Randy i just got my wife's ITIN a couple months ago. Since she is a filipina i can give you what the IRS had me submit.
first a certified copy of her birth certificate called the RED RIBBON/GOLD SEAL certified. the same for the marriage contract.(red ribbon/ gold seal) Also a certified copy of her passport bio page. She needs to have this done at the CFO office she received the passport from to save you time because Manila is the only place that can make the "RED Ribbon copies" but Manila will tell you it will be several weeks for them to get a certified copy from the place they were originally issued so to save this hassle take the certified copies with you when you do the Manila step. It will save you a lot of time getting the documents. She then takes the certified copies to CFO Manila to get the Red Ribbon/ Gold Seal copies made. Get all 3 documents with the red ribbon gold seal to save a headache later down the road.Once you have those 3 documents you send those with the completed and signed W-7 form to the IRS in Houston or Austin i don't remember the address but it is on the W-7 form. Once the IRS has it it normally takes around a month or so for her to receive the ITIN letter. It will have her ITIN number on it. Sorry DFA not CFO.

We did a W-7 while my wife was still in the Philippines and didn't have anything notarized. She got her ITIN without any problems.
That was a couple years ago and maybe the requirements have changed.


This is what we are working at this time... i'm going to get a new updated passport and once i get my passport i will go to DFA (for red ribbon). This is what my friend told me...

The filing of tax is until april 15, is this true? By the way, you can notarize the passport to any notary public here in the Philippines. It's only P40 each.. i inquired it the other day near at my house..

I am getting ready to send everything over, but the affidavit only has room to put one employer. And I have two half time jobs. It was suggested to me to just write it in by hand when I go to get it notarized, but I think that might look sloppy or something... The version I have on my computer won't let me insert more lines into it either. I guess, understandably, you're not supposed to be changing the form around!

Any advice how to put both of them on there?

Thanks to the OP for a positive post!

As someone who has been through the wait - and survived it - I am thankful everyday for the opportunity I had as a USC to bring my spouse here to my country and enjoy the benefits of living here with me. It is a privilege we have as Citizens to do so, and while the system certainly is NOT perfect, it is in place to unite as many of us as possible. I don't believe USCIS employees take these jobs for the sole purpose of torturing the applicants, nor do I believe they are incompetent.

Staying positive and trying to focus on the long term result will help get through the waiting. Although I admit, I had sleepless nights, so much stress, and quite a depressed spell as we waited - it is worth it in the end!! Try to stay positive!

lol we married last year in November, and we are living in different countries. As most of couples here. it had been ok cus he 's been coming alot but now situation changes and I feel alone. I meant that I just discovered cus today I got some medical test for my job and one of them was pregnancy and the result was positive, so I just knew today, I do not pretend to expedite, but I am scared it takes more time.

After reading that, I am still confused...

So you've been apart from your husband since November 2009 (which was when you got married) and you haven't seen him since then? Or, he has been visiting throughout the past year and you feel alone now because you two are not together...So if that's the case, you have seen him recently. Hopefully things work out on time and you two can be together right after the baby is born.

Your proof is fine. You may need to have 3rd parties (e.g. family, friends) write an affidavit attesting to your marriage. This is copied from the I-130 instructions on the USCIS website:

(Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage) <-


- For the affidavit of support, my fiance won't be able to provide his last 3 tax returns because he doesnt have filled out them some years since he was living at his parent's and didnt earn enough. However he can provide all the W2 he have and his bestfriend agrees to be the co-sponsor. Will it be a problem ?



Like ghanagal said, as long as his income is sufficient you should be fine. I'll add that you should be fine since his best friend is willing to co-sponsor.

I am filing an I-130 petition for my wife. I have been married since August 10th, and thus I do not have much to prove bona fides of marriage. What I have are three affidavits, photos of the small wedding we had, a credit card that I pulled out for her under my account, and messaging and calling logs.



1. Would it be ok without the photos or is it a good idea to include them?


Include the photos.



2. Is it okay to send a copy of both our credit cards in the same account, even though she lives outside of the USA?


Yes, so long as it is a joint account. Your objective is to show co-mingling of financial resources.



3. Is it still required to send beneficiaries copy of passport and birth certificate with the I-130 form?


No. Her birth certificate will be required once your case reaches the NVC. However, don't forget to include your marriage certificate with your I-130.

Well, they can access your whole file, but they have to do the extra step of downloading it from NVC. That is what the agent told me in Montreal. This is the reason you are to bring the originals, as that is what becomes the contents of your active file. Whereas, if you paper file, they already have built the file for you, and that is what gets transferred to the consulate.

The reason for e-filing is not so they can have all your papers, it is foremost to expedite the acceptance process for you. They still need to have all the originals in the end. Essentially it is enough to have electronic copies at the NVC stage, but once it gets to the consulate, and in order for them to make the final determination, they always need the originals in their hands.


And I still continue to wonder. Will Consulate personnel still look through a file once it reaches them electronically? Especially one that is front-loaded with evidence of a relationship prior to and after a wedding ceremony? :unsure:

When I went for my interview for the CR-1 in Montreal, one of the employees told me directly: "When you do electronic filing, I get your file totally empty. If you do regular filing I will have the copies of the documents that you send already in your file." Then she showed me an empty file, mine!


:o This makes me curious. I thought the whole point of electronic filing was to have everything you submit to the NVC electronically transferred to the embassy or consulate where the interview is taking place. Anybody else who has filed electronically encountered this?

Call the NVC and ask them if they sent the originals in the file to the consulate. You may need to speak to a Tier 2 person about this.

Call the consulate and explain that you sent the originals to the NVC and see if they are already in the file. If yes, ask if you need to bring originals again.

Once we get married and file an I-130, I am unclear about what that does to her eligibility of entering the US as a visitor. In the Comparison of Marriage Based Immigration Choices on VisaJourney (http://www.visajourn...content/compare) under the "Minuses" section, it says "The applicant will most likely not be able to enter the US while their IR1-CR-1 Visa is being processed." In addition, this tidbit of info is not in the K-3 section of this chart, which begins with the same I-130 application. What gives?

If I read this correctly, until we receive an NOA2, she should have no issue getting into the US as a visitor, but will not be allowed in after NOA2 until she is interviewed and approved by the consulate. First, is this really the case? Would a CBP agent at the border deny her entry because a CR-1 visa was in-process at the NVC? Second, is there a risk she could she be denied entry before NOA2, like immediately after filing an I-130 (receiving NOA1)?

I would think we could show she is not a risk to enter the US as an immigrant prematurely. We are both Nexus cardholders, so I'm sure CPB has thorough records of her entries which would show that she has a consistent record of visiting for a few days and then leaving. She has many ties to Canada and does not intent to immigrate before being issued a visa. Unfortunately she lost her job last month so until she finds work again she can't get a letter from her employer, but once she is employed again does this help? What are our chances of maintaining a 'normal' lifestyle -- and by normal I mean one where I don't have to drive to Vancouver every single weekend?

If anyone has insight on this, or if you've been through this before and you can share your experience, I would sincerely appreciate it.


Since the K3 visa is essentially nonexistent now, I wouldn't use that chart as a comparison. In a nutshell, she can start to make the trip, but there is no guarantee that she will be admitted, even if she is a NEXUS card holder. You have to assume that a CBP officer will have access to information that will allow them to know that an immigrant visa application is in process.

Once she is employed again, she would be able to use the letter from employer. If she has a lease or a mortgage, she should bring that with her. Again, they show ties but are ultimately not going to guarantee admission.

I thought I knew what we were doing for this whole CR-i immigration process but now Im a little confused. I figured we submitted the I-130 and then followed instructions etc. But I was poking around on the USCIS website looking to see about traveling to the US for the holidays to be with my hubby, and I came across this whole I-485 thing, and I wasn't really sure where that fits into the whole process. I had thought we needed to file it way back when, then I wasn't thinking we needed to and now I'm not sure. help?

I saw the following reply in another forum, but I think it's applicable here.

There are 2 service centers named CSC and VSC. CSC employs 1010 I-130 adjudicators and VSC employs 505 I-130 adjudicators.

In the U.S, every year there are 750,000 I-130 petitioners say all are USC petitioners. They send their package to Chicago Lock box. TLA for it, let's say CLB. CLB checks the load of each SC and forwards it to them. Say 500,000 went to CSC and 250,000 went to VSC.

Always at a particular time, 10 employees in CSC and 5 employees of VSC are on vacation since they are humans. Now let's do a math again. Balance employees in CSC is 1000 and in VSC 500.

A Quiz - How many petitions each CSC and VSC employee gets for an equal distribution?

Ummmmm... Nobody answers. Let me calculate. CSC employee gets 500 and VSC employee gets 500.

Some of the employees in each SC are hardworking. What does that mean? They don't smoke, don't go to pantry so often and do not discuss about their dogs and cats at office. They process 5 petitions a day. Those hardly working employees process 4 petitions a day.

Now another quiz! How many working days in a month? Take out 4 Sat, 4 Sun and 1 or 2 holidays. Let's assume 20 working days.

During this process, some name checks are initiated. This is really not a spelling check. First name, Last name, DOB etc. are fed into another system and they get an output. Some names bleed, some not. Sometimes, some innocent names also bleed. Bleeding names will be hospitalized to get some more cure. Non-bleeding ones come back to the SC.

Ok! Now out of non-bleeding ones, some missed to include a previous divorce decree, some included a copy of marriage certificate which not clearly readable, so on an so forth. Now the employee is interested to see those originals. They issue another sweet TLA named RFE. Some petitioners will respond immediately to this RFE. Some may be on vacation or busy getting some of the documents from various sources.

Ok, final quiz! How many months it takes for a petition to be processed? Let's take a ball park.

Hard working employee gets 500 petitions and 20 working days in a month and process 5 per day. To process a petition on an average takes 5 months! Oh boy! This doesn't mean the first petition is processed on day 1. Since previous petitions are in his/her queue. Hence the term - recurring process!

Hardly working employee gets 500 petitions and 20 working days in a month and process 4 per day. To process a petition on an average takes more than 6 months! Oh geez!

To put it simply, yes you can. :)

Like others have said, as long as you return to the UK, which you will do, you will be fine. Also, it's unlikely you will be asked many questions by CBP, however, in the event that you are, answer all questions truthfully to avoid problems later.

We are aware that we will have to stay apart for awhile until a visa is approved, but would I still be allowed to enter the US on a visitor visa to see him while our application is being processed? Is he allowed to leave the US on a visitor visa to see me?


Harsh_77 said it best in regards to you coming to the US while the application is being processed. As for him coming to the UK, the US and UK have reciprocal visa waiver agreements for 90 day stays so he can visit you without a visa (so long as he departs after 90 days).

If your wife's name has been legally changed to your last name, then she would put that name on the paperwork. The name change for her requires her to bring the marriage license to the Social Security office and the Department of Motor Vehicles to her new DL.

If she is the USC I am not sure that it matters for her to change her name before you do the paperwork or not. That would be between the two of you. I am assuming you are the beneficiary?

I think you might be confused with your visas.
CR1 is for SPOUSES not boyfriend/girlfriend.
K1 is for FIANCE(E) not spouses or boyfriend/girlfriend.

The question is do you want to get married in the USA and stay to adjust status or do you want to get married prior to entering the US?

For the CR1 you would need to be married prior to applying for that visa and you would apply from the beneficiaries home country. For the K1 you apply prior to being married, once you receive the visa you then enter the US, get married and adjust status.

It would be helpful for you to read the guides and have a look at processing times for each visa, after deciding whether you want to get married first or not.

1. On section: D of the form I-130. It asked for 'Have you ever filed petition for this or any other Alien'. I filed I-130 for both of my parents before and both of their petitions got approved. Should I answer YES to that question and list their names? Also, if anyone has filed this question before, please let me know what informat do i need to provide there. It ask for name, date, place, and result. I think I filed in California Service Center so for place can i write CSC?

4. Just to be on the safe side you might want her to sign all 4 pages. I did that and had no problem but that was before they changed it to 1 page. Just follow the one page thing if it is current.
5.Say none if it asks for employment. School doesn't qualify for employment.
6. If you filed for anyone than you would want to list them on the line provided because USCIS would already have that information. So you would place a YES and write the results and such.
