I am wondering if I should include the English name my fiancee has used on social networking and that shows up in the from section of her emails. I'm certain she has never used it in any official capacity; however, it will be seen by reviews as I intend to use those emails to prove the relationship.

Just a few questions with regards to the components of the I-129F form.

Does the statement of intent need to be notarized?

Will my fiancee need to include a copy of her birth certificate and/or copy of her passport in addition to a form G-325A? Or will she submit those items at a later time?

Her address is too long for the form so I will have to use a supplemental, I figure that should not be a problem.

I agree with the others who are saying to have your fiancée sign and date the G325 at the time you see her and not post-date it. When you answer question 18 on your I-129F, you can indicate that you had her sign the form during your meeting at that time knowing that you were going to file the form and accompanying paperwork.

I am reading the guides.. I just didn't see what I was looking for. Thanks for the help. I have a few more questions..

1. How much money should be sent with the form, and does it make a difference whether you send a check or money order?
2. For question 20, it asks which embassy I will be applying at. I am in Canada and am not sure which embassy to put. I thought it was only Vancouver and Montreal, but when I googled American embassy in Canada it showed there are quite a few.
3. According to the guide, for question 18 I should put "(mark additional sheet as "I-129F Supplement: Part B, Question 18: Has your Fiance(e) met and seen you)". Do I write out an explanation on the additional sheet of everytime we have met in the past two years?

Answer to question 1: $455 accorindg to uscis.gov; I don't think it matters whether you use a check or money order
Answer to question 2: I think only the consulate in Montreal issues K1 visas now (K visas are only issued by immigrant visa posts)
Answer to question 3: I personally think it is a good idea to write out your meetings, makes it easier to prove the relationship is bona-fide when your case is being reviewed by USCIS and the Consulate.

Greetings VJ Community!

I'm helping my fiancée fill out her G-325A form and I used the sample form from this site as a guide. On the following section (located approximately halfway down the form) it asks, "Applicant's last address outside the United States of more than 1 year." We encountered some confusion here. My fiancée has been at her current address for less than one year. However, she was at her previous for 5.5 years. Would this be the address she would use in this question?

Near the bottom of the form; this question is asked, "List occupation abroad if not shown above. (Include information requested above.)" My fiancée had written down "None" but I followed the sample form on this site, which left that section blank and advised her to do the same.

Another thing, she had been reluctant to type in the place of birth of her parents because others had told her if she typed it, she would have to show more material about her parents. I proceeded to tell her that if she knew that information, she must disclose it because I am thinking in my mind that not disclosing is deception by omission and a discovered deception would have huge consequences. She listened to me and included the information. With that being said, has anybody ever encountered anything like that before?

I always intended to front-load the I-129F. After reading about the denials at Guangzhou, it makes front-loading more imperative.

While we have been instant messaging each other for nearly 2 years, it was only these past few days that I started saving the conversations so there is not much there. Furthermore, sometimes the way we talk to each other while all good as far as we are concerned, it would likely give a Consular official the wrong impression. I am also inclined not to include a chat log that has gaps in it.

I have all the phone records of us texting each other. I would also throw a text message or two as well. In some instances, I used my phone to sign into MSN messenger, which showed up on the bill.

I have many messages we exchanged on the social networking site, however, a sizeable portion of them were converted to Word documents and not directly from the site.

I will definitely include some emails we have exchanged and was thinking I could also include a print screen of the fold that I have saved the messages she has sent me.


One more thing:
Also, I have been to visit her twice. It was during my second visit that we got engaged. I have looked through the red flags that I've seen posted and I don't see any problems there.

Has anyone ever brought an attorney on-board well after filing with any success?


Most attorneys would probably tell you they would be the most effective from the outset. However, that's only a guess on my part.

I'm trying not to run every conceivable scenario through my head but sometimes it's difficult not to...


I know how you feel. I have confidence in myself with regards to the inital filing. However, I have recently been looking ahead to the consular phase of this and reading the great advice that people are giving and reading what they have done when they went through this. I've also read about negative experiences that people have had to deal with too (i.e. denials). Thankfully I had the presence of mind to save things such as airline tickets, emails, text messages, etc. However, it did not occur to me to save chat logs until very recently. Based on everything I have been reading about the consular phase of this, the best way to describe how I currently feel about things can best be done with a sports reference, "I'm behind in the game and overmatched; so I'm calling a timeout to determine what kind of reinforcements I need." :wacko: If that means hiring an attorney, so be it. This is just way too important to leave to chance and hope alone. I will find my own path and make my own decision.

My fiancee wrote the address of VT when she mailed me her letter of intent. Do I have to get her to make a new one and send it back with Dallas address? Or can I just keep it as is, but send the whole packet to Dallas and not VT?


the TX lockbox facility, which one would a person write down? Since I (or if I retain an attorney) would send it Express Mail, I would assume that is the address to write down.

As for the general subject of intent letters, I have combined my Statement of Intent with an EOR.

I know this is a silly question, but I would rather be 100% sure instead of 99% sure and the question I have is, should my fiancée write her own EOR and combine it with her intent letter? If she were to write her own EOR, could she reference the items I would submit as evidence?

I assume you are pursuing a K-1 visa? Your profile says you are pursuing a F-1 visa, which is a student visa.

This link (http://london.usemba..._documents.html) is directly from the London Embassy website which is the document checklist you will be required to present to the CO on the day of the interview. I did not find anything about receiving a packet from the embassy, but that does not mean they will not send you one. People who have applied through London in the past are better able to speak to that. I recommend you neatly organize all of your documents.

On all the forms I have filled out thus far, I obviously have written the actual street address where I reside. However, I have a PO Box and that is where all my important things are sent. So far, the only way I could see informing USCIS that I want any correspondence from them in relation to the petition to go to my PO Box would be to address that at the end of the cover letter. Anybody have any other suggestions? Thanks!

Greetings. I was denied a K-1 visa because the consular officer said I could not prove that we have an ongoing relationship with my fiance, that why did we have only one photo together. He also said they could not tell whether my fiance is the one who makes deposits into my account. The CO would not give me a chance to explain a thing. I have been married and divorced before and subsequently deported. They said the whole thing is a fraud. They also said we could appeal. I don't know how long this is going to take, I just want to be with the man I love and these people at the embassy just won't believe me. Why are they so unkind?


Tero and NigeriaorBust have perfectly valid points. The second I read that you only had ONE photo made me think that a denial in your case was automatic. From the two in-person visits I have had with my fiancée, there is no shortage of pictures of us together. I'll say that out of those, I have selected 29 that I think are the best. Whether or not all of those 29 are used depends on some things.

Sounds like you have a very complicated case and may need an attorney to sort it all out.

Two questions:

1. When filling out the forms should they be typed in all caps or normal case?


I suggest normal case unless CAPS are specifically called for.

2. When submitting the packet should original documents be submitted or copies?


Copies unless orignials are specifically asked for.

Any time orginals are not submitted, have them ready for interviews (Consulate, AOS, etc.)

I met my fiance online in June of 2009. We have been talking nonstop everyday since then. I finally got the chance to travel to Peru to meet my fiance June of 2010 and spent ten wonderful days together. We are now ready to start our K-1 visa process. However, we are concerned that only meeting once in person and for only 10 days may be a problem and get denied. Do you think this is an issue? Thank you so much for your time.

Thanks for posting the information regarding the service you utilized, the announcement regarding the change to filing I-129F petitions was made in June; however, given postings I have seen about people who sent off their petitions to the service center and then noticed the change to the lockbox facility in Texas, the June announcement may not have been that well publicized. With that being said, I would expect a professional service to look for announcements like that and keep their customers up to date, especially with the amount of money people pay them.

I know you are happy with the package they prepared for you. However, IMO, knowing where to send it is important and the fact that they did not know or did not relay that information to you concerns me.

The Service Center will simply forward any petition it receives to the lockbox facility from now until mid-September. After that time, it will be returned to you with the instructions to send it to the lockbox facility.

I need some help on something(s) and I'm hoping someone will chime in! I'm reading and following directions, but I sometimes second guess myself so I wanted to ask again.

Okay here goes... Filling out papers for I-129f and wondered a few things:

DS-230 Question 12 asks for Present Occupation... this question is directly after the question that asks for Name and Address of person in US that beneficiary plans to live with. So is #12 asking for beneficiary or petitioners information?

DS-157 Question 9 asks for all countries entered in the last ten years, then asks for the year of each visit. Fiance lived in Canada for 3 years. So, would he enter Canada 2007 to 2010, or Canada and list every time he left the country (say to visit home) and then returned? ---Hope that questions clear---

I would tend to agree that a multi-page descriptions of their relationship (AKA the EOR letter) that couples send in with the paperwork when they begin the process is probably unnecessary for initial USCIS review. IMO, I think it is very necessary to send because it will go on to the Consulate for further review prior to the interview and that is where the bar is usually set higher.

Prior to making the decision to alter course and pursue a CR-1 instead of a K1, I had written a combined LOI and EOR. Advice I had received and was planning on taking was to de-combine the LOI and EOR.

Like others have said, sometimes it just depends on the adjudicator and if they decide an lengthy EOR is as good as a simple LOI.

Is it a crime if I put the Texas address? It's not like they have a structure for the fiancé(e) letter of intent or for the cover letter. I doesn't depend on that. Or if I'm wrong, please give me a link, from USCIS only, where it says you should write your service center address on the letters of intent and the cover letter. Because the instructions for the I-129F don't mention it. I know VJ has some forms/docs in the Example Forms section, but USCIS doesn't say that is the right one. They accept it, but they don't request a certain structure for the letters. I hope I'm making myself clear... I still think all they want to see is that you have declared you're legally able and willing to marry, you've signed and dated the letter and that's it. Is it possible to receive a request for evidence just for that, for not putting the right addres on the letters? Or is it possible that they send your petition back? I'm worried. :D Any help would be greatly appreciated!


@Sunshine13: Before I changed course from K1 to CR-1, I told my fiancée to use the TX address that I was planning to send the application and accompanying material to. Even though TX is only an intake center, I don't think it is a problem to use the TX address.

@ToddnJessa: I see why you might be confused. Even though only the service centers in CA and VT will handle these types of applications, it is not clear which states are handled by CA and which states are handled by VT since the implementation of the intake facility in TX.

In my opinion, go ahead and use the TX facility address even though the TX facility is for intake purposes only.

Yeah, definitely don't make any wedding plans until you get your interview (unless it won't be costly or difficult to change your wedding plans if need be). We risked a little by putting down a deposit on our venue as soon as we had the interview date, but our wedding was very low-key and it was far enough in advance we felt safe. Luckily we were, but I've read stories here were people weren't so lucky.

Hopefully you'll be able to have your November wedding, though!

Why will she be deported?
When she goes home you can file a K1 for her and wait. Or you can go to her country and marry her and file a CR1 or K3 (probably not THE best option). Read the guides to decide which visa to use.

If you don't make enough money to be at 125% of the poverty line for your household size (including her) then you will need a co-sponsor. Anyone can be a co-sponsor if they are willing to take on the responsibility.

Please re-read my sentence. It SHOULDN'T but unfortunately, all too often it DOES. Legally, age difference is not a basis to refuse granting a visa. However, it is very often a red flag, especially from certain countries.

OP: You and your fiance will have to prepare for possible greater scrutiny at the consular level. Prepare for your interview. Make sure you can answer questions truthfully about each other. Have prepared evidence of your bona fide relationship. There are others on VJ with similar age differences who can help guide you.

My personal opinion doesn't matter about the relationship. Neither does the opinion of anyone else on here. What the OP needs is anecdotal information, not judgment.

We knew P had to stay in Germany to finish graduate school before he could move here. He did, and luckily he finished his thesis from here whilst awaiting his EAD.

To the OP, first of all - congratulations!

You probably do want to take Wis-Can's advice and have a look through all the guides and FAQs on here to give you an idea of how long you are looking at waiting and which visa might be the best for you. You could apply for the K1 (fiancee visa) which means you'd wait typically 4-7 months before being allowed to enter and move to the US, then you have 90 days to get married and then you file to adjust your status to get a conditional green card. Or you can get married first, return home to Canada and apply for a CR1 visa (spousal visa).

You will need a copy of the divorce decree (and translation into English with certification) to submit along with the other paperwork.

So you can visit her beforehand but think about it, you may raise a red flag if your proof of having met was before her divorce was final (with the decree).

This might raise the question of both of your true intentions and the proof of a real relationship.

Probably best, considering the country and their Embassy's history, is to visit her again after the divorce is final and then begin the process.


I think it's his divorce, not the Filipina's.

But yes, you need to be legally divorced and provide a copy of the divorce decree for the K1.

People have been fired because of inappropriate content/photos, kids have been suspended from schools, etc. Just like anything else on the internet, once it's out there, it's out there for good. You may delete it but that is no guarantee it isn't there.

While the OP is talking about something different, the point is, your comment that 'no one cares about facebook' is completely false. Which is why
a) people should never put anything on FB (or any other site) that could give too much personal information or that they don't want anyone else to read
and
b ) they should know their privacy settings
and
c) it's not a bad idea to have an email address specifically for things like that with no association to your real name

Just saying.

This is not entirely correct. Depending on the state in which they reside the step-parent does not have any legal recourse to make decisions on behalf of the children, nor does the step-parent have any rights to or privileges to see the children. The biological parent, yes, but the step-parent, no.

I have recently dealt with this in Washington state.
