don't need phone cards or phone records for initial filing of I-129f. that's the type of evidence you use at the interview for proof of ongoing relationship. save it for the interview.


Perhaps but I was told by my attorney to submit it (calling card copies and cell phone records) to show proof of communication in lieu of pages and pages of emails. The OP said he did not have emails/IM chat logs, so this would be the proof of communication he might need. Maybe it will save me and RFE; maybe not. I agree additional cards/phone records will be needed later. I just offered an opinion from my experience. Doesn't mean this is the way it is.

Ok, its finally time that i file the K-1 package for the love of my life that lives in india.
I have a few questions though about supporting evidence about an existing relationship

We talk on the phone every single say since i met her in december 2005, only thing is though is that i used calling cards to call her. She has no internet access, and we havent sent any cards or anything to each other. How can i show the USCIS that we are constantly in touch with each other if the only method of communication i use with her is scratch off calling cards? I do dial the 1-800 number from my cell phone, and those records are available, do you think that will be substantial.


I sent copy of back and front of all cards I had used to date along with copies of my cell phone bill showing I had dialed the number on the cards.

I can't believe it - my fiancee rung last night to say that she'd just recieved our NOA2 in the post! I can't believe how quick that was. At this rate Ill be over in the States in a few weeks (well, maybe not)! Anyhow we didn't recieve any notifications via email or anything so it was quite a surprise. I guess I better start sorting out what I need for the next step of the process!

Anyway good luck to everyone still waiting - I feel a bit guilty like I've jumped some sort of que or something.

We went 76 days with no touches, then got touched, then approved. You still probably have a bit of a wait ahead of you so I'd reccomend busting out your paint by numbers.


Thanks for the encouragement. I was starting to feel like the OP. I am at 6 weeks and no touches, watching several around my date get touched right and left. I was beginning to feel there might be a problem and that is why they won't touch me! But it's true. We are still well within the timeline. I'll pull out the Pooh paint by numbers like Sarah suggested... :lol:

I think it is a good sign indeed!! I was told it would be 3-4 months (Nov or Dec :( ) when I filed but it was nearly 2 months to the day, and that's with CSC!! Congrats too all who got NOA 2 today!

But I kept telling myself, I am well within the expected waiting period so what's up with that thinking?? Lo and behold, here I am, on the approval list today. So don't give up. I saw the post of the person who mistook thier RFE for approval and went back and read all 5 of my emails from CSC to make sure I hadn't made the same error. Like the others said, don't give it a thought. We are all here to support you, and if anyone gives you grief about your error... :angry:

Trust me you will drive yourself looney if you do that. I never thought to check until I read somewhere on VJ this person was checking theirs every day. So I started checking mine daily, then 2-3 times cuz maybe they didn't touch it in the morning but they might touch it after lunch! :unsure: And you know what? When they touched it the first time I didn't hear a thing, but when they touched it and it mattered, I got , I got not one , but 5!! :D No save yourself the stress. Wait 4-6 weeks after receipt date before you even check.

As has been said here many times, it all depends on which pile or box your file goes into upon arrival, the speed of the officer that ends up with it, the pull of the tide and other things that seem to make no sense at all. Also Vermont (which is probably where you are seeing fast approvals) is much faster than CSC as they are only handling cases for a section of the USA, while CSC seems to be handling the rest of the country. I often wondered if something was wrong with mine, thus delying it, but then one day bammm!! approved. So just be patient. It's really all you can do, short of going crazy.

PS: No you can not refile your petition at VSC to get it approved faster, unless maybe you move there! But even then... :P

I also hired a lawyer due to potential problems and knowing ahead of time that the consulate we deal with is so unpredictable. Seems the clear cut cases are getting denied and the ones we think are a no go are getting approved!! :unsure: I agree with others who have said you must decide for yourself if the peace of mind is worth the money. In additon to having someone to ask my questions to, all of my forms were done electronically. So there were hours of time saved just with paperwork. Also, they had me submit items that are not asked for on the list. (For example the beneficiary birth cert that caused several people to receive RFEs). Maybe presentation/organization is part of it. I don't know if I was just lucky or what, but even going through CSC I was only 70 days with no RFE. Now comes the hard part...getting through the interview at Casablanca.. :crying: But if there are any hangups, I"ll be on the phone to my attorney. Bottom line though is that each person has to make a decision based on their circumstances and abilities. I think the people here at VJ and the guides provided are a great source of help, and most people could probably fair just fine.

I'm still stoked about getting my NOA2 today, but something occured to me. My fiance' is here with me in America right now, his return ticket is for January 7th, 2007. Does he have to go home right away or can he stay? I searched the forums but can't find a related question. Anyone know? [Man, I hope he can stay for Christmas & New Year but I suppose if it would endanger the rest of the process, we could take the momentary disappointment] Any help appreciated :) Thanks loads! If your question was does he have to hurry home because you got the NOA2, the answer is no. Like the other person said, it will take time to process things and get an interview date. The main concern would be getting home to complete the paperwork and schedule the medical in time for the interivew. If you look at the timelines for your country, you can estimate when the interview will be and then make the best decision. I would think with the holiday you will be fine. Congrats on the approval. :dance:

help! i just want to know if the previous annuled marriage would somehow affect my current petition. I was married to a filipina before but the marriage didnt work out. i filed for an annulment 19998 and was granted 1999. She never appeared on the court since she already took off prior to the filling and I was left with no idea whre my ex wife was. Her mother is actually the one who counter signed the papers in behalf of her. Im just really worried this might be a question to the USCIS and it'll affect our petition. My fiancee nad I has child already and he is already an American citizen.


uh I'm a little confused. You had an ex wife and now your fiancee is a 'he' (maybe just a typo) AND you said they are an american citizen???? Are you the petitioner or beneficiary??

Please, tell me your opinions what is best to hire a lawyer or do it yourself. We have a lawyer in our K-1 visa but Im thinking if we should still hire a lawyer when filling for Adjustment of Status once at the US already.

Your currentl lawywer isn't continuing to help with AOS? I hope you didn't pay much for him. Mine is helping with everything, if I decide I need guidance or have any questions. But we will try to do as much as possible on our own/with the help of VJ.

Personally I think the AOS is a little easier to get through than the petition. And now that you have all these wonderful VJ people and guides, I think you can get by without the lawyer. Definitely would not pay extra for one unless you have some issue that needs to be cleared.

It is good until the USCIS posts a new form on the website.... They could do it in a week or in a few months... Sometimes there is even a safe harbor period between old form and new form where both are accepted. Good idea to stay tuned into the website.


Even going with MMH's thoughts that the form expires on 12/31, if it is postmarked by then wouldn't it still be ok? Shouldn't she just get it in the mail as quick as possible?

Our application was approved on Dec 5. :dance: Much earlier than we anticipated. We only waited two and half months! We hope that someone in this forum can help us with this. My fiance currently holds a B visa and would like to make a visit in the next month. We are worried that the custom official will give her a hard time as she enters the US. Keep in mind that she is still going to go back to her country after. Perhaps our worries are sprung up from countless days of waiting and anxious moments. Has anyone entered the US with a B visa while their I129F has been approved? -Thanks for your help

The usual answer is if the fiance/e can prove strong ties to the country to show they will return, they can usually get in. Hope it works out for you.

Alright. I will try emailing NVC. As of today (Monday), I haven't received anything in the mail abou the NVC forwarded to the Embassy yet. If this is the case, I should be receiving the mail this week or so (if that is.. the NVC did indeed forwarded my case already). I hope they already did. Thanks everyone.



I never received a letter saying my case was forwarded either. I found that the date of the NVC letter saying they had received my petition and would contact me when forwarded was actually the date my petition left for the embassy. I did have luck with using email to contact the NVC.

Thanks for all the positive feedback. If it was against the law to travel, I would really be worried. But the need for my fiancee to make an informed choice overides any fear of a POE officer having a bad day.


From what I have read over the months, just make sure she has plenty of proof that she is returning (lease copy, bank statements, the letter you already have, anything you can think of that proves ties to her country and that she will return). Then you have done all you can and it's up to the CBP. Some people are let in and others aren't. It's just a chance you take. Good luck.

I am planning to go to Europe countries like Greece, Paris, Italy etc for coming honey moon trip, but I am wondering how should I apply for visa. I entered US by K1 visa and now still waiting for 2 years green card which is expected to be delivered in about 2 months. And I am a Chinese and I am not sure where I should go to apply for Europe visa.

Definitely do not go without a green card or Advanced Parole. The fact that you entered on a K1 visa holds no bearing on future trips. Good luck with the rest of your journey and have a fun trip. I am surprised it has taken so long to get a green card though. Is this your temporary or 10 year green card?

I had the same situation as you in regards to not being sure where I would be living when my fiance actually arrives. I just used my current address. When you move, your mail will be forwarded or you will get it somehow and I'm sure the government can figure out how to find you. :thumbs:

I'm sure there is a fairly simple :unsure: way to correct the address. If not in the guides, then hopefully someone more experienced will come a long and help you.

My understanding of the documents used for the interview is that they need to be within 60-90 days of the interview date. I would do a new I-134 (the notarizing part) when you have an interview date, and then not too soon. Same for birth certificates and police reports, unless your fiancee's country has different rules.

I would certainly include a letter of explanation. Don't want to give them a reason to deny you.

I would never risk lying on a government document. Just because you have the original I-134 in hand does not mean they do not have record of one.

I was told that the evidence for the interview (police reports, bank statements, employee letters, etc) have to be dated within 60 days of the interview. But see if your consulate has a different reqirement. Good luck.

The best plan is to find things to keep you busy while waiting for the process. You can get a general time frame from looking at other timelines from your consulate, as others have said. However, you never know when things will take a turn. This process is just so unpredicatable. I have read that Manilla is slow (by comparison) to get the interviews scheduled. However, we seemed to fly from submission of the petition to interview and now seem to be forgotten in AP land. (I know we're not, but watching others pass us by makes it seem that way). I have found that by busying myself the time seems to go faster. Good luck with your journey.

Hopefully you planned your trip with a long layover if you have a connecting flight. Immigration lines can be long if a lot of flights come in close to each other. I was there about an hour when I returned from Morocco. The non-citizen line was about 2 times as long.

A friend of mine knows someone who went to Mexico to pick up their fiancee and have a ceremony there. When they tried to enter the US afterwards, ICE found some evidence of the ceremony in their luggage and denied her entry saying her K1 was no longer valid. You have to be very careful about that kind of thing.

My wife is a Catholic Filipina. She originally wanted the ceremony in the Philippines, but we were able to work things out with my parish to have a Catholic wedding here in the US within the 90 days allowed by her K1. It was a tight schedule - started marriage prep one week after she got here, but we're glad we did it the way we did. We went back to Manila to celebrate with her family once she got her green card.


I have read about others trying this and having problems as well. The problem is, you never know what the government knows or will find out, and IMO, it's not worth the risk of being turned away and having to start all over with a K3, if you can even get approved for that after trying to enter on an invalid K1. I have heard of people doing a ceremony but leaving out the legal marriage vows, more like a committment ceremony, but again, I personally do not think it is worth the risk, now matter how much it means to the family.
