We just want to know if there is a way we can get the USCIS to explain to us why exactly they refused to issue the k1 visa.Any suggestions please.


As I said above, they may not tell you anything other than start over (which you have done with the CR-1).

You could contact your Representative or Senator and ask them to do an inquiry on the K1 case.

No guarantees that you will get the answers you seek regardless.

Here is the Contact Us page from USCIS. With an expired petition, they may not say anything except "start over." When the USCIS gets a K1 petition sent back from an Embassy or Consulate, they have 3 options: reaffirm it, send you a notice of intent to revoke approval, or let it expire. In your case (and in many other cases based on other postings I've seen), they let yours expire.

When was the K1 interview? I read your timeline and I see you are now married and have filed for the CR-1 visa.

I just thought of something thats really silly...

When I fill in the fiance letters of intent do I Keep "Fiance letter of intent" on the top of the letter, (as in the sample forms) and same with the I-129F Cover letter?

And what address do I use on those? I'm filing through Texas, and heard they all go to texas now to speed things up. Do I use the Texas address on all of them? And then they forward it to the appropriate place?

The Texas address is just an intake center. Your petition will be routed to CA or VT based on which state you reside in. With that being said, when my fiancee and I were planning to pursue the K1, I had told her to put the TX address.

While the K3 is still officially on the books, it is nonexistent in practice. Don't waste your time filing an I-129F after you file an I-130 for a K3 (should that be the course you chose). USICS will match up the I-129F with the I-130. Both petitions will be approved at the same time and sent to the NVC. The NVC will then adminstratively close the I-129F leaving only the I-130 for CR-1 active.

The answer to question #14 on the I-129F is the address you will live at when you go back to the US. In other words, do you have the keys to an apartment or house at present? If not, then you do not have an answer to that question.

I thought that domicile was only an issue with the visas for married couples. I haven't seen any info about needing to have domicile in order for my fiancee to enter the US on K1.

The domicile issue people are pointing out is a US domicile issue. If you do not have a US domicile, your fiance will not be allowed to immigrate. Question #14 on the I-129F asks: "Address in the United States where your fiance(e) intends to live?"

1) Under 'Applicant's residence last five years', I've moved a lot and have come back to my parents' house, do I need to list all the times I've been back, so as not to leave gaps in time? Because it'll look like this, starting from 2007 -> Parents' house -> Apartment -> Parents' house -> Different apartment -> Parents' house. Or should I only list the different residences once? Lol, seems like a silly question, I'm sorry, but I just want to make sure I do this right.


My take is to just list each time you went back to your parents' house for, as you say, continuity. You could list each residence once on the form itself and then address the time gaps on a supplemental sheet.

2) Also, a question for both the applicant's residence and 'full address' of employer, I add the city, province and postal code, as well as the street address right? Because adding the name of the employer and the full address won't fit, so I need to put 'See attachment' in that line, right?

3) For 'applicant's employment last five years', in 2007 I had two jobs, one for a week if that and one for about a month before I quit and moved again. Even though I wasn't there for very long, should I add them anyway? That would equal six lines for that section, can I just add one of them or do I need to add both and put the extra on another attachment? Lol, I'm sounding a little paranoid.


My train of thought is to list everything, regardless of how long you were there.

4) For 'last occupation abroad if not shown above', I would just put 'none' or leave it blank? I have not worked or went to school in the States.


I intend to put "see above" in this section on the form for my wife-to-be.

And finally, to add to the paranoia, 5) At the bottom of the page, it says I have to print my name and Alien Registration Number in boxes below. Do they mean type it out or print out the page and write my name? But I don't have an Alien Registration Number? Leave it blank, write 'none', write 'N/A'?


Since you do not have an Alien Registration Number, "none" would be the word to write.

Congressperson probably won't touch your inquiry until after your case has been sitting at the USCIS for 6 mos or more

Just a side note, if he wanted to, he could go to the Embassy in Rabat and apply for a tourist visa instead of the Consulate in Casablanca. However, that would not increase the likelihood of him being issued a tourist visa.

A denied tourist visa would have no bearing one way or the other on a future K1 petition.

OP: There is no rule that prohibits your SO from coming to visit on the VWP (so long as she does not overstay), however, there is no guarantee that she will be admitted either. CBP will likely have information that an immigration benefit has been filed on her behalf so she would want to have evidence of strong ties to Ireland when she arrives. Furthermore, since she had unsuccessfully tried to obtain a 6 month visitor's visa, travel on the VWP may not even be possible for her (though I'm not certain of that).

As others have said, forget the K3, it may still be on the books but it is nonexistent in practice.

My opinion is the CR-1 is the best option. Cheaper than K1 and AOS is not necessary.

My fiance (us citizen) and myself (uk citizen) are in the process of applying for our K1 visa. Once we are married, I will be moving to the states.


If a petition for a K1 is already pending, DO NOT get married until AFTER you enter the the US. Otherwise, the K1 visa will be null and void.

Furthermore, if you were to get married before your approval of the petition or issuance of a K1, it would be necessary to refile a petition for a CR-1. Think of it in terms of a board game that has a space in the early part of the game that says go back to start if it landed on by a player; refiling for a CR-1 means you go back to the start, the waiting you and your SO have done so far will have been for naught.

You only need 2 of those forms, 1 for you, one for her.

And we use yahoo messenger as our way of contact, I have chosen about 7 conversations out of plenty and i'm wondering if i have to print and translate all of them? or can i just print 1 page with a scroll at the side showing how long the conversation is. (because when i try to print the conversation, it just prints the actual page on the window. which gives me a part of the conversation that could fit and on the side, there's a scroll bar that was about an inch long.) these conversations are about 9 pages long each at 10 pt font and i have printed them out and translated them and it's a lot of paper and my package is pretty thick now.


I don't believe it is necessary to translate your yahoo conversations. If you want to print the out the entirety of the conversations you selected, as long as they have timestamps, you can probably copy and past them into a word document and print that. You would probably want to have a coversheet stating what it was.

Another question is that is all the pages supposed to be signed? even the attachments and proof of relationship? I'm hoping not because I feel right now that i'm ready to send it in but if i needed the signatures, that would mean i would have to send it to her and have her sign it and that would take 2 weeks at the minimum.


I don't think it is necessary for her to sign every page (or you for that matter). However, I may not be right about that; so others, please correct me if I'm wrong.

Neither. Put a coversheet before your evidence and then list the contents that will follow.

You only need to send a copy of your birth certificate. If you choose to use a copy of your passport for the purpose of proving you citizenship, then you have to copy all the pages.

IMO, I am in the camp of "the more the better." However, in this case, just select one option (copy of birth certificate or copy of passport) and submit that. Putting 'more' in this instance does not make any difference.

That's because the State Department made a decision at some point in time to only have immigrant visas (along with K visas) issued at the Consulate in Juarez. I could only speculate as to why they made that decision.

Write see attached on one of the lines of the form.

Format it however you wish on the supplemental. Just indicate the section from the main form.

You mentioned your current health conditions, would a doctor say those conditions absolutely preclude you from flying to India? Keep in mind that the "physically impossible" that JoannaV references often means living in a bubble or iron lung. As for the no being allowed to see each other prior to marriage, you can apply for a waiver, but you will have to jump through many, many, many, many, many hoops proving that your religion prohibits meeting before marriage. Again, as JoannaV said, it's very difficult to prove and those that have obtained those waivers would probably be the first to tell you just how hard it is.

so she will require a tourist visa to marry you, or you'll need to get married in India. I don't know how hard it is to get visitor visas from India to the US.


Entering the US on a tourist visa with the intent to stay and adjust status is FRAUD. She can get a tourist visa, marry you, and then return to India and then you file for a CR-1. However, she would have to show strong ties to India before being issued one.

Most people in the VJ community will most likely tell you not to bother with a lawyer in your case. Whether or not you hire one is completely up to you.

As far as fees go, it depends if they charge a flat rate in the retainer agreement for all services performed or not. You would have to check with individual attorneys or firms.

NOA1 will come next. That is the confirmation of receipt. Also, that is when your petition will be transferred to the service center in either CA or VT.

I know that's the longest wait, but how do you know where it's at, and how far along they are? Is there a way to view the progress on the

You can view the progress on the USCIS site. However, there have been many posts by people who have received their NOA2 without ever seeing anything updated on the site.

Having a party with your family in friends without getting married will not complicate things; as I have previously posted, many people already have such parties. Just don't use words like wedding, husband, wife, etc.

I have an approved K1 visa. And will be leaving soon. I wanted to get married here in the Philippines just before I fly to US. This is because I wanted that my family be with me for my wedding. Is this possible?


It is possible to have a ceremony so long as you are not legally married at the conclusion of said ceremony. Couples often have traditional ceremonies in the home country of the person who is leaving and then use the term "Engagement Ceremony."

Also, if you wish to have a ceremony in a church before your departure to the US, you can as long as you would not be legally married at the conclusion of the ceremony. I would check to see what the laws on that are.

When you use a K1 visa at a US POE, you must not be legally married.

The only requirement to file an I-129F is that you have met in-person at least once in the past two years of filing date. It doesn't matter that meeting took place.

I don't know if this would be an issue or not, so take it with a grain of salt but if you have not seen each other in-person at least once during the past two years of filing date, then you may want to make a trip to see each other, and that can be anywhere.
