Ok, I've read the faqs and flowcharts and forums but I'm still not completely sure what i need to be doing. We got approval notice NOA2 and the letter saying the case has been forwarded to the consulate in Brazil. I am getting all of my financial information together, a new letter of intent, updated evidence of our relationship, etc, plus a copy of the entire first package to send to my fiancé, but I'm a little bit confused about what he needs to be doing. Does he need to get the medical and the police report BEFORE the interview? And what EXACTLY is he looking for, I know there must be some specific exam/ some specific document. But I have not figured out what those are.
Do I need to send my financial documents anywhere else or just to him???


I would just like to know better precisely what I need to be doing, rather than just kind of knowing.

Perhaps I missed a more specific post about this.

Any help would be very much appreciated.

Hi Micheal. I do not know much about applying for resident card outside the states but I am happy that you're getting married. I say this because I don't see many people here from Mongolia. I am from Mongolia and I got married to my U.S. citizen husband last month and applied for AOS this month. It took me about 4 months to get all the information and papers needed. They asked for my Mongolian birth certificate and my mom scanned it for me from Mongolia and I got it translated into English in the states. This was the only piece of paperwork needed from Mongolia. Everything else I gathered it from here. I do not really think your fiancee will apply for green card from Seoul. She should be able to apply for it Mongolian U.S. Embassy. I know people who applied from Mongolia. You should check the direct consuling or the immigration visa from their homepage. Anyways, good luck for you guys. I reside in Seattle, WA. If she happened to be coming here would be cool to meet with you guys.

First let me say I am brand new to the site and very happy to have such a resource!!!

I am an American with a (lovely) smile.gif Indian fiance. We filed the original petition in Aug 07. She on Monday sent off the completed DS-230 to the New delhi office. My immigration attorney while good at document preperation really has no inside knowledge about timeframe. Does anyone here have any idea when she can reasonably expect to be called in for an interview? We are both obviously getting anxious and are just praying for a smooth execution of the vsa!! The I-797 NOA was approved on 1/29. We have since filed the DS-230 and are waiting for the interview date. I just now noticed that the orginal I29f approval expires in a week. It seems we will need to file an extension but Im worried as yshe should interview in the next month. We are 279 days into the process and Id hate for things to be delayed anmore than needed.

My fiance just had his interview on June 16, and our K1 visa was approved!!!!! So, after 9 months of waiting, we finally have an approved petition, and should be receiving the visa in 3-10 days!!!
My fiance is booking his flight to arrive here next week, and we're trying to figure out where he should fly through, to try and receive the temporary work authorization. The only POE I've heard of actually giving out the temporary work authorization is JFK, but it's incredibly expensive for my fiance to book a flight through JFK, compared to every other airport in the US!!
I was just wondering if anyone has heard of any other POE's giving out the temporary work authorization. We'll go through JFK if necessary, but if there's a chance of receiving it at any other POE's we would love to try that as well!

You said you met in 2007. The fiance visa requires that partners must have met WITHIN 2 years from the date the petition was filed. So you technically meet the requirements. It said must have met and not must have a relationship, that is, romantic relationship.

I know someone back in June 2008 from the Philippines where I came from who met her partner online for only a month. The guy immediately filed a petition for her. The girl was approved after a very brief interview at the US Embassy in Manila. She did not even receive the pink slip which delays the delivery of the visa and the passport. She got the visa ON THE SPOT. That was unbelievable, yeah? I felt jealous, I thought it was unfair, but hey, it happened!

So the others who responded to you were right. Just be honest. If you can retrieve proofs for your 2007 encounters, better but if not, proofs of 2008 encounters are fine. You've MET WITHIN 2 years from the filing date of the fiance visa application, that's the no. 1 requirement according to USCIS. And another important thing is that you have formalized the relationship, you are not merely friends, you are ... how do you call that ... lovers/boyfriend & girlfriend/fiance and fiancee. There is now a RELATIONSHIP.

I brought the following to my interview, some of which came from my American citizen fiance: copies of emails, photos, copies of telephone bills reflecting his telephone calls, letters, cards. Not of all them were asked for but I brought them all anyway.

(Anecdotally, my best friend's brother is having his wedding to his Mexican bride in two weeks, and she'll be entering on her K1 a week or so after they honeymoon in Cancun. They'll then legally marry after she gets here. Not a hint of worry anywhere. They know the laws and they know what they are doing. I think sometimes this place, as helpful as it is, creates one new fear for every 4 it puts to rest.)

Ok, I'm going to be an language nerd here but:

According to Webster's Dictionary
a wedding is: the formal ceremony in which one is to marry another person.
a marriage is: the social institution under which a man and woman establish their decision to live as husband and wife by legal commitments, religious ceremonies, etc.

So technically, the words are interchangeable and synonymous. In fact, they are listed as synonyms.

I know I sound like an azz by saying that, but the point is that some people don't understand the difference. I think what should be clarified is the legal or civil aspect of the ceremony. I am planning on a relgious ceremony, non-legal in my SO's country and non-legal in the US. If we are asked when entering the US if we got married in Germany, no we did not legally get married. I think that some people are afraid that a religious/non-legal ceremony in their SO's country will look bad. I read a LOT of information and made some phone calls before I felt comfortable with the idea myself.

I am just curious how this shoudl be outlined. I dont know what to put on this page other than the dates. Can anyone just show me an example of how they did it?


I would write it the same way I would send an email to a casual friend who asked how I met my SO. There is not set outline but you only want to mention things you can show evidence of. For instance don't mention traveling to a city you don't have a hotel receipt, ticket or boarding pass for.


I second this. I wrote it in three or four paragraphs. I briefly explained when we met the first time, including the dates and some places we went. Then I explained the next several visits and included some (non sentimental) info about him meeting my kids and our engagement. For everything I listed I have ticket stubs and/or photographs to back up.

If you don't give them his old A# then they may well assign him a new one. They may anyway. Or they may continue using the existing A#.

The point is that if he has a history with the USCIS or its' predecessor INS - and he does - they want to know about it. They will get his old file out of the archives and review it as part of the processing of the new case. His A# is the identifier for his old file.

My fiance had a green card previously which he surrendered when he moved back to Germany. His father was transferred to the US, the whole family was here for about 6 years and they all (parents and 4 children) received Permanent Resident cards. P was over 18 when they left the US and all of them surrendered their GCs to the consulate upon their return to Germany.

I'm wondering if this is something that we need to disclose somewhere in our I 129f paperwork. We've both looked, we've read guides here and scoured the USCIS website. I may be missing something, but I don't see a reference to this. I know that if he had overstayed a visa that could be an issue. Should we worry about this? Does it even matter? Everything was handled through his father's company and all the proper channels were navigated upon their departure from the US.

For that matter, he does have a SS number, which we've put on the paperwork, but obviously since his Green Card was surrendered, he no longer has an A number.

I truly did not think it could be this confusing, yet, here I am again asking a question which may be obvious to some....but sure as heck isn't to me :)

Any ideas?

You can put Mather AFB Sacramento Ca. When you where born thats what it was referred too :yes: Rancho Cordova just became a city a few years ago ;)


I would put as City "Mather AFB (Sacramento)". I assure you Mather AFB still exists as a place, even if the base itself is closed.

Rancho Cordova celebrated the first day of cityhood on July 1, 2003, so Rancho Cordova was not the city of your birth.

There are other reasons to have a ceremony outside the US. Its pretty unlikely that my fiancees parents will even be granted a visa to the US, much less any of her other relatives. Not to mention, it would be rather expensive for her family and relatives to travel here, even if they were granted a visa.

We preferred to take K-1 for a few reasons. 1. We could get started right away rather than waiting another 6-9 months to make another trip to actually get married. 2. Its shorter than k-3 or CR-1. 3. We preferred to be together once we are married and not apart anymore.

We will be doing a simple ceremony and reception in Indonesia before we leave together to the US. For us, its the best option for all the parties involved. We get to take the faster route at getting together by getting a K-1 visa. My fiancees family gets to celebrate our wedding while we are there.



I have to agree with Dan + Gemvita and with TimsDaisy. As long as people understand the laws of the country they are having a ceremony in, I don't see why people here get so upset with the suggestion?

There are plenty of countries in which a religious ceremony is not considered legal. In order to make the wedding into a LEGAL MARRIAGE one must file paperwork at the civil registry or a courthouse, etc. A pastor/preacher/priest/officiant cannot "accidentally" do that because only the man and woman applying for the legal marriage can do so. The reasons for having a wedding celebration in the Non-USC's home country generally have to do with wanting to incude his/her family and friends who are otherwise unable to attend a legal US ceremony. I figure if my fiance is leaving his country, his family, and his friends to be with me, the least I can do is have a celebration in his home town so that they can all be involved. We checked the laws beforehand to make sure that the celebration is non-legally binding. If asked at immigration if we are married, our truthful and non-fraudulent answer will be "No."

And again, many people on here are offering anecdotal answers and not "advice." Anyone who would blindly take advice from a person on a website who isn't an immigration attorney and then complain if things don't work out, should probably not be getting married or having a wedding in the first place. I don't mean that to be rude, but seriously, I read and gather information to help augment my own research and in the end, the advice, comments, suggestions, anecdotes, are just that.

I am sorry for your separation, but there are people who have been separated for far longer than 2 weeks and who are just as frustrated with the process. That doesn't mean the process doesn't suck, because it does, but that doesn't mean (imo) that we should skirt the laws.

But still...I think that fees to keep people apart, plus a waiting period (especially spouses, which have a longer waiting time), is somewhat inhumane. But, you know, it's all in the name of national paranoia.


I would say national safety. I would also say that though are laws may seem ridiculous and more stringent, especially when you view the laws of other countries, there's a reason for it. I could move to Germany and marry my fiance and become a resident in about a week. However, there aren't flocks of people trying to immigrate into Germany in the same manner that people are trying to come to America. If no one wanted to be here then we wouldn't have some of these issues.

I may be wrong, but I believe that USCIS is supported wholly by the fees....someone please correct me if I am wrong.

The amount I'll need to dish out for the I-765, I-131 and I-485 just increases from $675 to $1575, as I'll be filing a month "too-late" for moving to this godforsaken place that the US is.

I almost feel like dropping the move...this is adding insult to other already annoying factors.


Then why move here? You have the freedom to NOT come you know.....There are enough people who want to be here who will take your place....

Do you have stamps in your passport to show when you entered/left the country? That could help. I didn't have all my tickets or P's tickets either.
I am sending what I have, with copies of our passport pages showing the entry dates to back up my explanation of times/dates we met. I also included
a copy of my airline frequent flyer statement with the dates.

There's been a lot of discussion on this on here. Someone in the UK forum can probably help you more, but it depends (I think) on whether or not the "wedding" is legal in the country in which you are planning. For example, my fiance and I are having a non-legally binding religious ceremony in Germany with his family before he comes to the states. In Germany a wedding is not legal (and therefore does not result in a "marriage") unless it is FIRST registered at the courts (aka civil ceremony). We can have a church ceremony but it won't ever be recognized as legally binding by the German govt. or the US govt. We will still need to have a legal ceremony in the US upon his arrival on the K1.

I recommend contacting the U.S. Embassy in Nicaragua where the interview will be conducted. Check out their website and send them some emails. I had all the Spanish documents translated in to English. They were all certified translations. I.E. the person or organization that did the translations certified them to be correct translations. However, when we went for our interview, the interviewing officer didn't care if they were translated. Better to be safe then sorry.



I agree with this. I know that the Frankfurt embassy says documents can be in English or German. But you need English translations for AOS.

Most would recommend staying inside the US at least until advance parole is granted. Save the international trip for an anniversary.


Or do the "honeymoon" outside of the US before you ever enter and have the legal ceremony. That's what we're doing. So it's technically not a honeymoon, it's a pre-honeymoon, but once we have the legally ceremony and file for AOS, etc, we wouldn't be able to afford to do what we want anyway :)

My husband and I did that in Germany. Yes, this is what we are doing as well, and for the same reasons. But we did A LOT of checking first to make sure this wouldn't be considered fraud. Since it's not a legal ceremony, then it isn't.

This is a good suggestion. We already did the big engagement party with ushers and the cake cutting and all that to take the place of the wedding in the philippines. That lasted for a few months, but now her mom is back sliding seriously. What are the ins and outs of having a non-legal religious ceremony of some kind in the Philippines? I am divorced, so the church and I have gone our separate ways. I don't know of any other way to have a religious cerelmony. Faith is catholic also.


I know you can get your first marriage anulled if you were married in the Catholic church and then you'll be able to have a Catholic wedding. Or if you weren't married in the church, then you just need a form from your parish priest (or former parish, as the case may be) that says you are "free to marry in the Church." And this, my friend, is why I won't be having a Catholic wedding :) Still, if it's important to her, you might try this. But you do need 6 months of pre-wedding counseling usually.

i know other places sell it too but i just used that link because its easiest from amazon. its just really really useful, i got it before i found VJ and it explained everything. some things that i didnt get from VJ the book cleared up for me too. its worth going down to your local book store and having a look through it...it explains practically every way possible for couples to immigrate to the states and if you can get it on the cheap is well worth a read, especially for people still preparing the I129f package and i will definitely have it come in useful when doing the next stage of paperwork, not to mention the AOS

ddkm, what is the Nolo Fiancee immigration book?

Just thought I'd add that when I was talking to my fiance today he said that both times he's been through customs in Seattle and he says he's coming to visit his girlfriend they ask if we're planning on getting married. The first time we really weren't planning it yet so he said no truthfully. The last time he said that we were planning on getting married after he got his master's. He said they were very courteous and really just seemed curious. This will be the first time he'll go through Atlanta though, so I don't know what awaits him there.

Also, I think the local office here is in Tukwila (there may be more than one, but I know a couple of people IRL that have had to go through Tukwila) and they have issued the temporary EAD to someone that I know who didn't go through JFK to get the stamp. I don't know if this is common or not and it was a few years ago, so things may have changed. I do know that getting a DL here is relatively easy (at least for a German). I asked at the local office when I renewed my DL last month and they said all he needs is his German license (which he keeps) and proof of residency with his I-94 and he doesn't even need to take the test! I was surprised because I had to retest to change from my Louisiana to Washington license :)

Anyway that may have been more information than you wanted/needed, but it just occured to me.

There are quite a few UKers here on the UK forum who will undoubtedly be of great help to you.
May I suggest that you go to the home page and check out the FAQs and read the K1 guides as they are a great help. I spent ages reading the guides (and still had a lot of questions!). Also, if you fill in your timeline to date it will help people to give you information. I too filed in July (not early though and I still haven't heard a thing) and am also in Seattle.


I can answer right now about the visiting. My fiance is also flying in next week. He's going through Atlanta then on to Seattle. As per many suggestions here on VJ, he's bringing proof of ties to his home country (uni enrollment, for example, and a work contract). I suppose if he's asked what the purpose of his trip is, he'll say honestly, to visit my girlfriend. We have been to Vancouver and Victoria before on different visits and though it was before filing the K1 we were asked how we met and how long we'd known each other (at Victoria, at Vancouver they didn't care b/c he still had a valid Canadian stamp in his passport). I would think you are ok. Maybe send him a copy of the NOA1 to bring with him as well? I am sure that someone here can answer more, and again, there are threads about this already.

I would like to get more information on the addition of Brasil to the VWP. If it's already in place (functional) that means my girl could come up to see me for say 90 days, return back home for her interview and then fly back here. We would be together 90% of the time instead of being apart for 90% of the time!!


Just be careful of that. I know for Germany it's 90 days at a time, but more than 6 months in a year is considered a no-no.
