2. US Virgin Islands, Guam, and Puerto Rico are US Territories, but they could pose a slight risk as far as wedding goes, especially if you have to leave the US to get there/back
3. If you don't have the money for the destination wedding in Hawaii, you could always plan the cruise as a second honeymoon once AP or GC has been received.

It is possible to plan and have a traditional American wedding but you have to let places know and make the plans so things can be changed at any point in time. A lot of our wedding things we did by ourselves. I found a caterer through a restaurant several months before but didn't finalize anything until within the two weeks before. The photographer I started looking for when it was close to my fiance's wedding date. The DJ I found a week before. Everything went very well and it was a beautiful wedding. Let me know if I can help any with sharing some ideas of what we did.


That is what we did as well. It is very possible to plan an intimate wedding that guests can attend if you set the date once the visa is in hand. My husband received his visa in April, and we set our wedding date for August (after the visa was received). His family and friends were able to get plane tickets from Europe to the US with no problems.

Or if you want more time for out-of-town/country guests, go the route people have suggested and do a celebration after the legal ceremony.

For us it was a constant check with the USE once a week, I developed a relationship with the person on the phone and she'd recognized my voice everytime I called in for status. My wife and childrens passports/visa was in AP for over 60 days. When my contact in the USE told me over the phone that it has been approved it took another 2 weeks for VISA printing and one day for shipping. Goodluck to you.

Our NOA2 was from 6/6. We called the NVC at 6/19, they said before 15 workdays after NOA2 they would not even look at our case. We called 7/5 again, they gave us our new casenumber and told us that our petition has left NVC to the consulate on 6/27. On 7/6 I had packet 3 in my mail. It took exactly 4 weeks (we were at CSC)

They accept it in german language at Frankfurt embassy. You don't have to translate it. Mine was in german too, no problem.

Look at my timeline, it took exactly one month till I received packet 3. We called the NVC 2 weeks after NOA2 to get our new casenumber, and they said 15 workdays after NOA 2 they can look at our case, not before. So call them. And hang' in there, it'll come soon! :thumbs:

QUESTION: With the I-129 Cover Letter, Fiance and fiancees Letter of Intent, shall I put the address on the letter to USCIS Cleveland office but mail it to Lewisville, TX (courier)?????

I'm patient person and has more focused so I'm doing all the paperwork for me and my fiance (in the US) K-1 visa. I know the process that he should be the one to file it but I am the one preparing EVERYTHING. He hates complicated things and gets easily overwhelmed. All he just got to do is sign and mail things, with his name on it.

You mail your petition to the Lewisville, Texas address. It's your choice if you want to put this address on the letter of intent and cover letter too, we did put the address of CSC (California Service Center) on it, because we knew they would forward it to CSC. K1-petitions are forwarded to CSC or VSC (Vermont), depending in which state the petitioner is living.

1. Yes that is packet 3

2. You only need the I-134, the 864 is for once you guys are in the US and are going to adjust status. So you are fine!

3. I'm sure that those requirements are for people who are only going to visit the US. Your fiances passport doesn't expire for a year, which is fine. And yes at some point you'll have to get a renewal in the US through a Mexican consulate if he doesn't come back to Mexico before then to renew it.

4. You are correct, his birth certificate does NOT need to be translated.

My fiancé and I are trying to get everything organized for his interview in Juarez, but there are a few things we are not sure about…any answers/insight would be much appreciated!

-Is the appointment letter the letter that reads “Estimado ____: Your finace visa case is now ready for processing. Please go to…” and is from 'Chief, Immigrant Visa Branch'?

-When we received our NOA2 I went ahead and filled out the I-134 and collected tax transcripts, pay stubs, etc, but then I see people talking about the I-864 and I am confused as to which affidavit of support is to be used at this stage – the I-134 or I-864?

-The consulate info page says his passport must have a validity date at least six months beyond his intended period of stay in the U.S. His passport expires 7/2012 and he intends to stay beyond that date, but I was under the impression we could get his passport renewed in the U.S. at a Mexican consulate. Does he need to get a new passport before the interview?

-If I understand correctly his birth certificate does NOT need to be translated – is that correct?

That is the exact quote from the OP's second post. You only read the OP's first post. When a visa is denied at the interview, they usually send it back to the USCIS for revocation.


I did read the OP's second post and you are still missing the point so I'll try and clarify. The Embassy/Consulate did not issue the visa and sent the petition back to USCIS. When the USCIS receives a petition back from an Embassy or Consulate, they will do one of the following three things:

1. Reaffirm the petition and send it back to the Embassy/Consulate for another interview.

2. Send the petitioner an notice of intent to revoke the petition. The petitioner would have to respond to the notice and would be told the reasons why the visa was refused.

3. Since K1 petitions have an expiration date, USCIS can simply let them expire and that would be it. I have seen many posts from other people where this has happened.

This is what I am interpreting from the OP's SECOND post:
The OP and their significant other filed for a K1 in April 2009 and had the K1 interview in April 2010. They were not issues a visa in April 2010 and the petition was sent back to USCIS. The USCIS let the petition expire without taking any action on it. Now, the OP and beneficiary got married after not receiving a K1 visa and have filed for a CR-1 visa.

:ot2: This discussion is starting to stray from what the OP is asking about. What the OP is trying to find out is what were the reasons for not getting a K1 visa in the first place and how can they find out what those reasons are.

When our K-1 was revoked, the reason was given. Did they not give the beneficiary a form explaining the reason for the denial? And when the case was revoked by USCIS, the reason should have been given.


From what the OP has stated, USCIS did not revoke the petition, they let it expire. Revoking it and letting it expire are two different things.

As I said above, they may not tell you anything other than start over (which you have done with the CR-1).

You could contact your Representative or Senator and ask them to do an inquiry on the K1 case.

No guarantees that you will get the answers you seek regardless.
