The way I am reading your post, it sounds like you sent your paperwork via Express Mail to the PO Box in Dallas instead of the address in Lewisville that is designated for Express Mail or other shippers (e.g. UPS, FedEx).

My opinion is that it will ultimately be delivered. Thousands of applications are sent to that PO Box by other USPS services (i.e. first class, Priority).

If you buy now before the visa is in hand, you may want to get one with little to no restrictions and/or penalties should it be necessary to change the ticket. However, these are usually the most expensive to begin with. The best suggestion that I have is a re-stating of the embassy recommendation which is not to make any plans until the visa has been issued and is in hand.

I have read that people will write the date on the back of the photo because most cameras these days will not imprint a time/date stamp on the photo itself. If your camera has a clock in it and it was set correctly, then there is software (for sale) on the web that will imprint the date and time on photo files. You could then have the pictures printed with the date/time stamp.

You will want to include copies of your airline ticket and hotel receipts with your I-129F. Furthermore, you will want to include copies of the pages in your passport with the entry stamps on them because that is proof you actually went to the country.

I'm not qualified to answer this one way or the other. However, your above post makes me curious as to why you can't marry in China. If you were to get married in China and your spouse has been living there for more than 6 months, your spouse could DCF for a CR-1.

You will send the application to the lockbox facility in Texas. One of the addresses for it was given in this post:

If you were to send it from China, I would recommend you send it to the Lewisville address.

Furthermore, only the service centers in California and Vermont ajudicate I-129F's. Your application would be routed from TX to one of those two centers.

I think the more proofs the better.

Best advise - be sure to follow all instructins carefully and the guides here on VJ, great tool.

Include several photos of you together at different times and places. Include anything that can link the two of you together and provide proof of a relationship. Some emails and chat logs from when you two met online, phone call logs etc. His plane boarding pass and itinerary to prove when he came to see you. No need to go overboard, just include enough evidence to show you two really have something going on and are serious about committing to marriage.
USCIS in the US just needs proof that you two have met at least once to approve the petition, but i would send more than just that. This is called "front loading" the petition with evidence. So that once it goes to Guangzhou they will have strong evidence already, when your interview date comes you will want to bring more evidence of the ongoing relationship. The real challenge is proving your relationship to the Guangzhou consulate.

How long will he be in China? I think after 6 months you can do DCF= direct consular filing? I read here some people did that got approved in about 2 months.
Otherwise just file the K-1 those take about 6 months.


DCF is only an option for a CR-1 spousal visa, it is not an option for a K1 visa.

The fact that he would have left the US after you got married and then you filed would show that you were not trying to skirt the rules.

I had forgotten about the 6th month validity from date of issue for a K1. :bonk: I think Vanessa&Tony gave you a good suggestion on a course of action and said suggestion was reiterated by coraliesolms. With the 6 month validity of a K1 visa now in my mind and reading what your desires are in your original post, you may find the best course of action is to apply for a K1 and once it is issued, he can fulfill his 3 month commitment to his employer and prepare to relocate during this time. Once he fulfills his 3-month commitment, he moves and you guys begin your new life together. Just don't forget to marry within 90 days of his arrival. After you marry in the US, it will be necessary to apply for Adjustment of Status (AOS). While I suggest you familiarize yourself about the AOS process now, do not overly concern yourself with it at this stage; you will have plenty of time to learn all about it between now and when the time comes.

Since he would be intending to return at the end of the trip, there is no immigration intent on that specific trip, therefore, he can come on the VWP and you two can marry. He should bring evidence of strong ties to France should CBP decide to question him when he arrives.

There is one thing I should mention and I wish I had remembered to earlier. When you start the process, DO NOT use terms like husband, wife, or wedding. If you do, then you will have a USCIS adjudicator or a VO at the embassy say, "you are married, you are not eligible for a K1, file a CR-1." When referencing your ceremony in Thailand, the best terms that I have seen people use are "engagement ceremony" or "engagement party."

First of all: Congratulations to you both! :D :thumbs:

Secondly: Since your ceremony in Thailand was not "official" in the sense that you did not notify any local authority there, the K1 process is essentially the only option available to you as the CR-1 would require a marriage certificate. So you are doing it the right way.

Finally: It takes 5 months from time of filing to approval by USCIS for both I-129F (which you will file) and I-130 (which is for CR-1 and not applicable to you specifically). After USCIS approval, the petition is sent to the NVC, I-130's undergo additional processing (again, not relevant to you) whereas I surmise based on what I have read is all the NVC will do with a K1 petition is assign it a case number and send to the appropriate embassy or consulate (which will be Bangkok in your case).

I had attorneys in US and in the country my fiancee was from. Were they helpful - somewhat? Why did I hire them in the first place? To have a peace of mind and help me navigate the waters should we have any issues or unforseen items. Our case was straightforward but I had attornies anyways. Do I regret ? No - it is like having insurance - a necessary evil. Also, I felt better through out the process knowing all i's and t's were dotted and no mistakes were made. The end result was a smooth process resulting in K1 being granted.

If money/finance is not a factor you should hire an attorney - this is my personal take.
This site has a wealth of information for DIY'ers so you can do this on your own too.

I kind of feel the same way as mcdrew. I'm not a fan of spending the money to retain an attorney but I have read enough on this and other forums to conclude that going it alone for K1 would be rolling the dice, and I have an awful feeling that roll would come up snake eyes. Our case is straightforward and no red flags pertain to us. I have no qualms about filing paperwork for the first phase with USCIS. But to me, the Consulate phase can get tricky. I'm looking for the same piece of mind as mcdrew.

I'll repeat what others have posted; every case and its circumstances are different. The ultimate decision to retain an attorney will be yours and yours alone. People who post on here will give you great advice and information when you ask for it. We are all in this together.

I'm guessing the USCIS told your fiance the minimum requirements for submission of an I-129F. You should definitely send in more than one picture of the two of you together in different settings.

Second question: How long does it take for the k-1 visa to be aprove i know it depends on the fiancee's country and other things, im from mexico and my fiance is in the army he just got back from iraq and came to mexico to visit me and we went to the american embassy they denied us to get in because we didnt had an apointment so he call the congress man or senator from the state he is from, and the junior senator call him back and told us he was gonna wrote to the embassy to let us get in and he did. Few days ago he send him an email telling us to let him know when we sent our form so he would try to speed up the process would that help us?? him being in the army and the senator calling the USCIS???


Published times for approval by USCIS of I-129F is 5 months from NOA1 to NOA2 regardless of country. As for him being in the Army, he could ask the USCIS to expedite if he was about to be deployed. However, since he is coming off a deployment, he could still ask for an expedite, but there is no promise or guarantee that the USCIS would expedite. The Senator calling the USCIS will make no difference.

I highly doubt such a question would be asked at this point. If it is, just answer honestly and explain why. I could not see a visa (especially a fiancée visa) being denied for this.

While the question will likely not get asked at the Consulate, it may be asked when you are interviewed for the adjustment of status process after you are married. I remember my cousin's wife from Argentina told me that she was asked that question when she was applying for her green card.

All you would really need to tell Brazilian consular and border control personnel is that you are visiting your wife. If they doubt that you will leave when your authorization to stay is up, you can show them ties to the US, which would include your receipt for having filed for a CR-1. Keep in mind foreign officials will likely not know the term "CR-1" so if they question whether or not you will leave Brazil at the end of your authorized stay, you would tell them, "I have filed an immigrant visa petition for my wife, here is my receipt."

I don't think there would be any fraud risk at all. The fact that she returned to Brazil after the wedding and you filed for a CR-1 visa would show authorities that you want to do things the right way.


The K-1 process, to me, looks to be a lot more cumbersome and expensive. Also, with the CR-1, it appears she would arrive back here and not need to worry about change of status, and hopefully I could visit her in Brazil and meet the rest of her family while we are waiting.


You are correct, there is no need to do AOS with a CR-1 since it is an immigrant visa. Her passport would receive a green card stamp when she arrived and the actual card would arrive shortly thereafter. I too think the K1 process is more cumbersome and the wait times between K1 and CR-1 are similar these days.

You can go to Brazil and visit her while the CR-1 process is working itself out. You will need to get a tourist visa before going there.

Well, I have started getting everything together for the K-1, and have all the documents downloaded and starting to fill them out. But now, I am having 2nd thoughts again. My fiancee wants to come for another visit in November and bring her daughter and her daughters new husband to meet me. She wants to stay for the holidays, maybe 2-3 months in all, and so now we are thinking about just getting married while she is her and going for the CR-1 instead of the K-1. It looks to be a lot cheaper and maybe even simpler. Anyone have any advice? I know I have to make up my mind and get rolling on this. Is it ok to get married here on the tourist visa as long as she does not overstay and we file everything properly?


IMO: If you choose to get married on her next visit, she should return to Brazil and you can send the I-130 the same day she arrives back in Recife. I do not recommend trying to adjust status after marrying on tourist visa.

You have already started to gather required documents for submission of a I-129F so it will be easy to put together an I-130 packet should you decide to go the CR-1 route.

I found the K1 process to be more complicated than I anticipated (trust me, I did not think it was going to be easy to begin with). To make a long story short, the K1 process was not working for us (and I had not sent paperwork and our case was straightforward) so a change in course was made.

OP: One more thing to consider is how complicated the case may be. I have seen people post that their case was straightforward and no lawyer was necessary. I have also seen people post about issues in their case that made it quite complicated which necessitated the need for a lawyer. Ultimately the decision is yours and you will make the decision that makes you feel the most comfortable.

IMO, the items ArabLoveMorocco pointed are things people "get a lawyer" or "you can't do this without a lawyer" have never thought about or considered.

I have been browsing through the timelines of some of the members on this site, and some had indicated that they had express mailed their package to the Lewisville, TX lockbox...but that their package was then forwarded to Dallas,Tx. Why is that? I thought that we could mail our package to either address! How did they know it was forwarded to Dallas, if they sent their package and it was recieved at Lewisville TX?

The Lewisville address is for petitions that are sent via USPS Express Mail, FedEx, UPS, etc. The Dallas address is used for all other USPS services. I'm guessing people would know the package was forwarded because it was so indicated on the USPS website when they look up the tracking number.

You can use the Dallas address. The service center address on the samples comes from a time when petitions were sent directly to the service center itself. The Dallas Lockbox was set up just this last summer and it is only an intake facility. Your petition will be routed to the service center that has jurisdiction for your state (either California or Vermont). If you want to find out which service center has jurisdiction for your state, call CA or VT.

on the I-129F form, #12,If your fiancee is currently in the US - i answered N/A
what about on the box of Arrival/Departure Record and Date of Arrival box, should I also put N/A? or leave it blank since i answered N/A on #12?

Section #12 on the I-129F asks if your fiance(e) is currently in the US, complete the following.

Since your fiancee is not in the US, it does not apply to you and don't anything to write there.

Since Sweden is a VWP participant, your fiance can come to the US for 90 days without needing to obtain a visa. In that 90 days, you can marry and pack things up before relocating to the UK. Since you will be staying in the UK long term, you should check the UK Home Office for specific requirements you will need to meet.

Copy of birth certificate is sufficient. Sending copy of all passport pages would only be necessary if a copy of the birth certificate was not being sent. Everything else in the list is good.

It is not necessary to submit those items at this time.

The reason why is one was filed for my gal over a year ago by another guy. The guy vanished and stopped contacting her for no reason. She never received any notice from him or the UCSIS if the petition was canceled or withdrawn.

Of course I forgot to add a couple items. Is the K2 timeline same as the K1? Also, is there any other documents we need to submit with the I-129F, i.e. birth certificate?
