If the Consulate has the file (your first post indicates they do), then you go to that site and schedule an interview when:

  • A) The 2 year HRR is met.
  • B) The first date available that you can see

 

In addition, you will also need to use that site to designate where the passport will be picked up.

Hey guys need help. I just sent out my husband's I-130 application a little over a week ago. He has an 11 year old daughter which he would like to bring with him. I put her on the application but wasn't aware that i had to fill out a separate application for her. How do  I go about it?

There is one more thing and it's only a matter of semantics.  The I-130 is a petition form, not an application form.  You already filed a petition for your husband and you are about to file a petition for your step-daughter.

1. From my understanding the OP will need to have his brother use the i-864a because he is the OP's sibling and lives in the same household. Am I not understanding this correctly? Here is the instruction sheet. http://www.uscis.gov...i-864ainstr.pdf

 

You are misinterpreting the instructions on two levels:

  • The I-864A is for combining income, the OP has no income to combine with their brother.
  • You are not required to combine income just because you live under the same roof.

OP, this is the correct way to go about it:

  • You fill out an I-864
  • Your brother as a joint sponsor fills out an I-864

It's not a big deal, circumstances change all the time and they do so without adversely affecting the visa process.

Answers:

  • Changing jobs is not a big deal.
  • Your household size would be viewed as you and your husband (2).
  • If your father agrees to act as a joint sponsor, they will look at his income.  His household size would be as follows, him, your mother, your husband (3).
  • Your father can combine income with anyone living in the house.  I don't know if Social Security disability is allowable or not.  If your father chooses to combine income with your brother, his household count goes up to 4.
  • Up to you if you want to see if another family member who does not live in the same house is willing to act as a joint sponsor.

Answers:

  • Snail mailing packets is a thing of the past if they have email addresses on record.
  • They won't email you the forms.  The DS-260 and DS-261 are forms that are completed and submitted exclusively online.  You will have to go to the website on your own and download the I-864.
  • Original and photocopy of the civil documents are required.  Accompanying documentation for the I-864 can (and should) be photocopies.
  • If you want to include any additional relationship evidence with the visa application, photocopies are fine.

DCF is only possible if you reside in a country where it is available.  If it's not available in the country you reside in, then it's not an available path to you.

Everybody correct me if I'm wrong, but I don't think you need proof of ties to the U.S. for the I-130 package. That comes later, when you have to give proof of domicile to your embassy.


Domicile is dealt with when submitting the Affidavit of Support package (I-864), not when submitting the I-130.

We did not know exedited processing was available so we did not request it. Our I-130 petition was approved in 5 days (NOA1 to NOA2).


You wouldn't have requested expedited processing. There appears to be a trend at USCIS to quickly process petitions (without any request made) filed by US Citizens who live abroad and DCF is unavailable in the country the petitioner lives in. Your case (5 days from NOA1 to NOA2) is another example of this trend.

Do I submit the "No Cirminal Record Letter" from Mexico to NVC or do I just take it to CD Juarez Interview just in case they want it?

 

Police records are considered unavailable for Mexico per the Country Reciprocity Schedule.  You don't need to send this letter to the NVC and you don't have to bring it to the interview.

I have a question. 
 
My husband and I are taking a trip to the States in December for a visit only, for which he is applying for a tourist visa. When (if) he is approved for the tourist visa, I understand this lasts for 10 years. We want to move to the States next year. Would he be able to come into the States next year on his active tourist visa but then file all the paperwork for the spousal visa IN the United States (to avoid consular filing) and get his status adjusted there, or is that illegal?

Absolutely not, that would be visa fraud which is illegal. If you are planning to move to the US next year, then I suggest starting the spousal visa paperwork now.

I spoke with my attorney about this very subject just a few weeks ago and she told me that my husband cannot visit me here in the states while our application is in process. Maybe it's because he is in Nigeria, I am not sure, but everything I have researched says no, as well. This process is so difficult that it would be terrific if he could visit me, because I have a new job and I can't take time off since I am so new.

 

Regarding the statement in bold, that attorney is dead wrong, the beneficiary of an I-130 petition can visit IF they are able to obtain a visa or are a citizen of a VWP country.  With that being said, the chances of a Nigerian citizen who is the beneficiary of an I-130 petition being granted a tourist visa while that petition is pending are nil.

/Sigh. Is there any option for non VWP countries? My husband is Israeli...looks like he can't even visit. We submitted the I-130/CR-1 over 5 months ago and he won't get his visa for another year. This is really heartbreaking.

 

If you want to visit each other in the US during the process, he will need a tourist visa.  If he is not issued one (and the chances that he would be are slim at best) then you will either have to meet in a 3rd country where you are both able to enter or you will have to travel to Israel.

Can I enter the US on a C/1D visa while my I-130 is pending? I should mention that My reason for entry is NOT to adjust status or stay in the US, I strictly intend to board my ship and go to work!

 

You can use the crew visa while the petition is pending; the decision on whether or not you are ultimately admitted rests with CBP.

I entered on a VWP got married filed for my I-130 then left America before my 90 days was up. My VWP does not expire until June 2015 however I miss my husband and want to visit, can I apply for a 6 month visit visa instead of using my VWP so that I can stay with him for longer? Or will this raise suspicions about my intent to return to the UK?

 

You can apply; however, the visa will likely be denied and you would lose VWP privileges.

Has anyone been denied entry?  Does anyone know if this will hurt or delay the CR-1 process?  I will be getting married in about a month in Japan, and my wife and I would like to plan a trip for her to come here this summer, but we don't want to jeopardize the process in case she gets turned back.  As a precaution, we are considering having her fly into Canada and then cross into the US via Canada.  In case she gets turned back, she can stay in Canada and I can stay with her there (I am only about 30 mins from the border).

 

Being denied entry will have no bearing on the CR-1 process.  However, it will have to be disclosed when it is asked about on forms.

Could you go in on a student visa while waiting for the I-130? I assume yes, but I wanna double check.

 

Even with a sponsoring school, there is no guarantee a student visa would be granted as they are also subjected to presumption of immigrant intent and strong ties to country are needed to overcome.

Try having her forward the email to you and then you forward it to NVC. I got an autoresponse when it was sent from my email. I don't know why that made a difference but it did.

Yes. It is about 1-2 minutes later. This shows you that they have received your email but it takes up to 2 weeks for them to accept the email. I am still waiting for the acceptance. Good luck
