What you will have to comply with under IMBRA is providing certified copies of the court and police records that show the charges and disposition for your DV convictions (in your I-129F package).

 

The embassy will also provide your fiancee with the records of the conviction(s) at the interview, so she should be made aware of them in advance. I don't think you will need a waiver as you are not a multiple filer (i.e. this is your first petition for a foreign fiance).

 

You also say that you first met your fiancee 17 years ago. Have you met her in person within the last 2 years? That is a requirement for the I-129F petition to be approved.

1. If you dont live at usa permanentelly , then you arent aligible for k1. You cant send the packet from abroad.

2. You need to have recidence at usa to apply for k1.
 

 

1. You are eligible to petition for your fiance to apply for a K1 visa if you are a US citizen, regardless of where in the world you live. Loads of people send their package from abroad.

Just for your heads up, you will likely need a co-sponsor for the I-134 if you can't prove US-based income.

I'm not sure they do any research into your employment beyond what you provide them during the interview.  For instance I doubt they will call the Army to see if you are active.  Take from that what you will.

 

$8,000 in assets would count for about $1,600 when supporting a fiancee, which means he is $17, 787 short in yearly income for a two-person household.

 

Do not lie to the embassy. If you are unemployed, say so. Remember that by signing the form, you are certifying under penalty of perjury under US law that the statements you made in the form are true and correct.

Maybe someone else can chime in on whether you can include the stipend you will receive from the army as 'income'. While you have plans to look for a part-time job to bolster your income, they cannot base their decision on a plan that has not come to fruition, so, you will most likely need a co-sponsor. Your co-sponsor needs to make over 125% for his household own household + your fiancee. How to calculate household size:

 

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ

So, if your dad has 5 children and all 5 are minors, then his household size is him, his wife, his 5 kids and your fiance = 8. If his kids are over the age of majority and he doesn't claim them as dependents, then it's him, his wife and your fiance = 3.

I would also look at the reviews for your embassy to see if they accept co-sponsors for K1, as not all do.

Yes, I just broke the sentence down by clauses so it would be clearer that it doesn't matter where the US visa was refused. As long as she was refused one, the answer should be "yes". The 'port of entry' bit only applies to admission - POE doesn't issue tourist visas so it would be impossible for them to "refuse a US visa". smile.png

 

Yes, you have 30 days from the date of your previous submission to amend your new submission. After that point in time, the pre-filled information won't appear.

Okay, this thread is very confusing lol. Yeah, in most instances you can't edit the DS-160 after it's been submitted. But, there's a loophole.

 

Do you have your application ID number? How long has it been since you submitted the DS-160?

 

If you have the number, and it has been less than 30 days since you submitted the form, go to the CEAC website, and click "retrieve application". The system will prompt you to "create new application", select this, and your previous application should come up. You can submit the form again and and print a new cover page and bar code. You should submit both the previous and the new cover pages to the embassy (or bring them to the interview, whichever your consulate requires).

 

If it's been more than 30 days, I don't know the fix, sorry. If you don't have your application ID number, I think you need to be able to recall your answers to the security questions that were set at the time you registered your account.

 

 

Have you ever been refused a US visa, or been refused admission to the United States or withdrawn your application for admission at the Port of Entry - 

 

I think you are okay in this one saying NO because  the question is 'refused at the PORT OF ENTRY' which means here in the US and not in the US Embassy where the interview took place. Correct me if am wrong. Thanks. 

 

The wording is broken up like this:

(a) been refused a US visa; or

(b) been refused admission to the United States; or

© withdrawn your application for admission at the Port of Entry

 

As long as either (a) or (b) or © holds true, the answer should be "yes" - so the OP should have selected "yes" for this question since his fiance was refused a US visa.

No need to panic...it's all been sent in and out of your hands now. You have got lots of other evidence for the adjudicator to rely on - the boarding passes and hotel receipt are good ones.

I am the beneficiary and did the same as you (sent in entry stamps but no bio page), and was fine, no RFEs. Others have received RFEs in the past. It all depends on how strict your adjudicator is, and what other evidence they have to rely on.

I understand English but seriously who wrote this form lol "Name of Concern"?? Really? It took me an hour looking through forums/google search to confirm they wanted the Name of the business/company I work for. Yea I guessed it but I wanted to be certain. I've never heard that term used before.   Why didn't they use plain English!

 

OK anyway my concerns

1. from what I read in other posts if I make over the 125% of the poverty level,  I do not need to list my assets (cash/stock/real estate) Is this correct? If I leave the rest of items blank that is ok? I feel as though I am pretending or hiding something and I don't want that to be the case but also I don't want to have to provide evidence for each line it asks for. What's the official stance on this? if I do leave the savings blank will it be questionable/cause for concern that I didn't put down any savings?

 

2. On number 10 am suppose to put the beneficiaries name there even though this affidavit is for him? If I had to guess i'd put NONE but cant find clear explanation on any government website. Seems redundant to me if they want us to list the beneficiary listed in item 3. Oh and if I do have to put his name, would  the  date submitted be the date they received my fiancé petition?

 

3. number 11. He will be my husband but I don't intend to give him  "specific contributions" aka an allowance. I will of course support his room/board/food/clothing whatever expenses.  I feel if I say "don't intend" will they think I don't want to support him??? its confusing which do I mark?? I've seen some post say leave it blank or N/a and others state say something about full support indefinitely or something like that. Seriously confusing  what do I put there and which do I mark?

 

I'm a real stickler for filling out forms thoroughly so I hope you guys with experience can guide me.

You can also do up a timeline in addition to the letter of intent to marry if you like, but it's not required. Format is up to you, however you feel best presents your information. Ours was a narrative. Some people list important dates and a short description of each one.

As someone mentioned above, one way around the 310 day rule is to obtain a certificate issued by a qualified doctor showing that the divorcee isn't pregnant (section 1453, Thai Civil and Commercial Code).

 

Section 1459 goes on to say that:

 

A marriage in foreign country between Thai people or between a Thai people and a foreigner may be effected according to the form prescribed by Thai law or by the law of the country where it takes place. If the spouses desire to have the marriage registered according to Thai law, the registration shall be effected by a Thai Diplomatic or Consular Officer.

 

I read this to mean that you don't have to abide by Thai laws if the marriage is in a foreign country. You can, but you don't have to.

A naturalization certificate is for foreign nationals who are granted US citizenship. If you are a USC by birth, then you won't have one.

The passport stamps are good on their own, but I would suggest highlighting/circling the stamps on the copies to point them out to the person looking over your papers. Personally, I wouldn't include the BA confirmation email for the June trip just because it might confuse the adjudicator. Your mileage may vary. smile.png

 

Confirmation emails/reservations are not generally considered primary evidence because one can make a booking and even pay for it, but not appear in person. While, I think you'd be fine with the passport stamps + photos, do you have credit card receipts, atm withdrawal slips, showing transactions in your fiance's town/city? That is good primary evidence also.

Those documents pertaining to the beneficiary should be submitted to the embassy during the interview.

Chronologically would be best, and since you have multiple trips, it might help to put together a timeline of sorts to make things clear for the adjudicator.

You may want to front-load your package with some evidence of an on-going relationship since you'll be going through Cambodia. I wouldn't print all 23,000 messages...pick a few from every month showing that there is regular contact. Select your conversations carefully. The phone cards themselves won't prove anything but it would be good if you could get a detailed record showing that you contacted each other using those numbers.

Most consulates require the tax transcripts/returns from previous years as it helps to establish stable, consistent income. Whether it is needed will depend on the requirements of your consulate. It is ok if your past tax returns do not reflect your present job as current income generally bears more weight. You will be fine with a W2, letter from your current employer, in addition to the tax documentation.

 

If you don't have any tax information to provide because you were legally exempt from filing in previous years, then provide a written statement explaining why you were exempt (e.g. you made below the tax filing threshold).

If your jobs are new, it would be helpful to show that you have made stable, consistent income over the past few years. Even if you didn't, generally you should be fine since current income matters more than past income. If you have someone willing to co-sponsor, you could ask them to prepare their forms just in case, and bring them to the interview as a backup plan.

 

When is your fiance's interview? The more time you have between your start dates and the interview, the more paystubs you can gather. It will help build a more convincing case that you are likely to hang on to the new jobs.

If you suffer from depression/anxiety, and provide proof of this for an expedite request (i have no idea if they will approve/reject the request based on this though) you will have to answer "yes" to the question on whether you have any of these medical conditions during the exam. It will not be a hindrance to you getting the visa, especially if you have been treated/are receiving treatment.

Which instructions? The tax returns/transcripts are only required at the interview stage, together with the I-134. Most embassies require just the previous year's tax returns, some require 3 years, do a search for the information requested at the embassy your fiance(e) will be going through. You can scan in your tax documents or download them off the IRS website (takes only minutes), and email them to your fiance. The I-134 needs to be signed by hand, though, so you have to mail that to your fiance.

 

They will look at gross income, i.e. before taxes are taken out. If you have minor kids, you need to count them in your household size (regardless of where they live), as well as any other dependents you claimed on your taxes. I'm not sure how survivor's benefits works, so will leave that for someone else to answer. :)

For the record Harsh, I'm the lady in this couple. smile.png But you're right, I am within processing times. My problem didn't come from her saying there wasn't anything they could do, I fully anticipated that. The issue was with how poorly she handled the situation, and brushed the issue aside. For me to ask why there is such a delay and her to tell me she wasn't going to find out was unacceptable. 


That's what seems to be happening. It's a huge slap in the face to people still waiting from October/November to see a flurry of Jan/Feb filers being approved. 


 

For all we know, she gets 10 calls begging her to prevent all immigration to every call like yours. Or you were the last in a long line of callers asking for some type of special consideration or favor. Or she simply could have been having a bad day. Or, maybe she figured out that you despise her boss. Who knows why people act the way they do at any given moment.

 

If I was her, I wouldn't have felt any need to do what you were asking either, as it wasn't specific to you, but more of a general "why is this happening like this" question. Of course, I'd never work in politics, so... 

 

Best to not take it personally, nor let it dissuade you from your goals.

Everyone seems to say that, I guess I was one of the lucky ones. From filing to arrival in the US was 6 months + 1 day. I was able to schedule my interview 19 days after my NOA2.

 

That aside, I'd go for Italy! We love it there, and are planning to go back later this year :)
