We set a date knowing that we had a few months for P to enter on his visa. We did actually give our deposit on the venue before his interview and maybe it was a little too presumptuous but we really felt things would be fine.

As the rest of the people said, we just wrote out intentions to get married within 90 days of P's entry in the US.

I agree with Jomo's girl. Hang in there. It is hard, very hard for sure. But think of the things you did and enjoyed before you were separated from your SO and try to do them. Get out with your friends, engage in a hobby or focus on work/school/etc.

One way to make the time go by is to plan "dates" with your fiance. Maybe there's a specific time every day you can talk on the phone or you can get on IM/webcam? If you have a specific time to look forward to that can make things better rather than just waiting around not ever knowing. My fiance and I knew that every day no matter what we would talk on the phone around 10 pm my time (so I could wake him for school/work) and usualy around 2:30 or 3 my time to say goodnight to him (depending on my work commitments). This really helped because I always knew when we would talk. Of course sometimes that wasn't possible because of our schedules but as a general rule this is what we did.

We also did things like read the same books (we only did this a couple of times because of our other commitments) and discussed them. Or we'd watch the same movies. I tried to send him a card or letter every other week and we made always made sure the other person had an email in their inbox by the time they woke up.

Some of these things seem silly and there are times when no matter what you do you are going to feel empty and sad. Nothing can change that except time. But it will get better and eventually you will be together. Two years ago I thought I would never be able to handle a long distance relationship, yet we're getting married next Friday...

Hang in there, hon. Just remember that it's all worth it in the end. Hang with your friends, get busy and do NOT sit around and be sad and put your life on hold until you can be with him again. Indulge for a day or two and then make a promise to yourself to be happy.

For the interview I just sent P a copy of my last two tax returns and a letter from my employer. It was totally fine for the interview.

For AOS I am sending tax returns and letter from employer again, because I make far more than the minimum. I think this will be ok.

Just wanted to say good luck to you. I don't think him having a student visa will help expedite matters though, unfortunately. My husband lived in the US for 5 years, had a 10 year green card, etc. and our process was the same length as those applying for the first time.

Age difference shouldn't be a problem for you, though there have been reports that for some countries it is a problem. It appears to depend on what is culturally accepted and whether or not a bona fide relationship can be proven. It doesn't seem like you need to worry.

On the visa process alone, so far we have spent roughly $400 on filing fee, medical, embassy fee, POE fee (we filed before the K1 fee increased. AOS was $1010.

But, we spent much much more on flights between here and Germany, he paid about €250 to move his belongings to America, plus the wedding costs and the actual savings he had to keep us afloat until he receives EAD.

The thing to consider aside from the actual fees relating to the visa is how often you'll want to visit and how much money you'll need to have put aside to cover your expenses until you can work. Technically I make enough money alone to support our family, but it's nice having his savings there if we need it.

FIrst of all, welcome! Secondly, you should check the guides and the FAQs on the home page here for more information. I recall in the past someone applying whose fiance had overstayed their visa in another country and it did not affect their US visa petition. Proof of meeting her in London and being together shouldn't be affected by her status in London, though I hope others with more knowledge of this will be able to help you.

The main difference between the K1 and the K3 is that for the K3 you are already legally married. I assume you are back in the USA now? If you file for a K1 you will have to wait to get married until the petition is approved and she interviews at the embassy, receives a visa, and comes to the US.

It is very difficult to go through this for sure. I can empathize with your fiancee. I too was a single mom with two kids. It was exhausting sometimes thinking how close I was to being with Patrick, only to realize that as close as it was...it was also so far away (if that makes any sense). We took full advantage of the VWP too. For various reasons he didn't move until this past July, even though he got his visa in April. That was tough too, but we had no choice.

Is it possible for your fiancee to visit you in the UK?

Also, this may provide some comfort to you. We got everything ready for Patrick to send the consulate before he came to visit me. We actually got the NOA2 while I was visiting Germany for Christmas. He had already bought a ticket to come spend 6 weeks with me the week after I returned to the states. He got all his information ready and when the packet arrived from Frankfurt, his parents just scanned and sent everything to us. The rest we downloaded from the consulate website. He was able to send the packet back before he ever returned to Germany.

Hang in there. Both of you. It's tough but you are in the home stretch!

Read the questions carefully and interpret them literally. If any answer is yes, provide the corresponding records. The purpose of IMBRA is to assure the beneficiary is informed of your relevant criminal history, so you'll want to fully brief your fiancee before her interview.

The only criminal history that would get your petition denied relates to the Adam Walsh act, so you'l want to determine whether that applies to you. Just google it.

No one can tell you how long the wait is. Even people filing from the state have varying waits. There is no comparing/rationalizing. Use the timeline information as nich nick told you and you may well get it sooner than that. We had our interview before the date given in our timeline for NOA2. kicking.gif
Morocco is it's own animal once you get the NOA2 from USCIS. You should pop over to the middle east forum and connect with people who have gone through that consulate. We can espcially help you prepare for the interview.

To the OP, if your case got to the Consulate stage and you personally filled out and delivered a "visa application" to a US Consulate abroad, then the answer is yes. If the case was ceased prior to any "visa application" the answer is "no".

The petitioner may want to address the prior petition and its status in their cover letter.



Pushbrk brings up a good point. Have your fiance address the previous case when submitting the original petition. If USCIS approves your petition knowing this information, I don't think the consulate can later deny it. (not an atty, just what I have read around vj). Being from a high fraud consulate, many of us have addressed our 'red flags' in the original petition and not had problems, whereas others did not do this and had problems.

Go to the middle east forum and post. There are several ladies who have gone through Egypt and they can best advise you. Pushbrk brings up a valid point. Egypt is one of the high fraud consulates and can be difficult to deal with. Egypt scrutinizes everything and usally seems to make house calls and neighbor calls to verify things. Coming on a K1 your fiance should be able to get a temp work permit through JFK (if they are still doing it then) and go to work right away. Maybe knowing this would offset some of your financial concerns. (my husband got his temp EAD, started working within 3 weeks of arriving here, and got his work auth just before the temp on expired. While it doesn't always work that fast, even working for 2-3 months can add to your finances)

As long as you are aware of the possibilities of her being denied, and you have a back up plan for it, then go for it. I think people are just trying to point out all angles so you can make the best decision for you. Once the K1 is in the system they can deny despite all the proof of ties if they are so inclined. I-131- This a application for a travel document or AP- If she is planning to leave the country before the AOS process is over, whe will need to fll it out. If not, she will not need to fill it out.

I-485-This application is for the AOS and is required to be filled out and attach a copy of approved I-130 NOA2

I-765- This is the EAD application, This so that she can get a job while USCIS is processing the AOS.

I-864- This is also required. This application needs to filled out along with copies of three years of tax.
I-864 P-This is not to be filed, it is just for your information about poverty requirement.
I-693- This is the medical form. You will need to fill it out and then schedule an appointment with a medical examiner you can find one in your area by going on the USCIS website. The doctor fills the rest of the paper then he will hand you the results in a sealed envelope which you will need to send in with the AOS form.

G-325- This is only for her. She will need to fill it out again along with a photo taken within 30 days.
