Hello VJ, I hope you can have some advice about my worries right now..

Me and my fiance just meet in Manila and when he visit here, he didnt able to meet my family, only my father who go with me in manila airport to meet him. but we didnt have pics that show my father and my fiance meet.. My fiance have some worries to come here in cagayan de oro since it is a part of Mindanao, since he don't traveled that much even in the US and the US goverment have traveled advisories that they should not visit here in Philippine especially in Mindanao. I've tried to convince him that here is a safe place and a lot of foreigners visit here already but he still not convince. he still decided for us to meet in Manila and while were there , we really don't go out for his safety, we even don't have a lot of pictures, friends do you think I'll be deny cause my fiance didnt meet my family? but about proof of relationship, I have everything, but it's just we don't have much pictures together. He is coming this November but were still gonna stay in Manila just the two of us. I can't convince him to visit here in Cagayan. Please give me some advice... Thanks to all of you. Godbless and Goodluck to our journey.

if there is no pictures, better to have your receipts or any phone bills from him that he is calling you or you calling him by using a Smart, Sun or Globe phone cards or a receipts of package, love letters, cards or the lists of your chat logs. Proof of on going relationship should be given to the consulate on the day of interview.

K-1 Fiance(e) Visa Process & Proceduresmarriage while waiting for k1?
But the only legal wedding in Argentina is performed at the Registro Civil. And take it from me, It is not an easy process. So a religious ceremony is not legal, and they know that in the Embassy in Buenos Aires. Also they are pretty good people in the Embassy in Buenos Aires, I have dealt with them a few times.

Good luck!!! good.gif

There is not enough room to put their address in the box.
Also she lives in Pamlona Las Pinas City , Is Pamplona concedered a state or province . Or should I just leave that out " pamplona "

Even when the address was the same, I put the address on the form. When there is not enough room, just hand write it neatly in black ink.

As far as the other, I am sure someone from your country will be able to give you an answer on that.

K-1 Fiance(e) Visa Process & ProceduresA prayer for those still waiting.....
QUOTE (rupa @ Feb 24 2008, 11:51 AM) <{POST_SNAPBACK}>
Hi Folks,

it breaks my heart sometimes to read some of the stories and situations posted here on VJ. I myself am just starting the procss of waiting and have already begun experincing the emotions that can debilitate and sap your strength as we stumble through this process. I felt compelled to say that the love that we share with our SO's is something that is very precious and worthy to be upheld, nurtured and protected. Origionally I was going to post about how tough this week has been, but decided that instead I should offer up a prayer for those still waiting and those struggling in the process, who have had their love and patience tested.

Father, please hear my prayer.

You say to us Lord that the things that matter in this life are faith, hope and love and that the greatest of these is love. For each and every person who has started this proces of immigration because of the love they share with another, I ask you for your protection over their lives, their family and their relationship. Please grant them grace for the moments when their visa's are held up and the waiting becomes stressful. Father I pray for each couple who has hit a snag that you would watch over their communication, help them to deal with each other in understanding, being patient and encouraging even when it is a struggle to find the stength. Father I pray that their defered hope would not make their heart sick, but that you would grant them a special reprive, in some special way, a break from the stress and frustration of waiting. I ask that you would use this process for the good of their relationship and not for harm, and that you would intervene where the immigration process has treated them unfarely or where mistakes have been made. Pease father bring those people who are waiting too long for their loved ones together soon, bless and strengthen their love for each other and guard their hearts from despiar. Please make their homecommings a sweet sweet moment and watch over them as they build thier new lives together in America.

Amen

Thank you for posting this. It's truly heartwarming and so comforting to know there are others out there going through the same roller coaster of emotions, and somehow, in some way or another, we can lean on each other during the process.

Be well and good luck!

K-1 Fiance(e) Visa Process & ProceduresIgor's list representation of USCIS numbers question
QUOTE (b_weeks @ Mar 13 2008, 04:52 PM) <{POST_SNAPBACK}>
Here are stats for DHS

DHS STATS

These data are so interesting, thanks for the links b_weeks! It appears though, that even the pdf's put out by USCIS wont categorize petitions into any further detail than "I-130 immediate/all other", is that what you guys are seeing too?

The pdf says:

Jan 08: Major Receipt Volumes = 92,149 (for I-130 and others)
Jan 08: Major Volumes of Pending App's at end of Jan = 1,331,114 (for I-130 and others)

Anyone have an idea on how to translate that into how many total USCIS filers are also VJ members? We can determine how many VJ'ers filed each month, but I still don't know how to tell what the ratio is of VJ petitions to total petitions, for say I-130's or I-129's. unsure.gif Any ideas?

QUOTE (psiprez @ Mar 14 2008, 05:47 AM) <{POST_SNAPBACK}>
My instinct is to think that VJers are approved without RFE's more often than the general non-VJ population, and therefore our timelines move slightly quicker. To what extent, I have no idea.

We all know that having the support of the guides and the community is invaluable! And the fact that VJers are saavy enough to seek out and find VJ in the first place makes me think they are savvy enough to fill out the forms and adhere to the process more accurately. innocent.gif

I wonder if the case workers look at our petitions and think, "Oh... another VisaJourney member..." biggrin.gif

I think you're exactly right. The percentage of VJ'ers who end up with RFE's MUST be substantially lower than those who haven't found VJ. I wonder how much time that shaves off for all of us, on average.

Does anyone know if there is another VJ-like site out there?

K-1 Fiance(e) Visa Process & ProceduresExtrapolating Igor's List
To my fellow data-heads:

I've been crunching some numbers in an effort to see how closely we can rely on our dearly beloved Igor's list. (Seeing as how I check it nearly a billion times a day, it would be nice to know how close it is to the reality of our timelines). As far as I know, Igor's data comes from VJ timelines only. It is definitely nice to see how far along we are coming internally as VJ'ers, and of course its nice to see our names move slowly, but surely, up the 200-something person list as we get closer to appearing to be next for our NOA2 approvals.

However, our treasured list is merely internal. This does not indicate where we may be on the actual USCIS list, or which box of petitions we may be sitting in, on which shelf, and how many other boxes may be in front of ours.

From what I have been able to discern (and extrapolate accurately to the best of my ability), VJ members currently represent only about 5% of all K1 Visa filers. That means, when Igor shows us 52 NOA2's from last week (18 CSC + 34 VSC), we can extrapolate that to mean USCIS actually pushed out 1,040 for that week. It's a little mind boggling, but I've double checked my numbers, and it seems to be the case.

Any other number crunchers out there who would like to have a look at my crunching, just let me know, I'll send ya my sources. In the meantime, I guess the moral of the story is, don't be discouraged if Igor shows us little to no activity in any given period of time. Seeing as how we only represent about 5% of the petitions actually being shuffled through those boxes, it may not be a super-duper accurate reading, and things may still be moving at a reasonable pace in the CSC/VSC offices.

(All that said, I'm now going to go back to Igor's list to see if I've made progress from the last time I checked it, about 20 minutes ago!) whistling.gif

Hi guys,
I was wondering if there would be a problem if my fiancee was denied a visa before. She tried to get a tourist visa about 2 years ago. The petition was done through her sister who lives in Boston. Of course she wanted to come a visit me as well.

I don't believe this will have any impact on a K1 visa petition. They are different visas and serve a different purpose. My fiance had also previously applied for a tourist visa, and his country, about 85% of the folks who apply, get denied. I would be curious to see if anyone has more specific experience with this, but as far as everything I've read, as long as you're honest, and note your past applications on your petition, it should be fine.

Good luck to you!

K1 is clearly a non-immigrant visa but that's not the whole story. Because K1 has a path to immigration, they are processed at Consulates by the immigrant visa unit and dealt with at the POE as if the visa holder is immigrating.

You pay the non-immigrant visa fee and enter without permanent resident status.

Immigrant visa holders pay the immigrant visa fee and enter with permanent resident status.

Exactly. I know at the US Embassy in Costa Rica, the K1 is treated as an immigrant visa (meaning you stand in those lines, take Immigrant Visa seeking numbers, and talk to the Immigrant Visa folks).

Seems its not quite as cut and dry as one should think.

K-1 Fiance(e) Visa Process & ProceduresIs CVC picking up the pace?
It's true. The CSC has been actually active these last couple weeks which has been a HUGE relief to those waiting for several months. They seemed to have taken a nice long vacation for pretty much the whole month of April, which was stressing everyone out. But like I said, the past two weeks have shown a lot of activity and has been very encouraging.

That said, the VSC still pumps out NOA2's about twice as fast as California. There are rarely cases of the CSC doing a 90-day approval (except in the case of expedites or Cuba petitions) so I wouldn't get too hopeful for that one. The standard response is "be prepared to wait 6 months for your approval." It will probably be less, and you can keep track of current progress by checking Igor's list to see who from VJ has been approved that week. That is how I always keep track of my estimates.

The average numbers as of today say NOA1 to NOA2 at CSC is 141 days. NOA1 to NOA2 at VSC is 78.

Igor's list is here: http://cse.ssl.berke...ta/default.aspx

Good luck to you! good.gif

Have you heard first-hand from people on vj (or elsewhere) who say they were denied entry at POE because they admitted to having a non-legal ceremony? The reason I'm asking is because my fiancee and I are planning on having a church ceremony in Japan before coming here (but after receiving the K-1). I've checked, and religious ceremonies are definitely not recognized by the Japanese government. Papers must be signed.

We have no reason to tell them we've had a ceremony, but if we are asked our options are to tell them or bold-faced lie. I don't want to tell them if this has really been a problem for people. But I also don't like the idea of lying. I hope you don't mind me challenging your post. I just want to know if this really is a problem since we have been moving forward with our visa and wedding plans.

The link that others have already submitted is the couple I was referring to, it was not at the POE where they had trouble, they were denied at the interiew.

Just like you guys, my fiance and I are planing to have a non religious ceremony and celebration in my country before I depart and use the K-1. I'm more than aware what constitutes a legal here marriage and what is not. BUT one should not assume that POE officers know what constitutes a legal wedding abroad. In theory, a non-legal ceremony that was performed abroad and that does not constitue a legal marriage in the country it took place, should not be considered a legal marriage in the U.S. But on the case mentioned before, a non-legal hindu ceremony was the reason for the K-1 to be denied and they made the foreign fiance (she was obviously not well informed either) sign some papers to quit the K-1 process and was asked to file for K-3. So from their experience we can tell, that the CO would assume any type of ceremony constitutes legal wedding even when its not!

I'm NOT saying that you should lie at the POE, I just think its wise not to offer any unsolicited information. If they don't ask.. then do not bring nor try to explain that you had a non-legal wedding, it might only cause you trouble. Example of Question at the interview: "When will you get married?" Wrong Answer: We are going to have non-legal ceremony here in April, and then we're planning to get married in July when arrive to the U.S." as opposed to just answering: "We are planning to get married in July when I arrive to the U.S. " PERIOD. Same type of question might and will be asked at the POE, and it can be answered, on the same way, you are not lying you are saying WHEN you will get legally married, no need to explain about the non-legal wedding or you'll be in deep trouble as the couple who decided to bring pictures of the non-legal wedding to the interview to prove on going relationship! wacko.gif

If a couple takes the risk (yes, even if it does not constitute legal marriage abroad, I still consider it a risk, since the CO and POE officers take it as legal marriage even when its not!) then be prepared to answer honestly and wisely every question, and if you are directly asked about non-legal ceremonies, then tell the truth... but you must be well informed of what constitutes and what does not constitute legal marriage in your fiance's country. Get informed about the process, learn where the marriage has to be registered and which authority needs to perform it and any other legalities about marriage on the foreign fiance's country.

Thank you very much for your advice. We have scheduled an Interview with the USCIS on April 29th to ask them our questions and make sure it will be okay. We plan to get it in writing as well if we can so that incase we run into any problems we can show that at our interview etc. smile.gif I hope it all goes well! What a bummer if everything were to be set back!

K-1 Fiance(e) Visa Process & ProceduresCeremony vs. Legal Marriage
Hello Everyone smile.gif

My Fiance and I are religious and to us it doesn't matter when we sign our legal documents to say that we are married, as long as we have been viewed in our religion as being married, with a ceremony, and witnesses, etc. Will the US care if we have had our ceremony already but aren't LEGALLY married, just religiously. Then we'll sign the legal marriage papers when I am allowed into the US?

Also, I found a telephone number on this site once (I think it was from this site) of a number that you can call and ask questions, does anyone happen to know what number I can call to speak to a PERSON???

K-1 Fiance(e) Visa Process & ProceduresApproval question
As much as every one is saying it's "more or less" in order the facts really don't live up to that. If you look at this link which shows the 20 most recent California approvals of people from this site....

http://cse.ssl.berke...ta/default.aspx

There are 14 which submitted in November, 4 in October and measly 1 from September and 1 from August. Yet you scroll down and there are loads of us still awaiting, many like me outside the "standard" processing.

It's pretty obvious there must be some magical relationship set up or geographical which speeds the process.

Yes I'm whining, waiting is very tedious...I did it years ago for my green card, I did it for my citizenship and now I get to do it again...whoop-de-doo!
