hi ryan i forgot to specify that i will be adding a cosponsor (my father) since i do not meet the 125% poverty guidelines.


You and your father will both fill out the form I-134.

I have heard that some Embassies/Consulates do not accept co-sponsors. I don't know if Ciudad Juarez is one of them, you will need a CDJ specific answer in that regard.

Since you would not be legally married at the conclusion of the ceremony, it's ok to go ahead with it should you choose to do so. If you have not yet filed the I-129F, there is no requirement that you include pictures of this specific ceremony with the file. USCIS personnel may or may not be familiar with this type ceremony. However, as Harsh already alluded to, Embassy and Consular personnel should have a general understanding of what is what.

Would you be considered legally married in India by having such a ceremony? In some countries, you have to register the marriage to make it legal while in others, a simple ceremony or a meeting of the families at a certain formal get-together will make the couple legally married.

I have been into the US on VWP several times and never had an exit stamp but the details are in their system.


US does not have exit stamps. When a person departs, they hand their I-94 to airline personnel when they check-in for the flight or cruise ship personnel if they will disembark the ship in another country. If they are leaving by land (Canada or Mexico), they hand the I-94 to the border agent of the other country.

My 2 cents is this, if you want to ensure a CO looks at evidence that you want a CO to see, submit it at the beginning with the initial petition. I have read many posts regarding CO's not taking evidence at the interview. With that being said, I cannot predict what an individual CO will do at an interview, they may ask to see evidence, they may not.

Before I filed I had a problem similar to yours. We had plenty of picture together, but in them we were not wearing any clothing whatsoever. I spent many hours carefully drawing shirts and pants on each of us. And the beach pictures were another issue. I was able to get the Bikini looking nice on her, but I tried and tried to get that Speedo to look good on me. I just could not pull it off. So I had to settle for trunks. Darn those extra chili dawgs.

after getting u NOA2 u wait 4or 5 days, and start calling the NVC ...they will give u a different number called the NVC number and give a second number called INVOICE number which will give u acces to the website so u can pay the fees...


This may not be applicable to the OP because the OP had indicated a K1 visa is being sought. For K visas, all the NVC does is what I previously indicated, assign a case number and sent it to the appropriate Embassy or Consulate. Payment of fees comes at a later time. For Morocco, the fee will be paid at the interview.

AP for CCP membership is automatic. The AP is for a Security Advisory Opinion (SAO). If she became a member only because membership was a requirement for employment, this will be understood. She should prepare a statement explaining why she joined (required for employment).

It is your US representatives or Senators.

I have had the great pleasure of working with our Senator Lehay on immigration issues which he and his staff are excellent at and very knowledgable.

Despite what some beleive, Senators and Reps have exactly -0- control over USCIS and cannot "make" then do anything. Congress does have control of the pursestrings though and USCIS will usually try to at least give them an answer.

A Senator or Congressman can do NOTHING except make an inquiry. In the case where USCIS has made an error (it happens) they can "bump" them into doing something to correct it. They have contacts that you or attorneys do not.

In the case where your case has taken langer than you think it should, they can do nothing.

The best way to contact your Senator or Rep is do go to their office. Just walk in and ask to see the person that handles immigration issues. If the office is far away and you have to drive hours to get there, then write a letter to request an appointment.


You need a timeline then people can give better opinions and advice.

Sure, if she comes here again and you marry, you can file the I-130 petition to start the spouse visa process. She must not overstay her allowed time to visit, and must return to Russia where the will interview for the visa.

Also, it will be important to establish that she did not enter the U.S. on a TOURIST VISA with the intent to marry. If she travels here, with 20 pieces of luggage and they suspect she will be using her Tourist Visa to enter the country, then get married, and stay here forever, she may not be allowed entry. She should plan to come here, solely to visit, then while she's here, you guys can truly evaluate options, and if your love (and your life situations) determine that marriage is the best way to go, you can sure go for it.

Read around on the forums here to get a better sense of others who have experienced similar situations.

It's sure possible, but be aware of how it will look later down the road when you have to explain in an interview why she used one type of visa for something else. Good luck to you guys!

I second that. As far as AUS is concerned, you are just there visiting. When you re-enter the states, you'll be a citizen just returning home, so nothing other than your passport is what you need.

Otherwise, be prepared to take lots of pictures together. These will be helpful come interview time. If you have the chance to get some photos with his family, I'd recommend that too. It's all great evidence of your relationship! :thumbs:

I am in the military and I am scheduled to deploy the first week of July. On the 8th of February we received an email notification that our I129F has been approved. She is from Sao Paulo, Brazil but lives in London, UK. From what I've seen from the statistics on this website, the amount of visas and the wait time in Brazil is shorter. Would it be beneficial for us to change the interview location to Brazil instead of London? My concern is that I don't know how long it would take to process that address change cause if it would be equivalent to the difference between the two wait times, then it wouldn't make any sense. However, we would like to be married before I leave in July. Is that even possible?


Without knowing anything specifically about either Consulate, I would think it's better to keep it with your original choice. Paperwork may already been en route and having someone stop to track down your file and change its course may just put a hitch in the process.

Depending on how prepared you are for your interview, and how soon she can start getting her Packet 3 together, you guys could help the process significantly. In our case, my fiance was actually IN THE STATES a little over a month after our NOA2 approval. From there, it's up to you on how quickly you want to push through wedding plans.

I would solicit advice from those who have experience in London, as they may have a better idea on that Consulate's turn around time.

Save yourself the stress. There's so much to think about when you just focus on the visa, that if you start to consider wedding plans falling through and re-booking everything and shifting it all around, it will be so hard to mentally deal with. We didn't want to do the courthouse thing, so we just planned out a small ceremony and reception that could be easily booked WHENEVER he ended up getting here. When he arrived in July, we were able to book our date for September and still gave guests an appropriate amount of time.

(By the way, based on how our timeline went 2 years ago, October would be reasonable for you. I filed in January and he was here in July. However, it seems like we are an exception, not the norm!)

Costa Rica is pretty relaxed about the interviewing. So many Americans are residing there that I doubt it would even be an issue - especially if you have a co-sponsor for your financials.

A couple things to keep in mind too though:
The Costa Rican embassy moves quick, quick, quick once you get past your NOA2. Look at our timeline: We had our interview less than a month after our NOA2 was issued. The wait may seem SO hard right now, but if will help to set you guys up to be more successful by having your job, and getting things ready for his arrival, it would be better to stay here and wait for your NOA2. Once that's issued, hop on the next flight to SJO!

Check with other Costa Rica folks for this question. A lot of us have timelines that are easy to sort through to get a better idea of timing.

The good news: The costa rican consulate works QUICK!!! We had our interview 28 days after the NOA2 was issued! That was a billion times faster than anyone else who was getting approved around the same time as we were. Once your packet is received by the embassy, you can call and if you are prepared, they will let you schedule your appt. right away. They are usually booked out around 2 weeks ahead. In our case, we had the option to have the interview sooner than I could even get the time off work and get to Costa Rica, so I had to schedule it about a week later than they offered.

I'd be happy to share more about our situation and give you a heads up on your Packet 3. PM me if you'd like more info.

A lot of folks here on VJ have completed their entire process lawyer-free, and have reached their desired outcomes. It seems the advice you have been given is good. Something to keep in mind:

In the early stages, interviews taking place in the beneficiary's country can go either way. Usually the IO will ask which language you would like to have the interview in. Other VJ'ers have posted their advice on how to handle that one.

Later on, remember that your interviews will be happening in the US. Right after the wedding, the beneficiary will be filing for AOS. That does require another in person interview - and you can count on that one being in english. In our case, our IO was not accommodating to the fact that my husband was still learning english. He had a couple very tricky questions right off the bat ("Are you a spy?" and "How many crimes have you committed that you've gotten away with?") and my already nervous husband was thrown for a loop!

You guys have some time to prepare for that round, just something to keep in the back of your mind.

I don't think being obese will cause you to fail your medical. It's not a communicable disease, although it is seen as a disease, it cannot be wide spread to the public.

Hi everyone!

Recently I have posted a thread in relation to the email we got from USCIS saying that the status of our case is document/card production...I'm sure you've seen those. Yesterday we got a hard copy document in mail.

when filing I-129f in November our lawyer put Warsaw,Poland in Q20 ( when they ask about the consulate). Although I'm a Polish citizen I reside and work in Dublin, Ireland. Couple of weeks ago we called, since we wanted to have that changed. We really want the interview to be in Dublin since it will save as a lot of money, not mentioning the hustle!

What came in mail was 2 things.

Simply a note that we made the request and that the consulate will be chosen by the State Department when the CSC approve the petition.

BUT

Along with that came a note that they received a changed of address request and want us to fill out a AR-11. Which doesn't make any sense to me... they ask in that form to fill out present and last address...which would be exactly the same in our case! ?They're also asking for Alien number and port of entry details which do not apply to me. Any one has any insight or thoughts to share?

What is more they're telling us in that note to fill out that form (AR-11) and send it to address in London...why London? Does anyone know?

We're getting frustrated...we're almost on our 5 month mark and were hoping for an NOA2 soon... We were hoping to get married on memorial weekend...

How should we proceed with that? I know you'll probably say to call them...which we will...I'm just hoping to get some insight from anyone with proper knowledge and/or experience.


Hi, like I told you I nearly got the same message. We got this AR-11 too. In our case it turned out that USCIS made a mistake and had a wrong zip-code from my fiance, they tried to mail us the NOA1 but was re-mailed to them, so they tried it again and attached this strange letter and AR-11. The AR-11 only applies for address changes of aliens. My fiance tries to call today to correct the zip code. Maybe check if they have a wrong address of you or if something else is not right in the data?

Me and my Canadian fiancee met while working on board a ship doing non-profit work around the world. I've 'lived' in 34 countries over the past 2 years. When filling out the G325A Biographical Information form, should we list all these countries? I definitely wouldn't consider them residences, but I also haven't actually lived in my USA residence for a two year gap, although I don't believe I ever gave up that official 'residency'.

Ok - so I just got off the phone with USCIS to request a copy of my NOA2 for our interview only to be told that me might NOT be approved bc their system does not show it as being approved.....ummmmmmmm #######???!!!! We got our letter from Department of State on April 22 and my fiance' got his packet from the Embassy on April 26th! What do you mean we might not be approved????

Has this happened to anyone else?????

A friend of mine had the same case like you. She never got an approval notice from USCIS (NOA2), her case was routed to the NVC directly. She got packet 3 and had her interview, no problems. She got her visa some weeks ago and was on the plane to the US yesterday. So you are approved, even without getting a NOA2. The only problem is, for AOS you will need your NOA2. So better try to get one, I heard if you try to get it later, you have to pay some hundered $ for a copy of the NOA2.

Another question from a newbie. My fiance has a young child that we will be filing for as well. From what I understand is that we will need to include the child in the I-129F form. From there I am some what lost on what will happen next. What is the entire process for bringing a child over with a K2? Does he go through the interview and medical process with his mom? Our plans are for her to come over first while we get things situated. Then we would bring him over about 3 months later. He would be staying with his grandparents in the Philippines during this time.

Please can someone that has been through this outline the process. I do not see much info regarding the K2 process on the website.
