seeing this. My wife never updated her National ID Card. It still shows her maiden name to this day. We asked the police department about the name issue and they instructed us to use the name on the card. I also contacted the U.S. embassy in Colombo and they said there would not be a problem with the PCC being in her maiden name. Luckily, there was no issue! I attached a letter explaining the situation just to be on the safe side. We got a Case Complete yesterday.


You will need a cover letter when you submit everything to the NVC. It can't hurt to include a note in the letter saying the police cert uses the maiden name.

Here's our situation. My wife will be receiving her police clearance certificate only showing her maiden name. We filed the USCIS petition using her married name. In Sri Lanka, they will only issue PCCs using the surname on the National Identity Card. Her passport has been updated to married name, but she never changed it on her National ID card. We asked the police department if we could include her married name on the PCC and were told it wasn't possible. I will likely be sending in the IV packet this week and worry they will ask for a PCC showing married name. I spoke with the U.S. Embassy in Sri Lanka about this and was told it wouldn't be a problem, but I'm not so sure the NVC will be on the same page. Has anyone encountered a similar issue? I'm thinking of submitting an attachment explaining the situation.

I am sorry for not responding sooner. I can't help much with changing one foreign address to another. I changed my address from Japan to America. I think you can online though, once you change the country I think the state field disappears. other then that the best thing is to start a thread on Visajourney. People are very helpful on here and I'm sure it is a question that has come up before. Best of luck!

An applicant must obtain a police certificate from the local police authority:

 

IF you?

AND?

have been living in your country of nationality at their current residence for more than 6 months

you are 16 years old or older

lived in a different part of your country of nationality for more than 6 months

you were 16 years or older at that time

lived in a different country for more than 12 months

you were 16 years or older at that time

were arrested for any reason

you were any age at the time of the arrest

 

Now, the "lived in..." may be confusing. If you go on holidays abroad for 2 weeks, you "live" in another country for those 2 weeks.

For legal purposes, you should however consider if you were registered with local authorities to be living there. Typically this means you have taken residency in that location.

If you spent time in hotels, friends spare rooms etc while doing some work abroad, typically you did not notify local authorities of this, and you kept your residency where you were before.

In this case, you don't need a police certificate for visiting that country, the local authorities will not have knowledge of your existence.

Congrats! How did you change your address?  I have been trying to change my address and it is nearly impossible.  The call center does not have a person there to answer questions or to change your address.  I cannot ask for the AR 11 because there is a very good chance it wouldn't reach us. 




hey there i called the uscis 1800 number because i was unable to change my address online (my previous add was foreign and it wouldnt let me put the full zip code or submit without a state). When you call they actually give a change of address option, but you will end up on hold a long time because they will have the same problem. Once you finally talk to someone they will change it no problem.....

I am so bummed it looka like if we had filed a little later we would have gotten an autoexpedite. I am stuck at nebraska, and my priority date is feb 12th. Three months and counting waiting for noa2.

Hi everyone:

  We just got GUZ number on 28th April, after i log in the payment portal, i find a small mistake there, the petitioner's name should be STEPHEN,but they typed it as STEPHEB~~ We sent an email to NVC on April 30th, but no reply, so i called NVC on May 2nd, the operator told me that they were dealing email of April 3rd, so we have to wait~~

 so can anyone tell me that if this mistake will slow us down?

what's worse, i am a member of chinese communist party, it will takes long time for additional processing after interview :cry:  i tried to quit ccp, but was threatened to lose job, i will quit after i am issued a visa, so i have to prepare to wait for a long time :cry2:

 the payment status is like this:(you can see from the picture i attached)

  Affidavit of Support (AOS) Fees:   Not Paid   Pay

 

we can click the pay button now, so does this mean that we got AOS invoice and we can enroll to EP?

i am confused ,  hope someone can guide us, thank you in advance!
