You can go with both. It is an option to continue with the CR1 after receiving the K3 instead of doing Adjustment of Status. But most people do not do this, because you have to have the interview at the embassy. If you pay the IV bill and later decide to do the AOS because you do not want to return to the embassy, you will loose that money.

But if you are in his country now, and plan on being there for a couple of more months, I would continue with both.

Ok, first of all nothing was changed. Both your I-129F and I-130 were forwarded to the NVC. You have done what you need for the K3, and just waiting for your interview date. But at the same time, you could follow the process for the CR1. If you are with your husband now and can spend a couple more months there I would sugest that you do that. You can get through the NVC in about 4 to 6 weeks and enter the US as a permenant resident.

Since you are just waiting on the interview for the K3, I would still go to the interview and get the K3, just in case something gets held up at the NVC with the CR1. This is exactly what me and my wife are doing.

No, you do not need to worry about faxing anything. You can do everything online. You can pay yhe bills and print the coversheets and everything. You will need to call the NVC and get the INN number.

Yes, I know it is not easy, but you just need to wait a few days.

I called this morning and the automated response says that they have received my packet ,DS-230, and there are items incorrect or missing. When I talked to the NVC operator, she informed me that they do have my packet but have not reviewed it yet. This is why it is saying that I have something missing. She said until they complete the review of my packet, it will say that something is missing.

That is correct. They will not send you specific papers for your case. They only send out a form letter telling you to send in your documents.

If you do get an RFE, I received mine 4 days after the RFE, and sent everything in the next day that I received the letter.

I don't want to scare you, but I have heard horror stories of paperwork getting to China. I hear it can take a very long time.

But if the embassy in Sweeden already has your paperwork, it should not take 8-12 weeks.

I sent my package to a girlfriend in LA and she drew a cheque from her account and forwarded on for me. So it wasn't sent from abroad in my case.

Do you know anyone in the US or have family that can send it for you? I also attached an extensive cover letter explaining our situation.

Hey thanks for writing back . was going to use mother inlaw in the US to do excactly that but i end up sending from here and getting a USD check drawn here from Westpac as advised by the Sydney office of the US consular. I sent my app 16 days ago but havent heard anything yet and check hasnt been cashed so im WORRIED!!! most people have had a NOA1 within a week. so not sure what to do now.

I agree lemayz, I am in a similar situation. We won't go untill we are approved. We won't look for jobs until approval either. We are just trying to build proof or re-establishing domicile. Voter registration for my USC husband, ordering new SSN card for him, enrolling kids into school etc. I saw a post on here somewhere of someone in a similar situation, they suggested getting quotes from moving companies. It seemed to work for them. I am interested to hear the thoughts and ideas of others in this area. It would be nice to have a dedicated group for USC filing abroad - like the country groups. Can that be done?

Hi all fellow visa journeyers, we were recently approved! Now for the NVC process...

 

1. Country USC resides in: Japan (until May 1st, now USA). Husband is French.
2. Is there a USCIS field office in this country / Is DCF still possible? No
3. When did you file the I-130: November 2013
4. How long had you been living abroad: 2.5 years
5. Do you reside in the country legally? Yes
6. What is the reason for your residence: work permit/ ESL teacher.
7. Did you list your foreign address on all forms in I-130 package? Yes
8. Did you send I-130 package from abroad? Yes
9. Did you include evidence of your residence abroad in the I-130 package? Yes. We provided our lease -both names included on it, as well as many other things.
10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? Yes, I also included the fact that I would be moving back to the states in late April 2014.
11. Has your case been "auto-expedited"? How long between NOA1 and NOA2? No, 177 days from NOA1 to NOA2. I changed my address officially on May 1st, received acceptance of this change May 5th, then received approval of my husbands petition May 8th. We went through Nebraska Service Center.

To get the semantics out of the way first, you did not send a CR-1 application, you sent a petition.  The beneficiary of said petition actually applies for a CR-1 visa.

 

To answer your question, it appears that agency was of little use to you.  Evidence of relationship can go beyond items such as joint property, accounts, etc.  For starters, USCIS (as well as the Consulate) will not expect or require a couple living apart in separate countries to have joint finances, own property together.  Evidence such as pictures, shared travel, emails, phone records, etc. etc. can cover this ground.

 

There is no point in sending it in now because sending anything unsolicited at this juncture is usually nothing more than an exercise in futility because its unlikely such items will be matched with the file.

 

If USCIS wants more, they will issue an RFE.  If your petition is approved without an RFE you have two choices.

  • If you want such items to be part of the file before an interview takes place, include these items in the visa application package that is sent to the NVC.
  • If you don't include such items with the application package that goes to the NVC, then bring it to the interview.

 

With all that being said, Canada is on the low end of visa fraud cases which means it isn't necessary to include piles of evidence with or file.

we are processing our CR1 Visa. My USC wife and family were also planning to get letters from local congressman to expedite the case.

 

But as we are consulting immigration Lawyer, our lawyer said its not advisable to get them pushing in initial stage (that's where we are right now) but if the case gets stuck at NVC, then the letter from these congressman will help to expedite. And also having a copy of those letter can be great for visa interview.

 

Good luck  

 

Expedites don't carry over from one phase to the next so the lawyer who said "it's not advisable" doesn't really know what they are talking about.

 

Such letters will not have any effect on the outcome of a visa interview.

Lastly if I may ask, how much is the immigrant visa fee for CR1 i.e.the fee paid at the embassy on the day of the interview? I have been trying to look it up but nothing has come up yet.

 

If the file went through the NVC, then there is no fee to pay at the interview (unless the interview takes place on or after December 11th).  If the file was first filed at the USCIS field office in Accra, and the interview is on or after September 12th, then the fee is $325.

For myself, if I am doing this right, I have to fill out an i-864 for my joint sponsor and one for my petitioner ( he is unemployed currently.) I have also filled out ds-261.

 

Strictly speaking, the petitioner and joint sponsor fill out the I-864, not you.  You can fill out those forms if they provide you with all the relevant information; however, even if you fill out the forms for them, they still have to sign them and understand just what it is they're singing.
