This is not entirely correct. Depending on the state in which they reside the step-parent does not have any legal recourse to make decisions on behalf of the children, nor does the step-parent have any rights to or privileges to see the children. The biological parent, yes, but the step-parent, no.

I have recently dealt with this in Washington state.

All valid points. Others, like my wife and I, preferred not to go through such a stressful process without the benefit and commitment of marriage. Another consideration is the needs of families. It was better for us to marry where my wife's family could attend. Each couple needs to determine their own priorities. With a K1 visa the marriage MUST take place in the USA.


Very true. And definitely something for the OP to consider.

And I was lucky that my husband and I were able to visit each other often during the process with little hassle because of VWP, great vacation policies, and the ability for his family to attend the wedding. However, we did pause for a time because of the USA requirement for the wedding.

Well just to be clear once again, I am in no way intending to commit any sort of fraud and have already been looking at the guides to apply for the K-1 visa. Obviously I got some bad advice and I had no idea of the severity of taking this option. I didn't even know that it wasn't legal to take this route, because in my case I would be intending to marry her when she comes. Obviously this is a heated topic but I just don't want people to think that I'm here to do the wrong thing. There is no way I would jeopardize what I have with the most wonderful person I've ever met. How long did it take you guys just to gather all the information you need and get the application sent in? It looks quite daunting to say the least. Thanks again and I really just want to clarify that I'm not at all looking to do anything wrong, just trying to get some advice. Thanks

If you decide you don't want to be separated after marriage, then the K1 is the best route. It's a wait, of course, but many people would prefer to get married and stay together, rather than get married and be separated until the visa comes.

The guides at the top of the page are an excellent source of information, but it is easy at the beginning to get confused. So much info and your head is reeling, because you really just want to find the best way to be with the person you love!

You've gotten some great advice on here, and some people have jumped in with anger. I think you made it quite clear in your first post that you were seeking a second opinion from people who have been through the process, not that you were stating "Hey guys I want to circumvent US immigration laws!!!!111" Don't worry about the angry people :)

There are some inaccuracies in this post. First of all, it is possible to marry while on a visitor visa and adjust status, though the burden of proving that your INTENT was not to marry when you entered the country. Merely entering on a visitor visa and marrying isn't fraud. However, the OP can marry legally and return home to file the K3 (spousal visa) and that wouldn't be a problem. Also, it is possible to visit while awaiting the approval of a K1 visa, but it is necessary to show proof of ties to the home country.

In this process patience is everything. It is quite possible that they are still reviewing it. At the time we went through K1 process, there were people who filed 2-3 months behind us that got their NOA2 about the same time as us. There is no rhyme or reason. Have you signed up with the USCIS website to get updates on your case via email? You can sometimes see when it has been 'touched', which is sometimes reassuring that is at least not hiding at the bottom of the stack. I hope you get your NOA2 soon.

1- when you know from AVR that your case was forward to embassy ( mm/dd/yyyy) lets take an example case forward to embassy December 23rd 2009
2- go to DHL TRACK
3- then under track list click on track reference
4- put the reference in this shape EXP23DEC2009A and push track

Yep not really true agreed, every case differs. My case however was dramatically delayed by my lawyer. My lawyer was not aware of the exact requirements of my consulate. It was annoying and I had to do everything when it came to the consulate level.

I took care of 1 girl age 5 at the time, and a boy age 3, both really busy during the whole week. The new family had 3 boys, ages 7, 5, 2, not that busy, so Id be busy. Aahahaha. And I was.

I love kids no matter what, and I liked the boys when I met the family. So, for me it would be a fun challenge, and for sure an awesome experience when its my turn to be a mom (my greatest dream btw). So, the single dad wasnt an issue for me. He seemed respectfull guy, a really good dad, and it seemed we could be good friends. Since the 1st email we extended I felt like I knew him forever. I was not really worried about it. Anyways, the mom moved out after moving back in and out guess 2x. The mother of the kids moved out for good in March, and I moved in in May. And at the time they were sharing the kids custody.. 50/50.

A few days after moving in, my bf and I broke up. blink.gif Such crazy days worried about finding a new family in that State and breaking up a few days later. |o| Well, that was sad just for 2 days basically, cause I was having so much fun in my new life. I used to work hard, but I was able to have fun as much as I could, so it was really Ok!! kicking.gif So, everything was fine, and the father of the kids and I were becoming friends.. and with time we turned into good friends.

Well.. time passed by, and my host and I were getting even closer. We started having some dates. First kiss.. and more dates and more and more whistling.gif , and in September 18th, 2008 we started our relationship.

And here we are.... engaged!!! Its been 8 months since I got back from the States, and 3 since I saw him for the last time. He came to spend sometime with me in Brazil in July. He met my whole family and a bunch of friends, told my parents his intention to marry me.. and finally got on his knees and asked if Id marry him! biggrin.gif heart.gif Sooooo.. here's my concern! Would the fact that Ive been his aupair a reason to have our petition denied? They [my fiance and the x-wife] were going through the divorce process when I moved in, and they got officially divorced on sept 23rd. We did joke around about it saying it was my bday present. My bday was on the 24th. Well.. We sent the package on Aug 19th and on the 24th we had received our NOA 1. So its been a little bit more than 1 month since we had our 1st NOA, I know we are in time to get it, but I wonder so much about it.

Oh, here is another point, that I dont think it would be an issue but I want to share. Im 23 and he is 33. We cant tell the difference, we cant feel, we feel just the same. Just a man and a woman that love each other. Also, today he has 100% of the kids custody. So Im a step-mom to be. Hahahaha tongue.gif

We really fell in love and our relationship is not a sham. Since I came back to Brazil we have gone through really hard moments, but love has kept us. So I really get worried about it..
What do u guys think about our situation?

I wouldnt worry about that. From what I have learned going through all of this is if you can substantiate your relationship as being valid and real, then everything should be ok. I met my fiance on an online video game lol. Its not how you met them, but that you have met them, and you guys have been together in the last 2 years that they will need you to prove. Dont stress about how your relationship started. Just be honest. Good luck!

I just did this yesterday. Just call the NVC at 603-334-0700 press 1 then 5. It will connect you to an operator. Give her your USCIS number. If they have received your case, you can change your address then.

As for thinking you dont have time to plan a wedding while doing the k1 process........well youre wrong. Thing is, once the visa is stamped at or right after your interview, you then have 6 months to enter the us, and then another 90 days to get married. We have actually been planning our wedding for the last 6 months, we just got packet 3 and as soon as his visa is approved and stamped, we will set certain dates and send out invites. We are doing all this being half a world away from each other. It doesnt matter how close or how far apart you are, if you time it right you dont have to go down to the court house to get hitched. Im a wedding photographer, and even though we are doing this via the k1 process we will have a way better wedding than all the ones i shot this season. Good luck to you, its going to be a long wait, or maybe not depending on how the papers get pushed.

I also have to state, that this is in no way the fast way to do it to "get hitched" quickly......trust me all of us that are waiting on our k1s to be approved know that.

How could you not have photos taken together? It's easy to do self portraits. Any normal couple who are so far apart would want photos together. Seems odd.

I am no expert, and my fiance has not undergone the medical there yet, but I doubt that any issues with your teeth will be an issue. She had a retainer taken out which caused two of her rear teeth to be removed. They are most likely looking for any diseases, or health risks that can cause issues to US Citizens. I have not read up on it, nor do I know anything about the medical yet, but I seriously doubt if you have a medical issue (High Blood Pressure for example) or any other conditions that you will be denied unless it causes a health risk to US Citizens.

Dude, I'm sorry to tell you, but it is explicit in the K1 instructions that you must copy ALL the pages of your passport, not just your face page and stamped pages.

For mine, I made color pages of my face page and stamps at Kinkos, then just B & W copies of the blank pages.

You do need to dance to their music, my man, or else get kicked around by them.




I sent them more than enough proof that I am a US citizen including everything that shows I am. I am not sending them blank copies. If they deny me with my birth certifcate and passport, that's just stupid.

I find it simple silly to copy ALL pages of your passport. Why would the front page not be enough? It has my passport code on there they can look up!

I sent in my birth certification back and front, and my passport (First page with signature/id/info and the stamps.

If that isn't enough then they need to learn how to use a computer to look up information.


It is the petitioner's/applicant's responsibility to provide the evidence.

Please don't delay your process by thinking that the work will be done for you by those at the Service Center, NVC, and/or Embassy. Sure way to get an RFE.



I sent in two pounds worth of proof and documents. If that isn't enough proof for them then we don't deserve a visa, no one does.

I sent in plane tickets, stubs, conversations, letters, cards, photos, birth certs, passports, driver license, tourist visa extension, medical bills, hotel bills, receipts and more.

If that isn't enough information for them, then some stories I read here make the USCIS disorganized and needs to be disbanded. Some people send in a few sheets of evidence and their K-1 and G25A's and they get approved, yet people who provide more than enough get denied.

What a joke. I'm not going to copy my entire passport, I included more than enough proof I am a citizen.
