Does he pay taxes on the freelance income? If no, then I'm not sure if you'd be opening a can of worms trying to include that income using paystubs that aren't accounted for on his tax returns.

 

Either way he needs to show 125% of the poverty guidelines (before taxes are taken out). If he is $2000 short, he needs between 3-5x the amount in assets, so anywhere between $6000-$10000. If you have savings, you can also submit them, it is at the consular officer's discretion whether or not to accept them. You could drop the embassy an email to see if they'll consider your savings as well.

Consulates usually ask to see 125% income for the I-134 as well. You can make up the shortfall in assets (so, if you are short $1000, you need 3-5x the amount in assets, i.e. $3000-$5000), which it appears you have. Personally, I think it would be best to keep your job so you can get through the K1 interview and AOS without a co-sponsor.

Recent timelines show AOS is taking anywhere between 6 months to a year.

No one is going to check if you kept the job you said you had at the time you submitted your affidavit. But, you will need to show proof of current income at 2 points - 1, at the K1 interview, when the I-134 is submitted. 2, during adjustment of status, after you're married, when you send in the I-864.

 

If you are one of the cases that gets called up for an interview during the adjustment of status stage, they may want to double check that you have a source of income then as well. Safest time to quit is after you get a letter saying you are waived for interview for AOS or after the interview itself.

Thanks so much. How exactly is proof of income done? I just got back to the States, so that's a month I wasn't working in January. Then if I'm filing in March, I'll really only have one month under my belt at this new job. Please tell me they do some math instead of needing a year's worth of paychecks! Sounds like I need to get a second job, like it or not. The 125 percent this year is 19662.50. I'd have to be making 11 bucks an hour at the nursing home to swing it. No idea as to whether my student refunds count toward my yearly income?

 

You'll only need to show proof of income at the interview stage, so at least a few months from now, for sure. You'll verify it by providing a combination of your tax transcripts and W2s from the previous year, paystubs or a letter from your employer stating your income and type of employment (part time/full time).

 

I'm not sure about your student refunds, sorry. It seems like it might be a temporary thing? If so they might not put as much weightage on it.

Unless she has current legal status in the US, she can't stay with you and wait while the visa is being processed. She can visit, but she will need a tourist visa. Alternatively, you can visit her.

 

The first thing you need to prove is that you have met in person within the last 2 years. The best evidence is passport entry/exit stamps, receipts that show you made purchases in her country or vice versa, ATM withdrawal slips, etc. You can include photos in addition to those things, but the photos should not be the only evidence you rely on. You can show more proof of your relationship (more photos, emails/chats to each other, phone call logs, letters, etc) later, at the interview stage.

 

If you are a same sex couple then you should state in the letter of intent to marry that you intend to be married in a state where same sex marriages are legal. See this thread for more info on that: http://www.visajourn...129f-petitions/

 

As to the cost, $1000 is not sufficient. The initial filing fee for the I-29F petition is $340, not counting the mailing, printing costs, etc. There will also be a $240 application fee for the K1 visa, a separate fee for the medical (varies by country) and her airfare to the US. Once your fiance enters the US on a K1 and marries you, it will cost $1070 to apply for a 2-year conditional green card, and 2 years after another $590 for removal of conditions. My fiance and I have estimated our costs to be around $5-6000 in total.

Household size includes people you are financially resposible for, e.g. minor children (regardless of where they live), a spouse, dependents you claim on taxes. If you have none of those then it will be a household size of 2 (you and your fiance).

If you are asking whether it will help establish that you won't become a public charge, then, yes, the consular officer may consider the foreign beneficiary's income that will continue even after they move to the US. Some consulates are stricter and won't look at the foreign beneficiary's assets/income at all, but some may.

If he is just using it to prove meeting you in person within the last 2 years, then it may suffice to provide just the pages with the stamps. That's what we did, and we were fine. You might want to at least copy the bio page as well for easy verifiation that the stamps are from pages in his passport and not someone else's.

 

He doesn't need to send in an original birth certificate. He just needs a front and back copy of it in long form.

If the petitioner is a recent graduate, the CO is likely to understand why he did not make as much money in previous years. Current income is what matters most so you'll most likely be fine on the financial front. The only tiny thing I see is the overtime - is it fixed or does it vary depending on the amount of overtime available? I ask because if some weeks he works 50 hours and some weeks 20 hours, then you have to average out the number of hours he can expect to work for the year in your calculation.

 

As long as it averages out to above the income guidelines, I don't think you'll need a co-sponsor but no harm in having his mom's documentation with you just in case.

Well, you are sending in the I-129F in March and expecting him to be in the US by September. That's quite a short turnaround time and you'll need to have a combination of extremely good luck and planning to stick to that timeline.

 

If in the event it does work out that he's in the US by September, then you can do a quick civil marriage in the US and apply for advance parole at the same time as adjustment of status, which will allow him to travel before receiving his green card. It takes about 60-90 days to obtain AP. So, again, the timeline is rather tight for him to be back in Brazil by December, but with luck, doable.

 

The K1 is a one-time use visa so if he leaves before receiving AP then he won't be allowed back in the US on the K1. You'd have to start over with the CR1.

 

If he hasn't received his K1 visa by late December, then it would be extremely risky to go ahead with the wedding in Brazil (even if it is just a religious ceremony). If the consular officer or the CBP officer suspects you are already married, then they can deny the visa (at the interview) or deny entry to the USA on the K1 (even after the visa has been obtained).

 

Hope it works out for you, but, wow, that was a risky move booking anything before even sending in the I-129F petition. Best of luck.

Use the example letter and just have him sign it. Then have him scan it and send you a copy of the letter signed by him. print this out and send it to them (including a letter written and signed by you too) Real easy, worked for my case. Best of luck =]

 

Letter of intent to marry needs to have an original signature by hand, not a scanned copy. You were lucky you got through without the adjudicator noticing your letter was a printed copy.

 

In this case, since an RFE was received, the letter that is sent in will likely be subject to a bit more scrutiny, so an original should be sent in and not a print-out.

i don't think the words you put in parantheses are from my post. the crux of my post was that the requirements for the I-134 vary by consulate. it is not impossible to get a co-sponsor through any consulate, but there are consulates that are known to be more reluctant and stringent about allowing the use of a co-sponsor - without naming names, so as not to derail the thread, a quick search on VJ will uncover which consulates these are.

in that scenario, the embassy would still allow her to attend the interview, but they would wait to issue the visa until she has submitted the new passport.

 

it is really up to you whether you send in packet 3 now or later. personally i would wait so i could avoid the hassle of re-submitting my passport to the embassy later.

US Embassy Singapore won't print a visa in a passport with less than 6 months validity. So if her passport expires on 12 November 2014, then the visa can only be issued in the old passport before 12 May 2014.

 

If her passport will have less than 6 months validity before the interview date (e.g. interview on 14 May, then takes another week or two for the visa to get issued), then she should definitely plan on applying for the new passport now.

I booked a one way flight trhough opodo.

 

They scammed me and there second follow up email showed a return flight.

 

I contacted them and they said the return leg will be cancelled whihc i was under the impression was illegal and will put me on a no fly list with the airline. However I rang us airways and they said that its fine to cancel it after departure.

 

So im now confused can i travel on this flight to america cancel the return flight and it wont have any affect on my immigration process. For example USCIS having record of me on a return flight i never got on.

 

Any experience would be apprecitaed and who should i contact with regards to Customs and border control as to whether this is allowable? Do i contact the USCIS or DOS or NVC?

 

it is not illegal to cancel a return leg. i have heard of airlines charging a no-show fee in some cases. in general if you cancel way ahead of time, there should be no penalties. check the terms and conditions of your ticket to be sure.

 

since you have a return ticket, be sure to cancel the return leg once you've arrived in the US as there have been cases where the airline forgets to update their flight manifest and the exit system records that someone has left the US when in fact they just didn't turn up for that flight. it can cause complications with AOS, so remember to cancel that return portion.

 

You can't be on any lists if you don't board that flight!!

 Hi,

 

 Does the evidence of meeting and things like that require translations? Like for instance bus tickets, rent contracts and hotel reservations. We have a bunch of them in spanish and most of the content of a whole contract or a hotel reservation looks pretty useless to me so I was wondering if it's necessary to translate the whole things or just some parts or nothing at all? Maybe just an explanation of the paper is enough? And also, can I translate or do I need to hire a translator?

If a document is in a foreign language, yes, translate it before sending it off to USCIS. You don't need a certified translator, and can definitely do it yourself providing that you are competent in the language. See: http://www.visajourn...nt/translations

 

For evidence of meeting, hotel reservations are not considered strong evidence as you can reserve a hotel but not appear on the day. Stronger evidence are things like passport stamps, credit card billing statements that show transactions in your fiance's country/city, etc.
