A birth certificate shouldn't expire, if you have already obtained and submitted yours to the NVC, then it should be sufficient.

 

CO's have the discretion to ask for documents that were issued no less than 6 months prior to the interview.  It may not be a bad idea to have an updated police record ready for submission.

When you say application, are you speaking of the DS-260? If you are referring to the I-130, that is not an application form (it's a petition form)..

You can use your married name on the DS-260 if you wish but your passport will also need to have your married name? If you have already submitted the DS-260 with your maiden name and want to change it, you can do so at the interview provided you have the updated passport as I previously stated.

Whatever the circumstances are on the date the petition is filed is how it should be answered. Having a US Citizen spouse (regardless if a petition has been filed or not) drastically reduces the chance of any tourist visa being granted.

If you get a tourist visa (or any other type for that matter), you can submit an updated application and new cover letter to USCIS to explain.


To very problematic items with the above:
  • Submitting a new I-130 just to update that section is completely and wholly unnecessary. Doing so would only cause problems that would not have otherwise existed.
  • The I-130 is a petition form, not an application form.

I want to expand on the above statement to avoid misunderstandings.  Having a lawyer at the NVC phase means both bills will be invoiced at the same time and the need for the DS-261 is negated.  However, a lawyer cannot make the actual processing of files at the NVC go any faster.

You do not need to send wedding photos. Those are for the interview where they may ask you questions about persons other than you and your spouse who are in the pictures.

 

OP, while this is technically true, I've seen it posted many times over how people save evidence such as pictures for the interview and try to pass it to the CO only to have the CO immediately pass it back without so much as a glance.  While such items should be brought to the interview, even if they are included in the petition, it does not hurt to include them at the outset.  Furthermore, including them at the outset makes them part of the file that is reviewed prior to an interview taking place.  Ultimately, it is your choice.  Since it was brought up through reference to the instructions, USCIS and the Embassy/Consulate will not expect a couple living apart in separate countries to have joint finances, joint leases, or own property together.

OP, I've lined out the items in the list below that you will absolutely not need when you submit your petition and made some minor corrections regarding semantics.

 

These are the documents we sent with our I130 package. We got approved on 09/02/2014 from CSC.

 

  1. Application filing fee -420$
  2. Form G-1145(e-Notification of Application)
  3. Form I-130
  4. Evidence of my US permanent residential status (Green Card)
  5. Form G-325A completed and signed by the petitioner (me name removed - VJ Moderation)
  6. Two passport size photographs of name removed - VJ Moderation, replacing name with beneficiary
  7. Form G-325A completed and signed by the beneficiary (my wife name removed - VJ Moderation)
  8. Two passport size photographs of name removed - VJ Moderation, replacing name with beneficiary
  9. Copy of our marriage certificate
  10. Copy of beneficiary passport
  11. Copy of beneficiary birth certificate
  12. Copy of affidavit of change of name of my wife after marriage

OP, to answer your question about how much is needed.  My opinion is that each individual themselves has to decide based on the evidence they have what they feel makes the most compelling case.  However you choose to do that, focus on quality over quantity.

 

My two cents regarding your specific list is listed below your evidence list:

 

-All flight itineraries,

-Many flight boarding passes,

-Many hotel and camping receipts and reservations (with only the name of either one or the other of us in it)

-All passport stamps

-Some few pictures of both together (maybe around 10) and pictures of each of us in the same location but not the same picture.

-Tickets of things we did, places we ate, etc.. but this things don't have our names on it.

 

  • Flight itineraries show nothing other than making arrangements, skip them
  • Boarding passes show you actually took the trip.  Furthermore, if you took trips together, boarding passes show evidence of travel together.
  • Receipts are good but don't go overboard.
  • Passport stamps are good, they show you entered the country.  If you wish, you can use them in lieu of boarding passes.
  • Don't submit multiple pictures of you in the same location.
  • Tickets from things you did are good because it is evidence of time in the country and time spent together in-person.

 

Also, since the beneficiary is from Spain, there are not many cases of immigration fraud from there (i.e. low fraud country) so there may not be a need to include a pile of evidence compared to someone who is going through Nigeria or Morocco.  With all that being said, I go back to what I said before, put together a package you feel makes the most compelling case.

  1. G-1145 if submitting is first with the fee payment paper clipped to it.  Then the cover letter, followed by the forms themselves, followed by required documentation, and finally followed by the evidence.  The evidence can be in any order you wish.

  3. Large USPS envelope from the Post Office.

All 'packages' are sent by you to them - the only thing that comes to you in the mail are just snail mail are just confirmations that they have received your packages, issued case numbers, and the dreaded checklist (lets hope not) BUT you can confirm all of that through e-mail & telephone support so it's not important per se -- Just for your records.

 

The NVC doesn't send confirmations that they received packages and if they have a valid email address on record, they will send the checklist visa email (if one is issued).

Another question as I am compiling the I-130. . . Will NVC be sending forms via e-mail? I highly doubt I will be able to receive any snail mail on this side due to the dismal postal system. . . I read somewhere else that there was a way to contact the NVC to ask them to send me everything electronically, but can't find the post anymore. Would it be acceptable to write on my cover letter that I prefer correspondence via e-mail and can I give them my parent's address in the States should they need to mail anything?????? 

 

You can print the forms from the website, they will not email them.  Once you have your case number, call them to ensure they have your email address on record for any correspondence.

 

While some of the forms will be submitted online, other forms and all accompanying documentation will have to be mailed to the NVC.
