Yes, it is possible. He has been issued a visa because he is the Spouse of an American Citizen. What you get after your interview is your visa number to go along with that visa. He has a visa ready in his name but cannot travel to the US yet because he does not have the visa number and it is not yet stamped in his passport. This info came directly from USCIS.

 

USCIS doesn't issue visas, the task of adjudicating an actual visa application and deciding on whether or not to issue a visa is the exclusive purview of the State Department's Bureau of Consular Affairs (i.e. a Consular Officer at an Embassy or Consulate).  Since you stated your information came from an agency that does not issue visas to begin with, I stand by my original statement.

1.       Do I need to get some confirmation from USCIS that her I130 was filed on times, before I reapply and ask for consular processing?

2.       Other than a new I-130 and the supporting documents we sent last time, What additional forms do I need to submit for her and how do I ask for consular processing at AIT (US Taiwan, out-sourced consulate) ?

3.       I?m undergoing cancer treatment but want to join my wife in Taiwan ASAP, what complications might travelling cause a new I130 application?

  2. Nothing, on question #22 of the I-130, leave the left two lines blank and write "American Institute in Taiwan" and Taipei on the right two lines.  Fill out all forms with her foreign address.  There are no special forms to fill out to request to have the file sent abroad.
  3. None (you will have show that you are maintaining a US Domicile, but that doesn't come until the NVC phase; also, the I-130 is a petition form, not an application form)

In addition to the date on an updated I-864 needing to be the date it is actually signed, the case number does not need to be written on the upper right corner of the page, that is merely a suggestion by the NVC, not a requirement.

 

If you choose to write the case number on all the pages on an I-864 package that is being submitted at interview time, it will not be rejected for this purpose alone.

The Embassy does have the discretion to ask for police clearances issued no later than 6 months prior to the interview date.  I can't speak to whether or not a CO will exercise that discretion in your case; you may want to have updates clearances available should a CO decide to exercise this discretion.

If they don't accept the LCR copy, then they will issue an RFE for the NSO copy.  Sending the NSO copy at this juncture will likely be an exercise in futility because it's highly unlikely that it would be matched with the file.

A joint sponsor will likely be required.  Affidavit of Support paperwork is not filed at the same time as the petition and sponsorship requirements do not come into play until after the petition has been approved.  The I-130 can be filed when ready and your husband can work on finding someone who is willing to be a joint sponsor while waiting for the petition to be approved.

Circumstances change all the time, I received a pay raise between the time i submitted the I-864 to the NVC and the time my wife was interviewed so i just brought a new form to reflect this. I'll speculate that it took a CO a few minutes to look it over to ensure it was properly completed and that I met the qualification; there were no delays associated with this.

Remember, the NVC is not the decision maker on whether or not an I-864 is accepted, the CO is.

Hello? Any one one have any advise on what I would need to do if I filed all my papers with the NVC and left for India after acceptance. I will ensure that i am above poverty line for the year 2014. Do I have to do anything special? Can i just be coy and not mention anything to the CO? Waiting for your resposnes, fellas. 

 

No, you cannot be coy as that amounts to Material Misrepresentation, if the circumstances on your I-864 change from the time it is submitted to the NVC to the time of the interview, then you will have to submit a new I-864 at interview time.  Also, it will be highly unlikely that you will see a CO since it's your spouse they would be interviewing.

Yes if you there at visa interview it helps. My cousin went for interview at bombay and agent ask her about something weird and she said my husband is sitting outside (visiting from USA) can I get him to answer your question. No question asked after that. He just stamped the visa.

I see that in 2010 you switched from K-1 to CR-1.

 

That's kind of a long story and it's not relevant to your case.  I will say that the switch occurred before any paperwork was filed and fees were paid.

 

From what you know, would you recommend that we go the K-1 or the CR-1 route?
We debated taking the K-1 route for a long time because it could possibly be quicker to get.
But we recently decided to go for CR-1 because it doesn't seem to take much longer than K-1.
BTW, my wife is in Japan and we are petitioning with I-130.
Any suggestions?




Are you living in Japan right now, if so I would recommend you go the CR-1 route.  Here's why, right now, if a petitioner is living abroad when they file all the paperwork using foreign addresses, the file enters a queue where it will be automatically expedited (USCIS will deny such a queue exists).  You may have a decision on your petition within weeks of it being received by USCIS.  The NVC might be somewhat of a slow go at this time due to volume (and you can't control things on the NVC end); however, if you study up on that phase of the process and know what you need to submit when the time comes, then you get to the end of that phase of the process sooner and have an interview scheduled.

YES; your child will be able to get a US Passport, you apply for it when you file for a Consular Report of Birth Abroad (CRBA). BTW, it's your marriage certificate that indicates the citizenship, not marriage license.
 

Would anyone also happen to know the answer to the following:
 
I recently entered Japan as a foreigner on a student visa (with my US passport), but while I was here I obtained a dual Japanese citizenship based on my father's Japanese nationality (mind you dual-citizenship is technically not recognized in Japan, but I and many others have both anyway).
My question is, will I be able to leave Japan on my US passport without any problems? Does Japan have a right to deny my departure? I don't have a Japanese passport because I don't have enough time to apply for it.

And to avoid separation from your wife, you could always do DCF (direct consular filing) at the Dublin embassy, Generally this only takes 3 to 4 months.

 

There is no USCIS field office in Ireland so DCF will not be an option.

 

DCF is only possible in countries that have a USCIS field office, the list of international field offices is linked below.  If a country is not on that list, then DCF is not an option.

Yes, you correctly sent the original documentation to the NVC.  The Consulate will have these documents when they receive the file from the NVC so there is no need to bring them to the interview.

Once your case reach nvc she can submit her name change request. She should get a new passport with her new last name.

 

The OP is the beneficiary, his wife is the USC petitioner and would not be submitting any name change request to the NVC.  Her obtaining a new passport is completely irrelevant to the case.
