Regarding your husband staying with you in Canada the entire time; you need to look through the pinned thread in the Canada regional forum titled "Proving Domicile When Not Living In The US."  The Consulate in Montreal is very strict in how they define the petitioner having a US domicile.  The Canada regional forum can be found here:  http://www.visajourn...orum/93-canada/

 

The USCIS customer service line is called the misinformation line on VJ for a reason, they often give out inaccurate information.  Your husband's Canadian income will only be accepted if it will continue uninterrupted from the same source (i.e. a company transfer from Canada to the US).  Otherwise, his Canadian income will be disallowed and a joint sponsor or sufficient assets will be required.

Two things you can do:

  • His sister can write the check for the appropriate amount and you can use that check to pay the fee.  USCIS will not care where the check came from or who wrote it; they only care that the fee is correct and that the check will clear.
  • You can open the USA checking account with RBC and you don't have to wait for personal checks to arrive.  You can obtain a cashier's check from the bank that is drawn on your US account for the correct fee amount.

Even if you don't meet the financial requirement to be a sponsor on your own, you are still considered the primary sponsor and will be required to complete an I-864.

 

Since you don't meet the requirement, you can only have ONE qualifying joint sponsor who must also complete an I-864.

when do I need to send pictures, I am IR-1 petitioner. Is it along with IV package?


What stage of the process are you in? Are you about to send the I-130 or is your file at the NVC?

If you were not required to file taxes, then the explanation letter is sufficient. Since your dad is not filling out any forms, his taxes are irrelevant to your case.

Well it is incorrect. Apple21 is right. The NVC schedules all CR1 interviews. All you can do is wait... and sometimes they are just waiting to hear from the embassies of any available dates.

Hello everyone , so as the title says i'm only posting this thread to have some answers for my questions : 

 

 Nvc received my papers and all the fees are paid also i completed ds 261 online so everything is fixed but my question is :

 

When they asked for my papers ( criminal record and marriage certificate .....) i send them all the original papers bcz i was confused of different answers from people..

 

So anyway i just want to know ;

 

--- How long the processing will take ?

--- do i have to make the papers again when my interview is set up ? or i only need the photocopy?

--- does the NVC send originals to the embassy or not ?

 

Thank u those are my questions i hope you guys help me  with your experiences

For pictures, only select pictures where both of you are in the same frame and can be recognized (Avoid hats, big sunglasses, bad exposure (too light, too dark), ...)

If postcards don't mention both your names, they are not useful. If you have envelopes sent to "Mr & Mrs Beautifulbeach", those are good

For plane tickets, only use boarding passes

You might also look into facebook messages, e-mails and so on.

    we just got our joint sponsor's IRS transcript, but it's surprised to know that her total income on the transcript is only $9,607, doesn't reach the poverty guideline, but she has much assets ans bonds, can she still be our joint sponsor?(she is 84 years old)

As long as your father can show that he meets the poverty guidelines for his family size which includes himself and your husband and you can show proof to the USCIS as to why you were not required to file an income tax return--i.e. no income and a spouse that is a non-resident.  Just remember that as a USC your are required to FILE a US tax return based on all world-wide income. Whether you have to pay taxes is another matter, but the USCIS expects you to have filed a tax return or show using the IRS tax laws why you do not need to file--this is typically under the "Who must file a tax return" section on the IRS website.

 

If your father makes over $30K per year he can be a joint sponsor if you meet all the qualifications.  If not, than he can be a co-sponsor.  Look over the I-864 form for the differences.

Mostly correct except the part about showing USCIS about the tax filing requirement.  It's the Embassy in Islamabad that the OP will have to satisfy.  USCIS is not involved in the decision making process regarding an Affidavit of Support in a spouse visa case.

For starters, your husband submitted a petition, not an application.

Right now, you wait until you receive a decision notice. Plan on waiting no less than 6 months at this juncture (that may change).

If the petition is approved, it will go the NVC. Study the wiki i linked to below and when the time comes, you will be rays to deal with the NVC.
