IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 preparation questions (split topic)

TeaCup/All,

I was wondering about one thing with the G-325A.  For the section of my parents info.  on the last field, it requests City and Country of Residence.  Since both of my parents passed away, should I just put Deceased?  Or should I put Deceased and the previous state and country ?

it looks like from reading the instructions of the I-130, it looks like the best answer is to put N/A (and maybe i'll add the deceased next to it?)

thanks again guys.

All you need to write is  "deceased" for that field.  DO NOT write N/A.

For your pictures, did you also dated them and added your own description of the photo?  such as Date, Time, place/location, with (names of people) friends or family?

Yes

Ryan, in another post you sent on a different thread, where you mentioned we could translate chats, certificates, any supportive evidence by ourselves if we're fluent in those languages right?

Another question is, do we just need one page stating that we certify ourselves as the translator, or do we have to put this certification on each paper that requires translation?

Attestation statements need to accompany item, but they are not needed for every page.  For example, if a certificate was two pages, only one attestation statement is needed.

There is no rule that I know of that says you can't do the translations yourself if you are fluent in the language.  One notable exception that I was made aware of is USCIS is specifically requiring translations of Chinese documents be done by a Chinese Notary Office.

Also, it is not necessary to translate evidence items such as chats, emails, personal letters etc.  If you want to do that, you can.

Just paperclip things together and use large binder clips for the package.  Don't bother with manila folders, prong fasteners, or tabs/flags.  Those are only going to be removed and thrown out.

Size of the package does not matter, it's the quality of evidence that you enclosed (FWIW, my I-130 package was nearly 5cm high).

I submitted the file using USPS Priority Mail.

Greetings,

The requirement of chat logs and phone calls or instant messaging are not mandatory. If your marriage is legal and real, than you don't have to worry about sending in your chat logs or video logs and even phone/text logs.

Simple way to proof your marriage is through
- Marriage Certificate registered with your local government where you got married
- 2-4 Affidavits, 2 Affidavit of your self asserting that your of legal age to marry and are joining in marriage with ____ your partner at free will
- Marriage/Reception pictures, with description of what is it you are showing, Don't send them a 40 page album, few are fine, that shows the couple, couple with relatives, friends, gifts, than 3-4 pictures from a vacation or a dinner you guys attended,
- Passport Entry and Exit stamp
- Copy of your tickets
- And if possibly you got pregnant than that's something they can't deny. If you have a doctors report  that shows you got pregnant during the time of your stay and after marriage they won't have anything else to question about your marriage and eliminates the requirement sending in pictures, but you should still send like a minimum of 10.

If you have further questions, don't hesitate to ask.

Thanks Ahsan.  Why would you need the legal age affidavit? If you're sending in your Birth Certificate.

2 Affidavit of your self asserting that your of legal age to marry and are joining in marriage with ____ your partner at free will

For the affidavits, will just a few sentence be okay and then have it notarized?

You mentioned that the chat logs etc are not mandatory, but it can only help right?  Yes, our marriage is legal and real.  We married here in the states, she entered with her C1D visa (Crew visa) and she's been back to work as usual (she's a flight attendant).  We had our reception in Vietnam just last month.  So that's why I'm very thankful for the support from you guys and all of VJ.  I want to kick off my CR1 request as soon as I can.  Although I am very fortunate to see my wife, but one day with her every now and then just isn't enough.  Thank goodness for Skype and all the technology out there to help us communicate and see each other.

Thanks again for your advice

My husband worked n his C1/D right up until the IR1(CR1) visa was put in his passport... Then he worked using the I551 stamp (given upon entry to the USA) until his GC arrived so no worries... It is not cancelled until another visa is issued.

~~Moderator hat off~~

Regarding the part of the post in bold and red above, CBP is no longer placing special I-551 stamps in passports of immigrant visa holders.  Instead, CPB places a standard entry stamp on the page next to the visa itself (the endorsement).  It is a combination of the visa endorsed by an entry stamp that acts as a temporary green card until the actual card arrives.

  • Thailand is on the brink of civil war and under marshal law now. I am thinking about writing a letter to my representative asking to expedite her visa so that she can be here before the war starts.

Your representative has no say in expediting a petition or visa application.  Those decisions rest solely with USCIS and the State Department respectively.

For starters, you would be filing a petition, not an application.

If you find a job in China, don't withdraw the petition. It can sit at the NVC for one year with no action. Another option is to file the petition at a USCIS field office in China (DCF). Filing this way moves way quicker than petitions filed stateside. When filing DCF, there are domicile and sponsorship issues that you will need to address.

It is possible for your wife to apply for a tourist visa; however, the odds of her being granted one are next to nil.

If the file is at the NVC, you can stall it there. The NVC keeps files active for one year from the date of any contact.

You can keep contacting the NVC at various times to keep pushing the 1 year click back until you are ready to proceed.
