$350 for visa (paid to Embassy or Consulate, what country are you from)

cost of medical, varies by country

K-1 Fiance(e) Visa Process & ProceduresPoint Of Entry - HELP

I'll be entering SeaTac next week and I would like to know what to expect and if there are certain things I need to be extra mindful about.

Regardless of whether SEA is your final destination or you have a connecting flight, your flight will arrive at the south satellite terminal, after you clear customs you will have to take an underground train to the main terminal to exit the airport or to catch your connection (unless your connection also departs from the south satellite).

K-1 Fiance(e) Visa Process & ProceduresK1 visa - both living abroad.

I will also read into the CR1, no idea what that is.

It's a spousal visa issued to a foreign spouse of a US Citizen when they have been married for less than two years. After entry to the US, the foreign spouse will be issued a green card that will be valid for two years, known as a conditional green card. Within 90 days prior to the year anniversary of arrival in the US, filing for Removal of Conditions will need to be done. Once conditions are removed, a green card valid for 10 years will be issued.

Posted Image If you are going to be living together there why not marry and apply for the spouse visa directly with the embassy when you are ready to head to the US?

Effective Monday 8/15, filing a spousal visa petition directly with the Embassy in The Netherlands will not be possible and there is no USCIS field office in The Netherlands.

I'm not sure I understand your post. If you submitted the required forms, then what's the issue?

Don't try sending anything now as it will likely not get matched with your file.

Now if you did submit them to the USCIS and NOT to your fiance, then there would be a problem of incomplete evidence.

This sentence makes no sense. Anything submitted to USCIS along with the petition becomes part of the file that ultimately goes to the Embassy or Consulate.

K-1 Fiance(e) Visa Process & ProceduresBeaurocrats Trying To Increase The Odds Of Failure?

Do they test her English there?

This notion of an "English test" at any point in this process is false; period, full stop.

The point of needing a translator at the POE is if the CBP officer can't speak the language of the person they are processing.

K-1 Fiance(e) Visa Process & ProceduresBeaurocrats Trying To Increase The Odds Of Failure?

Thanks Anh map. I hope very much that is the case, I was told the opposite.

Anh map is 100% correct, there is no "English test" at a K1 interview and to take it a step further, there is no such test at any other visa interview. What a CO will be looking for is how you and your fiancee can communicate with one another, if one cannot speak the other person's language at all, then the CO may doubt the sincerity of the relationship (as DanTes alluded to).

K-1 Fiance(e) Visa Process & ProceduresK1 fiancè visa
The form I-129F for K1 visa can be filed anytime by the USC. The process can begin before your authorized stay expires. As you are already aware, you will need to leave when your authorized stay ends.

There should not have been an I-130 in that package. Hopefully the adjudicator will notice that you are only petitioning for a fiancee and dismiss the I-130 and proceed with adjudicating the I-129F.

Do what Penguin and William have suggested; get that straightened out ASAP.

K-1 Fiance(e) Visa Process & ProceduresWhat is Priority Date?
Priority date is the date your file was officially received by USCIS when the petition was submitted. It should be printed on the NOA1 and NOA2.

K-1 Fiance(e) Visa Process & ProceduresLength of Time to Enter Country on Approval?
Your fiancee must use the visa before it expires (usually a 6 month validity). She must marry you within 90 days of her arrival in the US.

K-1 Fiance(e) Visa Process & ProceduresDoes K1 expire?

K1 expires after 90 days.

Incorrect, an issued K1 visa is usually valid for 6 months (may be less than that in some circumstances). The 90 days you reference is the requirement that the beneficiary marry the petitioner within 90 days of arrival in the US.

K-1 Fiance(e) Visa Process & ProceduresDoes K1 expire?

In fact, I am surprise that your petition got approved without her passport. As I remember in our case, a copy of my wife's (then fiance) passport was required to be submitted with my petition (but of course, I could be wrong).

A copy of the beneficiary's passport is not required when submitting a petition.

K-1 Fiance(e) Visa Process & ProceduresDoes K1 expire?

hi everyone, finally in about 3 days from now my fiancee will be able to get her passport and pay her visa and schedule online for an interview. My concern is that our visa petition was approved in May 11, and because of the passport taking 3 months to be made delayed us this long, i was wondering if i should be aware of something expiring? i was going through the mails i have received from USCIS i notice from the I-797 notice of action has an expiration date of(9/102011) do i need to renew this? and is there anything else i should be concern about? thanks everyone.

For a K1 petition, they do expire, however, if the an interview has not taken place prior to the expiration date and you have submitted the required documents to the Embassy, the Embassy has the ability to re-validate the petition.

K-1 Fiance(e) Visa Process & ProceduresLifetime Ban From Entering the U.S.?

They ask my fiancee if she has ever used drugs and she thinks they are talking about pharmacutical drugs like Asprin,

I don't know if this will ease your mind or not, however, when I was in China last February, I had a plastic sack in my luggage that said '{name of company} DRUGS' on it that my wife saw and said to me "drugs?" I simply told her "medicine" and she immediately understood. I suppose the point I'm trying to make is the term "drugs" would be likely be interpreted as the illicit kind and not the pharmaceutical kind.

K-1 Fiance(e) Visa Process & ProceduresAddress in I-129F

I don't receive mail at my residential address, but rather a Post Office Box. Which address should I use on my I-129F? Will they mail me anything or is it in reference to my residential address? The form does state "Address (Number and Street)" Should I make note of this in a Continuation Sheet?

Use your PO Box; you don't need to make any notes about it on a continuation sheet. Use your residential address to answer the question "address where your fiancee intends to live."

I receive my mail at a PO Box and I used it for my address on all forms except for the question that asked where my wife will live. Received both NOA's from USCIS at my PO Box.

Yes you can visit. However, there is no guarantee CBP will grant you entry to the US, it's best to carry sufficient ties to Australia with you in case a CBP Officer decides to ask for proof of ties.

What about direct consular filing?

There is no USCIS field office in Brazil so DCF will not be an option.

And if we filed for CR-1, do we have to wait an entire period again for it to go through USCIS and the NVC?

Yes

K-1 Fiance(e) Visa Process & ProceduresEmbassy received petition what are my options?

I read somewhere that you have to wait 2 years after a petition is approved to file for another one.

If you were to marry your fiancee and withdraw the K1 petition, then you could file right away for the CR-1. There is no time restriction in that scenario.

K-1 Fiance(e) Visa Process & ProceduresI-129F Petitioner INTERVIEW!?

I HAVE A VERY QUICK BUT IMPORTANT QUESTION! SINCE I AM THE I-129F PETITIONER FOR THE FIANCE VISA, WILL I GO TO AN INTERVIEW BEFORE MY FIANCE COMES TO THE STATES? AND WHAT SHOULD I EXPECT?!?!? I'M A BIT WORRIED!!

What point are you at in the process, have you received an NOA2 from USCIS yet? :time:

The reason I ask is this, while it is rare, sometimes the service center will tag a petition and send it to a local office to interview the petitioner prior approving the petition. If you have already received your NOA2, then you don't have to worry about this.

The K2 does not need to be applied for at the same time as the K1. Your significant other's daughter can follow to join at a later date using a K2.

IMO, it's best to file for a K1 after that second trip.

K-1 Fiance(e) Visa Process & ProceduresNeed Advice about Changing from K-1 to Married

Should we delay the K-1 somehow?

You can request a reschedule.

Can we switch from the K-1 process, get married in Honduras, and then restart her paperwork to get her and the kids here?

There is no switching, as you already said, you would have to go back to the start and file new paperwork. Also, you would have to pay the appropriate fees as the fees you already paid will not be refunded or prorated.

if there is a layover for the next flight at an airport other than airport of origin and not in the US for point of entry, can the K-1 VISA holder go outside of the layover airport for a hotel stay, or is this restricted?

As Oksana & Max and bigdog have already told you, if you want to leave the layover airport itself, you would need a visa for that country you are laying over in.

K-1 Fiance(e) Visa Process & ProceduresGUZ interview soon, please help!

1. NOTARY BOOKS:We already have "notary books/gongzhengshu" for birth certificate, non-married status and police(no crime)from place of HuKo(perm residence). This police certificate says that covers his record to date. However, my fiance has been a student in Beijing for the last two years. He obtained another "police certificate of no crime" from the schools "Baoweichu," which I believe is the university's police station. I am wondering if this necessary? Is it sufficient or does it need to come from Beijing's real police station? Also do I need to get this also notarized?

They (the Consulate) only wants the certificate from the notary office from where the Hukou is.

2.I-134 EVIDENCE: I am currently on a Graduate student's stipend so I fall behind the income requirement by a small amount. The amount in my bank account satisfies (just barely) covers the 3X difference rule. So in theory, I am enough. I did not plan to actively offer a Co-sponsor unless the officer asks. If he does, I have one prepared. DO CO-SPONSOR'S TAX TRANSCRIPTS NEED TO BE ORIGINAL? OR ARE COPIES SUFFICENT?
My co-sponsor satisfies the financial requirements above and beyond. However, I recently realized that my Co-sponsor has reported a dependent on her past tax returns that she is legally not supposed to. I know this is a problem for the IRS, but I don't if this affects her ability to be a co-sponsor. Does the consulate communicate to the IRS ? I don't want to cause more trouble for the Co-sponsor than necessary.

Copies are sufficient. Don't know the answer to the second part of your question.

3. PETITIONER's ADDRESS:
My lease ended right when I came to visit my Fiance in China beginning of this summer and I did not plan to look for a new apartment until I went back this fall. I am also finishing my degree this fall and relocating. I changed my mailing address to my parents house while I am away, so I put that as the "house of residence" on the DS immigration forms. Will this be a problem? Do I seem vagabond?

Will not be a problem.

3.PASSPORT NAME PROBLEM
My fiance's passport has her GIVEN and FAMILY name reversed on his passport compared to his visa application(where we filled his given name and family name as per logic) Because he is an rarer ethnic minority, his name is written FirstnameLastname instead of LastnameFirstname on his ID card and thus when creating a passport we were informed they always put the real first name as FAMILY and the real last name as GIVEN. This is they way they write Ethnic minority name passports in China. Do you think this will cause major problems at the interview/visa/POE later or are they used to this kind of confusion. I suppose in many cultures so people only have one long name or no inherited surname.

Family name is always first and given name is always second in Chinese passports. The Consulate knows and understands this.

4.GUANGZHOU:
I am currently in China visiting him but I am due to come back right before his interview. How important is that I accompany him to GUZ to show support? Does this help?

Stay if you can, but if you can't, it's not a deal breaker.
