My (US citizen) husband and I want to move to the US so I've just begun to look into how to get a visa.  I've found a lot of the available information quite confusing, but this site seems to have answered lot of my questions - thank you!

 

Can someone let me know if I have this right please:

 

Step 1 - Send I-130 to the US, with supporting documents as listed in the I-130 guide on this site

Step 2 - Wait for that to be approved, then await contact from the Sydney consulate After the I-130 is approved, you will need to obtain a case number from the NVC.  Familiarize yourself with that process by reading this:  http://www.visajourn...php/NVC_Process

Step 3 - Attend interview in Sydney after obtaining police checks and medical check, and take along lots of supporting documents, including the affidavit of support (or should that be filed with the I-130?)  The Affidavit of Support goes to the NVC, not with the I-130.

 

It seems that this process can take up to a year, sometimes more.  Is that right?!  We were hoping to move in the first half of next year, so it would be really disappointing if it took that long.  Other than getting the documents right, is there any way to speed this up?  Also I've seen reference in some places to a K1 visa, but I gather the processing times for that can be equally long so there's little point.

Since the petitioner is living abroad, the petition may enter the auto-expedite queue if it is sent to the service center in California.  USCIS will deny such a queue exists and there is no guarantee your petition will end up in this queue.

 

Finally, in terms of documents evidencing our marriage is genuine, would the following be sufficient or should we get more (e.g. affidavits from those who know us)?

Affidavits carry little to zero weight in the overall evaluation of a file.  Skip them if you have plenty of other evidence.

 

1) Marriage certificate

2) Birth certificates of our two children

3) Copy of our lease showing it's in joint names

4) Copies of bank account statements going back 5 years showing joint accounts

 

Any other tips or hints most welcome and appreciated!

 

 

Just to correct one thing the previous poster said and it's only a matter of semantics, an I-130 is a petition form, not an application form.

As a matter of semantics, an I-130 petition is not something that is "applied for," it is something that is "filed."

Yeah, I do tend to over-think things, but for something this important, I believe I prefer over-thinking to under-thinking... :)

 

FWIW, the very nature of this process lends itself to paranoia, over-thinking, and second guessing (was guilty of all 3 when I was in your shoes).

Priority Date is irrelevant if the petitioner is a US Citizen.

Will that be a problem when the times comes I get interviewed by the CO? I believe that the marriage record/certificate will be reviewed and I heard that the address will be indicated there.. I feel stupid now for giving my sister's address because ever since I came back this year I started staying at my husband's place.

 

Is there anything I can do to correct this? 

 

Also, do you think we have a red flag?

 

1. I am 29 he is 33

2. We have been together (including dating days) 1 year and 5 months and then got married

3. He didn't visit me yet as he couldn't get out of work as he and his dad owns a business. But now, during the process of the application and since it'll be so long before I can be with him, he will be visiting me in my country.

 

I see no issues with any of the above.

I agree with NLR, receipts for engagement and wedding rings are nothing more than fluff pieces.  They only show you went to a store and bought them, they don't show any evidence about your relationship.

 

Your strongest evidence is evidence of time spent together in-person, focus more on that and less on things that are meaningless.

From the way I'm reading the link, it is simply stating that the DS-260 must be completed and submitted prior to the interview date.  If it is not done, then the interview would have to be rescheduled.

 

OP, if you have submitted the DS-260 and have confirmation of submission, then you should be good to go.

The standard response the NVC is giving is 60 days.  It may take that long, it may take longer, or it may not take that long.  With the volume of files that the NVC is currently working with, expect that will take as long as they say if not longer and count your blessings if it doesn't.

I misunderstood question 22 of form I-130 and put "N/A" in there, instead of the consulate's city and country where I will have my interview.

 -> ("If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad in the American consular post in:" )

 

When I found out about my mistake, I thought they'd either send me a RFE or they would  approve my petition (status update "Decision") and then send me a letter asking about my consulate.

 

Now I got approved yesterday and my status says "Post Decision Activity".

Can I safely assume my mistake didn't play a role and they send it off to the NVC?

 

Or should I be proactive and inform them about my consulate?

Disregard the previous post, it's incorrect.

 

Allow at least week for the file to be sent to the NVC, then call USCIS to see if it has been sent.  If they answer that it has been sent, then start calling the NVC to see if it has been received and to see if a case number has been assigned.

 

NVC will usually go off the address of the beneficiary that is listed on the form.  While you technically answered that question incorrectly, it is a mistake that is often overlooked.

An I-129 is a petition form that is filed by employers for non-immigrant workers.  The fiancee visa process is started by filing an I-129F petition form.

Since you were the beneficiary of the previous I-130, you don't withdraw it, only the petitioner can do that.  USCIS won't speak to beneficiaries so you will probably not be able to determine the fate of that petition.

 

You also won't file the I-130, your wife does that, an I-485 will be filed along with the I-130 to start the Adjustment of Status process.

I'm surprised that the national visa center, the department issuing Visas, is not aware of the visas they issue. 

 

The actual issuing of a visa is not done by the NVC, visas are only issued by and at Embassies and Consulates overseas.

 

The purpose of the NVC is to assign case numbers and to function as an intake center for documentation for petition based cases prior to a visa interview taking place.

How will NVC know if he has sufficient assets or not. They don't require us to send bank statement along with AOS. And will they know that my sponsor's work is discontinued? I am sure he will find a new job but it might take a while it depends and I am in a hurry.

The I-864 instructions spell out how to use assets to qualify, the NVC as well as the Embassy or Consulate know if it's sufficient or not because assets are clearly documented.

 

All forms and documentations submitted are subject to verification at any time.  Your joint sponsor's source of current income has discontinued, knowingly submitting an I-864 that does not reflect this fact is to knowingly submit false information and this is Material Misrepresentation.  Penalties for Material Misrepresentation are severe.

I think this is what makes USCIS deny your dad: your parents divorced, and then in 2006 they remarried. And then your Mom filed for immigration for him first back in 2006. This makes USCIS think that he remarried your mom for immigration benefits. Good luck, but I think you guys' case is weak for approval. But who knows, maybe persistence proves USCIS that this was not the case to remarry.

 

USCIS had nothing to do with the denial, it was the Consulate that denied the visa application.  USCIS approved and subsequently reaffirmed the petition.
