I would like to get more information on the addition of Brasil to the VWP. If it's already in place (functional) that means my girl could come up to see me for say 90 days, return back home for her interview and then fly back here. We would be together 90% of the time instead of being apart for 90% of the time!!


Just be careful of that. I know for Germany it's 90 days at a time, but more than 6 months in a year is considered a no-no.

I agree. Once the visa is approved and you can plan for US entry, then you can begin planning a wedding if you want the big to-do. If that doesn't matter, or finances dictate that you must wait to do the big thing, then what is the deterrent in going to the courthouse and getting married? In some states there's no waiting period after getting a license, or it's only 2 or 3 days.

Please also write the Arizona State Bar Association, with copies of your paperwork and a copy of the information form from USCIS. If the lawyer's assistant handled this, the lawyer is still responsible. They should be refunding their fees as well as what you paid the government.

Dude make your own thread if you have an unrelated question...

bwahahahaha. Touched means just that they have literally touched your application or updated it. You can tell because your date changes online (on your case). It's under the guides.

Andrew, here's a thought. You do miss your family and friends back home and you and your fiancee aren't sure if you are ready to rush now. The process can be lengthy, especially now, and it can be daunting. This is obviously a personal decision for you, but here are my thoughts. Listen to them, trash them, whatever smile.gif

1. Consider how long you've been together already and if you've had any long-distance experience before (long vacations, etc.)
2. Will you be able to visit during the time you are waiting for your K1 to process? This has been an important factor for my fiance and I because we've not had to go more than 5 months without a visit. Some on here have gone far longer, but for us, it wasn't an option we wanted to consider (though if we had no choice, we would of course deal).

3. Has she met your family or could she come for a visit.
4. Are your family accepting of you being required to have a wedding ceremony in the US?

These are just a few issues that I thought of when we decided to embark on our journey. The difference is that he's at Uni in Germany and we started out long-distance.

Most people just don't understand what this is all about. Especially the stress of it all. I have joined the USAF and am leaving for basic in november and Alex's Visa is only valid until February, so I'm having to deal with applying for vacation to marry and housing which is difficult to get since I'm not offically married. If only more were as understanding as those who have gone through such a process...

Well, I'm a high school teacher, so I get 2 weeks at Christmas, a week in February, a week in April and 2 weeks June, all of July and 2 weeks of August. P is in graduate school and Germans like their vacation time. Even though I'm the one with the "real" job (he works for the uni), he has less expenses than I do so I have only made the trip to Germany 2 times. He's been here 3 times, the last time for 6 weeks. I'll go there in Christmas for 2 weeks and he'll come here a week later and stay for another 5 weeks. He's working on his thesis and can do his actual work-work from anywhere with an internet connection, so he can work here.

Then we won't have any visits from February until he moves here in July. I feel very fortunate for all the time we've had together, but I still hate the thought of going 5 months without a visit. The only consolation is knowing that when he comes in July it will be for good. (We hope it's July!!!)

My two cents: once you get the visa, do what needs to be done for the wedding from Canada. Go to the US and then get married! No reason you can't do the legal wedding right away when you get your visa and still take 4 months to plan the fancy wedding. I think that's what a lot of people do. And you will be with him, can have already applied for AOS, and will be much happier than going back to Canada and playing the waiting game all over again.

Sorry :-) I remember when we first started even looking into this process I talked to some friends who had done it and my mind was racing. I highly suggest the guides and the FAQs for help with much of this. VJ is just short for "Visa Journey" so don't worry it's not an immigration thing smile.gif

Since you have your Notice of Action (NOA1) you can input that and your filing date and hopefully get an estimate. Good luck. And don't stress too much. You must be talking about the California Service Center. Supposedly the time on the USCIS website tells you the date of applications that they are processing. In other words, according to the site, CSC is processing applications they received in April. However, this is not correct, as we know of many filers on VJ who filed their petitions in July and have been approved in the last week....

The I797 Notice of action here has a recieved date of Nov 13th 2007 and Notice date of November 19 2007 , im trying to estimate the time for the approval , can anyone please help me with this . I would really appreciate the help thank you


I really think the VJ estimate is a pretty good one. I know it's been off for some people, but I think the processing is taking somewhere around 4-5 months normally. Have you filled in your VJ timeline and looked at the estimate there? Otherwise, I'd say roughly 5 months is correct, as the first poster said.

The funny thing is that we planned the filing the way we did knowing that P can't be here until June at the earliest anyway. He has to finish his Diplomarbeit first and get his graduate degree. So we don't really have a choice but be patient. For some reason getting the NOA2 has calmed me down though. It means that things are progressing the way we want them to.

But overall, P is incredibly patient and very optimistic. I won't lie, this sucks butt, however, we'll just take our few visits and promise that once we get to be together "For reals" that we will truly appreciate the time together. I think this has made (and will continue to make) our relationship stronger.

Dont waste your money on a kit like that.
Use the step for step guides here on VJ,thats all you need.



ITA with everyone else. And if you're still nervous about messing something up, go to the library and get NOLO's Guide to Fiance and Marriage Visas. Someone else on here recommended it to me and I got my library to order the newest edition and it's been fabulous in helping us feel secure about the interview part. Between that, VJ's guides, and the occasional question to members here, I've had a really easy time.

4:00am this morning my fiance called to say interveiw went perfectly and he will have his visa in a week!!!!! My honey is coming home! What an incredible, heart wrenching ride this all has been. But in the end worth every tear shed, every minute spent missing your fiance. For all of you waiting months and months god bless you. Our visa was approved start to finish in just under 2 months (and thats with the holidays). I guess we were EXTREMLY lucky with the right service center and consulate. Thanks to all on VJ for your help and guidance and to all those who said a prayer for us last night. I am rooting for ALL of you out there. Best of luck for a speedy process. :)

The best thing you can do for yourself is plan for a long wait and have it be shorter, rather than hoping for a short wait and finding some delays. Many can tell you that even within the same consulates the waits can vary from case to case. Ours was exactly 6 months start to finish. I saw a few cases filed through our consulate where the FBI name check alone was 5 months and others were just a few weeks. Stay in touch with each other and continue to get to know each other so you will be well prepared for the interview. Sounds like you have a long history so that shouldn't be an issue anyways. I did 2 sheets of wallet sized photos (9 per page) and wrote under each one. I also sent copies of my passport and boarding passes to show the dates I was in his country. Good luck.

I'm not sure about the visa waiver program, but from what I have read on here as long as you didn't overstay by more than 6 months you will be ok. I used a lawyer because I had 3 of the 11 red flags and wanted to be certain that I didn't miss anything in proving the validity of my relationship. Had I found this site before I hired the lawyer I probably could have done it on my own. The only thing that my lawyer had me send that the VJ list didn't include at the time was my fiance's passport. So he saved me time from an RFE I suppose.

I agree. Aside from having an unknown wait time to even get the visa, IF the visa isn't denied, there is still the possibility Heaven forbid, that the situation won't work after you are together in the USA. I have heard of several recent relationships breaking off just before the interview or within a few months after the SO arrives in the USA. Since it doesn't help you get a visa, I'd wait.
