IT's best to tell the truth, espeically when dealing with the government. They just KNOW things whistling.gif so it's better to tell them yourself rather than get caught in a lie. If I were in your situation, I would get the personal doc's note to address it up front, and be prepared to hand over the report IF asked about the scars. Then know that there is a good possibility there will be further clearance required. Since he wasn't a threat to others, I would think this will not be a big deal, just a slight additional investigation/delay. But a lot easier to deal with than wondering if they will find the truth after you lied to them!

That's right! The petitioner has to follow poverty guidelines to find out if he/she needs to a co-sponsor or not. If your household is going to be only two people (husband and wife,) your annual income has to be $17,112 or more. A beneficiary, on the other hand, does not need to work and is not asked to show his/her income. i used ups and fedex alternately and the documents arrived in 3 days just the same. regarding the annulment, she has to follow up on Advance Endorsement from the municipal registrar that has a record of her prior marriage and send it to the National Statistics Office. Her marriage certificate should bear an annotation declaring the marriage null and void based on the Annulment Decree. Mine took months to be released from the NSO because my name was misspelled on the annotation. it had to be corrected again by the local registrar and sent it again to NSO Manila.

i am still using my married name at the workplace as i haven't told everybody about it because i don't want to answer why's and how's for a hundredth time. i think there's no problem if on her passport and nbi clearance she is using her maiden name. if she has children, better have a solo parent id with her maiden name on it.

It varies by embassy and consulate. In Jakarta, you can get an interview as soon as the next day after turning in your documents. Most countries have a waiting period of 2-4 months for the interview. Some are long, like Montreal, which takes about 6 months.

If you click on the embassy info page, it will give you an idea how long it takes to get an interview in the country you are petitioning through.

It looks like you had an RFE, which definetly would have delayed your processing time. Most February filers were approved in May.



yeah, I got flagged because the UCSIS didn't believe that I was a US citizen (since 1976 baby!) So I had to re-send my passport to them.

So I sent in a request via internet for the K-1 visa interview. Sent it 3 times matter in fact. This was back on the 9th of Sept. They explicitly said don't inquire about interview requests until 2 weeks have passed. I even tried. Got rejected everytime. So I waited...until the 2nd week. Inquired about the request....and guess what. THEY NEVER RECEIVED ANY REQUEST!!!!!

Ok didn't want to start a new thread so figured I'd tag on this to try and get clarification on what is said above as it pretty much covers my subject. My girlfriend is in the Philippines, her mother and sister live in the US, I'm a new US citizen.

As we are frustrated with being apart I was thinking that I could move over there for a year or whatever while the K1 gets processed then come back to the states when visa issued.

So from what is said above is this correct that if I submit the application in the US with my girlfriend's mother/sister's US address I can then jump on a plane and head out there and be with her until the visa is complete?

I looked through the step by step guide and it doesn't look like I need to go and interview at all, she just has to do it all locally over there?

She had queried an agency over there and they had said I would need to stay in US and prove I had a home and a job but having looked through the form and requirements I see no mention of anything like that, can anyone concur?

Also her Mother is only green card holder and has had a petition for her in for years, would we have to cancel that before submitting the K1?

You will need to show that you have a US domicile but that's easy. Keep your drivers license, a bank account and a friend or relative's mailing address. The public charge issue is a bit more complicated. Unless you have a US Citizen co-sponsor, you are going to need to show by assets or income that when she arrives, you can support her at least to the minimum required.

So, you don't technically have to be here but depending on your circumstances, you might need to return and become employed long enough before her interview to show enough current (annualized) income to qualify as her sponsor.


Do you know what the amount and periods are for the above and can you do it with just assets?

(I looked at that 864 form that JASMAN just posted and it just had salary minimums)

Yes some agent being the visa agency she visited to see what they offered for their fees, we decided they were adding no value to the process so never used them and did it ourself but they had mentioned that we needed to move quickly because of fee rise and how it would cost us $285 extra X2 for her and her daughter. (Good example for those people who post on here if it's worth going with an agency...no, they're useless is my advice)

As soon as I got the return I was kicking myself for not coming on here and asking the questions. The extra money is very annoying but it's that whole wasted month that has seriously pissed me off!

I thought that if you sent your application before the 30th July then you could submit using the old fee of $170 (postmark says 27th and it arrived 30th..then they stamped envelope August 2nd) . They returned it to me and said that I had to submit $455.

However I did submit 2 X $170, the second fee being for my girlfriends daughter. We had been told by some agent we had to pay for her but the paperwork returned said that a single fee of $455 is required with a note saying children do not get charged (the first reference I have ever seen about this). Would this be the reason for knocking it back as it's the wrong old fee, and I suppose now as it is a later date they demand the new fee? (But it does clearly say on my return "cannot be accepted because $455 not attached")

I guess it's not really the money that's the problem, I'm more annoyed at having lost yet another month. I was hoping that if I could call foul on them with the date then I could have them give me back that month (assuming they agree with me). I do assume that me returning with the new fee puts me right at the back of the line again?

Ok this is sounding like a rant, it kind of is but any advice from any one would be appreciated.

Hey Julia,

When I filled out all the paperwork for Duygu's K3 Visa, I did not include province information on the paperwork. When it came time to entering her address information, I simply listed Istanbul, Turkey and Bursa, Turkey and I never had any problems.

As for the processing time information on the USCIS website, I would take it all with a grain of salt. I did not find those processing times to be effective in my case. Sometimes I would get updates and approvals before the processing dates listed on the website, sometimes it would be the opposite.

Let me explain the situation, using handy bullet points:

• I am a U.S. citizen; my fiancée is a Japanese citizen and has been living in the U.S. since March 2003 on an F1 (Student) Visa.
• She completed her degree at the end of 2006 summer term and her Visa expires at the end of this August (2007).
• We've been planning on marrying this summer, perhaps early July.
• We both have full-time jobs, working as contractors.
• We have a substantial "nest egg" saved.
• She has had a very difficult time finding a full-time, permanent position because of the employer-based Visa sponsorship issue (i.e., few companies seem willing to sponsor these days, for whatever reason).
• We have been together for 3+ years and have several "bona fides" that can attest to the legitimacy of our relationship.
• We have no children.
• We basically live together but do not share a lease contract (we each have our own place).
• We do not have a joint banking account but would open one if necessary.

I've reviewed TONS of materials, including here and elsewhere, but it seems the more I read the more choices there are, and thus the increasing confusion. Is this a typical K1, or K3 Visa situation? If so, do we start with I-129F form, or I-130? She's been living in the same state for 4+ years and has no intention of going back to Japan unless there's no choice in the matter. We really don't want to bother with an immigration lawyer, so I came here for some help.

A couple other queries: I've been thinking about paying the $1000 bux or so to an attorney to help, since they claim to have 100% success in obtaining the visas. Does anyone have experience with these companies, or think that it's unnecessary?

The only problem I can think of with our criteria is that, well, we just met in February, and although it hasn't been that long, we are completely sure we want to spend our lives together, and especially since it's going to take a LONG TIME to process these documents, we don't want to waste any time "dating" from overseas...Would they deny us on the basis that we didn't date for very long?
Also, while I was in Brazil, through some dumb fluke I only got a 30 day tourist visa, which I overstayed for about 2 months.
And, we only have but ONE photo of us together (since my camera was stolen 2 days after we met :( and he didn't have one at the time.)
Are these issues a big deal, do you think?

Hi, I'm American and my fiancé is Brazilian. We're just now beginning the K1 visa process. I've talked to a couple people. Some people have told me that it is ALMOST IMPOSSIBLE to get a K1 visa for him to come join me here. A Brazilian married to an American told me it's better to marry in Brazil and get a spouse visa. Unfortunately, that seems a little financially prohibitive at this point (plane tickets for BOTH of us, maintaining rent here, not working while I was there, etc.) whereas if he were to come here that would be manageable. I'm afraid to go through this process and then have our request denied (after having wasted so much time and $ and hope). We're willing to do whatever it takes, but can somebody tell me what the CHANCES are of having our request denied, and what we can do to make sure it comes through? I'm worried! I just want to be with my love as soon as possible (and we realize it will probably be a year or so.) Any input would be extremely appreciated, especially from US-Brazil couples who have both succeeded and failed at their requests.

Well, I'm getting EVERYTHING together FINALLY to send off the K-1 petition!
On the G-325, I've got a couple little issues.

1. I honestly don't remember ANY of the many of the addresses I lived at during college, as I moved a lot and did not keep records. Is it ok just to put my mom's address, which I have listed as my PERMANENT ADDRESS for years, even though I did not live there? So far I put my mom's address and made a note of the college address thing.

2. I had soooo many jobs in the last 5 years. Can I just put my current one that I have had for 2 years (since that is the financial information that really matters). Is it ok just to put "Student" before that (with the name of my university) and note that I had many, many jobs during those years?

3. I am sending in copies of our Myspace and Orkut commentary pages...But we always communicate in Portuguese...Should I translate it (just lovey-dovey stuff) into English, and do that form that says I accurately translated both pages.

Any tips would be greatly appreciated!!!

After months of getting things together, I finally sent of the packet today!

I fear that I perhaps we have not furnished enough proof of relationship. I never kept our msn conversations, and I finally gave up on printing a copy of my skype records when I couldn't figure it out after a week of trying.
But I did have a letter, our comments on our online myspace and orkut pictures, and my plane ticket to visit for three weeks over Xmas and New Year's!

I have done a lot of research though, and I figure it's better to send it off and have forthcoming evidence ready if they ask for a RFE. I sure hope not though!

I'm so grateful for this site and forum, I don't know what we would have done without it!

Just looked at my bank account and the check has been cashed!

Does that mean we already have a NOA1?

I know there's some number to put into the USCIS system but its unreadable on my check....

I will be getting something in the mail, right?

(Sorry if I'm asking dumb questions, I really do read this forum ALOT but I'm still confused)

I'm happy it means things are on track though, now, they can't just take my $455 and do nothing haha!!!!
