Hi Amirah, I believe the US embassy in Singapore will ask for past years' tax returns so even if he is not self-employed, he should send copies of these to you. We're also trying to get these in time for our interview next week. Here's a list of the items I'm bringing with me, there's helpful comments from other members in that thread, and here as well relating to Singapore.

 

I think if your fiance's sister is going to co-sponsor then you will need an I-134 and the relevant supporting documents as well from her.

Here is a recent case that went through London (link) where the beneficiary submitted evidence of continued income (through remote work with a UK company) and the visa was approved.

 

As to whether it's legal or not, I feel like it's a gray area. US laws don't have jurisdiction over the hiring practices of a foreign company and before you receive your GC, you're not technically a permanent resident yet either. The I-864, which K1s use for AOS, also states that if the intending immigrant is a spouse, their foreign income can be counted so long as it continues after they become an LPR. The way I understand it, this suggests that it could include the time following marriage/submitting AOS but prior to receiving the EAD.

 

Income from the intending immigrant, if that income will continue from the same source after immigration, and if the intending immigrant is currently living in your residence. If the intending immigrant is your spouse, his or her income can be counted regardless of current residence, but it must continue from the same source after he or she becomes a lawful permanent resident.

I am currently legally unable to leave the country, and securing a visa for my significant other to visit me will be both costly and time consuming, how do I qualify for a waiver to apply for a K1 visa?

 

The K1 visa is even more costly and time-consuming than a tourist visa. Waivers for the requirement of meeting in person within the last 2 years are extremely hard to obtain - if you have a valid legal obstacle to leaving the country, showing proof that your SO has applied for, and been denied, tourist visas would help build your case. Without that, it's not going to be an easy argument to say that you couldn't afford to meet in person, therefore you should be granted a waiver.

My Canadian fiance and I haven't started fililng yet, but have been gathering information and documents.

I've read someone's timeline saying that the whole k-1 fiance visa journey from petition to his coming here would take about 8 months.   i think we'll have our ducks in a row by springtime and can have a nice visit and file the 129 fiance petition together.

 

If we file in the spring, then that would put his arrival in Dec,Jan,Feb, and I really don't want a winter wedding.   But from what I'm reading, the getting married in 3 months part is the legal issues.  So, when he gets here, we can go to town hall and file for the wedding contract and do the legal end of it, and then take our time planning a religious ceremony in the spring with friends and family and a nice place. 

 

I don't want to mess anything up, so I thought I'd ask.  Is this correct?

You can definitely do a courthouse wedding first to fulfil the 90 day requirement and then do a religious ceremony later (kinda like renewing your vows).

 

As to whether it will take 8 months, no one can say for certain if that will still hold in the spring. Right now, K1s are whizzing through the system (ours took 4-5 months from filing to visa issued) while in the past there have been periods where it's been well over a year. For a better indication, once you are ready to file, check the timelines of people who filed in the month/weeks just before you.

Since you already this far, it would be such a pity to let it go. You mentioned in an earlier thread that you have 8 months of study remaining. I *think* (and someone please correct me if I'm wrong) that you can contact the embassy to delay your interview till you are close to being ready to leave, so long as it is before your petition expires (count the expiration date as 1 year from the notice date on your NOA2 - not what is written on your NOA2 hardcopy).

 

8 months out of 12 leaves 4 months to get a new medical (old one would expire after 6 months) and schedule an interview. A little bit tight, but it should be doable?

The NVC assigns you a new case number. If you're applying at the consulate in Singapore, the case number will start with SGP. It is currently taking about 6-8 weeks from the NOA2 to get a case number from the NVC.

 

Once the NVC has assigned you a new case number, your case will be sent to the consulate in Singapore (takes about another week). You can check your case status at this website once you get your SGP case number (select immigrant visa). Typically, the status will change from "At NVC" to "In transit" to "ready". The NVC may do another round of background checks. If this happens you may be in "administrative processing" for a while.

 

Once your status changes to "ready", the embassy will then contact your fiance with instructions on what to do next (commonly referred to as "packet 3"). For a sneak preview of packet 3, check out this thread. :)

It's perfectly fine to do either one of those. Personally, I like to complete my forms in black ink, if I'm hand-writing them. Some people say that signing in blue ink differentiates the colour of the signature from the rest of the printed form and helps to establish that the signature is original.

I'll suggest a coupla things, maybe (maybe...) help you to decide whether you need an attorney or not.

a. read the VJ guides. map the steps out on paper and pencil. See if anything doesn't make sense to you.
b. Read the USCIS web portal about the forms. Map out the steps on paper and pencil. See if anything doesn't make sense to you.
c. Practice filling out the forms, at least 5 times. See if anything still doesn't make sense to you.
d. Have any red flags? Practice writing up attestation letters about each red flag.

Now, after doing (with major emphasis on DOING ) all of the above, if you do NOT understand the forms and the process and potential red flags for your petition,

then I'd suggest getting a good IMMIGRATION lawyer. You are concerned with time, I am concerned with your 'knowledge acquisition', as knowledge is power. You can have 'it' good, fast or cheap - pick 2.

Also, IF you do decide to go with the services of an immigration lawyer, there are many different types of services around..

 

There's the kind where you engage them for the entire process from filing the I-129F petition, all the way to the embassy stage, and for some even to adjustment of status/removal of conditions, etc. These types of arrangements are typically more costly, and involve the lawyer charging you exorbitant fees for basically, an administrative service (mailing in forms, etc).

 

There's also the kind where you can simply call in and pay per consultation whenever you have a question that you feel would be best answered by a lawyer. Much more cost effective, and low commitment.

You can travel to the US with a K-1 visa in your passport and ask to be allowed to enter without activating the K1, but I believe it's up to the POE officer to decide whether or not to let you in. I have only read of a few isolated cases on VJ where the request was successful, but if you don't mind the possibility of being turned back, it might be worth a shot?

I'm filling out the G-325 form and I've lived in more than 5 places and had more than 5 employments in the last 5 years. I know i need to attach an additional document but should I fill out all the spaces I can on the form and then in in the space say "see attached" and on the attachment just put the last 2 addresses?  OR do I put "see attachment" in the first box and put all the addresses on the attachment?  

Please help.  Thank you.

 

Either is fine, but personally I would go with writing "see attached" and putting all the information on a separate sheet of paper, just so that it's less confusing to the reader and they don't have to toggle back and forth between two pages.

No, it shouldn't. The I-129F petition has two broad requirements

 

1. That both applicants intend to and are free to marry within 90 days of the beneficiary's admission to the USA; and

2. That they have met in person within the 2 years prior to filing.

 

The reason why most people keep the letter of intent to marry succinct is so that point (1) is made extremely clear right on the onset. If you clog up the letter with mushy tales on how your relationship evolved, you run the risk of the officer mistaking it as a testimony of your relationship/relationship "timeline" and possibly even increasing your chance of receiving an RFE for a letter of intent to marry.

Your fiance's father is correct.  The question is asking YOUR relationship to your fiance's father (your future father in law).  It is not asking the relationship between your fiance and his father.

The question comes under section 3, which asks for the details of the person for whom the affidavit is executed, i.e. the beneficiary. Thus, they want the beneficiary's relationship to the person filling out the form.

Bear with me for a few more questions?

 

What would you all say about "describing the circumstances under which you met?" Should I put in lots of details, i.e. we met while he was fixing my computer during the Chinese New Year or just give the location and date?  

 

And do we need to provide a summary of all our meetings to date at any point? We've been saving EVERYTHING during our two visits (I came to visit him in Cambodia) since we met; and are wondering if they will want a summary of our two subsequent trips in writing at some point. Or should we include this in the aforementioned section?  Gah! Sorry for the long questions; just a bit nervous. I keep having small nightmares about getting an RFE; want to do everything right the first time. 

 

I suggest keeping it to a one liner on the space in the form, and then attaching an addendum to that question on a separate sheet of paper, with more details on how you got to know each other, a description of your two meetings since then, etc. As TBone said, it's advisable to frontload for Cambodia.

Hi all!!

 

So, my fiance and I (the USC) have been researching and gathering our evidence for the K-1 practically since before we got engaged.  We're still not sure exactly when we're applying, as we still have sponsorship stuff to figure out, but we would like to have all the evidence and documents prepared as we hope to send them in soon.  

 

As we go through the forms and the VJ K-1 checklist, we've been keeping a record of our questions. Would anyone be willing to help us answer a few?  

 

1. Perhaps the trickiest for us is this:  I recently graduated from my undergraduate program in May 2013. Since beginning college in 2009, I have moved to college and then back home every summer, including the summer after I graduated. My jobs have also switched as I move to college and back home.  I know we're supposed to extremely thorough; but do I have to put a change in address each time I moved back to college and then back home? Or could I just put my home address, and how long we've lived there, and then my college address, even if the dates over lap?  OR since I was technically living at home the entire time (claimed as a dependent)  should I forgo putting down my college address at all? (sorry that was a complicated question)

 

          Along with that; I had steady work on campus during the time school was in session, but a regular summer job back home when classes were out.  Do I need to put each time I stopped one job and started another?

 

 

2. Should our dates overlap? For example, if I moved to graduate school mid-August, should I put that I lived at home in August  and then again, that I lived on campus for August as well? (gah, these are simply maddening to me. I had no idea my life would be so complicated smile.png  )

 

 

3.  When my fiance was in graduate school, he did not have a job. Should we simple put he was unemployed for that time period or should we put that he was  a "student" and then give the address of the graduate school?

 

4.  Okay, I've heard horror stories of people getting RFE's for the blank spaced on a form. For example, if you put N/A instead of none and get all the forms sent back.  Does this actually happen? For example, neither my fiance nor myself have been married before, nor do we have children, so in all the spaces where one can provide information about prior spouses and children, should we just put None at the top of the section and move on, or do we need to put None in each space. Same question about things like middle names. My fiance doesn't have a middle name, so should I just put N/A? Nor does he have a SSN, but it won't let us type in the form "None," so can we leave that blank?

 

6.  If I am a USC by birth do I need to submit a "Certificate of Citizenship?" I assume that is for those who have been naturalized already? Or just my birth certificate? 

 

7. For my parents, do I need to include the state in which they were born, and if so, is it okay to abbreviate it?  The form just says "city and country" but I wanted to be sure. 

 

 

Thank you all SO much for putting up with these questions. I know there are sample forms and wonderful instructions on VJ, but I wasn't sure there would be answers to these specific questions. Thank you for helping this newbie out.  We don't know what we'd do without VJ to get us through this process.

Addresses - Personally, I didn't list my college address as I considered my family home my primary residence (I continued receiving some mail there).

 

Jobs - I didn't list the temp jobs I did (I did a lot in uni). But...since you seem to have two steady ones, just that you had alternating periods with each one, I would attach a separate piece of paper and list it like this, for example:

 

Job A:

(1) January 2011- June 2011

(2) September 2011 - November 2011

 

Job B:

(1) July 2011 - August 2011

(2) December 2011 - February 2012

 

and so on. You could do the same with your addresses, if you wanted.

 

Your fiance's employment status - Did he earn a stipend as a grad student? If so, list it as student/TA or whatever his position was, otherwise list unemployed.

 

Overlapping - I didn't overlap my dates, just made sure there was no gap, i.e. if I was employed from May-June in one job, I listed July as the start date for the next job.

 

Blanks/N/A/None - The current I-129F instructions state to leave all fields blank wherever the answer would have been N/A or none, so do this. Also, you can handwrite anything you can't type/fit into the forms. You can also attach sheets of paper and refer to them (see attachment A/B/C etc) in the text box if you run out of space.

 

Birth certificate - your birth certificate is sufficient.

 

State - Yes, city, followed by state (abbreviated) is fine.

Since the father is a US citizen, the child can generally acquire US citizenship, despite being born abroad. There are a few 'conditions' listed in the link below. 

 

"A person born abroad out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) of the INA"

What did you submit initially? Some other suggestions include:

 

- Credit card receipts showing transactions made in Kuwait (should be dated before the date you sent your petition in but within two years of that date)

- Bills listing your address in Kuwait

- Paystubs from your employer

I don't know why but I assumed that part of the I-129F was if the finance was living in the United States.  We just sent our package away a few weeks ago while I was visiting, but we left that blank because I left the next day (I am back in Canada).  Is that going to cause problems??

 

One of the options under "he or she last arrived as..." is "visitor" :) No, I don't think it's going to cause you any problems. Your package probably took a couple days to reach the intake facility anyway, and you'd have been back in Canada by then.

Another question I have is what if we were to file the K-1 while she was here visiting. Would that cause any problems?


 

Overstaying = staying past the expiry of your I-94. For Canadians entering the US as visitors/tourists, this is generally 6 months.

 

No issue filing the I-129F petition while she's visiting you. There are fields in the I-129F form specifically for you to state that she's in the US with you currently (Part 2, Qns 15a-h). She will have to return to Canada for her medical exam, interview, etc once the petition has been approved.

US citizen - needs to make 125% of the poverty guidelines (guidelines for 2013 listed here), otherwise, a co-sponsor will be needed. It's at the consulate's discretion whether or not to accept a co-sponsor.

 

Foreign fiance - does not matter whether or not he is employed.

My Lover who is in India, started this forum.  He is concerned that his english is to bad to write here. We are a gay couple.  I am in USA, and I was concerned when he mentioned that a straight friend of his had applied for a k1 visa a few years ago.  He says he was unaware that the visa she applied for was a fiance/marriage visa until he went to interview.  He went to interview with no paperwork. The visa was denied. This is it in a nutshell. He was only trying to visit USA.  I know these kinds of actions, no matter what, do harm to those who are legit.  I to was concerned about "visa fishing" when I first met him.  And if not for my elderly parents, he would wish I come live with him in India.  He is better off than I am.  I told him I was very concerned about this and would like some opinions.  And I do appreciate ALL replies as all are constructive.   Thx

 

One of the requirements for the I-129F to be approved, way before the interview, is that both the petitioner and the beneficiary submit signed letters of intent to marry - that really should have tipped him off.

To your original question - my fiance is older than 25, and childless, and the US embassy in Singapore didn't give me a hard time over it. When asked, I said no, and that was that. 

 

You don't need to disclose your vasectomy to them, or your inclination to remain childless, unless specifically asked.

And the interviewer is not obligated to tutor you in the rules of visas.  You applied for the WRONG visa.  Denied.  Not his fault and not his job to inform you what visa TO apply for.  There was a hint when he asked why she didn't just apply for a B2.  

 

Apply for a B2, show adequate ties to her home country (such as YOU live there) Get the B2, come and get married have your honeymoon in CA and leave.  Thank goodness the USA does not turn away the billions of foreign dollars we make every year as a honeymoon destination!

 

An I-129 is not a visa and USCIS does not issue visas.  USCIS should have denied the petition and kept your fee for not reading the rules first, but they approved it.  So what?  It does not obligate anyone to issue a visa.

 

If they do not issue the visa it will be because you do not show sufficient ties to the country.  Not their problem.  If denied, plan on an alternate place for the wedding/honeymoon.  

 

The only 'rule' of the K1 visa is that you get married within 90 days of arriving in the US. It is not a requirement to complete AOS if the OP's fiancee does not want US permanent residence, and while unorthodox, it is not the "wrong visa". While it is rare, there have been couples that have chosen to go the K1 route because of difficulties in obtaining B2 visas.

 

His main difficulties in obtaining the visa would be getting a co-sponsor that can show US-based income to meet 125% of the poverty guidelines.

There is no hard and fast rule, do whatever is easiest for you to be able to pull out the documents you need at the time of the interview. Personally, I found the easiest way for myself was to create a contents page listing all the documents in my plastic L folder and numbering them (e.g. A-1, B-3, etc). Then I created tabs for each section/document using post-it tabs. This was kind of time-consuming but it helped me.

You can print the photos on regular printer paper, it does not need to be photo paper. :)

 

Use clips instead of staples so that it's easy for the person handling your papers to disassemble the package.

The foreign beneficiary won't receive any written communication from the USCIS at the petition stage. Once you receive your NOA2, your case will be sent to the National Visa Centre (NVC) within two-eight weeks of the NOA2. You can update the beneficiary's mailing and email address by speaking to an agent at the NVC over the phone at the same time you get your new country-specific case number. At that point, you can also email the immigrant visa unit of the embassy with your new case number to let them know that the there has been an address change for the beneficiary and to send snail mail to that address instead.

It does not matter if you end up living in a different state than what was listed on your petition. USCIS understands that people do move houses, switch jobs, etc. :)

 

Since you received your NOA1 just recently, if your fiance moves while your case is being reviewed, he should inform USCIS of his change of address here: https://egov.uscis.g...splayCOAForm.do so that he will receive any written communication from them (e.g. RFEs, NOA2, etc).

Don't worry - it is not a requirement to provide copies of the I-129F package (including any RFEs you responded to) to your fiance. It is only suggested so that she can look over the documents for her own reference. The embassy will receive everything you submitted to the USCIS.
