hi everyone! I have a question my interview date will be on April 22, 2012 in Abu Dhabi, but we received the I-797 Notice of action from the USCIS, giving my case an approval notice from DEc 21/2011 to April 20, 2012.My question is can the interview date be before the approval notice expires? or can the embassy extend the approval notice that USCIS have given us? Should I call the embassy and inform them or just leave it for its ok. thanks in advance


The Embassy has the ability to re-validate a petition if an interview has not yet taken place.

A second question: Is it a good idea to include my fiances Chinese Birth Certificate with my I-129f package? If so does it need to be in English? Can a Chinese passport (all pages be an acceptable replacement?


This will not be needed until her interview at the Consulate. What she will submit is a "white book" obtained from the notary office having jurisdiction where her hukou is located.

A third question: My Fiance also had a name change when she was 12 years old. As long as this is included in the documentation for the K1 process is there any other problems I should expect?

No notation is necessary. You would not get an RFE for not making a notation on a check what the check was for. The lockbox facility will know what the check is for because they will see what form is being filed and automatically know the proper fee.

Your are sending a petition, not an application. It is not necessary to note that it is a petition fee as long as the amount is correct and the check properly made out (i.e. write out US Department of Homeland Security, no abbreviations).

This week we're really excited to begin the process of seeing each other again and getting married.

My fiancee is in Colombia, while I'm here working in the U.S.

What I'm seeing is that the process takes about 5-8 months right?

My question is, if at some point within that timeframe while the visa is being processed if I can take some time off from my busy work schedule to go and visit her and marry here there. Would that speed anything up?




For example a lawyer in Chicago told us that if I were to marry her in Colombia than she could just go in and apply for a tourist visa or something like that?

We just want the fastest way to be together, just like everyone else :)

We talk all the the time to review our stories and dates and asked each other possible k1 visa interview question and possible answer.

Help....Anything else we are missing in preparation for interview for Lagos please advice

Come by surprise I send e-mail to lagos Embassy last night. I wake up this morning its e-mail from Embassy sheldule 2nd interview for Feb 1 2012. The first interview we got form 221(1) requesting for more proof of relatioship to include but not limited( recent 1-2 month correspondent) pictures, post cards.
most especially her high school diploma.
we got her high school diploma handy and we have being sending more e-mail, chat on yahoo, I maile couple of post cards already to had to the numerous pages we have before.
Here is my question, I might not be able to make it to Nigeria to take more pictures before the interview.
Sshould we re- sscheldule or just re presented old pictures with all the new evidence we got.

Once the K-1 is issued, and your fiance comes to the US, then he cannot leave the US without abandoning his ability to return. The K-1 is a one-time use visa. Then you guys get married, and you must file for Adjustment of Status (please read up on this for future filing, some K-1 filers don't realize this step exists and are pretty mad when they realize). With the Adjustment of Status, you an file (for free) a form that when approved grants him temporary travel permission. That takes about 3 months. So effectively, he cannot leave the US for a few months, so be prepared for that. I said opposite way because he'll be stuck in the US, not in Canada :) Once he gets his greencard (when AOS is approved) he can travel without special permissions. You have a long while to worry about this though.

There is a travel block the opposite way, however, once the K-1 is issued and the Canadian enters the US - he will not be permitted to travel (can leave, just can't come back) until marriage, file for Adjustment Of Status, and receive temporary travel permission (Advance Parole). That takes about 3 months from AOS filing.


Um. Sorry but I'm confused by the above statement "there is a travel block the opposite way". My understanding is that HE would be restricted from coming to the USA for some period of time. I'm the petitioner and I live in Seattle, he lives in British Columbia, and he hopes to immigrate here. So are you saying that he is still free to come here for visits during the I-129 process, but once they issue the K1 visa THEN he will be restricted from traveling to the USA? But that we can file for an Adjustment of Status requesting temporary travel permission (Advance Parole)? If so, THAT IS COOL NEWS!!

I'm new and this is my first post. I filed my I-129 on 12/30/2011 and received my NOA1 on 1/5/2012. I live in USA and my fiance lives in Canada. Exactly at what point will he be banned from coming to visit me? We have a seminar that we'd like to both attend (here in the US) the first week of February. Will his travel be limited once he receives some type of letter / notification, or will he be blocked from entering the states now that we've filed? Also, can someone confirm that I (the petitioner) will be free to travel to visit him (in Canada) during the application process?

Proof of ties to Canada (without a job):
- lease agreement/letter from landlord
- return flight ticket or other return arrangements
- medications (only enough for the time you will be staying)
- bank statement (proof of funds to pay for your time in the US)

Other things that help:
- be completely upfront and honest about your relationship and vacation plans
- pack lightly (only take what you need for the time you're staying)
- don't bring sentimental things (things you would take if you were moving)

Hello,

OK. So I posted the other day and discovered that my finace (Canadian) will NOT be blocked from coming to visit me (in the USA) since we're now engaged and filed our I-129f. I understand that he needs to be prepared to show strong "proof of ties" to Canada to show that his intention is to simply visit and return (and not immigrate illegally) when he comes to visit me. The problem is my fiance has been out of work (lost his career as a realtor when the housing market crashed) and was severely injured 2 years ago to the point where he is now on disability income. He has no employer. He has no mortage. What other forms of evidence, besides employer and homeowner, could he produce that would convince the border people that he plans to go back to Canada?

A note from me promising that I will send him back??? :)

As long as you're within the 5 month frame you can't really ask for a service request. Waiting sucks but they have their processing times for a reason. The fact that CSC is sticking to that time frame is a bit frustrating, especially when you see that the VSC is being extra efficient.

Wait until the 5 months are up and ten start calling them before taking more "agressive" steps, like contacting your congressman. We tried calling the USCIS last week and we only could get a machine, talking to a eral person for a change must be great!

Crossing my fingers for June filers!!!

Indeed it does. When we actually bring ourselves to go out with others we go back to constantly IMing each other, sending pictures of the party, etc... So much so, that we had our phones sometimes get "confiscated" by friends when we go out :P. I've become this annoying person who doesn't turn her phone completely off during a movie in case it blinks... and the texting starts again. He also has a collection of social faux-pas under his belt.

People take for granted to have their significant other with them. When the happy time comes and we're together for good, I'm never leaving his side ever again.

(The Holidays are kicking me in the butt :crying: )

We can all relate in a way or another. Jack and I spend every minute of our spare time videochatting with Gtalk (I find it has a better call quality than Skype), with that, your social life can dwindle faily quickly.
Try and make a point to spend time with your friends and family, it's hard but not impossible. In our case we end up sending "wish you were here" text messages and all I want is to go back home and hang out with him.
Still, it's very important to see your loved ones because once the AOS process starts, who knows when will you be able to be with them.

The impatience you build up by wanting to start your life with your partner is normal but don't let it get to you. The last thing you both need is stressing over being apart and put a strain on the relationship. The fact that we have LDR has made us extremely creative people when dealing with things. I feel that, as strange as this may seem, Jack and I have acquired a tool set to deal with anything life will throw at us in the future and it's an encouraging thought :P

I can't wait for my next visit though, nothing beats having morning coffee sitting by his side and I'm looking forward to do this for the rest of my life <3.

We received the instructions for package 3 and 4 a couple of days ago. So far, we've been running down the list and gathering the documentation that need a certain time to get prepared, ask questions about specific requirements, etc BEFORE scheduling our interview. I thought it would be best to get those out of the way and prepare the rest of our folder while we waited for the interview.

It made me wonder, is there a specific time limit between getting the local case number and the scheduling of the interview at the Embassy?
