Hello!  I am finally ready to file a K-1 Petition for my Serbian fiancé!!! I have the I-129F with a check for the $340 filing fee, two G-325A's (one for each of us with 2x2 passport photos attached), Statement we have met with evidence attached (airplane tickets, hotel receipts, 5 photos of us and a sample of the Facebook messages we sent to each other), a statement of intent to marry for each of us, and finally, a copy of my passport.

 

HOWEVER, after reading through all of websites for the 100th time to make sure I have everything correct, I am now confused about WHAT I need to send to WHO.  In other words, Do I need to send ALL the evidence along with the K-1 petition or is that information only needed for the interview??? 

 

Can someone who has been through this process before please tell me exactly what I need to send to the USCIS office with my I-129F in order for it to be approved?

The Embassy has the ability to re-validate the petition if an interview has not taken place by the expiration date listed on your approval notice.  Re-validation of petitions is common and routine; plus, no action on your part is needed in order for this to happen.

 

Do not worry about this date, it ultimately will not be an issue.

As others have already pointed out, this is incorrect. If a K1 was an immigrant visa, then the Adjustment of Status process would not be necessary for K1 visa holders because Immigrant Visa holders are given green cards on arrival.

Answers:
Part 1: If a CO at the Embassy is aware of the charges, you be asked if you are aware of them and what the details are. However, since DUI does not fall unde the Adam Walsh Act, then the chances if the petition being adversely affected are low.

Part 2: If you hold a K1 visa upon arrival into the US, it will be activated, no way around it. The validity of a K1 visa is less than or equal to 6 months from the date it is issued and must be used prior to the expiration date. Additionally, the validity of the visa is tied to the validity of the medical exam which is why the medical exam is not conducted until close to interview time.

DS-160 form is filled out by beneficiary so the purpose of question refers to the beneficiary not the petitioner as my understanding.

 

I am well aware the DS-160 is completed by the beneficiary, my answer was worded in a manner directly addressing the OP.  I also stand by my original statement as the purpose of the question is who is traveling the applicant on a US visa and the OP as a US Citizen with a US Passport would not have a US visa.

The expiration date is the expiration of the comment period to the Office of Management and Budget; the form itself does not expire and can be used if its the only version available.

We followed the VJ guide and wrote N.A. (K1 Visa process) for Qn 11. However, maybe the sample form could make clear that the sponsor's full name should be entered in the oath section as some people work off a printed form and may not notice the "hidden" instructions that appear when you mouse over a section.

You'd be very happy to hear that the girl who interviewed before me didn't have any ITRs or W2s and only had an offer letter from her fiance's job (because they were both new graduates) - she wasn't asked to send in any more documents. I think you'll be just fine. :)

I don't remember I have to bring tax returns, W2 for K1 visa.

I only took employment letter, recent pay slips, bank statements, unemployment benefits letters.

 

My hubby also started new work for about 1 month before the Interview.

He was laid off and on unemployment benefits for a few months after I-129F approval.

 

 

Thanks for sharing, Merry, that's a relief for all of us who don't have ITRs on hand. My fiance also recently started a new job after a brief (6 weeks) period of unemployment. Will let you all know what documents the consulate asked for after my interview next week.

From my experience with the US Embassy, it's perfectly fine to send in photocopies of the Forms 1040 (if applicable), and W2s are not necessary.

 

I think she doesn't have forms 1040 i.e. her fiance's income tax returns, because he just started working 3 months ago. Her main evidence will be the employer's letter verifying his employment. Did they take that letter when you interviewed?

Yes he is able to get the letter from his employer and he has his job offer contract if that helps.

Thanks for replying! Was so confused. Need your help just for a bit more.

 

I'm just really worried because my fiancee does not have an W2s. He just finished his masters and recently got a job three months ago that pays well above the poverty guidelines. But it's a new job so no W2s yet.

Also, what are ITRs? I'm not sure if he has any because he only just started working three months ago..

 

The way I see it, we need a co-sponsor sad.png So i guess my fiancee's sister has to provide the exact same evidence (W2s, ITRs, employer letter, bank statements eg.)?

 

ITR = income tax returns. These are better evidence than W2s because if your fiance, like mine, has had a few different W2s in a year, the consular officer doesn't need to add them all together - they will be reflected as one total amount in the ITRs.

 

Based on the advice I was given, it seems that current income is what counts, so if his job pays above the poverty guidelines that's not an issue. Since the earnings from his new job won't be reflected in his ITRs, can he get the letter from his employer (item (b) on your list)? There's a sample somewhere on VJ, let me dig it out...here it is.

 

Since it's a new job I don't think having a co-sponsor will hurt - you can just present his I-134 + documents and IF the consular asks for more, present the co-sponsor's information. But judging from what I've read and what others have said, I don't think you'll need one.

Hi Amirah, I believe the US embassy in Singapore will ask for past years' tax returns so even if he is not self-employed, he should send copies of these to you. We're also trying to get these in time for our interview next week. Here's a list of the items I'm bringing with me, there's helpful comments from other members in that thread, and here as well relating to Singapore.

 

I think if your fiance's sister is going to co-sponsor then you will need an I-134 and the relevant supporting documents as well from her.
